Fabbroni , Town Engineer Barbara Holcomb , Planning Board Chairwoman Beverly Livesay , County Representative Klara Clayton , 3 Woodgate Lane Alex Dickson , 106 Drew Road Robert Boothroyd , Boothroyd Insurance Agency Radio , TV , and Press 1 1 REFUNDS OF TAX ASSESSMENTS Supervisor Schwan reported that Ronald and Barbara Apgar had been billed in error on the 1975 Town and County tax billing for a sewer benefit charge in the amount of $ 5 . - 00 ; that $ 4 . 99 should be refunded to them ( $ 5 . 00 less 1 cent nominal charge , according to the formula ) . The Tax Parcel Number is 54 - 2 - 24 . Motion by Supervisor Schwan $ seconded by Councilman Powers , RESOLVED , that the Town of Ithaca refund to Ronald and Barbara Apgar $ 4 . 99 ( $ 5 . 00 less nominal 1 cent per thousand of assessed valuation , according to the formula ) for a sewer benefit charge , since no sewer is available to the parcel ( 54 . 2 - 24 ) , the refund to be contingent upon the tax bill being first paid in full . Unanimously carried . Supervisor Schwan reported that Theodore Koch , 1432 Hanshaw Road had been billed in error on his 1975 Town and County tax bill for water and sewer surcharge in the amount of $ 5 . 81 ; that this amount should be refunded to him . Motion by Supervisor Schwan ; seconded by Councilman Powers , RESOLVED , that $ 5 . 81 be refunded to Theodore Koch , 1432 Hanshaw Road , Ithaca , New York , for water and sewer surcharge erroneously billed to him on his 1975 Town and County tax bill , such refund being contingent upon the tax bill being first paid in full . Unanimously carried . Town Board Minutes 2 February 3 , 1975 Supervisor Schwan reported that a letter had been received from Attorney Armand Adams requesting a refund of $ 379 . 80 for the Independent Order of , Oddfellows on . Tax Parcel 24 - 4 - 5 . 2 , contending that this parcel has no sewer service . The Board agreed that the assessment for sewer , in the amount of $ 380 . 00 was in error * that a correction for this was made in the tax roll last. year , but was not picked up for 1975 and the . error was repeated . Therefore , the Board acted as follows . Motion by Supervisor ,; Schwan * seconded by Councilman Powers , RESOLVED , that a refund in the amount of $ 379 . 81 ( $ 380 . 00 less nominal charge of 19 cents , 1 cent . per thousand of assessed valuation ) be made to the Independent Order of Oddfellows with respect to sewer charge made in error on Tax Parcel 24 - 4 - 5 . 2 , it being understood that no re - fund will be made until the original tax bill is paid in full . Unanimously carried . Mr . Adams in his letter again requested that the water charge also be eliminated . However , the Board felt that the water charge is prbper in accordance faith the formula in use throughout the Town . Therefore ] the request for refund of water assessment was denied . Supervisor Schwan read a letter dated January 3 , 1971 from Norbert H . Schickel , Jr . requesting that the water and sewer benefit charge assessed for dwellings at Eastwood Commons be reduced from 32 units to 20 units which was the total number of units completed as of October 1P 1974 . As of January 1 , 1975 , 12 units have been deeded to their new owners . Mr . Schickel asked that the Town send a separate bill to each owner for' the water and sewer benefit charge for the com- ing year commencing January 1 , 1975 . as this is their responsibility . Ee said that would leave 8 units for which Eastwood Commons Development Company would be responsible . tire Schickel in his letter enclosed a list of the unit owners as of January 1 , 1975 . The Board was "in agreement that tiro Schickel should have a refund on 12 units as 'indicated , but felt that the units deeded to individual owners should be ' billed direct by Mr . Schickel . Therefore , the Board acted as follows , Motion by Supervisor Schwand seconded by Councilman Powers , RESOLVED , that this Board hereby authorizes a refund of 12 units of water and sewer benefit , $ 876 . 00 , to Eastwood Commons Development Company , based on the fact that 20 units were completed by October 1 , 1971 -rather than 32 units , it being understood that the refund will be made contingent upon the original tax bill being paid in full . Unanimously carried . Councilman Desch recommended a modification of the formula to cover the specific problems encountered in condomini specific ums . .BIDS ON MATERIAL SPREADER AND BODY AND HOIST Proof of posting and publication of advertisement for bids k having been presented by the Town Clerk , the Board discussed the matter of the purchase of material spreader and dump body and hoist . Only one bid was received on the dump body and hoist . Highway Superinten- dent Parkin said it met: the specifications . The bid was in the amount of $ 2 , 583 . 00 and was received from Binghamton Equipment Corporation . IP Town Board Minutes - 3 - February 3 , 1975 Motion by SupervisorilSchwan seconded by Councilman McElwee , RESOLVED , that . the Tbwi Board . does hereby accept the bid of Binghamton Equipment Corporation in the amount of $ 2 , 583 . 00 for a . Dumo Body and Hoist . Unanimously carried . Supervisor Schwan reported that two quotations had been re - ceived on the S reader, one from . Hanna & Hamilton ,,milton , Inc . , Bath , New York , in the amount of $ 3 , 162 . 05 , the other from J . C . George Equip- ment Corporation , Syracuse , New York , in the amount - of $ 4 , 253 . 00 for a nine foot spreader 'ln Motion by Supervisor , Schwanq seconded by Councilman Desch , RESOLVED , that this TTown Board hereby accepts the low bid of $ 3 , 162 . 05 of Hanna and Hamilton , Inc . for 6 ' 9sfoot Spreader in accordance with specifications . prepared by the ' Town Highway Superintendent . Unanimously carried . INSURANCE. REVIEW - ANNUM, Robert Boothroyd , Jr . , Robert S . ' Boothroyd Agency , Inc . , dis - tributed material tothe Board for its review " Insurance Insurance Schedule for Town . of Ithaca . °° i, ( This material is on file in Town Clerk ' s Office , available for inspection . ) In the course of the review , Mr . Boothroyd noted that he did not recommend disability insurance . The Town hasljan excess liability policy which will protect the Town up to $ 5000000 ; however , there must be ' actual property damage and/or actual bodily '' injury . It does not cover an error or omission in the course of day to day business . This " catastrophe " policy will cover the Town for everything thin g which cannot be defined or foreseen at this time . Mr . Boothroyd said he could not at this time imagine the Town being involved in a suit in excess of $ 5 , 0000000 . Another one , million dollars of insurance would cost about $ 300 . 00 annually . There was some discussion of the Town ' s liability in the event of an accident involving a fireman injured in answering a fire call in the Town of Ithaca , . in view of the Town ' s contract with the City for fire protection . Mr .! Boothroyd recommended that the Town should ask the City for a certificate of insurance and further that the City ' s insurance carrier should name the Town as an additional insured on the City ' s policy . The Town would then be covered . ( Discussion with Mr . '- Boothroyd after the meeting indicated he felt , on further thought , that the Town ' s " catastrophe " policy would cover any situation with regard to accident or, injury to a City fireman or any other liability which might result from a fire call within the Town of Ithaca ; under its contract for fire" protection with the City of Ithaca , and that he would withdraw his recommendation that the Town of Ithaca require a certificate of insurance from the City of Ithaca and withdraw his recommendation that the Town be named as an additional insured on the City ' s policy . ) Hr . Boothroyd, did not recommend coverage on the Town ' s pump houses , except for the wooden ones . He advised he would provide a figure on the cost ofi! this insurance . He said the Town ' s standpipes are not coveredr that the City of Ithaca does not insure theirs ; and that there is very little that can happen to them . 1, Town Board 11614inutes _ 4 - February 3 , 1975 r Piro Boothroyd recommended that the Town Board adopt a reso - lution which would enable the'lEoothroyd Agency to add Workmens ' Com- pensat-ion coveragelto " volunteers "° - e that is , persons who perform a service for the Town , but who are non - salaried , at 21 cents per $ 100 of payroll . Councilman Desch' recommended that this should be - limited to people who are duly appointed in some capacity by the Town Board . The Board acted as followso Notion by Supervisor Schwan , "seconded by Councilman McElwee , tgHEREAS , the present Town of Ithaca Workmen ' s Compensation policy does not provide benefits for individuals who are . non ° salaried , but who provide service to the totem , and 11HEREAS , the Town of Ithaca wishes to provide statutory work ° men ' s Compensation for such individuals , NOtAl , THEREFORE , BE IT , RESOLVED , that the Town of Ithaca ask its Insurance Carrier to . provide , by ! endorsement or rider to its present policy , statutory Worlmen ' s Compensation coverage for the following * Town of Ithaca appointees too City of Ithaca Youth Bureau Tompkins County ad hoc Committee on Youth and Recreation Alsoo Thirty- six Town of Ithaca ' Election Inspectors Unanimously carried . TAX EXEMPTION FOR THE ELDERLY Supervisor Schwan read a memorandum from T . G . Payne , Direc - tor of Assessment , dated November 25 , 1974 regarding Senior Citizen Property Tax Exemption - Income Limit , in which he recommended that the income limit for county nt tax purposes rt o I' y oses be changed from $ 4 , 000 to at least $ 60000 effective on the assessment , roll filed in 1975 , and that a notice of any action be sent to the other municipalities in the County to foster uniformity in this regard . The Town of Ithaca had already set the limit at $,, 50000 . The Town Board at this meeting is contemplating increasing the income limit from $ 5 , 000 to $ 6 , 500 . Barbara Holcomb , Planning Board Chairwoman , presented prepared mater - ial to the Board for their review . In the material presented Mrs . I-€olcomb assumed a top figure of 150 parcels which might qualify under the contemplated $ 6 ,J1500 limit °anti assumed an average exempt value of $ 76rOOOo On the basis of these two " guesstimated " figures and based on this year ' s tax rate ( part -''town and fire ) the Town would have lost ; 5 , 113 in taxes or less than 1!% of the total tax levy . Based on this relatively negligible effect on the overall tax collections for the 'own and the benefit which would accrue to elderly citizens , the Board acted as follows. 0 IN klotion by Councilman! Desch ; seconded by Councilman TIcElwee , RESOLVED , that the Town Board of the Town of Ithaca hereby approves an increase from ss , ,OOMO to $ 6 , 500 . 00 as the maximum income an owner or the combined maximum income owners of real property in the Town of Ithaca , who 'are ( or one of whom is ). 65 years of age or over , may earn and still qualify for the 50 % tax exemption from real prop- erty taxes . Unanimously carried . it Town Board Minutes 4 5 - February 3 , 1975 PROPOSED DOG CONTROL ORDINANCE Town Attorney Buyoucos presented for review a preliminary draft of - the proposed Dog Control Ordinance for the Town - of Ithaca . During the discussion Mre Buyoucos suggested that that part of the proposal which would find the owner of a howling , whining or barking dog in violation oflthe " ordinance . might be eliminated . EIrs . Klara Clayton objected to this . saying such howling , whining and barking dogs are a nuisance ;: to her and her neighbours . . tars . Livesay suggest - ed it might be well to base the ordinance on such .. '° nuisance`* as might threaten the healthiand safety of persons and their right to enjoy their premises , rather than on particular prohibitions against dogs running loose , howling , whining and barking , which might - well be un - enforceable and which might inhibit the freedom of all dogs , particu ® larly in sparsely populated areas . The inclusion or elimination of other sections of the draft were discussed . Since no general agree ° ment could be reached it was agreed that the draft would be generally left the way it is (with possibly some modifications by I3r , Buyoucos ) so that the public may continent on all of it at a ?public hearing . ASSOCIATION OF TOWNS .MEETING o TOTIZI ATTORPdEY ° S EXPENSES Supervisor Schwan reminded the Board that the expenses of the Town Attorney had o Y n t as yet been approved for the Association of Towns meetings on February 9 , 10 , 11 , and 12 , 1975 . Motion by Supervisor Schwan ; seconded by Councilman Powers , RESOLVED , that the Town of Ithaca will pay the expenses incurred by the Town Attorney in connection with his attendance at the Associa tion of Towns reetings on February 9 , l0 , 11 , 121 19759 Unanimously carried . PROPOSED AMENDMENTS TO SIG"? ORDINANCE SCHEDULING OF PUBLIC HEARING 04otion by Supervisor Schwan * seconded by Councilman man Desch v RESOLVED , that the Town Board of the Town of Ithaca will conduct ' a Public hearing on March 10 ,, 1975 at 5030 p . m . to hear all P ersons for or against proposed amendments to the Town of Ithaca Sign Ordi - nance . Town Engineer Fabbroni will fol - low up on this . FIRE, CONTRACT WITH THE CITY OF ITHACA It was agreed that Attorney Buyoucos would meet with Mr . Donald Jo Slattery , ',acting Mayor of the City of Ithaca , and Mr . Martin Shapiro , Attorney for the City of Ithaca , • to put the fire contract with the City of Ithaca in final form . PUBLIC INFORMATION . LAT4 This matter 'was tabled; until the March 10 , 1975 meeting . . Town Board Minutes e 6 A February 3 , 1975 CAPITAL RESERVE FUND Supervisor ,Schwan recommended that the Town of Ithaca hold a public hearing to consider the establishment of a Capital Reserve Fund for highway machinery . The fund would begin with funds appro - priated for 1974 bu't not spent in 1974 for highway machinery . Motion by Supervisor Schwan ; seconded by Councilman McElwee , RESOLVED , that the „Town Board conduct a public hearing on March 10 , 1975 at 5 : 45 to consider the establishment of a Capital Reserve Fund for Highway Machinery , Item III . Unanimously carried . REPORTS OF TOWN OFFICIALS Town Engineer Fabbroni said he would have information with regard to the National Flood Insurance Program at the next regular Board meeting . 5upervisor 'Schwan reported that there was a request to the Town from Willis 5 . Hilker , President of South Hill Estates , for a refund of $ 100 . 00 deposit on excavation for 117 and 118 Kendall Avenue , which excavation work has been done and restoration made to the Town ° s satis, .fact 0 Motion by Supervisor SchwanB seconded by Councilman McElwee , RESOLVED , that $ 100 . 00 deposit be refunded to Willis S . Hilker , President , South Hill Estates on street opening permit for excava - tion at 117 and 118 Kendall Avenue , based upon the Highway Superin - tendent ' s statement that the work has been completed and the street restored to his satisfaction . Unanimously carried . Supervisor , Schwan reported that a Certificate of Road Clos - ing , dated January "30 , 1975 had been received from Howard Stevenson , Commissioner of Public Works , . Tompkins ,County , pursuant to Section 104 of the Highway '',Law , the certificate being executed and filed for the purpose of stating the necessity of temporarily closing Forest Home Drive between 'Warren Road and Caldwell Road for purposes of bridge repairs . The effective date of closing is February 3 , 1975 . CATHODIC PROTECTION OF TRUMAN SBURG ROAD STANDPIPE SupervisoriSchwan reported that a letter had been received , dated January 16 , 1975 , from Wallace & Tiernan , Belleville , New Jer - sey , advising that their Engineering Department had reviewed the Town ' s cathodic protection system and have found that the hand holes were never installed in the roof of the Trumansburg Road Standpipe . The letter indicates that in order to avoid using the spider rods in the tank , they could cut necessary - hand holes and install an anode suspension system for the Town ' s cathodic protection system . They indicate that the installation of these hand holes would completely eliminate the need for their "service crew to enter the interior of the tank to service the system . The cost of this modification is $ 254 . 00 plus applicable taxes . P-lotion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , that the offer of Wallace & Tiernan to install hand holes in the Trumansburg 'rRoad Standpipe , as indicated above , for the sum of $ 254 . 00 plus applicable taxes , be accepted . Unanimously carried . Town Board Minutes ! 7 - February 3 , 1975 ITHACA BIKEWAY STUDY Mr , Fabbroni reported that he had a letter dated December 31 , 1974 from the College of Architecture , Art & Planning , Landscape Architecture Graduate Program , rer"uesting that the Town Board of the Town of Ithaca appropriate $ 200 ,, 00 in support of the Landscape Archi ° tecture Graduate Program ' s Ithaca Bikeway Study . The Planning Board has recommended the allocatiion df this amount of money , but the Town Board must approve it , � it will , however , come out of the Planning Board budget , The Town Board agreed to fund this program to the extent of $ 200 . 00 . CONTRACT WITH COUNTY SEWER ! DISTRICT No . 1 FOR SEWER SERVICES Supervisor Schwan reported . that County Sewer District No . 1 would assess the excess cost, to . the Northeast when the Village of Cayuga Heights treatment plant is purchased from the Village . The Commission decided to ask each Board how they would like the Commis - Sion to handle it * . that a resolution was needed from the Ithaca Town Board . The Board felt they would prefer to contract with the County Sewer District for sewer services and that the Town would perform the billing services and collect its share of the excess costs . There- fore the Board acted ` as followso Motion by Councilman Deschi seconded by Supervisor Schwan , RESOLVED , that the Town Board of the Town of Ithaca will contract with County Sewer District No . l for sewer services which are provided within the Town of Ithaca by County Sewer District No . 1 , and that as part of such arrangement the Town of Ithaca will perform the billing services and collect its share of the excess costs * that the sense of this resolution be conveyed to the County Sewer District No . 1 Commission . Unanimously carried . RESIGNATION FROM PLANNING BOARD Barbara Holcomb , Planning Board Chairwoman , reported that Mr . Arnold Albrecht had resigned from the Planning Board : Because . the Board wished to express its appreciation for Mr . Albrecht ' s ser - vices over the years , the following action was taken * Notion by Supervisor Schwan * seconded by Councilman McElwee , WHEREAS , Arnold Albrecht has resigned from the Town of Ithaca Planning Board effective December 31 , 1974 , and 1�,JHEREAS , Arnold Albrecht has faithfully served the Town of Ithaca as a member of the Planning Board from January 13 , 1969 to January 1 , 1975 , NOWT THEREFORE , BE IT RESOLVED , that this Board does hereby express its formal and sincere thanks to' Arnold for his six years of service to the Town of Ithaca as a member of the Planning Board , dur - ing which time he has been constant and devoted to the welfare of the Town of Ithaca and its citizens , and BE IT FURTHER RESOLVED , that a copy of this resolution be spread upon the minutes of the Board meeting of February 3 , 1975 * and that a copy of this resolution , accompanied by a formal testi - monial be presented to Arnold with the thanks and appreciation of the members of the Town Board of the Town of Ithaca . Unanimously carried . Town Board Minutes - 8 one February 3 , 1975 t REPORTS OF TOWN OFFICIALS James V . . Buyoucos , Town Attorney , said .he ' 'had discussed with Mr . Martin A . Shapiro , City Attorney , the easeirieits which the Town needs with respect to the Bolton Point project . He did not think there . would be any trouble with these . U Mr . Buyoucos said he was concerned 6 d the timing for sub- mitting propositions regarding the proposed ward system of elections . He said he needed time for the reparation , oV. a resolution . The Board agreed td discuss this mater at the meeting of March 10 , 19759 Lawrence Fabbroni , town Engineer ;: , reported that Stein Build- ers , Inc . of Endicott , New kbik , have requested reconsideration of the $ 25 ,, 000 bond the"' Board , required with regard . to the work they are doing on' Sharlene and Tudor Roads . They Have roughed out the road and have done complete siib -grading and have only to put the gravel in . They would like to' submit a - $ 10 , 00b Irrevocable Letter of Credit in favor of the Town of ithaca for the account of Stein Builders , Inc . Town Attorney Buyoucos recommended accepting the iettek of credit if it satisfactorily replaces the security offered by a bond in the same amount . He said the resolution should include the fact that the acceptance is subject to review by the Town Attorney and Town Engi - neer . Motion by Supervisor Schwanf seconded by Councilman McElwee , RESOLVED , that the Town Board of the Town of Ithaca hereby accepts from Marine Midland Bank ( Southern ) , Binghamton , New York , their Irrevocable Letter of Credit in the Town of Ithaca ° s favor for the account of Stein Builders , Inc . , Endicott , New York , in the amount Of $ 10 , 000 . 00 with regard to the completion of the work in the East- ern Heights subdivision , Tudor Road Project , subject to review by the Town Engineer and the Town Attorney . Unanimously carried . * * * I Mr . Fabbroni reported that he had attended several sessions of the Transportation Research Board in Washington , D . C . One of the sessions was on funding and it appeared the Town of Ithaca is not eligible for a number of these programs because it is not a town of 50 , 000 people and does not have a continuing comprehensive study of the whole area . The Town of Ithaca comes under the small city sec - tion . Mr . Fabbroni said he would work with City of Ithaca people on what the Town may be eligible for . l�lr . Fabbroni said that at the sessions in Washington ,? D . C . there was a report on model zoning ordinances which included a lot of material on Planned Unit Development . Mr . Fabbroni said he would send for that material . With regard to bikeways , it does not appear that anyone has any clear guidlines , but there are many safety studies under way . At the meetings there was considerable emphasis on land use.. legislation which may or may not be passed . It has been in Congress for two years already . This legislation could have important effects on funding for different planning functions . Mr . Fabbroni noted that these were just a few of the subjects covered at the sessions . Town Board Minutes : 9 - February 31 1975 r , Fabbroni reported that the Bolton- -i I t constrd '! on r M. oad is now completed and a lot of thanks ought to go out from the South- ern Cayuga Lake Intermunicipal Water Commission +o Mr . Hdwgrd Steven - son , County Highway Department , and to all { he Highwa Departments in the various municipalities concerned . Mie. . Fabbroni noted . that there is a little more work' to do on clearing the4 . site at the water treat- ment plant because of " some modikications thdt were made , changing from sludge bed to lagoon , set-up : There area couple of acres of trees to cut down . The whole project is tiding very we11e Mr . Fabbroni , as Building Inspector' ; ropbrted that building Permits were issued , three , amounting to $ 39 , 500 wdrth of improve - ments in Jahuary , . as agaihst $ 316 , 250 last year . Last year ' s figure is inflated by reason of the 25: units in the Monkemeyer development . Under the circumstances it would be difficult to make a comparison . Mrse Barbara Holcomb reported that there was an amendment to the New York State Environmental Conservation Law , effective April 1 , 1974 , which regulates any operator who takes gravel and other mater - ials out of the ground to the extent of more than 11000 tons in 12 consecutive months . It is a permit procedure , the operator to fur - nish a map of the area , what they plan to do , how they intend to re - claim the land , and the like . This is essentially what the Planning Board intends to do in an excavation ordinance for the Town of Ithaca . Attorney Buyoucos asked if this State regulation pre -empted the pow- ers of the Town of Ithaca . Mrs . Holcomb said the Town could estab- lish more restrictive regulations but could not be less restrictive . Mrs . Holcomb reported that the Town of Ithaca , City of Ithaca , and Tompkins County Planners have been having informal luncheon meet- ings to discuss what various people are doing and keeping in touch with each other . At the last meeting transportation and the exten- sion of bus lines was the subject . It appears a mini -bus is being considered to serve Ithaca ; that this might be developed into mini - bus transportation for the Ellis Hollow Road project residents . Mrs . Holcomb requested authority for herself and Mr . Fabbroni to visit With City of Ithaca officials to discuss possible establishment of bus routes in the Towne The Board heartily approved of such discus - sions . REPORTS OF COUNTY REPRESENTATIVES Drs . Beverly Livesay reported that the County has a transpor - tation study under way , the Myberg study . Mrs . Holcomb noted that the Zlyberg study 'is to be a model for areas like Tompkins County ; that out of that study useful information would be developed . In the meantime , the Town of Ithaca can be working out some bus routes . Supervisor Schwan said that what was needed was some specific numbers , number of people who would use the system , number of dollars involved , and lelineation of specific routes . It is difficult to work without pecifics . ` ° ' Mrse Livesay , reported that the " two -hat '° law was tabled for two weeks . Supervisor Schwan was concerned over the wisdom of allow= ing one person to hold two elective offices . Mrs . Livesay said it. could be done and has been done .
