DECEMBER 11 , 1967
The following are minutes of a regular meeting of the Town Board
held in the Town of Ithaca Offices at 108 East Green Street , City
of Ithaca at 4 : 00 P . M . on Monday , December 11 , 1967 .
BOARD MEMBERS PRESENT : Supervisor William B . Kerr , Councilmen
Andrew W . McElwee , Joseph N . Mayer , Jr . , Harry N . Gordon and
Harry U . Baker .
Also Present : Lozier Engineer James Dunlap , Superintendent of
Highways Marion Morey , Attorney James V . Buyoucos , Planning
Board Chairman Noel Desch , Journal Reporter Roger Langley , Clerk
Myrtie Hewitt , Mrs . Livesay and Major Fisher ( part of meeting ) .
• Attorney Walter Wiggins - Candlewyck Apartments - Streets
Mr . Wiggins appeared before the Board to appeal for Town
acceptance of the roads in the Candlewyck Apartments multiple
residence area . He stated that the developer had conformed to
town specifications in laying out the roads within its develop -
ment with the assumption that the Town would accept them as
" town roads " . There are 77 families in this development . The
Board concluded that inasmuch as these short egress and ingress
roads aren ' t desirable they have no alternative but accept
them providing they meet town specifications . Mr . Wiggins was
instructed that the Town would need a deed for acceptance and
for Planning Board approval the 60 foot right - of - way would be
necessary before recommendation by Superintendent of Highways
and approval of acceptance by the Town Board . Mr . Wiggins
indicated he would take care of this immediately .
RESOLUTION 146 - TRANSFER OF FUNDS
VOTED resolved to approve the transfer of $ 1300 from Contingency
account to Town Hall and Offices .
Be It Further resolved to transfer Street Opening Funds from
Withholding account to a separate account .
RESOLUTION 147 - APPROVAL OF WARRANT
VOTED resolved to approve warrant dated December 11 , 1967 in the
following amounts :

RESOLUTION 148 - APPROVAL OF MINUTES
Voted resolved to approve minutes dated November 9 , 1967 ,
RESOLUTION 149 - ANNUAL ASSOCIATION OF TOWNS MEETING
VOTED resolved to authorize all town officials , i . e . Supervisor ,
Justices , Councilmen , Assessor , Highway Superintendent , Clerk ,
Planning and Zoning Board members to attend the Annual Association
of Towns Meeting in New York on the 5 , 6 , and 7th of February 1968 .

RESOLUTION 150 - APPOINTMENTS
Voted resolved by the Board to make the following appointments
effective January 1 , 1968 ; Assessor - Donald Franklin , 2 year
appointment ; Superintendent of Highways -Marion Morey , 2 year
appointment ; Town Clerk -Myrtie Hewitt , 2 year appointment ;
Receiver of Taxes -Myrtie Hewitt , 1 year appointment for 1968
collection period .
RESOLUTION 151 - MAILING OF TAX BILLS
Voted resolved to authorize Mrs . Hewitt , Receiver of Taxes to
mail the 1968 tax bills not later than January 1 , 1968 .
RESOLUTION 152 - EXTRA HELP FOR CLERK
Voted resolved to authorize the Clerk to obtain extra help for
the tax and dog licensing period for 1968 from funds allocated
in the 1968 budget for this pl.rpose .
RESOLUTION 153 - BID AWARD - EAST ITHACA WATER
DISTRIC
WHEREAS , on December 5 , 1967 , bids were received for the
construction of Watermains and Appurentances for the East Ithaca
Water District ;
WHEREAS , the Town Board has carefully considered the Engineer ' s
Report on these bids , and ;
WHEREAS , the Town Board has further considered the bids
received and the type of construction offered :
NOW , THEREFORE BE IT RESOLVED : that the best interests of
the East Ithaca Water District will be served by using cast
iron pipe watermain ; and that Bid Item No . 9 ( Additional Work
Crossing County Highway - 6 " Watermain ) and related watermain
( forty feet , more or less ) and 6 " gate valve ( one ) be deleted
from the contract ( the bid cost of these deletions being $ 1 , 337 . 00 ) ;
AND BE IT RESOLVED that the contract for construction be awarded
to the lowest responsible bidder , Bill Auble Construction
Corporation , Trumansburg , New York at an estimated contract sum
of 37 , 619 . o0 .

RESOLUTION 154 - RELEASE RETAINERS
Nort eas ewer Dist .
Voted resolved to release the retainer held on the Northeast
Sewer District from Contractor Howard and Sprague , Inc . of
Binghamton , New York in the amount of $ 3 , x- 59 . 54 less the
claim of James Hartshorne , 110 Kky Street , Ithaca , New York
in the amount of $ 795 . 96 leaving the amount of $ 2 , 663 . 58 due
the Contractor .
BE IT FURTHER resolved to release the retainer of Bill Auble
Construction Company , Trumansburg , New York on the Ellis
Hollow Road Sewer job - - the one year guarantee period having
expired .

RESOLUTION 155 - AUDIT MEETING
VOTED resolved to set date of Friday , December 29 , 1967 at 10 : 00
A . M . as date for the Annual Audit by the Town Board ,
RESOLUTION 156 - DELEGATE TO ASSOCIATIQN OF TOWNS
VOTED resolved to appoint Justice Fred Hartsock as the official
delegate to the Association of Towns Meeting to be held in New
York February 5 , 6 and 7 , 19680
RESOLUTION 157 - TOWN REPRESENTATIVE - GIPB
The Board unanimously resolved to appoint Frank Liguori of 1210
Trumansburg Road as the Town representative to the Greater Ithaca
Regional Planning Board for a one year term .
TOPICS OF DISCUSSION
Zoning Officer - Donald Franklin asked to be relieved of his
duties as Zoning Officer for the Town of Ithaca , effective
January 1 , 19680
Building Permit Fees - - It was the consensus of the Board that
Building Permifees should be revised and increased in accord -
ance with type and cost of construction contemplated at the time
building permits are issued . A new schedule of fees was introduced
and recommended by the Zoning Officer for consideration by the
Town Board , and the Planning Board . If found acceptable these
will be incorporated in the new ordinance which is being revised
for later adoption .
Snow Removal from Northeast School Walkway - -Mr . Morey , Superintendent
of Highways advised the Board that the Town of Ithaca has no
equipment suitable for snow removal from the school walkways
at Northeast . It was the Board ' s suggestions that the Town
contract with the Board of Education for this service since
they have equipment available for this type of snow removal .
Chamber of Commerce - Ordinance for Out - of - Town Solicitors - -Mr . Ker
reported that the Chamber of Commerce does not have an ordinance
readily available at this time for the Boards consideration , but
soon after the first of the year will present one to the Town
for study and acceptance .
Changes of Zoning Ordinance - - There was considerable discussion
on proposed changes o he Zoning Ordinance which the Board
feels should be revised as soon as time allows for clarification ,
study , publication and enforcement etc . With certain suggestions
being made , further discussion will ensue at the next meeting
of the Board scheduled for December 29th .

The regular Audit Meeting of the Town Board for auditing books
and records of the Town Officials and for all end of the year
business was held at 10 : 00 A . M . on December 29 , 1967 in the Town
of Ithaca Offices at 108 East Green Street , City of Ithaca ,
New York .

In 'the Matter of the Establishment of the " Second South 1
� i Hill Water District ( 1966 ) " in the Town 'of Ithaca , County of
Tompkins and State of New Fork , pursuant to Article 12 �A of the
Town Law
WHEREAS the Second South Hill . Water District ( 1966 ) has
been . duly established as a water district in the Town of Ithaca
. � pursuant to Article 12 - A of the Town Law , the Final Order
, estab -
lisping said district having been adopted on the 12th. day of
December . , 1966 , and recorded in the Tompkins County Clerk ' s
Office on the 14th day of December , 19669 and all provisions of
law required for th.e establishment of said district having been
i � duly complied with, and
Ei WHEREAS the maximum amount proposed to be expended for the
improvements in said district and for the acquisition of the
necessary lands and easements has been heretofore established
at Two Hundred Seventy Thousand Dollars ( $ 270 , 000 . 00 ) , and -
WHEREAS it now appears that it may be in the public
interest to authorize the increase of such maximum amount by the
additional' suin of Two Hundred Ten Thousand Dollars ( $ 210 , 000 . 00 )

so that the. total maximum amount proposed to be expended for the
improvement in such district shall be Four Hunl.-3rt. d Eighty
ousand Dollars ( $ 480 , 000 . 00 )
and all papers , maps , plans and reports in connection with the
establishment of this district being on file in the Town Clerk ' s
Office , and the Engineer having filed his report with the Town
Clerk with respect. to the proposed increase for the amount propose
to be expended for the improvement in such district , all of which
are open for public inspection , and
WHEREAS the proposed method of financing the cost of said
improvement consists of the issuance of serial bonds of said Town
to mature in annual installments over a period not exceeding
thirty ( 30 ) years , the cost of constructing the foregoing improve -
ments to be assessed by the Town Board in proportion as nearly
as maybe to the benefit which each lot or parcel will derive
therefrom.
NOW , on motion of Councilman Andrew W . McElwee
and seconded by Councilman Joseph N . Mayer , Jr .
IT IS HEREBY ORDERED that the Town Board of the Town of
Ithaca shall meet and hold a public hearing at the Town Offices ,
at 108 East Green Street in the City of Ithaca on the 15th day

determine whether or not it is in the public interest to authorize

( 1966 ) is more accurately shown on the " Map of Proposed South
Hill Water . District " prepared by Lozier Engineers , Inc . , dated
April 4 , 1966 , revised April 11 , 1966 , on file in the Town Clerk ' s
! Office , and also is more particularly described in the above-refer ec
to Final. Order Establishing the said District . For the general
information of the public and not intended as a final and accurate
description , Parcel A of said District is bounded substantially
on the south by King Road East and by lands lying on the northerly ,

; side of King Road East and on the east by Troy Road and Coddington
Road , on the north by the South Hill Water District and Extensions
thereof , and on the west by a line lying between Stone Quarry
Road and the Danby Road . Parcel B of said district is bounded
on. the north
substantially /by the south line of the City of Ithaca , on the
east by lands of the City of Ithaca Water Department , on the
west by South Hill Water District , and in part by a line lying
between Conover Avenue and Lackawanna Avenue ,

1967 Annual Reports of Assessor and Zoning Officer
Gentlemen .
The following reports are submitted for your information and
action .
Assessment - - The Total assessed value of taxable property in
the Town of Ithaca on the 1967 Tax Roll after exemption is
$ 59 , 379 , 033 . 00 ., which reflects 80% of the apprai
9 sed value of
this property . This total indicates anc increase of $ 27 , 643 , 880 . 00
in assessed value over the 1966 tax roll , New construction
amounted to $ 1 , 994 , 550 . 00 of this increase , New exemption for
tax payers 65 or over amounted to $ 170 , 040 , 00 , The equalization
rate established by the State Board of Equalization and
Assessment for 1967 is 89 and is an increase of 42 over the
1966 rate .
Property sales remained active with indicated prices increasing ,
Grievance Day was held June 20 , 1967 at which time 36 people
were heard personally and approximately 160 Grievance Forms
were filed . All complaints were satisfactorily settled without
certiori action ,
ZONING- - - There were 150 building permits issued in 1960 with
$ 62U . 70 collected in permit and appeal fees and remitted to
the Supervisor , The number of permits increased 33 % .
The Zoning Board of Appeals hb and 25 cases during 1967 , an
increase of 8 over 1966 or 32% .
Multiple Housing inspections skyrocketed this year .

RESOLUTION 159 - OFFICIAL NEWSPAPER
VOTED resolved that The Ithaca Journal be designated as the
official newspaper for the Town for the year 1968 .
RESOLUTION 160 - SUPERVISORS RECORDS - Audit
VOTED resolved to engage Certified Public Accountants Maxfield. ,
Randolph and Carpenter to audit the account books and record's
of the Town of Ithaca Supervisor for 1967 .
RESOLUTION 161 - OFFICIAL MEETING DATES

VOTED resolved that all Town Board meetings shall not be held
before the first Monday after the first Tuesday of each month
except as the Town Board shall otherwise authorize by resolution .
BE IT FURTHER resolved that the regular meeting for the month

RESOLUTION 162 - TRANSFER OF FUNDS
VOTED resolved to transfer $ 93 . 20 from Contingency account
( 10 , 000 ) to the Town Clerk ' s account ( 1530 ) .
RESOLUTION 163 - DEPOSITORIES FOR OFFICIAL FUNDS
RESOLVED that the Tompkins County Trust Company be and the
same hereby is designated as depository for all moneys coming
into the hands of the Supervisor and the Town Clerk of the Town
of Ithaca ; County of Tompkins and
Be It Further Resolved that the First National Bank and. Trust
Company of Ithaca be and the same is designated for all moneys
coming into the hands of The Receiver of Taxes for the Town of
Ithaca , County of Tompkins .
Resolved that this designation shall continue in effect until
revoked by action of said Town Board .
Motion made by Supervisor Kerr and seconded b Councilman Gordon
that this resolution be adopted . An all " aye ' vote carried .
RESOLUTION 164 - APPROVAL OF OFFICIAL BONDS
Voted resolved by members of the Town Board of the Town of
Ithaca to approve the bonds or undertakings for the following
town officials : Supervisor William B . Kerr - $ 40 , 000 ; Clerk
Myrtie Hewitt ^ $ 50 , 000 ; Justices Hartsock and LaFave - $ 4 , 000
each ; Highway Superintendent Morey - $ 4 , 000 . These bonds are
carried with the Robert S . Boothroyd Agency , Inc . , Ithaca , N . Y .
RESOLUTION 165 - PUBLIC HEARING - Consider Changes
to Zoning Ordinance
Upon motion made by Supervisor William B . Kerr and seconded by
Councilman Andrew W . McElwee and unanimously carried , it was

RESOLVED to hold a public hearing on January 15 , 1968 at 4 : 00
P . M . at the Town of Ithaca Offices at 108 East Green Street ,
in the City of Ithaca , for the purpose of considering the
certain changes to the existing zoning ordinance and for the
re - adoption and re - enactment of such zoning ordinance and the
Town Clerk was directed to cause all necessary notices to be
published and to take such other steps as might be required
by law for the purpose of such public hearing .
RESOLUTION 166 - SECOND SOUTH HILL WATER DISTRICT
19 Apply to Audit and Con rol
by Supervisor
It was moved by Supervisor William B . Kerr and seconded by
Councilman Joseph N Mayer , Jr . , that the Supervisor be and he
hereby is authorized to apply to the Department of Audit and
Control for approval of an increase in ' he total amount to be
expended for the improvements in the Second South Hill Water
District 1966 ) in the amount of Four Hundred Eighty Thousand
Dollars (480 , 000 ) , so that the maximum amount proposed to
be expended for said improvements shall be increased from Two
Hundred Seventy Thousand Dollars ( $ 270 , 000 . 00 ) to Four Hundred
Eighty Thousand Dollars ( $ 480 , 000 . 00 ) .
The Supervisor is further authorized to obtain extension of
time within which the bids for other districts in the vicinity
may be accepted. , with or without conditions , and to take any
and all other action and steps which may be necessary to obtain
bids for the Second South Hill Water District ( 1966 ) , obtain an
increase in the maximum amount authorized to be expended and any
and all other steps in the . premises .
RESOLUTION 167 - ORDER FOR PUBLIC HEARING
SECOND
SOUTH HILL WATER DISTRICT ( 1966 ;
In the matter of the establishment of the " Second South Hill Water
District ( 1966 ) " in the Town of Ithaca , County of Tompkins and

was duly ordered that a public hearing be held at the Town of
Ithaca Offices , at 108 E . Green Street in the City of Ithaca
on the 15th day of January , 1968 at 5 : 00 o ' clock P . M . on that
day to determine whether or not it is in the public interest to

WHEREAS , on December 20 , 1967 , bids were received for the
Construction of Sanitary Sewers for the South Hill Sewer District -
Contract 1302 - 90
WHEREAS , the Town Board has carefully considered the Engineer ' s
Report on these bids , and ,
WHEREAS , the Town Board has further considered the bids received
and the type of construction offered ,
NOW THEREFORE BE IT RESOLVED : that the best interests of the
South Hill Sewer District will be served by using asbestos -
cement pipe@
AND BE IT RESOLVED , THAT THE CONTRACT for construction be awarded
to the lowest besponsible bidder , The Marcelletti and Son Construction
Company , Webster , New York at an estimated contract sum of $ 651 , 585 . 00 ,
and Optional Items 141 thru 144 which will be used as required
during construction .

VOTED resolved to have Donald Franklin continue as Zoning
Officer until interviews have been conducted and a qualified
person chosen for this position .
RESOLUTION 172 - HIGHWAY DEPARTMENT EMPLOYEES
SALARIES
Upon motion made by Supervisor William B . Kerr and seconded by
Councilman Mayer it was duly resolved that 1968 salaries for
the Town of Ithaca Highway Department employees should be
increased by a 4% increment plus individual hospitalization
coverage for each employee .
RESOLUTION 173 - SOUTH HILL SURVEY
VOTED resolved to pay bill of John MacNeil the sum of $ 1500
for South Hill field survey on Burns Road from Planning Board
funds .

TOPICS OF DISCUSSION
A group from the Snyder Hill area were present to discuss the
proposed changes in the Zoning Ordinance , their main concern
being as to what definition constitutes " a family " . After
much discussion Attorney Buyoucos asked for suggestions from
the group in defining " a family " . The final result being as
follows :
" A family consists of one or more persons related by
blood , marriage or adoption or any domestic help ,
or gratuitous guests , or a group of one or more persons
occupying the premises and living as a single house -
keeping unit , as distinguished from a group occupying
a boarding house , rooming house , lodging house , club ,
fraternity , hotel or motel . "
During the same discussion " a boarding house " is defined
as follows :
" Any dTA!elling in which more than three person either
individually or as families are housed or lodged
for hire with or without meals . A rooming house or
a furnished rooming house shall be deemed a boarding
house . "
