APPROVAL OF MINUTES
Councilman McElwee noted that the minutes of May 12 , 1975
on page 8 should be corrected to read ° " Sandra Place . Mr . Fabbroni
reported that Otto Schoenfeld has agreed to install 260 feet of
pipe on Sandra Place which will loop the water line . '
Motion by Supervisor Schwan ? seconded by Councilman Powers ,
RESOLVED , that the minutes of April 14 , 1975 be approved as pre =
sented , and that the minutes of May 12 , 1975 be approved as cor -
rected as indicated above .
Unanimously carried .
APPOINTMENT TO BOARD OF REPRESENTATIVES
Supervisor Schwan reported that the Town Board has before
it two candidates for replacing Robert Bruce cn the Tompkins
County Board of Representatives - - Professor Roger A . Morse ,
425 Warren Road , who has presented a resume which the Town Board
4has reviewed , and Henry Theisen , 202 Winthrop Drive , a .local
~
attorney , who has been recommended to fill the vacancy by the
Town of , Ithaca Democratic Committee . The Supervisor also re-
ported that a question had arisen as to whether the Town .- Board
may appoint a replacement or whether the governor of the State
should make the appointment . The Town Attorney read his formal
report on this matter . He cited the clear wording of the Tompkins
County local Charter and Code which provides that the vacancy shall
be filled by a majority vote of the Town Board . He cited two cases
in support of this position and concluded NO . " The purpose of this
report is to inform you that two very strong precedents , decided in -'
1975 , sustain the appointment to fill a vacancy in accordance with
procedures adopted by a County local law . (The complete report
of the Town Attorney is available for inspection in the Town Clerk ' s
Office . )
Town Board Minutes - 2 - June 23 , 1975
After the Town Attorney ' s report the Board acted as fol -

Motion !, by Councilman Desch ; seconded by Councilman McElwee ,
RESOLVED , that this Town Board hereby appoints Roger A . Morse to
fill . a , vacancy on the County Board of Representatives , created by
the resignation of Robert L . Bruce , the term of this appointment
to runli� through December 31 , 19750

ELECTION INSpECTORSFOR 1975 - 1976

The Town Cletk , submitted a list of Republican and Democrat Elec -
tion inspectors and alternates for 1975 - 1976 . for the Board ' s con-
sideration .
Motion by Supervisor Schwana seconded by Councilman McElwee ,
RESOLVED , that the Republican and Democrat Election Inspectors
and alternates , as approved ' by the respective chairmen of the
Republican and '' Democrat parties , a list of which inspectors and
alternates is attached to and made a part of these minutes , are
herebyljapproved by the Town Board of the Town of Ithaca for the
period 'I' July 15 , 1975 through July, 15 , 1976 .
Unanimously carried .
CONSIDERATION OF NCR SIGN

jj Mr . Fabbroni reported that the Town has a request from
National Cash Register Company for a new sign in their parking
islandJ At the same time they are . moving their old sign to a
new location . The new sign meets the requirements of the sign ,
ordinance . lit . Fabbroni illustrated the locations on a plot
plan .
Motion � by Supervisor Schwan ; seconded by Councilman Powers ,
RESOLVED , that the Town Board hereby grants the request of Nation -
al Cash Register Company for a new sign in their parking island ,
to be located a

" Mr . Fabbroni reported that Miss Susan Blumenthal had been
hired as a Student Planning Assistant , under the Federal govern -
ment program referred to at a .previous meeting of the Town Board .
FBC SIGN AND PANELS - EAST HILL PLAZA
Mr . Fabbroni reported that a letter dated June 17 , 1975
had been received from Mr . Stewart Knowlton , with regard to the
panelsjof the former FBC sign , requesting that Groff Associates
be permitted to leave t the panels in . place until a tenant is found .
Mr . Fabbroni said the panels are in violation of the sign ordinance
because they are above the roof line . The Board discussed possible
time limit for removal of the panels or until a tenant is found ,
whichever comes first . The plans of the building were reviewed
( cross sections' ) . The question arose as to why the panels should

not immediately be removed or cut to the roof
ht ' line . Mr . Fabbroni
noted ( 1 ) the new tenant might pay for the removal or cutting to
the roof line , and ( 2 ) the portion of the panels remaining below
the roof line might serve as ' a backing for a sign for the prospec -
tiveltenant . There was some discussion as to whether a security
deposit for the performance of the work was necessary . The Board
did not feel it was necessary in this case .

Motion by Supervisor Schwan ; seconded by Councilman Del Rosso ,
RESOLVED , that Groff Associates be advised that they are required
to remove the panels or cut same to the roof line by November 1 ,
1975 or until they rent the building , whichever comes first .

I Mr . Fabbroni reported the Town has a request from the
County to consider the formation of a Tompkins County Transit
Commission , The County has prepared a working paper on this
matter , looking toward getting in -put and comments from munici -
palities . It '' was agreed that a copy of the working paper would
be made available to all Board members and Town officials , and
a work session would be scheduled to review the material .
Mr . Fabbroni reported that Blackstone e Avenue and Tudor
Road have been oiled and stoned . Another road will be so treated
in the Lucentesubdivision ( Sycamore Road ) . Mr . Schoenfeld is
starting activity off of Burleigh Drive .
Councilman McElwee inquired about Sandra Place * Mr . Fab-
broni said it was decided last year to accept a deed from Otto
Schoenfeld if he would put in a water line . Mr . Schoenfeld has
agreedito do this .
Council
man �Powers inquired about the bus service for the
elderly of the , Ellis Hollow Apartments . Mr . Fabbroni said he had
information that there are about 13 people using the service per
run . Since it '' is a 19 passenger bus the occupancy rate is quite
good . jlMr . Fabbroni said he - would have more figures available for
the next meeting . Councilman Powers suggested that Groff Associ -
ates . should have a report on how the service is being used .
li Councilman Del Rosso asked when Campbell Avenue would ba
surfaced . Mro :Fabbroni said the road would be oiled and stoned
in August when other roads throughout the Town are done . Since
there was no provision for dust control between now and August ,
Councilman Del 'Rosso felt this should be higher on the priority
list .

_y ssistant Building Inspector , reported
that thle sign �nven ory has been updated - - those that existed
prior t,,°o the sign ordinance and those which have been changed since ,
He noted , in passing , that Park Displays , Inc . billboards are still
up although the three -year limit has expire or and as a matter of
fact , they have added two signs on the Danby Road . Mr . Fabbroni
said the inventory was taken so owners maybe notified and may be
given s2 Me period for removal of signs , the idea being to
do it all at one time , so that if any action must be taken it can
be one concerted action . Although the inventory of signs is now

completed , the number of signs which are on variances and the num-
ber ofl" signs which are illegal has not yet ' been determined . When

Attorney Buyoucos reported that no determination has yet
been made in the Lucente case . With regard to the Fanciamone case
this was in court on May 12 . At that time the defense presented a
brief which the judge is studying .
l Counci. lman • Del Rosso inquired as to the status of the
Wiggins barn on`, Danby Road . Mr < Fabbroni reported that a hearing
had been held on Mre Wiggins cluster proposal , and with certain
modifications of the building to meet fire codes and City plumbing
codes , Mr . Wiggins was granted approval for three units .
Mrs < Barbara Holcomb , Planning Board Chairwoman , reported
that th'e Planning Board at their meeting on June 17 , 1975 granted
preliminary approval to the subdivision plan for the Eddy Hill Farm
( formerly the Marshall Farm ) on Mecklenburg Road . This is a sub-
division of a large parcel of land into four parcels : one parcel
of 8 acres , one parcel of 26 acres , one parcel of 15 acres which
was sold on a land contract to Chase ' s Roadstand , and one parcel
of 145 acres which is the remainder of the original Marshall Farm .
There are also two small lots with houses on them that have been
there for some time . They are not a part of this subdivision plan .
It was recommended by the Town Board that the owners of the Eddy
Farm indicate on the map -that they file with the County Clerk that
the 66 ft . strip on the western edge of the 15 acre parcel should
be designated as a future road . Councilman Desch suggested that
with regard to the 26 -acre parcel a provision be made on the plan
that isijfiled with the Town Clerk as a . subdivision map showing
location of road and utility easements before this land is sub-
divided furthere Attorney Buyoucos cautioned that as many reason -
able conditions as possible ought to be included in an approving
resolution to prevent problems from arising if a future Town-wide
improvement should be put in conditions particularly with res -
pect to ' the road because traffic problems are always a matter of
concern to adjacent owners . Provision for utilities easements is
also important . Mr . Buyoucos said all these things do not have to
be indicated on " the map , but should be referred to in the resolu -
tion .
Nlrs . Holcomb reported that the Planning lanning Board had held a
public hearing. on June 17 , 1975 to consider the site plan for a
church and school for the Church of the Seventh Day Adventists . on
their property at 1217 - 19 � Trumansburg Road . The Planning Board
gave conditional final approval for the site plan for a church to
be constructed on the lands of the Seventh Day Adventists . The
church is 300 feet back from the road and the property meets all
the requirements for ' par.king .
Mrs . Catherine A . Valentino distributed to the Board mater -
ial prepared by the Ad Hoc Youth and Recreational Committee . She
said the Committ''ee would like to have feed-back from the municipali -
ties in „the County so that something concrete may be available by
this fall . It, was the sense of the Board that this material should
be reve ;wed at a work session on June 30 , 1975 at noon .

Mr . Herbert Mahr , 103 Judd Falls Road , asked whether it
wouldllbe possible , for the Town of Ithaca to sponsor an ad. for
Youth, Employment Services ( cost about $ 23 ° 00 per ad ) . These ads
would appear in the Ithaca Journal and would be instrumental in
many 'teenagers being hired . Attorney ftyoueos questioned whether
the Department of Audit and Control would permit a Town to use funds
for this purpose . , It was agreed that John McQueen , Legal Consult -
ant , would - research this .

CITY YOUTH BUREAU PROGRAM AGREEMENT
Supervisor Schwan reported that the contract with the
City of Ithaca and the Town of Ithaca with 'respect to the Ithaca
Youth Bureau program has finally been worked out for the year 1975 ,
the amount paid to the City of Ithaca by the Town of Ithaca to be
$ 24 , 116 . 00 . The Supervisor , said a resolution was required author -
izing1lhim to sign ' the contract for the youth services to be render -
ed .
Motion by Councilman Powers ;: seconded by Councilman Desch ,
RESOLVED , that the Supervisor be authorized to execute a contract
between the City of Ithaca . and the Town of Ithaca in which the
Town of Ithaca agrees to pay the City of Ithaca $ 24 , 116 . 00 for the
year 1975 for " the provision of a recreation and youth service pro -
gram to the Town .
Unanimously. carried .
HOURLY WAGE RATE INCREASES FOR HIGHWAY EMPLOYEES
Highway Superintendent Parkin submitted to the Board a
request to raise the hourly wage rate of Leon Poelvoorde ' from
$ 4 . 50 'Ito $ 4 . 70 per hour and of Arland Westmiller from $ 4 . 00 to
$ 4 . 65 ! per hour . Supervisor Schwan said money is available for
these ! increases in the contingency fundo The Board felt these
increases are , justified for these workers and , in general , to get
and retain good people in the Highway Department .
Motion by Supervisor Schwan , seconded by Councilman McElwee ,
RESOLVED , that this Town Board hereby approves the increase in
the hourly wage rate of Leon Poelvoorde from $ 4 . 50 to $ 4 . 70 per
hour and an increase in the hourly wage rate of - Arland Westmiller
from $ 4 . 00 to $ 4 . 65 per hour .
Unanimously carried .
