The majority of the Board was of the opinion that it . ' should not
hinder the progress and development of any area of the Town , and
did not feel out of line ..in their decision to rezone this area
from resident to multiple .

RESOLUTION 29 - WARRANT
Voted resolved to approve warrant dated February . 13 , 1967 in
the following amounts :
General Fund - - - $ 26 , 434 . 37
Highway Fund - - - 53093 . 12
The December 12 , 1966 minutes were approved with a correction
as follows : Page 3 - -Topic - Northeast School Bus Transportation-
Supervisor Kerr consulted with a "majority" of the Town Board
members ,
Due to the dissatisfaction of the crossing guards at the
Northeast ' School in not receiving the requested . salary increase
last month ' it was again brought before the Board and the
following resolution was passed .
RESOLUTION 30 -SALARIES - SCHOOL CROSSING GUARDS
Voted resolved that the school crossing guards at Northeast
School receive a set salary of $90 per month for full time .
The following votes were cast : Supervisor Kerr- aye

Voted resolved that all Town Board minutes be mailed to all ~
appointed and elected officers of the Town Board .

Transportation to Association of Towns Meeting N . Y. C . .
It was the consensus of the Board that due to the hours spent. .,
in travel to New York by bus , it would be : more practical and
time saving to travel by other means than by bus and it would
be up to the individual to choose his own transportation .
RESOLUTION 32 - DESIGNATION OF BANKING DEPOSITORY
Resolved , that the Tompkins County Trust Company . be , and the . .
same hereby is designated as depository for all moneys coming =
into the hands. of the . Supervisor of the Town of Ithaca , County :
of Tompkins and be it further
Resolved , that this designation shall continue in effect
until revoked by action of said Town Board .
Motion made by Joseph N . Mayer , Jr . and seconded by *
Harry N . Gordon that this resolution be adopted . Duly passed .
T RESOLUTION 33 - CORRECTION OF .SPECIAL DISTRICT
ROLL� EAST STATE .
Voted resolved tha the - East State Street-Ext . Water District is -
incorrect and that moneys collected from the owner . of the follow-
ing , parcel should be refunded .
Parcel No . 57 - 1 -7 .2 assessed - to Nancy Hammond c/o John
Marion and was charged with 600 foot frontage which is outside
the district and the sum of . $18 . 00 should be refunded .
RESOLUTION 34 - CORRECTION OF SPECIAL DISTRICT
ROLL�NORTMULST WATER DISTRICT
Voted resolved that the Roll for the Northeast Water District .
is incorrect and that moneys collected from property owner
Rocco Lucente be refunded in the following amounts :

Voted resolved to authorize Supervisor William B . Kerr to execute
and ° varify all or any papers necessary to defend the Town of
Ithaca against action taken by Donald G . Fisher vs Town Board
regarding Multiple Residence District established - on West Hill
known as former Seville Reulin property .

RESOLUTION 37 - STREET. LIGHTING AT INTERSECTIONS
Voted resolved to authorize the New York State Electric and Gas
Corporation to proceed with installation of the second phase
of street lighting as presented in summary to the Town Board
at a cost of $ 2 , 565 . 00 .
RESOLUTION 38 - BOND RESOLUTION- SLATERVILLE
ROAD SEWM DISTRICT
The following resolration was duly voted acid passed .
Bond Resolution dated February 13 , 1967 . •
A Resolution authorizing the construction of a Sewer System
to serve glaterville Road area Sewer District of the Town of
Ithaca, Tompkins County New York at a maximum estimated
cost of $ 520 , 000 and authorizing the issuance of $ 5203000
Serial Bonds of said town to pay the cost thereof .
Lawsuit Pending Against Town
Action is being brought against the Town of Ithaca by
Maurice Marion , 1431 Slaterville Road . A building permit
was issued Mnd then revoked for a green house to be erected
near an existing fruitstand . A request for a variance was
denied by the Zoning Board as it was their contention that
such a building could become a traffic hazard in the designated
location and it would not be in general conformity with ad -
joining properties . Mr . Marion maintains that he- has suffered
an undue hardship inasmuch as he has already invested $ 3000 on
the , project .
RESOLUTION 39 - SCHEDULE OF PUBLIC HEARINGS
Voted resolved to schedule the following Public Hearings at

Ordinance Violation

Mr . . Vincent Franciamone of 108 Ridgecrest Road was denied a
variance as well as a building permit for permission to construct
an adjoining apartment to his original house and carport . He
proceeded to construct under the assumption that a permit
issued in 1963 ' was still valid for the proposed construction .
The - case has come before the Zoning Board of Appeals on two
occasions , each time being denied a permit or variance . ' ' The
Town Board finds no other recourse than to bring action against
Mr . Franciamone for a violation of 'the Zoning Ordinance .

Need for New Town Highway Truck

Mr . Morey , Superintendent of Highways approached the Board -- '
with the need of buying a new truck for the highway department - - - .
price range between4 $ 1 , 000 . to $ 24 , 000 , one which could be
utilized for both summer and winter use . The Board gave
their permission for Mr . Morey to prepare specifications
and advertise for bids with the understanding that any or
a117 bids could be rejected .
Notice to Builders on Reulin property- Trumansburg Road
Upon action brought against the Town Board by Donald G . Fisher
regarding establishimnt of Multiple Dwelling District on the - -
former Seville Reulin property , Supervisor Kerr on January 303
1967 wrote a letter to Ceracche and Petito , builders on said
property informing them of such action being taken and further
informing them that they were proceeding at their own risk
and ' would assume all responsibility of consequences resulting
from court action ®
