87 a Lead Agency be established for conducting environmental review of projects in accordance with
88 local and state environmental law and the Lead Agency shall be that local agency which has
89 primary responsibility for approving and funding or carrying out the action; and

91 WHEREAS,The Planning Board of the Town of Lansing is believed best suited to review the
92 impacts of this proposed Subdivision as (i) the Planning Board is the only body with jurisdiction
93 to classify the Subdivision and issue the final Subdivision approval, (ii)the Planning Board is best
94 situate to understand and evaluate the potential unique impacts of such Subdivision upon the
95 Town based upon the developmental patterns, topography, and unique natural and non-
96 natural features of the Town of Lansing, including known streams, wetlands, UNAs, agricultural
97 resources of value, and archeologically sensitive sites within or near the Major Subdivision area,
98 (iii) the Planning Board has the broadest governmental powers for investigating the potential or
99 actual impacts of the Subdivision and implementing conditions or mitigating controls, and
100 accordingly (iv) the Planning Board has the greatest capacity for providing the most thorough
101 environmental assessment of the proposed Subdivision; and

103 WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning
104 Board is the sole involved agency for the purposes of a State Environmental Quality Review Act
105 ("SEQRA") review;

147 - Many Planning Board members stated that while they do not agree with the Dollar

159 WHEREAS, an application was made by Steve Vukas, Bohler Engineering MA, LLC on behalf of
160 Franklin Land Associates, LLC, Owners,for construction of a 10,640 sq. ft. retail store with parking
161 and other site improvements and lot line adjustment of three existing parcels in Lansing, New
162 York, TAX PARCEL NUMBER 16.-1-40.225, 16.-1-40.222 & 16.-1-40.223, located in the Rural
163 Agricultural (RA) Zoning District; and

165 WHEREAS, this is a proposed action reviewed under Town of Lansing Code § 270-27 Site Plan
166 Review and § 235 Subdivision, for which the respective completed applications were received 27
167 August 2021; and
168
169 WHEREAS, 6 NYCRR§ 617 of the State Environmental Quality Review Act ("SEQRA") requires that
170 a Lead Agency be established for conducting environmental review of projects in accordance with
171 state environmental law and the Lead Agency shall be that local agency which has primary
172 responsibility for approving and funding or carrying out the action; and
173
174 WHEREAS, the Planning Board, being the local agency which has primary responsibility for
175 approving the action, did on October 25, 2021 classify the project as an Unlisted Action and
176 declare itself the Lead Agency for the environmental review; and
177
178 WHEREAS, legal notice was published on November 11, 2021, December 1, 2021, and January
179 14, 2022and adjacent property owners within 1200 feet were notified by mail on November 10,
180 2021, November 30, 2021, and January 16, 2022, and pursuant to Town Code § 270-27(F); and
181
182 WHEREAS, a public hearing was duly held before the Planning Board upon November 22, 2021,
183 December 20, 2021, and January 24, 2022, and the public was duly allowed to speak upon and
184 address the proposed Subdivision and Site Plan, including the SEAR environmental review
185 thereof, whereafter the Planning Board considered approval of the Subdivision and Site Plan
186 upon receipt of final stormwater input and SWPPP updates, all including and in accordance with
187 the provisions of the Town Code § § 270-27(D); et seq., and including concerns addressing site

188 drainage, lighting, nearby residences, landscaping, and buffering/screening, driveway and any
189 potential on and off site environmental impacts; and
190
191 WHEREAS, the Tompkins County Department of Planning and Sustainability, Tompkins County
192 Highway Department, NYS Department of Transportation, and Town of Lansing Highway
193 Department were given the opportunity to comment on the proposed action; and
194
195 WHEREAS, Project plans, and related information, were duly delivered to the Tompkins County
196 Planning and Sustainability Department per General Municipal Law § 239; et seq., and such
197 Department responded in an 18 November 2021 letter from Katherine Borgella, Tompkins
198 County Commissioner of Planning, pursuant to §239 -1, -m, and -n of the New York State
199 General Municipal Law recommended the following modification of the proposal:

201 We suggest that the Town encourage the applicant to utilize lower level LED
202 lighting. The
203 County's Environmental Management Council has studied outdoor lighting and
204 recommends
205 through the attached Environmental Alert: Important Recommendations for Indoor and
206 Outdoor Lighting (2017) that outdoor LED lighting be not higher than 2700K CCT to
207 minimize adverse human and ecological impacts in addition to minimizing adverse
208 aesthetic impacts to the Cayuga Lake Scenic Byway.

210 WHEREAS, the Planning Board has considered and carefully reviewed the requirements of the
211 zoning code relative to site plan review and subdivision review, the unique needs of the Town
212 due to the topography, the soil types and distribution, and other natural and man-made features
213 upon and surrounding the area of the proposed site plan, and the Planning Board has also
214 considered the zoning in the area and the project in light of the Town's Comprehensive Plan and
215 compliance therewith, and as the underlying use is a permitted use in the zone in which located;
216 and
217
218 WHEREAS, the project has incorporated architectural design features such as a peaked front
219 fagade and concrete board siding and has selected a color palette all of which the Planning Board
220 finds will be harmonious with the character of the neighborhood; and
221
222 WHEREAS, the project has incorporated a landscaping plan that includes the planting of a treed
223 buffer which sufficiently mitigates the concerns of light and noise pollution to neighboring
224 properties; and
225

226 WHEREAS, the project includes a lighting plan which is Dark Sky compliant, containing cut off
227 lighting fixtures and limiting the CCT of external lighting to no more than 2,700K CCT to protect
228 the rural character of the neighborhood from light pollution; and
229
230 WHEREAS, the project has reduced the number of parking of spaces to further lessen its impact
231 on the character of the neighborhood and decrease the amount of impervious surface to reduce
232 stormwater runoff; and
233
234 WHEREAS, the project has submitted a stormwater pollution prevention plan which complies
235 with the NYS General SPDES Permit for Stormwater Discharges from Construction and sufficiently
236 attenuates any increase in stormwater that project may create; and
237
238 WHEREAS, the project has coordinated with NYS Department of Transportation to further
239 address flooding concerns in the vicinity of the project, but which are not a direct result of the
240 project; and
241
242 WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board,
243 now therefore be it RESOLVED as follows:
244
245 1. That the Planning Board of the Town of Lansing determines the proposed project will
246 result in no significant impact on the environment and that a Negative Declaration for
247 purposes of Article 8 of the Environmental Conservation Law be filed in accordance with
248 the provisions of Part 617 of the State Environmental Quality Review Act for the Lot Line
249 Adjustment and Site Plan approvals for Town of Lansing Tax Parcel Numbers 16.-1-40.225,
250 16.-1-40.222 & 16.-1-40.223, for Steve Vukas, Bohler Engineering MA, LLC, Applicant, on
251 behalf of Franklin Land Associates, LLC, Owners.

253 2. The Planning Board of the Town of Lansing does hereby grant Minor Subdivision approval
254 for Town of Lansing Tax Parcel Numbers 16.-1-40.225, 16.-1-40.222 & 16.-1-40.223 as
255 depicted in "Lot Line Adjustment Plan of the Lands of RMS Gravel Inc." prepared by
256 Ausfeld & Waldruff Land Surveyors LLP, revised 1-01-22 subject to the following
257 condition:

259 a. The sealing and endorsement of such Minor Subdivision Final Plat by the Planning
260 Board Chair or Vice Chairperson, thereafter presenting and obtaining the signing
261 of the plat by Tompkins County Assessment Department stamp followed by filing
262 in the Tompkins County Clerk's Office,followed by provision of proof of such filing

268 Vukas, Bohler Engineering MA, LLC on behalf of Franklin Land Associates, LLC, Owners,
269 which includes all parking layouts, screening, dark sky lighting, and other site conditions
270 listed in the plan set titled "Proposed Site Plan Documents for Franklin Land Associates
271 LLC, Proposed 10,640 Square Foot Retail Store, location of site NYS 34B,Town of Lansing"
272 prepared by Bohler and W.D. Goebel Professional Engineers, respectively, revised
273 02/09/2022, and "Dollar General I Exterior Elevations I Option A prepared by RDL
274 Architects, and dated 2/8/2022 subject to the following conditions:

276 a. Compliance with the recommendations of the Town's Engineer and SMO for any
277 final stormwater plans and the terms of the approved final Stormwater Pollution
278 Prevention Plan (SWPPP) for the developed site, and proper completion of all
279 stormwater reports, permits, and facilities in a form and manner as approved by
280 the Town and NYSDEC, including execution and filing of Stormwater Operating,
281 Management, and Reporting Agreement ("SOMRA") in the form as set forth
282 pursuant to Town Code § 225-8(D), which executed and filed SOMRA (and any
283 supporting easements) is required to be submitted to the SMO prior to the
284 issuance of any certificate of occupancy or compliance for the Project.
285 b. Building Permits are required to construct the approved building and site facilities.
286 Plans must meet all code requirements, including the sealing of plans by a licensed
287 engineer or architect. All improvements shall be constructed in compliance with
288 all state and local building code requirements.
289 c. The applicant will be required to obtain i) a Bolton Point water permit for a new
290 water service and meter to connect to the existing Consolidated Water District
291 Mains, and ii) a Tompkins County Health Department Onsite Wastewater
292 Treatment System (OWTS) permit. Both permits shall be obtained prior to
293 obtaining any building permit or Certificate of Occupancy ("CO").
294 d. In accordance with Town Code § 270-27(K), this site plan approval is valid for only
295 36 months from the date hereof, and the applicant/owner is required to
296 commence and substantially complete the construction or other activities for
297 which the site plan is applicable within said 36 months or this approval shall,
298 unless extended upon application timely made, expire, lapse, and be of no further
299 validity, force or effect.
300 e. Compliance with curb cut and NYSDOT permit conditions and requirements,

301 including receipt of final NYSDOT approval or permit close-out for any curbing or
302 driveway, culvert, or related land use designs or improvements as may be
303 emplaced upon or adjacent to any existing highway right-of-way or public
304 highway. Modification of vehicular ingress and egress requires modification of Site
305 Plans, and this approval, by the Planning Board.
306 f. The applicant must be issued a Sign Permit in compliance with Town Code Chapter
307 210 to erect, install, build, place, emplace, site, or substantially rebuild or repair
308 any signs.
309 g. All plantings (including as shown on the plans described above) shall be
310 maintained as healthy and natural non-invasive vegetation designed to provide
311 both visual and sound buffering. Existing and any new vegetation shall be properly
312 maintained and any dead, diseased, or dying trees or plants shall be promptly
313 replaced, and any tree or plants that, whether singularly or in combination, due
314 to lack of growth, death, recession, disease or other cause, cease to function as
315 buffers shall be replaced in a manner as promotes the goal of such buffer as stated
316 in this site plan approval. This condition shall be deemed to augment and further
317 define prior site plan approval conditions and site plan features hereby or
318 heretofore approved by the Town.
319 h. All lighting fixtures will be "dark sky compliant" glare-free, downward directed,
320 and shielded lighting as promotes the dark-sky standards of the International
321 Dark-Sky Association (IDA) and lamps will be not higher than 2700K CCT to
322 minimize adverse human and ecological impacts.
323 i. Exterior lights and sign lights will be turned off no later than 30 minutes after the
324 store closes.
