AUGUST 4, 1993
The Lansing Town Board met in Special Session at 8 : 00 p .m. at
the Lansing Town Hall Board Room with Supervisor Kirby presiding.

VISITORS: George Totman, Pete Larson, Richard, Flo, Scott and
Rick Pinney, Barry Putnam, Gary Wood and Larry Updike .
The Supervisor called the meeting to order and had the clerk
take the Roll Call .
Proof of Notice having been furnished, the Public Hearing on
the proposed repairs to the Highway Barn roof was called to order
at 8 :00 p.m.
No one appeared voicing any objections to the proposed repairs
to the Highway Barn and all persons desiring to be heard, having
been heard, the Public Hearing was terminated at 8 : 01 p .m.
Proof of Notice having been furnished, the Public Hearing on
declaring the Gravel Bank in Myers was called to order at 8 : 15 p .m.
No one appeared voicing any objections to declaring the Gravel
Bank in Myers a surplus and all persons desiring to be heard,
having been heard, the Public Hearing was called to order at 8 : 16
p.m.
Mr. Updike presented the following letter to the Board Members
which explains his problem:
1111 Many residents have been experiencing drainage problems in the
area bordered by Forest Acres Drive and Bean Hill Lane. This has
been occurring for many years .
The homes in this area were constructed by several different
contractors . Due to the fact that the Town had no zoning
requirements pertaining to drainage systems , no common
infrastructure was installed to handle drainage properly. The
nature of the land with the problems of shallow topsoil and bedrock
dictate that such a system be present .
The land on the west side of Forest Acres Drive generally
slopes away or down from the road. Many of the homes were built
with footer drains emptying to the rear of the lot with very little
"fall" to the drains . A common drain system was installed for
several of the upper lots (i . e. near Hillcrest) by Alex Cima. The
outlet for this system came out on a building lot which was
subsequently covered by a contractor during the construction of a
home.
Most residents in this area are experiencing problems with
water . Some basements have been flooding, sump pumps are running
frequently and surface water exits on some lots which provides a
place for insects to breed.
Some of the water eventually makes it to the South end of the
peninsula and exits through a large drain located under the
Anderson property . No permanent solution has been put into place to
• take the water away from south of the Anderson property (property
owned by Zadarlik) .
Last fall several residents met with the Town Board to discuss
this problem. The Town Board agreed to work with residents to
address the problem upon receipt of a petition from the residents
affected requesting the formation of a drainage district .
Mr. Updike presented the Board with a petition for a Special
District for Drainage .
Mr . Larson stated that he has received permission from Liz

Bizz and Mr . Anderson to clean out the end of the pipe and
reestablish the drainage .
Mr . Butler informed the Board that Mr . Tom Gift is also having
drainage problems on Hillcrest Road .
Mr . Larson asked the Board for permission to hire someone with
a track machine to complete this work . He stated that it would cost
around $500 . 00 .
Mrs . Kirby will contact Mr . Herrick and get back to Mr . Updike
with figures before proceeding further .
Mr . Gary Wood, who was representing the Pinney' s as their

Engineer, presented the Board with his report on tests taken from
the road in Fiddler ' s Green. He stated that the material DID pass .
Mr . Larson was concerned about the depth of the road . Empire soils
stated that the depth was only 6 or 8 inches . After some
discussion, the following resolution was duly adopted :
RESOLUTION offered by Mr . Cleveland and seconded by Mr .
Tvaroha :
RESOLVED, that on recommendation of the Town Board, Mr . Larson
and Mr . Pinney will measure the exact place where Empire Soils took
a test and stated that it was six to eight inches deep . If this
measures at least twelve inches , the Pinney' s will then be required
to put at least six inches of limestone on top of this and
guarantee the road for three years .

Mr . Barry Putnam of Murfield Drive addressed the Board with
concerns he has in regard to this road. He stated that the pot
holes were so bad that you could not drive around them and that
stones are ending up in lawns . Mr . Putnam stated that Mr . Larson
told him the road would be fixed by the end of July and it is not
fixed yet . Mr . Putnam asked when the road would be fixed .
Mr . Larson felt the repairs needed to be started within the •
next two weeks . Mr. Larson will draw up an agreement on the Town
Board' s recommendation and go with the same inspector used in the
Lakewatch Development . Mr . Larson stated that the Town would stone
and oil the road if Mr . Hicks has the job done by September first
and if it is not done by that date the Town will stone and oil it
in the Spring . Mr . Larson will also include a note that Mr . Hicks
will have to give a one year guarantee from the time the limestone
is put down.
Mr . Cleveland asked about a letter that was to go out to all
realtors stating that building permits and C.O. ' s could not be
issued in the Hickory Knoll Development . He stated that this should
NOT be sent out as the Town Board NEVER authorized it .
Mr . Cleveland stated that two lots were sold in the Hickory
Knoll Development two years ago and wondered if Building Permits
could be issued to them if needed. It was the consensus of the
Board that NO Building Permits could be given out until the road
was repaired. The Town Board anticipated this would not be until at
least September first of 1993 .
Mr. Larson will write a letter of acceptance for the roads in
the Lakewatch Development and then Mr . Totman will be informed when
Building Permits and C. O. ' s can be issued again .

repairs to the Highway Garage .

BE IT RESOLVED, that all that tract or parcel of land known as
tax map parcel no . 33-3-15 . 2 and more definitely described on a
survey map entitled "SURVEY MAP OF PARCEL TO BE CONVEYED BY TOWN OF
LANSING" dated June 29, 1993 by T.G. Miller, P.C. is declared
surplus and subject to sale pursuant to law; and
BE IT FURTHER RESOLVED, that the Town Board shall fix a date
of advertising notice of a sealed bid auction of said parcel of
land, bids to be received by the Town Clerk after due publication,
reserving to the Town the right to reject and refuse and all bids ,
requiring all bidders to be present at bid opening, the accepted
successful bidder being required to deposit certified check, bank
• draft or cash equivalent with the Town of ten percent of the bid
price and that the balance of said sales price be paid to the Town
by certified check, bank draft , cash or equivalent at time of
closing which shall be within thirty days , that the Town shall
provide no abstract of title and supply a quit-claim or covenant
against grantor deed and that the Supervisor is hereby authorized
to execute such deed in the event of the closing pursuant to the
terms hereof .

It was the consensus of the Board to have the Highway
Department plant a flowering tree in the Woodsedge area in memory
of Philip Munson, a past Lansing Supervisor. There will also be a
bronze lettered placque placed near the tree.
RESOLUTION offered by Mr . Tvaroha and seconded by Mr .
Cleveland:
WHEREAS, certain municipalities in the North East suburban
area are currently without treatment capacity that would allow
additional sewer hookups and
WHEREAS, a project known as the Kline Road Bypass Project is
1111 being developed by the staff and consultants of the involved
municipalities , such project diverting flow from the Cayuga Heights
Waste Water Treatment Plant to the Ithaca Waste Water Treatment
Plant and
WHEREAS, the purpose of this project , following further
agreements among the involved municipalities would allow up to
250 ,000 gallons per day of replacement capacity within the Cayuga
Heights Waste Water Treatment Plant for use by the Town of Lansing,
the Village of Lansing, the Town of Ithaca and the Town of Dryden,
be it therefore
RESOLVED, that the governing board of the Town of Lansing
supports the purpose of the Kline Road Bypass Project and
encourages the further development of plans and agreements that
will meet the purpose.

having been given to the Board members beforehand, the Supervisor
asked for a motion to make any corrections or to accept them as
submitted.

Mr. Cleveland asked the Board for a consensus in regard to the
Tompkins County Youth Service Program. It was the consensus of the
Board to stay with the County for at least one more year or until

a full time recreation director was hired.
The Lansing Housing Authority asked for assurance from the
Town Board that if the time ever came when Woodsedge could be
expanded, they would like to be sure the Town of Lansing would
provide them with the land necessary for an expansion. It was the
consensus of the Board that this would be acceptable and land would
be provided.

RESOLVED that the Special Meeting be adjourned to go into 4110
Executive Session at 9 : 55 p .m.
