LEGISLATIVE INTENT In order to facilitate the location of buildings along the various roads and highways•by fire, police and other emergency services, and to facilitate • the reporting of emergencies and dispatching of emergency vehicles and personnel under the county 911 system, the Town Board does hereby deem the enumeration of all buildings to be of major importance for all of the Town of Newfield. In order to effectuate the efficient and accurate enumeration of buildings, the Town Board hereby enacts this Local Law. r • • (If additional space is needed, attach pages //thle same size as this sheet, and number each.) DEFINITIONS As used in this Local Law, the following terms shall have the meanings indicated: BUILDING - means each building utilized for residential or commercial purposes within the Town of Newfield. This definition shall not be deemed to include any minor buildings, such as storage sheds and garages. PROPERTY OWNER - means any individual or entity that owns real property within the Town. SECTION 3. ENUMERATION REQUIRED All buildings in the Town of Newfield existing and those hereafter constructed will have displayed either upon said building or at the driveway entrance thereto a number uniquely identifying said building's location on any given road or highway in compliance with this Local Law. SECTION 4. ASSIGNMENT OF NUMBERS Within ninety (90) days of the effective date of this Local Law, each property owner shall display the respective identification number assigned to any existing building owned by him within the Town of Newfield. If a property owner does not know his respective identification number, he may obtain same by contacting the Town of Newfield Numerator at the Town Clerk's Office. The Town Numerator shall assign an identification number to any new building after the issuance of a building permit and prior to the issuance of a certificate of occupancy or compliance. Any new certificate of occupancy or compliance issued after the effective date of this Local Law shall have written upon its face the building number and street name upon which it is located. SECTION 5. SIZE AND DISPLAY OF NUMBER A. The numerical figure or figures comprising the number to be displayed on a building shall be at least three (3) inches in height and shall be placed on the Front of said building in a prominent and conspicuous place and in such manner as to be plainly legible from the center of the street at all times between sunrise and NEW YORK STATE DEPARTMENT OF STATE Local Law Filing 41 STATE STREET,ALBANY,NY 12231 Town of Newfield, Local Law No. 1, 1999 Page 3 sunset. The color of said figures shall be in sharp contrast to the color of their background; provided, however, that, so far as the purpose or intent of this Local Law is concerned, the front of a building.shall be construed as that side of the building which faces the street on which the number or numbers of such building or premises have been allotted and that the number or numbers shall be displayed on such side of such building or premises. B. The numbers shall be so placed so that they will not be obstructed by trees, shrubbery, porches or other extensions of the building. C. Wherever practicable, said number shall be placed near some light or source of illumination so that it may be readily seen at night. D. Where the building upon which the number is to be displayed is more than seventy-five (75) feet from the edge of the right-of-way of the street or road serving the building, the number shall, in addition to the other requirements of this chapter,,be displayed on a sign readily visible from the road or street and in no event further back than twenty-five (25) feet from said street or road right-of-way. Said number shall be at least three (3) inches in height. A number of the requisite size displayed on a mailbox located on the subject property which number is readily visible from the road or street (from both directions of traffic) may be utilized to fulfill the requirements of this Subsection D. • E. In the case of an apartment, condominium and/or townhouse complex, the number posted shall be the official mailing address number. Numbers shall be placed on each building. The number shall be at least three (3) inches in height and shall be adequately visible from the roadways within any apartment, condominium and/or townhouse complex. Each main entrance shall display numbers at least three (3) inches in height of the apartments, condominiums or townhouses within the entrance way. Each apartment, condominium or townhouse door shall display numbers at least three (3) inches in height. A storm or screen door shall not obscure required numbers. In the case of a mobile home park, the number posted shall be the official mailing address number. Numbers shall be placed on each mobile home. A storm or screen door shall not obscure required numbers. The numbers shall be at least three (3) inches in height and shall be adequately visible from the roadway within the mobile home park. Each main entrance into the mobile home park shall display numbers at least three (3) inches in height and shall indicate the mobile homes within the entrance way. SECTION 6. DISPLAY OF OTHER NUMBERS PROHIBITED Each separate building or dwelling shall be assigned a separate distinguishing number by the Town Numerator of the Town of Newfield in conformity with a uniform numbering system encompassing the entire Town. The display of any house number other than the number assigned by the Town Numerator is expressly prohibited. SECTION 7. TIME LIMIT FOR COMPLIANCE All existing structures in the Town shall be required to display their respective assigned number in the manner required by SECTION 5 hereof within ninety (90) days of the enactment of this Local Law. Any structures for which a certificate of occupancy or compliance is issued after the effective date of this Local Law will be required to be in compliance with the provisions hereof upon issuance of the certificate of occupancy or compliance. SECTION 8. RESPONSIBILITY FOR ENFORCEMENT The Code Enforcement Officer is hereby declared to be responsible for the enforcement of this law. The Code Enforcement Officer will cause all property owners to be in compliance. SECTION 9. NOTICE; NUMBERING BY TOWN; PENALTIES FOR OFFENSES A. Any property owner found not to be in compliance with any provision herein shall be provided written notice identifying the nature of the violation and advising that he has ten (10) days to remedy same. Any property owner that fails to comply with said notice shall be liable for a civil penalty in the sum of up to two hundred fifty dollars ($250:00) for each day that the violation shall exist following the expiration of the ten (10) day period after the issuance of the notice to remedy. The penalty herein is declared to be civil in nature. • C. Service of Notice. The notice P rovided for in Subsection A of this SECTION 9 may be given by personal service or by mailing a copy thereof via certified mail to the last known address of the owner. D. Numbering of building by Town. In the event of the neglect or refusal of any owner, after notice to cause any building to be properly numbered, the Code Enforcement Officer may cause said building to be properly numbered. The cost of numbering said building by the Code Enforcement Officer shall be borne by the roperty owner in addition to any civil penalties assessed pursuant to Subsection B .,f this SECTION 9. SECTION 10. VARIANCES Upon the proper application of any person, the Town Board may vary or modify the requirements contained herein upon such terms and conditions as they deem appropriate. To obtain a variance, a property owner must submit a written application therefor, together with any supporting documentation setting forth in detail the hardship or some other reason why he cannot comply with the provisions of this Local Law, at least twenty (20) days prior to the next regularly scheduled Town Board meeting. The Town Board will then hear such application at its next regularly scheduled Town Board meeting. There shall be no appeal from the . decision of the Town Board on an application made under this subparagraph. SECTION 11. SEPARABILITY If any section or provision of this Local Law shall be held invalid in any court, the same shall not affect the other sections or provisions of this Local Law, except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof. PRONOUNS For the purpose of this Local Law, the use of the single masculine pronoun shall be deemed to include the feminine and neuter sex, as well as, whenever the text requires, the appropriate plural number.
