OCTOBER 20 , 1993
The Lansing Town Board met in Regular Session at the Lansing
Town Hall Board Room at 8 : 00 p .m. with Supervisor Kirby presiding.

VISITORS: Pete Larson, Highway Superintendent , George Totman,
Code Enforcement Officer, John Davis , Mr. Kyle, a representative
from Cargill Salt , Inc . Dave Herrick ( 9: 35 p.m. ) and one other
Lansing resident .
The Supervisor called the meeting to order and had the clerk
take the Roll Call .
Bids were publicly opened for salt for the winter of 1993 -
1994 , as advertised. They were as follows :

The bid opening for the sale of property owned by the Town of
Lansing located in Myers was called to order . There were no bids
presented.
RESOLUTION offered by Mr . Butler and seconded by Mr .
Cleveland:
RESOLVED, that the Town of Lansing does hereby withdraw said
property from the bidding process .

Mr. Kyle who resides at 120 Ludlowville Road approached the
Board in regard to a portion of Ludlowville Road (Snake Hill ) that
has been closed by the Town of Lansing.
Mr . Kyle asked what the future plans were for this road. Mrs .
Kirby stated that it may be a bike trail . Mr. Larson stated that he
had received two estimates of what it would cost to reopen it to
vehicular traffic . One was one half million and the other was one
and one half million dollars .
Mr. Kyle stated that parties have been taking place in this
area since the road has been closed. He also stated that one child
fell into a hole and was cut up. Four wheelers have also been a
problem.
Mrs . Kirby stated that the Town could leave it as is and defer
it back to the owners on each side. Mr. Kyle was afraid this might
happen and then he would be responsible for anything that might
happen.
Mr . Thaler stated that the people who are interested in having
this made into a bike trail could form an association and then the
Town could deed it to them and make them responsible.
Mr. Kyle will be present at the meeting on October 27th to
discuss this further.
Mr. John Davis approached the Town Board asking for a

reduction in the speed limit on North Triphammer Road to 45 m.p.h.
all the way to the Village line. The Board informed Mr . Davis that
a petition signed by the residents would have to be done before it
could go any further .
Mr . Kim Davis was in earlier and talked to Mrs . Kirby about
payment that he has not received from the Village of Lansing. Mr .
Davis and Mrs . Davis set up the Town's voting machines for a
Village Election in the Spring of this year and charged the Village
of Lansing $50 . 00 . The Village has refused to pay this and has
offered them $ 35 . 00 . It was the consensus of the Board to have
Mrs . Kirby write a letter to Ted Wixom stating that the Town' s
voting machines are to be set up by Town Custodians ONLY, who are
Kim and Bea Davis and that the fee for Town Custodians is $50 .00
per set up.
RESOLUTION, offered by Mr. Cleveland and seconded by Mr .
Butler:
RESOLVED, that on recommendation from the Highway
Superintendent , the Town of Lansing does hereby accept the low bid
from Cargill Salt , Inc . for salt at $25 . 24 per ton delivered and at
$ 22 . 24 per ton picked-up.

A discussion was held concerning the bill from Empire Soils in
regard to the soil testing they performed on Richard Pinney' s
property. It was the consensus of the Board to pay the $140 . 00
portion for the services but they recommended that the bookkeeper
NOT pay for taking the samples . The Board would like to speak to a
representative form Empire Soils before paying the balance.
Mr . Larson stated that the truck traffic did a lot of damage
to Farrell Road. He felt he could loose the road completely if
something isn' t done before Spring . He could stone and oil it at
approximately a cost of $4 ,000 . 00 or he could fog seal it for
$2 ,000 . 00 . The County would be willing to provide a paver if the
Town wants to put down a shim layer of pavement at an approximate
cost of $10 ,000 . 00 . The Board was in favor of this process .
Mr . Larson stated that the Highway Department will run short
of money for salaries if the check from the State of New York for
the blizzard monies does not come soon. He felt they would be
around $12 ,000 . 00 short .
The bill for the stone and oil on Murfield Drive was
$5 , 537 . 00 .
John Hicks does not feel he should pay the sales tax on the
lime stone that he purchased from Cayuga Crushed Stone, Inc. Mr.
Hicks 's Accountant told him that since it was used on a Town road,
he should not have to pay the sales tax on it . Andy LaVigne, the
Town' s Accountant did not think there was any way the Town could
allow him to escape paying the sales tax . If Mr . Hicks 's Accountant
will get something in writing from the State Comptroller Office
stating that it is legal , the Town will abide by this .
Mr. Larson stated that the roof job on the Highway Garage is
complete and turned out good.
Mr. Totman has been in contact with Deanco Inc. and stated
that they will have the remains from their fire cleaned up or will
get back to him by November 1 , 1993 .
Mr. Totman also stated that the Munson' s have collected 12 to
15 cars .
A discussion was held on Cornell 's newsletter regarding the
Radiation Burial Site and the Board Members had no problem with
this .

hereby thank Bradley Griffin for serving on the Tompkins County

Environmental Management Council .

In regard to the Bolton Point water rates , it was the
consensus of the Board to wait until all members were present
before a resolution was passed.
Mrs . Kirby has been approached by the Boy Scouts asking
permission to use the Town Annex for a Halloween Spook house they
did last year. The Town Board was in favor of allowing this .
Mr. Thaler stated that he will write Mr. Wiggin's a letter
stating what needs to be done before the roads in the Lakewatch
Development can become Town roads . Mr. Thaler also stated that an
order was signed authorizing the payment of money from the escrow
at the Tompkins County Court House and the Town should be receiving
their money and revised descriptions soon in regard to the
Lakewatch Development .
Mrs . Kirby informed the Board that there will be a meeting at
the Lansing Middle School cafeteria on November 9, 1993 at 7 : 30
p.m. in regard to the changing of the road system in front of the
Middle School . Mr. Thaler will join the Board at this meeting.
A copy of the minutes of August 18th, September 1st and
September 15 , 1993, having been furnished to the Board Members
beforehand, the Supervisor asked for a motion to make corrections
or to accept them as submitted.

Mr. Thaler informed the Cargill representative of the
following:
The project would have to be funded by a Private Activity
Bond, therefore Cargill could not use more than 75% of the capacity
of the facility .
At this time Mr . Herrick arrived and stated that the water
line could run down Myers road and along the lake to Cargill . The
pipe that is now in Myers would have to go to an 8" pipe instead of
the 4" pipe that is in place now.
If the other adjoining properties would participate in the
payment of the bond, then a Municipal Bond could be a possibility.
Cargill asked if the Town would give an exception to the
policy that says "On all extensions to water districts the water
line will go to the boundary" . The Town Board would like to think
about this before giving an answer .
Mr. Thaler stated that there are other bonding possibilities
if the Board wants to do them. This would be a NON tax exempt bond.
Mr . Thaler felt it would be less expensive if Cargill would do it .
It was decided that Mr . Herrick and Mr. Thaler could review
the plan with Mr . Thorton and have Cargill type up a draft and
present it to the Board.
Mr . Herrick stated that he had just attended a meeting in
regard to agriculture and farm lands . Mr . Herrick felt the next
step for New York State Electric and Gas would be to do the notice
of intent and then to complete the long environmental assessment
form. This would be a charge to Water District No. 17 .
Mr . Thaler will write to a N.Y. S.E. and Gas representative
tomorrow in regard to this .
Mr . Herrick passed out the finalized Engineer's report for
Water District No . 2 - Extension # 2 (Ladoga Park area) . He stated
that the number of units have gone down as some vacant lots have
been consolidated with building lots . There are now 54 units and
there were 60 to begin with. The unit cost would be the same
($216 .00 per unit if the interest rate was 6. 5%) Mr . Herrick stated
that the work would have to be done within the access that is
available and that all easements would have to be secured. There
may be some inconvenience for the people who live there year round.

At a meeting of the Town Board of the Town of Lansing held at
the Town Hall in the Town of Lansing, Tompkins County, New York, on
the 20th day of October , 1993 at 8 :00 p .m.

In the matter of the establishment of Lansing Water District
No. 2 , Extension 2 , Town of Lansing, County of Tompkins , State of
New York , pursuant to Article 12-A of the Town Law.
WHEREAS, a map, plan and report have been prepared in such
manner and in such detail as has heretofore been determined by the
Town Board of Lansing , relating to the establishment of a proposed

water district in the Town; and
WHEREAS, such map, plan and report have been duly filed in the
Town Clerk's Office in said Town; and
WHEREAS, said map, plan and report were prepared by T.G.
Miller & Associates , P.C. , Engineers and Surveyors , Ithaca, New
York, duly licensed by the State of New York, showing the
boundaries of the proposed district , a general plan of the water
system and a report of the proposed method of operation; and
WHEREAS, said map shows the proposed water district , water
mains , fire hydrants and other related and necessary appurtenances ;
and
WHEREAS, the boundaries of the proposed district are described
in Exhibit "A" attached hereto and made a part hereof; and
WHEREAS, the improvements proposed are as follows :
SERVICE AREA - As shown on the map filed in the Town Clerk's
Office and described in Exhibit A the proposed water district will
include approximately 26 living units and 4 subdivided lots
currently undeveloped. The area of the proposed district is 6 . 8
acres of land and the current assessed value of all property
included is $ 3 , 368 , 400 .00 .
POPULATION TO BE SERVED - With ultimate development , the
maximum population to be served in the proposed district is
estimated at approximately 90 persons . The present population is
approximately 78 .
WATER SUPPLY - Treated water requirements , estimated not to
exceed an average of 5 , 300 gallons per day, will be purchased from
the Southern Cayuga Lake Intermunicipal Water Commission (Bolton
Point Water Supply) . The Town of Lansing is a member of the
Commission and the capacity of the Bolton Point supply is
considered more than adequate to serve this district .
FACILITIES TO BE CONSTRUCTED - As shown on the map filed in
the Town Clerk' s Office of the proposed water district , the
facilities to be constructed will consist of approximately 1 , 850
linear feet of 8 inch ductile pipe, 1 , 850 linear feet of 8 inch
polyethylene casing, 50 linear feet of railroad crossing together
with valves, fire hydrants , services to street R.O.W. ' S and other
related and necessary appurtenances .
CONSTRUCTION CONDITIONS - The water mains will be constructed
within existing road right of way or acquired easements . No unusual
soil and/or construction conditions are anticipated to be
encountered and no bedrock is anticipated to be encountered. Due to
anticipated high water table, construction should take place when
the lake level is down. Because of potential flooding and
relatively high groundwater, special preventative measures will
need to be taken for fire hydrants . It will also be necessary to
cross existing railroad tracks . Traffic will not be interrupted.
Test borings will be taken to determine the depth of the water
table and any rock excavation necessary; and
WHEREAS, the estimate of project costs are shown below:
PRELIMINARY ESTIMATE OF PROJECT COST - As shown below, the
preliminary estimate of project cost , including an allowance for
contingencies , engineering, technical , legal and administrative
costs is $ 114 ,000 .00 . This estimate is based on prices received by
the Town for other water projects bid during the past two years .

WHEREAS, the operation will be as follows :
METHOD OF OPERATION - The proposed water main extension will
connect at a new main connection point as shown on said Map at the
intersection of Old Myers Road and Myers Road with Water District
2 distribution system. Pressure will be provided by the water tank
number 3 which has a capacity of 200 ,000 thousand gallons located
off of Wilson Road which has an approximate overflow elevation of
696 feet . Water is pumped to this tank by the Town pumping station
located at Burdick Hill and North Triphammer Roads . The source of
supply is the SCLIWC water tank which is located near the pumping
station.
Due to changing topography and a wide variation in ground
surface elevations , water main pressures in the existing Lansing
Water system at lower elevations are controlled by main line
pressure reducing stations . Due to extreme drop in grade along
Myers Road there currently exists a pressure reducing valve at the
intersection of Wildman and Ludlowville Roads . With the regulated
outlet pressure from this PRV at 50 p.s . i . the static main line
pressure in Ladoga Point will be roughly 105 p. s . i . All homes will
be required to install individual PRVS so that each house service
can be maintained in the 30-60 p .s . i . range as opposed to the 105
p . s . i . at the PRV location; and
WHEREAS, the method of financing will be as follows :
METHOD OF FINANCING
PROJECT COST - The $114 ,000 . 00 project cost of the water
district improvement is planned to be financed by the issuance of
serial bonds to mature in annual installments , and that said annual
installments , which include repayment of principal and interests ,
shall be assessed by a proposed formula as follows :
1 . Existing Subdivision Lots 2 acres or less : Assessed one
(1) unit per dwelling lot .
2 . Existing subdivision Lots greater than 2 acres : Assessed
one ( 1) unit for initial 2 acre dwelling lot . All remaining acreage
will be assessed one-sixth (1/6) unit per acre .
3 . Undeveloped Acreage : For the purposes of assessment , non-
subdivided lots will be divided into approximately two acre lots
with a minimum of 150 foot frontage and assessed one ( 1) unit for
each lot . Remaining unimproved rear land will be assessed one-
sixth ( 1/6) unit per acre .
Assuming the total project cost of $ 114 ,000 is financed with
20 year serial bonds at 6 . 5% interest and a minimum principal
repayment at 80% of average, the first year payment is calculated
as follows :
Principal = $114 ,000
Interest = 6 . 5%
Term = 20 years
1st Year Principal Payment = 114 ,000/20 x 80% = 4, 560
1st Year Interest Payment = $114 ,000 x 0 . 065 = 7 , 410

WHEREAS, the maintenance and operating costs are as follows :
MAINTENANCE AND OPERATING COSTS - The costs of maintaining and
operating the Town system, including the costs of treated water
supplied by Bolton Point , are recovered in the per-gallon price
charged to water users . Metered water charges , using the current
Town per-gallon pricing schedule are estimated at $ 150 .00 per
average single family household per year and are in addition to the
annual capital repayment cost ; and
WHEREAS, there will be a one time connection charge as
follows :
ONE TIME CONNECTION CHARGES - For each household
Bolton Point Water Supply connection fee, water meter,
pressure reducer, etc. $ 475 . 00
Water service line from curb box at street line to
house (estimate average)* $_ 750 .00
* Note: the cost of any interior plumbing changes which may be
required will vary for each house and are not included here; and
WHEREAS, there will be a one time buy-in fee to the parent
district as follows :
ONE-TIME BUY-IN FEE TO PARENT DISTRICT - When an extension is
made to an indebted Water District the extension is subject to
share in the original infrastructure costs by means of a one-time
lump sum buy-in fee. The formula governing the buy-in fee was
established by the Town Board. The formula requires that at the
time an extension is made, a per consumption unit fee is levied
against all consumption units within the extension.
Based on 1993 consumption units and the current debt
retirement for existing districts within the Town, the buy-in fee
has been calculated as $505 per consumption unit . At this time it
is anticipated that with the exception of the two multiple family
residences (MR) all other occupants will be assessed one
consumption unit , thereby incurring a one-time cost estimated at
$505 . For the multiple residences the consumption units will be
assessed based on the number of individual living quarters . If two
were assessed, then one-time buy-in fee is estimated as $1 ,010; if
three were assessed, then the one-time buy-in fee is estimated as
$1, 515 , etc. ; and
WHEREAS, the capital costs will have to be financed by bonding
and the issuance of serial bonds and/or to be paid by annual debt
service assessments by those properties included in the district
for the facilities .
NOW, on motion of Paul Butler , seconded by Jeffrey Cleveland,
it is hereby
ORDERED, that the Town Board of the Town of Lansing hold a
public hearing at the Lansing Town Hall in said Town of Lansing on
the 17th day of November, 1993 at 7 : 15 p.m. on that date and
consider said map, plan and report and to hear all persons
interested in the subject thereof concerning the same and to take
such action thereof as is required or authorized by law.
The adoption of the foregoing order was duly put to a vote and
upon call the vote was as follows :

Mr . Herrick will send out letters to property owners and a
sample easement . Mr . Thaler asked that the easements be signed and
put in escrow until such time that the district is formed. He also
asked that the people come into his office to sign the easements .
Mr . Cleveland asked Mr . Herrick for a description in regard to
the piece of road between the Village and the Town. The Village
would be willing to take it over if they get a description from Mr .
Herrick' s office .

hereby request the Watchtower Society to put $5 ,000 . 00 into an
escrow account to cover expenses to be incurred by the L .A. Group.

WHEREAS, a map , plan and report have been prepared in such
manner and in such detail as has heretofore been determined by the
Town Board of Lansing, relating to the establishment of a proposed
water district in the Town; and
WHEREAS, such map , plan and report have been duly filed in the
Town Clerk' s Office in said Town; and
WHEREAS, said map , plan and report were prepared by Novelli &
Sat

Co. , Consulting Engineers , Peter D. Novelli being duly licensed by
the State of New York, showing the boundaries of the proposed
district , a general plan of the water system and a report of the
proposed method of operation; and
WHEREAS, said map shows the proposed area of the water
district , water mains , and other related and necessary
appurtenances; and
WHEREAS, the boundaries of the proposed district are described
in Exhibit "A" attached hereto and made a part hereof; and
WHEREAS, the improvements proposed are as follows :
SERVICE AREA - As shown on the map filed in the Town Clerk' s
1 ill Office and described in Exhibit A the proposed water district is
approximately 200 feet frontage along New York State Route 34B and
extends southward for approximately 700 feet , consisting of 3 . 21
acres with two apartment buildings located thereon. There are five
two bedroom apartments and one bedroom apartment in the building
and two bedroom apartments and two one bedroom apartments in the
second building . The current assessed valuation of the property
within the district is $ 220 ,000 . 00 .
POPULATION TO BE SERVED - With ultimate development , the
maximum population to be served in the proposed district is
estimated at approximately 35 persons . The present population is
approximately 35 .
WATER SUPPLY - Treated water requirements , estimated not to
exceed an average of 1, 260 gallons per day, will be purchased from
the Southern Cayuga Intermunicipal Water Commission (Bolton Point
Water Supply) . The Town of Lansing is a member of the Commission
and the capacity of the Bolton Point supply is considered more than
adequate to serve this district .
FACILITIES CONSTRUCTED - As shown on the map and plan of the
proposed water district , the facilities constructed consisted of
two inch copper line extending from the eight inch ductile water
main running along the north side of New York State Route 34B to
the apartment buildings together with valves . No other
appurtenances , fire hydrants or services were required .
III CONSTRUCTION CONDITIONS - The connecting water line was
constructed pursuant to the plans and specifications approved by
the Bolton Point Water purveyor.
COST OF CONSTRUCTION - The total cost of construction was
absorbed by the owner of the premises comprising the district .
WHEREAS, the operation will be as follows :
METHOD OF OPERATION - The connecting line to the water main of
Water District 2 has been installed pursuant to the rules and
regulations of the water purveyor and a water meter installed and
paid for by the owner of the property. The owner of the property
will continue to be responsible for the water line from the north
side of New York State Route 34B right of way to its buildings . The
water district will be responsible for maintenances from the north
side of the New York State Route 34B right of way to the connection
with the eight inch cast iron ductile pipe.
WHEREAS, the method of financing will be as follows :
METHOD OF FINANCING - All costs connected with the
installation of the water facilities within the district shall be
paid for by the owner of the property.
WHEREAS, the maintenance and operating costs are as follows :
MAINTENANCE AND OPERATING COSTS - The costs of maintaining and
operating the Town system, including the costs of treated water
supplied by Bolton Point , are recovered in the per-gallon price
charged to water users .
III WHEREAS, there will be a one •time connection charge as
follows :
ONE TIME CONNECTION CHARGES - Will be $ 3 , 597 . 70 less an
overpayment by the owner of $ 809.05 for a net cost of $ 2 ,788 . 65 .
Now on motion of Jeffrey Cleveland, seconded by Paul Butler ,
it is hereby
ORDERED, that the Town Board of the Town of Lansing hold a
public hearing at the Lansing Town Hall in said Town of Lansing on
the 17th day of November , 1993 at 7 :00 p.m. on that date and
consider said map, plan and report and to hear all persons
continued October 20 , 1993
interested in the subject thereof concerning the same and to take
such action thereof as is required or authorized by law.
The adoption of the foregoing order was duly put to a vote and
upon call the vote was as follows :

PROPERTY DESCRIPTION FOR LANSINGWOOD APARTMENTS, WATER
DISTRICT NO. 2, EXTENSION NO. 1
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of
Lansing , County of Tompkins , State of New York and being a part of
Military Lot 82 in said Town and being more particularly bounded
and described as follows :
BEGINNING at a point in the center line of New York State
Route 34B, also known as Ridge Road in said Town and which point is
the Northwest corner of premises now or formerly of Anna Sobol ,
thence running South 06 degrees 12 minutes West passing through
five ( 5) iron pipes , one at twenty-six feet from the point of
beginning, a second at 164 . 5 feet from the point of beginning, a
third at 210 feet from the point of beginning, a fourth at 229 feet
from the point of beginning, and a fifth at 431 feet from the point
of beginning , running a total distance of 731 feet from the point
of beginning to a point marked by an iron pipe; thence North 85
degrees 28 minutes West a distance of 200 feet to a point marked by
an iron pipe marking the southwesterly corner of the parcel herein
described; thence North, 06 degrees 25 minutes East passing through
four iron pipes , one at 200 feet from the southwesterly corner of
