LOCAL LAW PROVIDING FOR THE
CONDUCT OF GAMES OF CHANCE IN
THE TOWN OF NEWFIELD
PROPOSED LOCAL LAW #80-2
BE IT ENACTED by the Town Board of the Town of Newfield as follows :
Section 1 TITLE. This Local law shall be known as the Town of
Newfield Games of Chance Law.
Section 2 DEFINITIONS .
(a) "Authorized Organization" shall mean and include any bona
fide religious or charitable organization or bona fide educational,
fraternal or service organization of veterans or volunteer firemen,
which by its charter, certificate of incorporation, constitution or
act of the legislature , shall have among its dominant purposes one or
more of the lawful purposes as defined in this article , provided that
each shall operate without profit to its members , and provided that
each such organization has engaged in serving one or more of the lawful
purposes as defined in this article for a period of three years
immediately prior to applying for a license under this article .
No organization shall be deemed an authorized organization which is which
formed primarily for the purpose of conducting games of chance and
does not devote at least seventy-five percent of its activities to other
than conducting games of chance . No political party shall be deemed
an authorized organization.
(b) "Games of Chance" shall mean and include only the games known
as "merchandise wheels" and such other specific games as may be
authorized by the State of New York Racing and Wagering Board, in
which prizes are awarded on the basis of a designated winning number or
numbers , color or colors , symbol or symbols determined by chance, but
not including games commonly known as "bingo or lotto" which are
controlled under article 14-H of the General Municipal Law and also not
including "slot machines", "bookmaking", "policy or numbers games"
and "lottery" as defined in section 225.00 of the penal law. No games
of chance shall involve wagering of money by one player against another
player .
Section 3. GAMES OF CHANCE AUTHORIZED. Authorized organizations
may upon obtaining the appropriate license from the Town Clerk conduct
Games of Chance within the Town of Newfield as provided in Article 9-A
of the General Municipal Law and as further provided in this local
law. Such Games of Chance shall be conducted in accordance with all
of the laws of the State of New York and with the rules and regulations
adopted by the New York State Racing and Wagering Board and as further
provided in this local lata.
Section 4. RESTRICTIONS . The conduct of Games of Chance shall
be subject to the restrictions imposed by Section 189 of Article 9-A
of the General Municipal Law and of the rules and regulations of the New
York State Racing and Wagering Board.
Section S. SUNDAY GAMES. Games cf Chance may not be conducted
on Sundays pursuant to this local law.
Section 6. ALCOHOLIC BEVERAGES. No alcoholic beverages except
for beer shall be served on the premises where games of chance
authorized by this local law are conducted.
Section 7. ENFORCEMENT. The chief law enforcement officer of
Tompkins County shall exercise control over and supervision of all
Games of Chance conducted under a duly authorized license. That chief
law enforcement officer shall have all those powers and duties as
set forth for the enforcement of Article 9-A of the General Municipal
Law.
Section 8. SEVERABILITY. In any provision of this local law or
the application thereof to any person or circumstances shall be
adjudged unconstitutional by any court of competent jurisdiction, the
remainder of this article or the application thereof to other persons
and circumstances shall not be affected thereby, and the Town Board
hereby declares that it would have enacted this local law without the
invalid provision or application, as the case may be, ,had such
invalidity been apparent .
Section 9. EFFECTIVE DATE. This local law shall take effect
upon its passage by at least the majority affirmative vote of the
total voting power of the Town Board of the Town of Newfield and
after a proposition therefor is submitted to a General or Special
Election in the Town of Newfield and approved by a vote of the
majority of qualified electors in the Town of Newfield voting thereof
