The Lansing Town Board met in Special Session at the Lansing
Town Hall Board Room on June 03 , 1992 at 8 :00 P.M. with Supervisor
Kirby presiding.

The Supervisor called the meeting to order having the clerk
take the Roll Call .
George Schlect passed out a copy of a letter he received from
Cortland Paving Company Inc . dated June 3 , 1992 . The letter
pertained to the Kim Subdivision's roads .
Mr. Schlecht requested from the Board a conditional acceptance
of the roads in the subdivision. Conditions to be approved by the
Town Engineer, Town Highway Superintendent and the Town Attorney.
The Town Board will research this further and schedule it for
the next Board meeting on June 17 , 1992 .
Mr. & Mrs . Garrett addressed the Board regarding the potential
noise that the new bar on the corner of Peruville and North
Triphammmer could generate. They asked the Board for any kind of
protection that could be given.
After further discussion Mr. Totman, Code Enforcement Officer
will meet with Mr . Capalongo to see if something could be worked
out to make things more tolerable.
The Garrett ' s thanked the Board for their time and would
appreciate anything the Board could do for them and their problem.
George Totman spoke on behalf of Phil Munson Sr. regarding the
Solid Waste Law. Mr . Munson is questioning the legality of Dennis
Eldrige, a farmer in Cayuga County, who is spreading manure on to
lands in the Town of Lansing. Where does that fit into the Town
Law, is it legal or not legal?
Mr. Tvaroha stated that this is the first one that has been
brought to the Board' s attention. The alleged spreading would have
to be verified and the law researched to see if it could be
rewritten to take in this kind of common farming practice. The laws
intent was not meant for the general standard practice of
prohibiting this . Also there would be a hardship to the farmers
who owned property in both counties .
Mr. Munson stated he could name a dozen farmers who transport •
animal waste across the line into Lansing. He stated that he
approached the Board in December to ask for an exemption to
transport food waste. Mr . Munson stated that this was never
settled. Mr . Munson said he received a 4 page document explaining
that under this law you can only spread waste on the parcel where
it has been generated. This document was never signed.
Mr. Munson stated that his intention was not to create a
hardship for Dennis Eldridge or anyone else.

After further discussion it was the consensus of the Board to
work on an amendment to the law regarding farmers .
RESOLUTION, offered by Mr. Tvaroha who moved its adoption,
seconded by Mr. Beckwith:
RESOLVED, that the Town Board at this time does not feel that
it is in the best interests of the public to purchase the Bill
George Road culvert and that monies previously allocated in the
budget for that purpose should be used for the unexpected expense
of repair to the Myers bridge which has more immediacy for the
public welfare and good.

RESOLUTION, offered by Mr. Cleveland who moved its adoption,
seconded by Mr. Beckwith:
RESOLVED, that the Town Board authorizes an increase in the
Town of Lansing' s annual sewer fee from $7 .00 to $14 . 00 per unit .

RESOLVED, that the Town Board of the Town of Lansing does
hereby approve the 1992 Bolton Point Benefit Levy in the amount of
$25 , 492 . 50 .

A copy of the minutes of May 06, 1992 , having been furnished
to the Board Members beforehand, the Supervisor asked for a motion
to make any corrections or to accept the same as submitted.
RESOLUTION, offered by Mr. Cleveland who moved its adoption,
seconded by Mr. Tvaroha:
RESOLVED, that the minutes of May 06, 1992 are hereby accepted
as submitted.
Carried.
RESOLUTION, offered by Mr. Tvaroha who moved its adoption,
seconded by Mr . Beckwith:
RESOLVED, that the Town Board of the Town of Lansing hereby
extends their gratitude to the Cayuga Lake Charter Boat Association
for their donation of a ship to shore radio to be used at Myers
Park for emergency use on Cayuga Lake.

goes into Executive Session at 9 : 15 p.m.

RESOLVED, that the Executive Session be terminated at 10 : 00
p .m. and the special meeting be reconvened.
Carried.
Mr. Cleveland requested that all Town Board members receive a
copy of the Planning Board minutes .
On motion, meeting adjourned at the call of the Supervisor at
10 : 25 p.m.
