Merton Wallenbeck , 201 Woodgate Lane e Radio , TV , and Press APPROVAL OF MINUTES Motion by Supervisor Schwan., seconded by Councilman Powers , RESOLVED , that the minutes of August 12 , August 19 , and September 16 , . 1974 be approved , as presented . Unanimously carried . LIST OF TOWN ROADS Supervisor Schwan reported that a list of roads and streets in the Town of Ithaca ( as listed at County Fire Control Center ) was received from Tompkins County Fire and Disaster Coordinator John L . Miller . P2r . Miller asked that the list be examined , necessary changes and additions be made , and that the Town Board adopt a resolution de - claring them to be the official names . The Supervisor read Mr . Miller °- k-° letter dated August 28 , 1974 . Mr . Miller ' s list of roads and streets included private roads and streets and some " paper subdivision roads " . It was agreed that Mr . Miller could be supplied with a list limited to approval of official names for the roads or streets , and could be furnished a separate list - of private roads and " paper subdivision roads . " ® 2 October 7 , 1974 WHEREAS , John Lo Miller , Tompkins County Fire and Disaster Coordinator , submitted a list of roads to the Town Board of the Town of Ithaca and requested that the names of said roads be given official status , IT IS RESOLVED , upon motion of Supervisor Schn-7an ? seconded by Councilman Powers , That the Town Board of the Town of Ithaca approves the names . of the roads listed below *. ( See attached list ) The scope of this resolution is limited to approval of official names for said roads or streets and is not intended as a resolution of acceptance of said streets or roads , Unanimously carried . INVENTORY OF HIGHWAY MACHINERY , TOOLS AND EQUIPMENT Highway Superintendent Morey presented to . the Board the Inventory of Highway Machinery , Tools , and Equipment , in accordance with Highway Law , Section 142 ( 3 ) , inventory dated September 18 , 1974 , Motion by Supervisor Schwan . seconded by Councilman Powers , RESOLVED , that the inventory of Highway Machinery , Tools and Equipment , dated September 18 , 1974 , as presented by the Town Highway Superintend - ent in accordance with Highway Law , Section 142 ( 3 ) , be accepted . Unanimously carried . Mr . Morey ° s list indicated that the 1961 truck should be replaced with a larger unit and larger cinder spreader and that the pickup needs re - placing . Motion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , that the Highway Superintendent be authorized to prepare specifications for the replacement of the 1961 Truck with a larger cinder spreader and for the replacement of the pickup . Unanimously carried . I'Y . Morey also noted that the Old Backhoe should be replaced with a unit that can be used in the new water system . The Board did not al -hnrize this but suggested that Mr . Morey investigate what is avail - al� -. e and then the Board could reconsider it , Mr . Morey indicated it might be possible to find a used one . WILLIAMS GLEN ROAD IMPROVEMENT PUBLIC HEARING 5830 p . m . Proof of posting and publication having been presented , the Supervisor opened the hearing on the improvement of Williams Glen Road . In the original publication of the public hearing the maximum amount to be ex - pended was indicated as $ 2 , 500 . Mro Fabbroni , Planning Engineer , re ° ported that the cost has now escalated to $ 4 , 000 because of the increase in the cost of gravel . In view of the fact that all of the people from the Williams Glen Road area who might be interested in this matter were not present and the ones present did not represent a majority of the property owners , it was the recommendation of the Town Attorney and 3 October 7 , 1974 the sense of the Board that the matter ought; to be . re �published and a new public hearing held on November 7 , 1974= to. re -consider the mat - ter at the increased price . Town Board , . -Linda-'Coke had to withdraw , it was necessary to appoint another Dog Enumerator ° Motion by Supervisor Schwan ; seconded by Councilman. . Desch , RESOLVED , that William Hauptaman , 1031 Taughannock Boulevard , be appointed Dog Enumerator for the. Town of Ithaca for the year 19750 Unanimously carried . APPOINTMENT OF TOWN HIGHWAY SUPERINTENDENT In view of the fact that Mra Marion °4orey , Town Highway Superm intendent , is retiring effective October 3l , 19740 it was necessary to appoint a new Highway Superintendent , effective November 1 , • 19740 Motion by Supervisor Schwan ° seconded by Councilman . Powers , RESOLVED , that Robert Eo Parkin , 1146 Danby Road, Ithaca , New •York , be appointed Highway Superintendent of' the .Town of Ithaca , term of office to be from November " 1e 1974 through December 31 , 107-So APPOINTHENT OF TOM JUSTICE Unanimously carried , Since a vacancy will exist in the office " of . Powers IN TFE RZATTFR OF THE PETITION OF THE OWNERS OF' MORE THAN Mtd HALF OF THE REAL PROPERTY FRONTING ON WILLIAMS GLEN ROAD , FOR THE IMPROVEMENT OF A PORTION OF SAID STREET Motion by Supervisor Schwanr seconded by Councilman Desch , WHEREAS , a written petition dated August 12 , 1974 , was duly filed with this Board pursuant to Section 200 of the Town Taw , for the improvement of that portion of the highway in said Town , known as Williams Glen Road , which runs northerly from the City boundary line approximately 1 , 000 feet to its new termination in a cul de sac , there by abandoning the northernmost existing interchange of Williams Glen Road and Route 96 ( Cliff Street ) , all as more particularly shown on a. suvey map on file in the Town Clerk ° s Office , 108 East Green Street , Ithaca , New York , made by Carl Crandall , C . E width of 50 feet ° and . , and drawn by J . D . Parkes on November 1. , 1971r the right of way of said road to have a WHEREAS , it duly appears that such petition has been duly signed by the owners of real estate on at least one -half of the entire frontage or bounds on both sides of that portion of Williams Glen Road which is to be improved and made a Town streets and WHEREAS , it duly appears that such petition was duly signed by resident owners owning not less than one -half of the frontage owned by resident owners residing in or along the portion of Williams Glen . 'Therefore , Motion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , that Lawrence Po Fabbroni ° s title as Zoning Officer be changed to - Building Inspector and that Reynolds Metz ° s title as Assistant Zoning Officer be changed to Assistant Building Inspector . Unanimously carried . AREA BEAUTIFICATION COUNCIL OF TOMPKINS COUNTY Supervisor Schwan let it be known that there is a vacancy on the Area BeautificationpCouncil of Tompkins County and said the Town Board would welcome suggestions as to who might fill this vacancy . COMBINED REGULAR AND BUDGET 4BETING Notion by Supervisor Schwana seconded by Councilman Powers , RESOLVED , that the Town Board of the Town of Ithaca shall hold a com� bined regular and budgot meeting on November 7 , 1974 , at 5000 pome in the Town Officesb as required by Town Law , Unanimously carried , PUBLIC HEARING CITY OF ITHACA FIRE CONTRACT Motion by Supervisor Schwan ; seconded by Councilman Powers , RESOLVED , that a public hearing be held by the Town Board of - the Town of Ithaca at 5035 p , m , , November 7 , 1974 in the Town of Ithaca . Offices , 108 East Green Street , Ithaca , New York , for the purpose of hearing all persons interested in the renewal of a contract with the City of Ithaca for fire protection for a one °year period on the basis of $ 136 , 500 for the year 1975 in the Town of Ithaca , excepting the .following areas , to wito a ) the Village of Cayuga Heights , b ) the area comprising all the territory lying between the east boundary of the Village of Cayuga Heights and the east boundary of the Town of Ithaca , c ) the Hamlet of Forest Home exclusive of the structure housing the Cornell University Filtration Plant . PUBLIC HEARING FIRE CONTRACT WITH VILLAGE OF CAYUGA HEIGHTS Motion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , that a . public hearing be . held by the Town of Ithaca Town Board at 5040 porno , November 7 , 1974 in the Town of Ithaca Offices at 108 East Green Street , Ithaca , New York , for the purpose of hearing all persons interested in the renewal of a contract with the Village of Cayuga Heights for fire protection for the year 1975 on the basis ® 6 October 7 , 1974 Of $ 17 , 525 in the Hamlet of Forest Home and in that portion of the Town to the north of Forest Home and between the east boundary of Cayuga Heights and the east boundary of the Town of Ithaca . Unanimously carried . PUBLIC HEARING ° LIGHTING IT4PROVEMENT DISTRICTS AND WATER AND SEWER IMPROVEMENTS Motion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , WHEREAS the Town of Ithaca has prepared assessment rolls on the parcels of land included in the following ; ( 1 ) Forest Home Lighting Special Improvement District . ( 2 ) Glenside Lighting Special Improvement District . ( 3 ) Renwick Heights Lighting Special Improvement District , ( 4 ) The Town of Ithaca water and sewer improvements now operated by the Town as a Town °wide function and cover ° ing all lands in the Town , pursuant to Section 209 °r of the Town Lawf this assessment roll includes not only all the parcels formerly included in all the former water and sewer districts , but also all other lands in the Town of Ithaca outside of the Village of Cayuga Heightsea and has apportioned and assessed upon such parcels of land in proportion to the amount of benefits the improvements shall confer upon the same the costs chargeable to said districts and said land in the Town of Ithaca for the establishment and con ° struction of the improvements in said districts , in ° cluding the water and sewer systems therein , which charges are payable in the year 1975 and , therefore , pursuant to Section 239 of the Town Law , the said Town Board will hold a public hearing thereon at the Town Offices ( third floor ) , 108 East Green Street , Ithaca , New York , on the 7th day of November , 1974 , in in the order listed above , beginning at 5 : 45 p . m . , at which time it will consider any objections which may be made to said assessment rolls and apportion mentso Unanimously carried . PRELIMINARY BUDGET 1975 liotion by Supervisor Schwan ; seconded by Councilman Desch , RESOLVED , that the Town Board hereby prepare and approve as a Prelim - nary Budget of this Town for the fiscal year beginning \�ranuary 1 , 1975 ,__ the itemized statement of estimated revenues and expenditures , as pre ° pareda a copy of which is to be made a part of these minutes , and BE IT FURTHER RESOLVED , that the Town Board of the Town of Ithaca shall meet to hold a public hearing at 5 : 50 p . m . on Thursday , November 7 , 1974 at the Town Offices , 108 East Green Street , Ithaca , New York , for the purpose of hearing any person for or against any item or items therein ; and BE IT FURTHER RESOLVED , that the Town Clerk shall give notice of such public hearing in the manner provided in Section 108 of the Town Law providing that such notice shall be published in the Ithaca Journal at least twice . Unanimously carried . Won 7 e October 7 , 1974 REVIEW OF PRELILMINARY BUDGET Supervisor Schwan reviewed the preliminary budget for 1975 page by page , and item by item . There did not appear to be any obi et: °• tions to any items in the preliminary budget for 1975 , as presenter? . Supervisor Schwan , therefore , closed the review of the budget , noti:..0 that a formal public hearing on it would be held on November 7 , 19 ; 4 . TOWN HIGHWAY BUILDING FEASIBILITY STUDY. With respect to the Town highway building , Mr . Fabbroni , Plax, ® ning Engineer , furnished the Board with a bill of materials ( quantity , unit price , cost ) , including architect ' s fee ( 5n ) , contingency ( 20 % ) , profit ( 15 % ) , for remodeling and adding to the existing highway bull-d - ing . He provided also side elevation of the existing building and pro - posed addition , a back elevation of the building , ground floor plan of the existing building and plan for proposed addition , including re � modeling a part of the existing ground floor for locker room , lockers , showers , and toilet facilities . He said the purpose o £ , furnishing this material to the Board was merely to draw up a list of existing equipment , what might be added to the existing structure , a functional sketch and a rough estimate of the cost . He said the estimated cost is an °' outside `° figure ( it could come to as much as 25 % less ) furnished only to help the Board determine whether the Town should pursue the matter further . Mr . Fabbroni suggested the matter could be . more :. :pSrofit - ably discussed in a work session , after the meeting . TOWN PRIORITIES Supervisor Schwan , in response to a suggestion made at public hearing recently that the Town establish a set of priorities indicated that the Town ' s priorities , basically , are ( 1 ) the Bolton Point project ; ( 2 ) a Town Hall , ( 3 ) remodeling and adding to the existing Town high® way building (which is at present functionally deficient ) , ( 4 ) parks and recreation areas , and ( 5 ) sewage treatment . He noted that revenue sharing was funded by Congress for a five -year period and that next year ( 1975 ) is the last year . He questioned whether revenue sharing would be extended and , therefore , felt that revenue sharing funds should be confined to capital improvements , rather than spent for projects with on°going expenses which would eventually have to be supported by the tax rate ® ® projects such as a constable and related equipment , mass transit , and peripheral parking lots . He noted that the first two years of revenue sharing have been committed to Bolton Point and the cost of the new Town Hall , $ 138 , 500 , will use roughly one and a half years more . He said there are funds available in the Town-wide general fund for a study of the highway building and for parks and recreation .. r�rs . Herbert Mahr asked how the priorities indicated by the Supervisor related to the priorities noted by the public at the pub® lic hearing on priorities . She contended there was no feeling at the hearing that a Town Hall was a priority . She sriid some of the priori - ties suggested by the public were not on the list . Supervisor Schwan said the Board was not in favor of peripheral parking lots at this time . With regard to mass transit he said a study of bus service throughout the Town is under way . When the study is available the Board will be in a position to discuss mass transit . He noted that a mass transit system involves an annual expense ( with very likely less income than expense . ( The City of Ithaca operates its bus system at a loss . ) A mass transit system is something that would have to be supported by the tax base . He said that new road construction could probably be supported out of Town-wide surplus , with no need to raise taxes . . With respect to the Town highway barn , Councilman Desch noted that monies which might be spent in this area would result in increased` productivity and serviceability . 8 - October 7 , 1974 PETITION ON TWO PROPOSITIONS - ONE FOR THE WARD SYSTEM AND ONE FOR AN INCREASE IN THE NUMBER OF COUNCILMEN ON THE TOON BOARD FROM FOUR TO SIX Supervisor Schwan read the petition , which was signed by 524 Town residents ( that is , qualified electors ) , and which was filed with the Town Clerk on October 4 , 1974 , Town Attorney Buyoucos furnished the Town Clerk , and the Board members with an outline of the requirements with respect to the peti - tion and the holding of a special . election and time table involved . He said he would provide the Board with a legal opinion on the petition before the end of the week . Mro Buyoucos said he had reservations about the fact that both propositions were submitted on one petition . He thought there were some inconsistencies in Sections 85 (ward system ) and 87 ( increase or decrease in number of councilmen ) . He said this matter would be covered in his formal legal opinion , It appeared that if the ward system were established and the number of councilmen in creased from four to six that all councilmen would be elected at the same time for a period of two years . This might seem to mitigate against experience and continuity on the Board . Assuming four council ® . man and the ward system , it appeared that the Board could never be in- creased , without a change in the Town Law , Mr . Buyoucos said he would look into all these matters more thoroughly before rendering his form- al legal opinion . Mrs Buyoucos indicated that should the .Aetit ' on be deficient , the Board could on its own motion could place either one or both of the propositions on the ballot without requiring the circula- tion of another petition . FIDLER ROAD m HAAG & 11THITE Mro Mark Haag renewed his request that the Town of Ithaca accept Fidler Road . Mr . Arthur A . Prince , when he reserved the right to convey a fifty foot strip as a proposed road ( Fidler Road ) to the Town of Ithaca , he also granted to Haag & White a right of ingress and egress over this road and the right to cross such road . with utility and water lines . It appeared that the Town could accept Fidler Road contingent upon the Town Attorney including in the deed all the protec - tions required by the Town , taking into consideration the rights of Haag & Whites Motion by Supervisor Schwan * seconded by Councilman Powers , RESOLVED , that the Town of Ithaca hereby accepts Fidler ?.toad as a Town road , contingent upon the Town Attorney approving the deed to said road > Unanimously carried . (Mr , Buyoucos let it be known , for the Board ' s information , that his partner , John Co Barney , has represented Mr . Haag . ) REPORTS OF TOWN OFFICIALS Afire Fabbroni , Planning Engineer and Building Inspector , re - ported that the Rennilworth planting strip should be completed in the next two weeks . He reported also that work on Campbell Avenue is pro- ceeding in spite of a lot of rain * that the deed for Campbell Avenue has been recorded in the Tompkins County Clerk ' s Office . Mrs Fabbroni reported that seven building permits for homes , and five for additions , about $ 144 , 000 worth of new construction , had been issued as compared to five permits and $ 19 , 000 of new construction for the same month last year ( September ) . Barbara Holcomb , Planning Board Chairwoman said the next Plan - ning Board meeting will be devoted to the new Zoning Ordinance . Mr . Fabbroni and Mre Francese ( consultant ) have been working on the finish- ing touches . 9 m October 7 , 1974 REPORT OF COUNTY REPRESENTATIVE lArse Beverly Livesay reported that the meeting of the Super visors and Rural Representatives will be held on October 23 , 1974 at 7030 P . M .
