RESOLVED , that the minutes of June 10 , June 17 , and July 8 ,* 1974 be

Norbert Ho Schickel , Jro requested that the Town Board accept as Town
roads Wildflower Drive , Harwir::k Road and Strawberry Hill Roada He
sai��1 the roads were finished except for the top course and that all
utilities are in . He said they would finish the roads and give the
Tcvn whatever kind of bond it might require to assure completion . The
sense ,', ef the Board was that a bond in the amount of $ 6 ,000 should be

Further discussion led to consideration of amendments to the foregoing
resolution , and the Board took the following action :
Motion by Supervisor Schwan9 seconded by Councilman Desch ,
RESOLVED , that the Town of Ithaca accept as Town roads , the portions of
Wildflower Drive , Strawberry Hill Road , and Harwick Road within Phase
I of the Eastwood Commons development , with the requirement that the
developer provide a performance bond in the amount of $ 6 , 000 to com-
pletelthe roads and curbing , said bond to specify that the performance
of the work be completed to Town specifications by December 1 , 19740

Center for the Arts . Supervisor Schwan read a letter from
the Center of` r the Arts at Ithaca , dated uuly 11 , 1974 , requesting
$ 10 , 000 in funds for renovation of the old hangar building at Cass
Pa.rkll' The question appeared to be whether the Town of Ithaca could
legally contribute monezy toward the renovation of a building it dick

they are &Adequately funded through December 31 , 1974 . The

Mr . David 'Taube , of O ' Brien & Taube , Architects , made a pre

use als a Tatx7n hall . He indicated it would cost $ 130 , 000 to renovate
Boarazran House for. use as a Town hall , not including the cost of a
r...w :eating system , central air conditioning , and a new vault , which
would ircyea. se the cost to $ 160 , 000 , It appeared that the Town could
lease the building at some nominal cost and do the renovation ,

proposals before any decision is made with respect to the Boardman

to day :operation and for the convenience of the citizens . Sazc aio-te:c�

There was some discussion of buying the Boardman House. out -
ri.ght . The sense of the Board was that the Town of Ithaca make a
proposal to the County on the purchase of the building .
CLINTON HOUSE (AS A POSSIBLE TOWN HALL )
Mr . Fabbroni , Planning Engineer , noted that the Clinton House
flist: orical Society has not shut the door to the purchase of the Cl '
ton House after a certain time . He said that after renting it fcr a
certain period of time , it could be purchased .

Supervisor Schwan read a letter dated July 29 , 197`4 from
Mro Martin A . Shapiro , Attorney for the City of Ithaca o regarding

permits to tap into the City of Ithaca Water System . The Supervisor
a :t coo , read the amended policy statement of the City of Ith.aca . aat%d
iSay 12 , 1965 . Ide noted that the contract with the City of Ithaca
entered into in 1965 does not stipulate that the Town muejt have. sewer
service in order to get a water tap . The amended policy statement of
the City of Ithaca states . . U " New water line construction will only
be allowed if accompanied by new sanitary sewer construction serving
the areas to be served with water . The new sewers can only be con -
nect; d to the City system and must be P lanned built and maint- ained �
unda:p, the same conditions as the water extensions . "built , appears that
thi s " policy " creates a hardship for a number of residents of the
Town 'of Ithaca who need water but who do not have sewer . Supervisor
Schwan noted that only about 20 houses on South Hill could logically
be ear e
cted to ask for water ter w
ho do not have sewer . It was the sense
of tix;e Board that the Town Attorney should research this matter to
detwermine if the City ' s position is legally tenable . Attorney Buyou °
cos said he needed list of houses which might request water ( and
which do not have sewer ) , He suggested also that when a person -re °
quests a water tap they should be informed that they ought first to
qet Health Department approval of their septic system . Councilman
he: sch felt the Town ought to have an inventory of those in the Town
:l. ikpP IIy to request a water tap . The Board looks forward to having a
re: co744aendation from Attorney Buyoucos in this matter after he has had
an opportunity to research it .
1XJ T{I ENBURG ROAD FEASIBILITY STUDY
Supervisor Schwan read a letter from C . B . Shulman , dated .,
Ju1`vy l7 , 1974 , requesting that the Town have an engineering study
l made of the feasibility of extending water and sewer up Mecklenburg
Road ,',, to take in the properties owned by Cecil B . Shulman , Harold
Wallace , A . Cerracche , George Ideman , Al Eddy and Ralph Carpenter .
Thisl,group holds in excess of 700 acres for development .
It appeared to be the sense of the Board that this group ought
to fund the study themselves , since they would be essentially devel -
opers; , and not the same as individual owners with a particular aind
pressing need for water and sewer . Further , it did not appear that
the Town on its own volition would make a study of this area becaus :m
the::. are too few houses in the area to economically support it . On
this basis the request for a feasibility study in this area at the
Town 'lls expense was denied .

Mro Fabbroni , Planning Engineer , requoil the Board to gave
him 'authorization to order liability insurance and surety bond in
connection with the Campbell Avenue improvement which is required by
the New i'ork State Department of Transportation .
Motion by Supervisor Schwano seconded by Councilman Desch ,

The Board accepted Justice Hartsock ' s resignation , with regret ;
and sndicated that a resolution would be prepared and spread upon the

APPOINTMENT PARS o LAURENt RIPLEY
Supervisor Schwan reported that T.Irs o Laurene Ripley who re -
si.gn.ed from the Zoning Board of Appeals for reasons of ill health is
now prepared to serve on the Board again . In view of the fact that
Roger Bo Sovocool has indicated a desire to resign from the Board ,
t he Supervisor recommended Mrs . Ripley ' s appointment <
notion by Supervisor Schwan , seconded by Councilman Desciao

RESOLVED , that the Town Board of the Town of Ithaca will conduct a
public hearing on September 9 , 1974 at 5 . 30 pomo to consider the
petition of property owners on Williams Glen Road for the improvement
Of the said road and its eventual acceptance as a Town road .

BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY

Mr . Fabbroni reperted that 13 building permits and 2 certifim
cateslof occupancy had been issued ° that he and ioZro Metz had investi �
gate& several complaints made and had given notification of violations .
Attorney Buyoucos said the section of the ordinance violated should be
indicated each time in the notice of violation .
ACCEPTANCE OF FOREST . HOP-.E DRIVE ( Rt. 3 92 ) as a TOGA ROAD
Marion Morey , Highway Superintendent , recommended that -0h.o
