HomeMy WebLinkAbout7-5032-00019_-_Cayuga_Operating_Co._WW_Renewal_Application_-_RFI   February 17, 2021 John Marabella Cayuga Operating Company, LLC 228 Cayuga Drive Lansing, New York 14882 RE: Cayuga Operating Company Facility Renewal Application for Water Withdrawal Permit DEC Application #: 7-5032-00019; WSA#: 11,753 Town of Lansing, Tompkins County REQUEST FOR ADDITIONAL INFORMATION Dear Mr. Marabella: The New York State Department of Environmental Conservation (DEC) has reviewed the Water Withdrawal Permit Renewal application materials for the above referenced facility. The provide information was received by the Department on December 30th, 2020. The Water Withdrawal Permit expired February 1st, 2021, however, due to a timely and sufficient renewal application the facility’s Water Withdrawal Permit was administratively extended under the State Administrative Procedures Act (SAPA) on February 1st, 2021. In response to the provided information, staff have determined that additional information and/or clarification is required before a permitting decision can be made on the application. Pursuant to 6 NYCRR Subdivision 621.14(B), at any time during the review of an application the Department may request in writing any additional information which is reasonably necessary to make any findings or determination. Therefore, please provide the requested information outlined below: 1. Current Water Usage – The engineering report (Table 2) states that the facility is currently operating a house service pump only, at the rate of 700 gallons per minute (GPM). Please clarify what the water withdrawn from Cayuga Lake is currently being used for at the facility. Please describe usage (in volumes) associated with current facility operations. Please be aware that pursuant to 6 NYCRR Part 601.15(b)(3) of the Water Withdrawal Regulations, permitted withdrawal volumes are based on actual (current) water usage. As such, a permit renewal will reflect current usage at the facility. Once a new purpose for the facility has been determined, any future change in facility ownership, usage, or increase in withdrawal quantity would require a Water Withdrawal Permit Modification. 2. Anticipated Daily Usage – Provide the anticipated average daily and maximum daily water withdrawals while the facility is no longer generating power.
