HomeMy WebLinkAbout2014-06-04 SPECIAL TOWN BOARD MEETING JUNE 4, 2014 A Special Meeting of the Lansing Town Board was held at the Town Hall Board Room, 29 Auburn Road, Lansing,NY on the above date at 6:00 p.m. The meeting was called to order by the Supervisor, Kathy Miller and opened with the Pledge of Allegiance to the flag. Roll call by Darlene Marshall, Deputy Town Clerk, showed the following to be PRESENT: Kathy Miller, Supervisor Robert Cree, Councilperson Doug Dake, Councilperson Ruth Hopkins, Councilperson ABSENT: Edward LaVigne, Councilperson ALSO PRESENT: Sharon Bowman, Deputy Supervisor, Lynn Day, Code Enforcement Officer, John O'Neill,Village of Lansing, Ray Farkas, Mario Hernandez, Ted Laux, and a few other attendees. CONSIDER RESOLUTION AUTHORIZING THE ISSUANCE OF A $87,000 BOND ANTICIPATION RENEWAL NOTE #01-14 DISCUSSION Bookkeeper Sharon Bowman explained Interest Rates. The difference between Bonds and BARNS were discussed. Sharon Bowman indicated it is year 6 or 7 and there are 13 or 14 years left to finance. Procedures for joining the CWD were discussed. Attorney Guy indicated the theory was that since they were their own district, when the cost to retire the extension's debt had been reduced to equal, or less than the CWD's yearly fee, they would be merged into the district as they would be paying their own rate. Sharon Bowman indicated this is not written. Attorney Guy Krogh indicated there is not a policy, it is a rational mathematical view of it. Supervisor Kathy Miller stated a policy could be written. Attorney Guy Krogh indicated that there is a type of policy according to the CWD Local Law you are required to have a committee to look at these types of financial and engineering issues and make recommendations. Supervisor Kathy Miller asked what would be better, to leave it to the board or have a policy. Attorney Guy Krogh indicated he would have to look at the Local Law to see if it is expressed as a policy. But, the things that you need to make a decision on a case by case basis are within the Local Law. If you want to make a flat line rule opposed to making decisions on changing financial and engineering circumstances you could do that. Councilperson Ruth Hopkins indicated they should first put the board together. It is part of the Local Law that the board or committee exists. Sharon Bowman indicated the opening for committee members had been advertised. RESOLUTION 14-74 RESOLUTION AUTHORIZING THE ISSUANCE OF A$87,000 BOND ANTICIPATION RENEWAL NOTE#01-14 The following Resolution was duly presented for consideration by the Town Board: WHEREAS, the Town duly authorized expenditures to cover the cost of acquiring, constructing and equipping the improvements to be included in Extension No. 2 to the Town of Lansing Consolidated Water District (the "District"), consisting principally of the construction of a water distribution system covering a portion of Drake Road in the Town and the installation of water lines and meters, including valves, curb stops, original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements to provide municipal water services to the affected areas within said District, engineering June 4, 2014 1 and other preliminary costs, legal expenses and other costs incidental to the financing thereof (the "Project"), all of which Project expenses were authorized by a Final Order forming the District and funded by a Bond Resolution dated May 21, 2008, and which obligation(s) were satisfied, in accord therewith, by Bond Anticipation Note ("BAN") #01- 09 (in the amount of $145,000.00), as renewed by a Bond Anticipation Renewal Note ("BARN") #02-10 (in the amount of$137,400.00), by a BARN #01-11 (in the amount of $133,500.00) dated June 17, 2011; by a BARN #01-12 (in the amount of$94,483.75) dated June 15, 2012, and by a BARN#01-13 (in the amount of$90,000.00), dated June 14, 2013, which BARN#01-13 is hereby being partially paid and the balance thereof renewed; and WHEREAS, BARN #01-13 is approaching its maturity date and such financing must be renewed or the debt thereof paid, and in compliance with the Local Finance Law, the Town Board has decided to partially pay-down the debt pursuant to Local Finance Law § 23.00 by making a principal and interest payment thereupon and issuing a BARN for the balance thereof; and WHEREAS, the Town has contacted several lending institutions to find the lowest rates, and has determined that the Tompkins Trust Company, Ithaca, New York, has the best rates and terms for proposed BARN #01-14, to be issued in the amount of $87,000 for one year at a 1.90% interest rate (non-callable); and WHEREAS, this action is classified as a Type II Action under SEQRA and, as such, no environmental review is necessary or required; and WHEREAS, after a review of the foregoing and due deliberation and consideration thereof, and in compliance with Local Finance Law § 38.10, and other requirements of law, the Town Board of the Town of Lansing has hereby RESOLVED,that Section 1. BARN #01-14 hereby authorized is for the payment of indebtedness relating to the purchase and acquisition of goods to construct the Project for the District. Section 2. The said BARN hereby authorized was authorized pursuant to a Bond Resolution dated May 21, 2008, which Bond Resolution was duly issued under the Local Finance Law, with such Project having been subject to permissive referendum as required by law. Section 3. It is hereby determined that the cost of indebtedness relating to the objects and purposes of this Resolution is $91,000.00; said amount is hereby appropriated there for, and the plan for the financing thereof shall consist of the payment of$4,000.00 and the issuance of up to $87,000 principal amount of serial bonds (including, without limitation, statutory installment bonds) pursuant to the provisions of the Local Finance Law. Section 4. The Town of Lansing hereby authorizes the expenditure of up to $91,000.00, plus interest thereupon, for the payment of the obligations relating to the Project, which amount shall be paid in part by the issuance of BARN #01-14, together with a principal payment to be made in relation thereto in the amount of$4,000.00 (to be applied to the payment of BARN#01-13). Section 5. No other BANs or BARNs are issued and outstanding for the payment of the indebtedness relating to the Project (except BARN 01-13, which is being paid in full as herein duly authorized). Section 6. The BARN authorized by this Resolution is a renewal of BARN #01-13, issued June 14, 2013. Section 7. The BARN authorized by this Resolution shall be dated June 13, 2014, and shall mature and be and become due and payable upon June 12, 2015. June 4, 2014 2 Section 8. The BARN hereby authorized is for an assessable improvement of or within the Town, namely, the Town of Lansing Consolidated Water District Extension Number 2. Section 9. The temporary use of available funds of the Town, not immediately required for the purpose or purposes for which the same were borrowed, raised or otherwise created is hereby authorized pursuant to § 165.10 of the Local Finance Law for the purposes described in this Resolution. The Town shall reimburse such expenditures with the proceeds of the BARN authorized by this Resolution. This Resolution shall constitute a declaration of official intent as required by United States Treasury Regulation § 1.150-2. Other than as specified in this Resolution, no money is, or is reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the objects or purposes described herein. Section 10. The full faith and credit of said Town of Lansing, Tompkins County, New York, is hereby irrevocably pledged to the payment of the principal of and interest on said Bonds and the BARN hereby authorized as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest due and payable in such year. Such appropriation shall be made from the several lots and parcels of land in the Town of Lansing in the manner provided by law for general taxation thereupon. In the event the collection of such assessments shall be less than the amount required to pay the principal and interest of such obligations as they shall become due, the Town Board shall direct that surplus moneys not otherwise appropriated be applied, or the Town shall take such other action as is permitted or required by law to assure the timely payment of such obligations. Section 11. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of BANs and renewals thereof(in anticipation of the issuance and sale of the serial bonds) was and is hereby again delegated to the Town Supervisor, as Chief Fiscal Officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law and the Bond Resolution aforesaid. The question of the adoption of such proposed Resolution was duly motioned by Councilperson Robert Cree, duly seconded by Councilperson Doug Dake, and put to a roll call vote with the following results: Councilperson Robert Cree -Aye Councilperson Doug Dake - Aye Councilperson Ruth Hopkins - Aye Supervisor Kathy Miller-Aye Accordingly, the foregoing Resolution was approved, carried, and duly adopted on June 4, 2014. CONSIDER RESOLUTION CLASSIFYING ACTION,DECLARING LEAD AGENCY, IDENTIFYING INVOLVED AND INTERESTED AGENCIES,AND SCHEDULING PUBLIC HEARING FOR ENVIRONMENTAL REVIEW OF PROPOSED LOCAL LAW#3 OF 2014,A LOCAL LAW TO REPEAL, RESTATE, AND COMBINE THE OUTDOOR INVENTORY STORAGE LAW AND JUNKYARD ORDINANCE INTO A SIMPLIFIED SINGLE LOCAL LAW DISCUSSION Councilperson Ruth Hopkins asked when the documents they are referring to are posted. Deputy Town Clerk Darlene Marshall indicated the agenda and working documents are put on the website at least 24 hours prior to the Board Meeting once all the information has been received. The Local Laws are available now for review in the Town Clerk's Office. Councilperson Ruth Hopkins asked if copies showing what has been changed in the Local Laws could be made available. June 4, 2014 3 Attorney Guy Krogh indicated that one exists for the Zoning Law and for the Subdivision Law. He can send the red-line or highlighted copies showing the changes. You can't do this with the Proposed Local Law#3 as it combines parts of the Outdoor Inventory Storage Law and the Junkyard Ordinance. Supervisor Kathy Miller would like to post the local laws as soon as possible. RESOLUTION 14-75 RESOLUTION CLASSIFYING ACTION,DECLARING LEAD AGENCY, IDENTIFYING INVOLVED AND INTERESTED AGENCIES, AND SCHEDULING PUBLIC HEARING FOR ENVIRONMENTAL REVIEW OF TOWN OF LANSING PROPOSED LOCAL LAW#3 OF 2014, A LOCAL LAW TO REPEAL,RESTATE,AND COMBINE THE OUTDOOR INVENTORY STORAGE LAW AND JUNKYARD ORDINANCE INTO A SIMPLIFIED SINGLE LOCAL LAW The following Resolution was duly presented for consideration by the Town Board: WHEREAS, the Town of Lansing is considering adoption of Local Law #3 of 2014, a local law to repeal Local Law #7 of 2004 (Outdoor Inventory Storage) and the Junkyard Ordinance (#49), and combine them into a single new local law entitled as "A Local Law to Regulate Outdoor Storage and Junkyards in the Town of Lansing," which local law seeks to greatly simplify regulating junk,junkyards, and all outdoor storage; and WHEREAS, since this Local Law effects no significant new policies or land use or resource regulations, but only simplifies and combines an existing ordinance and local law into a single local law, which local law also incorporates the existing NYS Property Maintenance Code for definitions, terms, and enforcement provisions; and Whereas, the Town Board, as the approving agency, must conduct a SEQRA review for this action, and now, upon due deliberation upon the foregoing, now therefore be it RESOLVED AND DETERMINED, that 1. This action is classified as an Unlisted Action pursuant to SEQRA; 2. The Town Board of the Town of Lansing proposes to be the Lead Agency for coordinated environmental review, subject to consent or any requests regarding such coordinated review by any Involved or Interested Agency, as applicable; 3. The Involved Agencies are: the Tompkins County Planning Department; and 4. The Interested Agencies are determined to be: the Village of Lansing; the NYS Department of Agriculture; the Town of Lansing Planning Board; The Town of Lansing Zoning Board of Appeals; and it is further RESOLVED, that the Town Clerk issue a Notice of Intent to each and all of the Involved Agencies and Interested Agencies, including therewith a copy of the proposed local law and the SEAF; and it is further RESOLVED, that a public hearing to consider the environmental impacts of the proposed local law be and is hereby scheduled for the 16th day of July, 2014, at 6:12 pm, at the Lansing Town Hall, 29 Auburn Road, Lansing,New York, and to thereat hear all persons interested in the subject thereof, and concerning the same, and to take such action thereon as is required or permitted by law; and it is further RESOLVED, that the Town Clerk of the Town of Lansing, Tompkins County, New York, is hereby authorized and directed to cause a Notice of Public Hearing to be published and posted in accord with law. CONSIDER RESOLUTION RENAMING PORTIONS OF VILLAGE CIRCLE AND VILLAGE PLACE AND REASSIGNING ADDRESSES FROM WARREN ROAD TO SUCH NEW ROADS DISCUSSION Attorney Guy Krogh indicated there are mandated agencies under Town Law § 64(9) and some common sense agencies to notify of this change. Supervisor Kathy Miller indicated that Lynn Day is ready to send out the notices. RESOLUTION 14-78 RESOLUTION RENAMING PORTIONS OF VILLAGE CIRCLE AND VILLAGE PLACE AND REASSIGNING ADDRESSES FROM WARREN ROAD TO SUCH NEW ROADS The following Resolution was duly presented for consideration by the Town Board: WHEREAS, to avoid confusion and enhance emergency response capacities, and to make room for new structures approved along such roads, the dwellings and buildings located along Village Circle and Village Place need to have their Warren Road addresses changes, the buildings and lots need to be re-numbered, and such streets need to be more logically named in consideration of their existing layouts; and WHEREAS, the Town Board, as the approving agency, has the authority under Town Law § 64(9) to name and number streets and lots thereupon, and in consideration of the need therefore, the Town Board of the Town of Lansing has hereby RESOLVED as follows: 1. The roadways currently known as Village Circle North, Village Circle South and Village Place be and are hereby renamed "Village Circle." The roadway currently knows as Village Circle East is hereby renamed "Village Place." The said roadways as renamed are more particularly shown upon the Village Circle—Lucente Homes/Village Solars Site Plan diagram as marked-up by the Town CEO and submitted to this meeting. June 4, 2014 7 2. In accord with Town Law § 64(9) the Town Clerk is hereby directed to give formal notice of such changes and their effective dates within 10 days hereof to the County Department of Assessment, the Town of Lansing Planning Board, the County Clerk, the County Engineer, and each affected Post Office of the Unites States. 4. In addition, the Town Clerk and the Town CEO shall coordinate to provide further notice to each affected resident and owner(if known), the County Emergency 911 Office (who will notify Fire, Police, and Emergency Medical Responders), the Town Highway Department, Bolton Point Municipal Water Service, NYSEG, and the Tompkins County Health Department. 5. This change shall take effect at 12:01 am upon August 4, 2014. The question of the adoption of such proposed Resolution was duly motioned by Councilperson Robert Cree, duly seconded by Councilperson Ruth Hopkins, and put to a roll call vote with the following results: Councilperson Robert Cree -Aye Councilperson Doug Dake - Aye Councilperson Ruth Hopkins - Aye Supervisor Kathy Miller-Aye Accordingly, the foregoing Resolution was approved, carried, and duly adopted on June 4, 2014. PROGRESS REPORT ON PART-TIME EMPLOYEE IN THE PLANNING DEPARTMENT Supervisor Kathy Miller asked for an update on the part-time position in the Planning Department. Councilperson Robert Cree indicated that he and Councilperson Edward LaVigne had both reached out to two people who had expressed interest. They met with one individual to provide more information to this person. This individual wanted to think about time constraints based on their current availability and will get back to Councilperson Edward LaVigne by Friday. Advertising for the vacancy of a consultant was discussed. Councilperson Robert Cree and Sharon Bowman will coordinate the posting of the job description. Councilperson Ruth Hopkins asked if there needed to be any extra amount approved for the expenses incurred for tasks required in the interim. Bookkeeper Sharon Bowman indicated each month when the bills are paid there will be a budget modification for the expense. June 4, 2014 8 Bookkeeper Sharon Bowman indicated she would have to look to be sure but believes the legal budget has been exceeded. Attorney Guy Krogh indicated the new SEQRA reviews are taking excess time and everyone is going through this. A consultant would also have had excess time on SEQRA reviews. Supervisor Kathy Miller stated that someone had asked what the full-time Planner would cost on a monthly basis compared to legal fees for completing the same work. MOTION TO ADJOURN MEETING Supervisor Kathy Miller moved to adjourn the Special Meeting at 6:32 pm to enter the Work Session Meeting. Councilperson Robert Cree seconded the motion. Public comment will be taken at the regular meetings when the items are scheduled on the agenda. Meeting Time: 6:33 pm—7:55 pm Town Board Members Present: Kathy Miller, Supervisor Robert Cree, Councilperson Doug Dake, Councilperson Ruth Hopkins, Councilperson Absent: Edward LaVigne, Councilperson Also Present: Sharon Bowman, Deputy Supervisor, Lynn Day, Code Enforcement Officer, John 0-Neill, Village of Lansing, Ray Farkas, Mario Hernandez, Ted Laux and a few other attendees. Topics of Discussion: 1. Traffic Study—final decisions or further deliberations on the scope and need for a Traffic Study were deferred to a joint meeting with the Planning Board 2. Jonathan Kanter's Proposal for continuance of Professional Planning services for the Comprehensive Plan 3. Lynn Day, Code Enforcement Officer and Councilperson Doug Dake a) Update on Town Hall Roof Repairs and other matters discovered b) Initial Plans for an addition to the Town Hall due to the needs of the Justice Court and simply being out of room 4. Potential actions as to unsafe or hazardous buildings June 4, 2014 9 5. Speed Limit Reduction Request on Bacon Road 6. Wayfaring Signs and NYSDOT impediments and opposition to logical signage needs and solutions 7. A matter of threatening or Pending Litigation The Supervisor reconvened the previously adjourned Special Meeting at 7:55 pm. MOTION TO ENTER EXECUTIVE SESSION Supervisor Kathy Miller moved to ENTER EXECUTIVE SESSION TO DISCUSS A LIGITATION MATTER AT 7:56 PM. Councilperson Doug Dake seconded the motion. All In Favor- 4 Opposed- 0 MOTION TO EXIT EXECUTIVE SESSION Councilperson Robert Cree moved to EXIT EXECUTIVE SESSION AT 8:33 PM. Supervisor Kathy Miller seconded the motion.
