MARCH 04, 1992
The Lansing Town Board met in Special Session at the Lansing
Town Hall Board Room on March 04 , 1992 at 7 : 00 P .M. with Supervisor
Kirby presiding .

The Supervisor called the meeting to order having the clerk
take the Roll Call .
Fred Rogers updated the Board on his sewer situation for 11
Estates Drive . He informed the Board that a draft for a tri-party
agreement has been prepared and when it goes through the
appropriate channels he will present it to the Board .
Fred Rogers asked the Board what he was required to install
for plumbing concerning the pipe to be installed under the cement
slab at his property at 11 Estates Drive . There is a conflict with
the Town regulations and Bolton Point ' s regulations . After intense
discussion concerning this matter with the Town Board, George
Totman, Code Enforcement Officer and Kevin Kauffman, Bolton Point
Representative . It was concluded that a joint committee from the
Town of Lansing meet with Bolton Point ' s operation committee

to try to resolve the conflicts .
Mary Decker , representing the Horky Subdivision, along with
David Herrick updated the Board on the meeting which was held on
Monday with Jeannine Kirby , Richard Thaler , David Herrick and
Attorney Ruthig, John O ' Conner , Mary Decker and Al Fulkerson. The
water issue and road situation was discussed . It was noted by
Attorney Thaler that the Board has a policy that states when a
developer asks for extensions of water it has to be to their
property line unless there is a variance from the Town .
There will be a Public Hearing on the Horky Subdivision, Tax
Map #40 . -4-14 . 2 at 8 : 15 P .M. at the Lansing Planning Board meeting
on March 09 , 1992 .
David Herrick passed out information and a survey regarding
the HUD summary and application for the Myers Heights , Myers Road,
Park Lane and Marina Road area .
RESOLUTION offered by Mr . Cleveland who moved its adoption,
seconded by Mr . Beckwith:
RESOLVED, that the Town Board authorizes David Herrick , Town
Engineer to proceed with the cost estimation not to exceed
$2 , 500 . 00 for Water District #17 , to be recaptured out of funding .

Discussion was held on Murfield Drive in the Hickory Knoll
Subdivision . Dave informed the Board that in his opinion it was a
complete road failure . Dave has also found road failure on Reach
Run in the Lake Watch Subdivision . David recommended to the Board

that they use the Highway Department to have the soil testing done
on these two roads . Dave had an estimate from Empire Soils to do
core testing, 6 holes on each road for a total of 12 at a cost of
$850 . 00 . Mr . Cleveland informed the Board that Mahool & Tallman
have already had core testing done on his road and he would look
into getting the results from him.
RESOLUTION offered by Mr . Beckwith who moved its adoption,
seconded by Mr . Butler :
RESOLVED that the Town Board authorizes Dave Herrick to make
4111 arrangements with Empire Soil for core testing on Murfield Drive
and Reach Run ( 6 holes on each road for an estimated cost of
$850 . 00 ) . The cost to go against the developer . Mr . Cleveland
will contact Mahool & Tallman to see if they would submitt the
results from their core testing to save them further expense .
David Herrick to inform the developers that this will be done .

Richard John passed out a Draft Use and Occupancy Agreement
for the Board to review.
RESOLUTION offered by Mr . Beckwith who moved its adoption,
seconded by Mr Butler :
WHEREAS , the Board of Representatives of the County of
Tompkins , State of New York has resolved to impose an additional
sales tax on qualified goods sold within the County of Tompkins ,
and
WHEREAS , the Board of Representatives of the County of
Tompkins , State of New York has recently raised property taxes upon
landowners within the County, and
WHEREAS , the County Representative from the Town of Lansing,
Thomas Todd, has recommended restricting any increase in the sales
tax to one-half of one percent and that there be no increase in the
property taxes assessed against landowners within the Town, and
WHEREAS, the Lansing Town Board, after due consideration, has
determined it would be in the best interests of the Town and its
citizens that if additional revenue must be raised by taxes , that
such tax be in the form of a one-half of one percent sales tax
rather than any increase in the property taxes ,
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town
of Lansing that it supports the recommendation of the County
Representative from the Town of Lansing, Thomas Todd, to restrict
any increase in the sales tax to one-half of one percent and to
condition such increase upon no increase in the present property
tax rates .

• At a regular meeting of the Town Board, held in and for the
Town of Lansing at the Town Hall on March 04 , 1992 , a discussion
was had concerning the retirement from the Lansing Water Board of
William Bement . The Town Board felt that it was appropriate to
acknowledge the dedicated service of this Lansing citizen and the
following resolution was duly made by Mr . Cleveland , seconded by
Mr . Beckwith and unanimously passed.
BE IT RESOLVED, that the Town Board recognizes the dedicated

public service of William Bement who has served on the Lansing
Water Board from May 1 , e28 ? ' o December 31 , 1991 . In recognizing
the efforts of William Bement the Town Board calls the attention to
all residents of the Town of Ling that the democratic working of
Town government depends upon the time , effe-t and dedication of its
eitisens well ' no to aot In a non-paid position . Democracy is only
as good as the peo7le who : eve within a community and it is like
the eid adaoe "y :u enly aet cut what ycu put in" .
As a result of the work of William Bement , the Town of Lansing
can look at the new wit : d' strcts , which have eliminated private
water problems in a vast area of the Town for persons living within
the water districts which have been set up since 1988 can be
eFpecialy pleased and thankful with the work of this individual .

acknowledge the dedicated service this Lansing citizen and the

following resolution was duly made by Larry Tvaroha, seconded by
Herbert Beckwith, and unanimously passed.
BE IT RESOLVED, that the Supervisor be, and she hereby is ,
authorized to execute an escrow agreement with John Adams and
Elaine Adams providing for an amount of money sufficient to
discharge any lien placed upon the land accepted by the Town for
dedication known as East Meadow Drive and West Meadow Drive, and to
pay any costs thereon, and that the said agreement be approved in
its terms by the Town attorney; and
1111 BE IT FURTHER RESOLVED, that upon the execution of the
satisfactory agreement , the Town Attorney is authorized to file the
legal documents necessary to evidence the dedication to the Town of
the roads known as East Meadow Drive and West Meadow Drive .

RESOLVED, the Town Board of the Town of Lansing will hold a I
Public Hearing on April 1 , 1992 at 7 : 00 P.M. in the Lansing Town
Hall Board Room for Water District #12 .

110 Discussion was held on starting the procedure to establish an
ordinance for not parking along town roads . It was the consensus
of the Board to have the Sheriff ' s Department enforce the State Law
at this time .
Discussion was held on planning inspections being done by
Bolton Point and why they are not done by each municipality? Mr .
Thaler will write Bolton Point asking them to produce written
authorization that Bolton Point has authorization to do the
inspections .
Mr . Totman informed the Board he would like to meet with them
to discuss Bolton Point situations .
RESOLUTION offered by Mr . Beckwith and seconded by Mr .
Cleveland:
RESOLVED, that the Town Board hereby adjourns the regular
meeting at a 10 : 00 P.M. to go into Executive Session.
Carried .
RESOLUTION offered by Mr . Beckwith and seconded by Mr . Butler :
RESOLVED that the Executive Session be terminated and the
Regular Meeting be reconvened at 10 : 45 P .M.
