Motion by Supervisor Schwan ; seconded by Councilman Powers ,
RESOLVED , that the Town Board of the Town of Ithaca authorizes the .
awarding of the Kennilworth Planting Strip job to Bradley Landscaping
. Service of 305 Muriel Street , Ithaca , New York .
Unanimously carried .

IN THE MATTER OF THE PETITION OF THE OWNERS
OF HORE THAN ONE °HALF OF THE REAL, PROPERTY
FRONTING ON WILLIAMS GLEN ROAD , FOR
THE
IMPR.0VPMKFaNT OF A PORTION OF SAID STREET
WHEREAS , a written petition dated August 12 , 1974 , was duly
filed ',', with this Board pursuant to Section 200 of the Town Law , for the
irap:Lovement of that portion of the highway in said Town , known as
Williams Glen Road , which runs northerly from the City boundary line
approximately 10000 feet to its new termination in a cul de sac , there
` - by abandoning the northernmost existing interchange of Williams Glen
Road and Route 96 ( Cliff Street ) , all as more particularly shown on a
survey map on file in the Town Clerk ' s Office , 108 East Green Street ,
Ithaca , New York , made by Carl Crandall , C . E. , and drawn by Jo Do
Parkes on November 1 , 1971 ; the right of way of said road to have a
width 'lof 50 feeto and
WHEREAS , it duly appears that such petition has been duly
signed. by the owners of real estate on at least one -half of the en °
tire frontage or bounds on both sides of that portion of Williams
Glen Road which is to be improved and made a Town streeto and

Bo The date of the intermunicipal water agreement , herein ®
after also referred to as Agreement , shall , for purposes of identifi ®
catilun , be February 25 , 19740
Co All actions have been taken which are required to make
said! Agreement an agreement binding upon the Town of Dryden , the `Down
of Ithaca , the Town of Lansing , and the Village of Cayuga Heights , ,
and saic? agreement is now in effect as a valid , binding obligation
of the Town of Ithaca .

Section 20 The Commission is authorized to advertise for
the receipt of sealed bids for the construction of the intermunicipal
project in accordance with the provisions of said Agreement and the
plans , engineering drawings , specifications , contract documents , and
resolutions heretofore adopted by this municipality and the three
other municipalities and all other proceedings relating to the fore -
going which have been heretofore had . Such bids shall be received
and opened at the Town of Ithaca Offices , 103 East Green Street , Ithaca. .
New ,York at such time or at such other place , as the Commission shall,
determine to assure the most expeditious commencement of the construc °°
tion ,, of the project . The Commission is authorized to open any and
all bids and to make a report thereon immediately to each municipality ;:
copies of all bid proposals shall be made available immediately to
this municipality . The Commission is authorized to take such other
action as the Commission shall deem necessary and desirable . Any
such' action by the Commission , however , with respect to the accept °
ance ,, or rejection of bids is subject . to the final approval of this
municipality ° The form of the notice or advertisement for bids shall
be in the form approved by the Commission and its legal counsel .
Section 3e
A . . The Commission is authorized to negotiate for the acquisi -
tion � of such lands , in fee simple , or easements or other interests in
land , as may be necessary for the purposes of the project on such
terms and conditions , including price , as the Commission deems advisor
ablea Title to such lands , or easements or interests therein , may be
acquired jointly in the name of all four municipalities which are
parties to the aforesaid Agreement or in the name of any one or more
of said municipalities in behalf of any one or more of said municipalig
ties '.
Be The Commission is authorized to commence any actions or
proceedings , including condemnation proceedings , necessary to acquire
the title to any such lands , whether in the nature of a fee simple
title or a lesser interest , including easements and rights of way , in
any such lands . Any such action shall be commenced either in the name
of all or any one of the municipalities which are parties to said
Agreement or in the name of the several members of the Commission ,
acting jointly in behalf of this municipality and said other munici -
palities , and , without limiting the foregoing , the Supervisor of this
Municipality , na_*nely , the Town of Ithaca , is authorized to amend any
such proceeding or action , and to verify any and all pleadings in any
such proceedings and actions .

FEDERAL REVENUE SHARING - ACTUAL USE REPORT
Potion by Supervisor Schwan ; seconded by Councilman Del Rosso ,
RESOLVED , that the Actual Use Report ( Federal Revenue Sharing ) which
is to be filed prior to September 9 , 1974 , shall show one -half of the
funds are obligated to Bolton Point and the other half of the funds
are obligated to Town buildings and equipment .

HIGMA7AY SUPERINTENDENT AND TOWN JUSTICE
It was the sense of the Board that advertisements should be placed
immediately in the Ithaca Journal to fill impending vacancies in
the positions of Town Highway Superintendent and Town Justice , Marion
Morey , Highway Superintendent , intends to resign November 1 , 1974 ,
and Frederick Re Hartsock has submitted his resignation to become
effective December 31 , 19740

PLANNING BOARD CHAIRWOMANI /PLANNING CONSULTANT
The Board agreed that Mrs . Barbara Holcomb shall remain in her capacity
as Planning Consultant at the salary of $ 300000 per month until Novemt
ber 1 '; 1974 , at which time the position will be reviewed .
