HomeMy WebLinkAbout2021-10-06 Special Town Board Meeting October 6, 2021 1 SPECIAL TOWN BOARD MEETING October 6, 2021 A Special Meeting of the Lansing Town Board was held at the Town Hall Board Room, 29 Auburn Road, Lansing, NY, and streamed live on YouTube on the above date at 6:30 p.m. The meeting was called to order by Edward LaVigne, Supervisor, and opened with the Pledge of Allegiance to the flag. Roll call by Deborah K. Munson, Town Clerk, showed the following to be PRESENT: Andra Benson, Councilperson (remotely) (left 7:29pm) Doug Dake, Councilperson (remotely) Bronwyn Losey, Councilperson (remotely) Joseph Wetmore, Councilperson Edward LaVigne, Supervisor ABSENT: No one absent ALSO PRESENT: Sheri Munson ALSO PRESENT REMOTELY: Guy Krogh, Town Counsel, C.J. Randall, Director of Planning, Mary Ellen Albrecht, Information Aide, and a few other attendees AGENDA CHANGES Discussion on changing items on the Agenda to a different order. Town Counsel Guy Krogh stated it is allowed to adjust agenda items, “on the fly”. Councilperson Andra Benson – Aye Councilperson Doug Dake – Aye Councilperson Bronwyn Losey – Aye Councilperson Joseph Wetmore – Aye Supervisor Edward LaVigne – Nay Accordingly, the foregoing Motion was approved, carried, and duly adopted on October 6, 2021. ADJOURNING A MEETING PROCESS Discussion on a proposed resolution resulted in the resolution below to vote on. RESOLUTION ADOPTING ADJOURNING MEETING GUIDELINES RESOLUTION 21-128 RESOLUTION ADOPTING ADJOURNING MEETING GUIDELINES The following Resolution was duly presented for consideration by the Town Board. WHEREAS, the Town has long considered a need for more formally written meeting procedures, including to avoid the complexities of Robert’s Rules of Order, which do not always well dovetail with municipal process and the requirements of the Open Meetings October 6, 2021 2 Law, and pending the drafting, review, and adoption of the same, some interim steps are desirable; so WHEREAS, upon due deliberation thereupon, the Town Board of the Town of Lansing has duly RESOLVED, that the Town of Lansing shall hereafter adjourn meetings of the Lansing Town Board only by motion made, duly seconded, and carried by majority vote of the Town Board. The question of the adoption of such proposed Resolution was duly motioned by Councilperson Joseph Wetmore, duly seconded by Councilperson Bronwyn Losey, and put to a roll call vote with the following results: Councilperson Andra Benson – Aye Councilperson Doug Dake – Aye Councilperson Bronwyn Losey – Aye Councilperson Joseph Wetmore – Aye Supervisor Edward LaVigne – Aye Accordingly, the foregoing Resolution was approved, carried, and duly adopted on October 6, 2021. MORATORIUM DISCUSSION Andra Benson: • Need clarification on what area will be in the moratorium • What steps need to be taken to change or add to the local law Ed LaVigne: • Public Hearing is set for the proposed Local Law which states temporary moratorium in Rural Agricultural (RA) Zone Guy Krogh: • If local law is materially amended now or after the public hearing o Will need a second public hearing o Cannot vote on local law until after second public hearing • Final form of local law o Must be to the Town Board members and Town Clerk at least seven (7) days (excluding Sunday) before adopting o Must be available to public before public hearing Joseph Wetmore: • B1 Zone (Cayuga Lake Scenic Byway) should be added to the moratorium • Allocate money to bring in consultant to get both zones done in a year Doug Dake: • If add B1 Zone the proposed Local Law will need to be amended • B1 Zone is business 1 – commercial zone • Will take longer to do re-zoning, if B1 Zone is added C.J. Randall: • Outside professional consultant for graphic enhancements • About $60,000 left between 2020 and 2021 budgets • Planning Board does not recommend any zoning / land use moratoria Bronwyn Losey: • Allocate money to C.J. Randall, so the Scenic Byway can be included in moratorium and completed in one year • Need to figure out what business we want in B1 Zone • Zoning does not match what residents want October 6, 2021 3 Doug Dake: • RA Zone o Farmers want it the way it is, with little zoning Ed LaVigne: • Agriculture and Farmland Protection Committee approved the Agriculture Zone • If moratorium, assessments will go down, taxes may go up • Outside consultant – already hired planner Doug Dake: • Against moratorium because Town Counsel Guy Krogh, Planning Board, and Town of Lansing Planner all against it Ed LaVigne: • Comprehensive Plan o To guide zones o Completed 2017 o Maybe look at Agriculture section first – farmers had input Guy Krogh: • Timing Policy Perspective o When and how to amend local law draft to expand zones o Time needed to re-do draft o Could do RA Zone now and another local law for other zones another time o Code adjustments on reoccurring basis one or two at a time, rather than multiple Andra Benson: • Likes current moratorium local law o RA Zone only Andra Benson left the meeting at 7:29 pm Joseph Wetmore: • Assessment o Per Jay Franklin, Director of Assessment, assessment probably will not change in RA Zone because of a moratorium • Committed to give resources to C.J. Randall to complete this in a year Ed Lavigne: • Supports allocating resources to C.J. Randall o Hire consultant to complete this without doing a moratorium - compromise • Some municipalities - planners write this up C.J. Randall: • Consultant money for graphic enhancements o Will supplement work department is doing Ed LaVigne: • Asked C.J. Randall o How much money is needed in budget to complete zoning changes in a year without a moratorium o What is the scope of work • Everyone wants zoning updated • Take moratorium off table o Complete zoning changes in one year Joseph Wetmore: • Asked C.J. Randall o Budget to do RA Zoning and B1 Zoning o Scope and schedule of work October 6, 2021 4 Town Board Decision • Leave Moratorium Local Law as is o Only RA Zone o Public Hearing scheduled for October 20, 2021 MOTION TO ADJOURN MEETING Councilperson Joseph Wetmore moved to ADJOURN THE MEETING AT 7:50 PM.
