HomeMy WebLinkAbout1993-04-28 245 April 28 , 1993 The Lansing Town Board met in Special Session at 7 : 00 P.M. at the Lansing High School , Room 101 with Deputy Supervisor, Sharon Bowman presiding . ROLL CALL Jeannine Kirby Supervisor Absent Paul Butler Councilman Present Herbert Beckwith Councilman Present Jeffrey Cleveland Councilman Present Larry Tvaroha Councilman Absent Bonita Boles Town Clerk Absent Richard Thaler Town Attorney Present VISITORS: Deputy Supervisor , Sharon Bowman, Town Engineer , David Herrick, Linda VanApeldoorn, Lorraine Abraham, Pam & Darcy Morgan, Walt Sweazey, Gibran Baida, Mr. and Mrs . James Howell , Kevin Kauffman, Sarah Blazeyk, Margaret Shalaby, Mr . Caliel Abraham and about 10 other area residents . The Deputy Supervisor called the meeting to order and took the Roll Call . Proof of Notice having been furnished, the Public Hearing on the proposed Water District Number 7 , Extension 9 was called to order at 7 : 00 P.M. Mr . Herrick gave a presentation of the proposed district extension. Mr . Herrick explained emphasis on this years application and the water test documentation. He discussed target dates for the process and he stated that he hoped to have an answer from Albany by September of 1993 . An information packet was handed out and S reviewed by all present . Mr . Herrick stated that the estimated total cost would be $ 400 ,000 . 00 , and that if the grant were awarded, the only cost to the homeowner would be the hook up fee to Bolton Point and the cost for the contractor to make the connection from the water main to the home. Mr . Herrick also stated that if the HUD Grant is awarded and if there are surplus construction funds they could be used to offer low to moderate income households a chance to apply for reimbursement of Bolton point hook-up fees if they meet the qualifications . Linda VanApeldoorn then explained the importance of the surveys that were done . She stated that the test results from the water samples were back and could be obtained from her . Also, anyone still interested in having their water tested could make arrangements with her at a cost of $15 .00 to the homeowner . Mr . Herrick encouraged people to contact Mr . John Anderson at the Tompkins County Health Department for more detailed information on water test results . A resident asked what the chances were of receiving funding from HUD? Mr . Herrick felt the chances were very good due to the "Bad" water in the area . Lorraine Abraham asked if the project was turned down, could the Town reapply? The answer was yes we could. S A show of hands indicated all people present were in favor of roposed water district . All persons desiring to be heard, having been heard, the Public Hearing was closed at 7 : 37 P.M. ORDER AND RESOLUTION OF THE TOWN BOARD, TOWN OF LANSING ESTABLISHING WATER DISTRICT NO. 7, EXTENSION NO. 9 At a special meeting of the Town Board of the Town of Lansing held at the Lansing High School on April 28 , 1993 at 7 :00 P .M. Present : Jeffrey Cleveland, Councilman 246 continued April 28 , 1993 Paul Butler, Councilman Herbert Beckwith, Councilman In the matter of the establishment of Lansing Water District No . 7 , Extension 9 , Town of Lansing, County of Tompkins , State of New York, pursuant to Article 12-A of the Town Law. WHEREAS, a map, plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Lansing, relating to the establishment of a proposed water district in the Town; and WHEREAS, said map, plan and report was prepared by T.G. Miller and Associates , P. C. , Engineers and Surveyors , Ithaca, New York , who are duly licensed by the State of New York, which showed the boundaries of the proposed district , a general plan of the water system and a report of the proposed improvements , the estimated expense of these improvements , the proposed method of financing, which map, plan and report are on file in the Town Clerk ' s Office for public inspection, and all other matters required by law to be stated; and WHEREAS, the map shows the proposed water district , water mains , fire hydrants and other related and necessary appurtenances ; and WHEREAS, an Order was passed on March 17 , 1993 , designating April 28 , 1993 , at 7 : 00 P.M. at the Lansing High School , Room 101 , in Lansing, New York, to consider the plan, map and report and to hear all persons interested in this matter and to take action as required by law; and WHEREAS, the said Order was published and posted as required by law; and WHEREAS, The Town Board has reviewed the State Environmental Quality Review ("SEQR") and by Resolution determined that the establishment of the water district will not result in any significant environmental impact ; and WHEREAS, a public hearing on the matter was held by the Town Board on April 28 , 1993 at the Lansing High School as aforesaid, at 7 : 00 P .M. and the matter was fully discussed and all interested parties and persons were heard. Upon the evidence given at the hearing and upon a motion duly made by Councilman Herbert Beckwith, seconded by Councilman Jeffrey Cleveland, the following resolution was unanimously adopted. It is hereby determined that : (a) The notice of hearing was published and posted as required by law, and it is otherwise sufficient . (b) All the property and property owners within the proposed district are benefitted thereby. (c) All the property and property owners benefitted are included within the limits of the proposed district . (d) The establishment of this district is in the public interest . IT IS RESOLVED that the district as set forth in the map, plan and report be approved, that the requested improvement be constructed and that the necessary easements and lands be acquired • upon the required funds being made available and provided for. IT IS FURTHER RESOLVED that this district shall be known as the Water District 7 , Extension 9 in the Town of Lansing and shall be bounded and described as follows : (Exhibit A on file in the Town Clerk ' s Office) . IT IS FURTHER RESOLVED that no costs or expenses shall be incurred for the proposed improvement until and unless a grant shall be received from an appropriate Federal or State agency or agencies in an amount sufficient to pay for all such costs and 247 continued April 28 , 1993 expenses to a maximum of Four Hundred Thousand Dollars . IT IS FURTHER RESOLVED that this resolution is subject to permissive referendum as provided in Town Law, Section 209-E in the manner provided in Article 7 of the Town Law. IT IS FURTHER RESOLVED that establishment of Water District 7 , Extension 9 is subject to approval by the New York State Department • of Audit and Control . Vote of Town Board . . . (Aye) Paul Butler , Councilman Vote of Town Board . . . (Aye) Herbert Beckwith, Councilman Vote of Town Board . . . (Aye) Jeffrey Cleveland, Councilman Mr . Thaler discussed the N .Y. S.E. & Gas proposal for fly ash. He stated that N.Y. S .E. & Gas must ask for an amendment to Local Law No . 1 of 1988 and 1992 and set specific exceptions exclusively for this purpose. This will be discussed further at the next meeting. On motion, meeting adjourned at the call of the Supervisor. Minutes taken by the Deputy Supervisor and executed by the Town Clerk . •
