Roll call by Deborah K. Randall, Director of Planning, Charlie “Cricket” Purcell, Highway Superintendent, Mike Sigler, Tompkins County Legislator, and Justice John Howell PRIVILEGE OF THE FLOOR – GUIDELINES Available on Town of Lansing website and as a handout. The public shall be allowed to speak only during the Public Comment / Privilege of the Floor period of the meeting, or during public hearings, or when they have reserved and been granted time upon the Agenda. Speakers must be recognized by the presiding officer (or his or her designee) and step to the front of the room. Speakers must give their name and state whether they are speaking as a resident, a member of the public, or for any other person or organization. Speakers must limit their remarks to 3 minutes, and comments unrelated to the subject matter of the public hearing are not allowed. Speakers may not yield any remaining time they may have to another speaker. With the permission of the presiding officer a Board or committee member may interrupt a speaker for the purpose of clarification or information (and not for any other reason or to debate or disagree). Such time shall not be counted against the speaker’s 3 minute limit. All remarks shall be addressed to the Board or committee as a body and not to any member thereof, nor to any member of the public whether present at such public hearing or not. Speakers shall observe the commonly accepted rules of courtesy, decorum, dignity and good taste. Interested parties or their representatives may address the Board by written communications. Written documents and evidence may be submitted as part of the record of the public hearing. PRIVILEGE OF THE FLOOR – COMMENTS No one addressed the Town Board. LAW CLERK DISCUSSION – JUSTICE JOHN HOWELL Justice Howell stated the following: • Confrontational summary proceeding o Needs short term legal clerk – contract employee ▪ Third year Cornell law student for research and coordination ▪ $50 per hour – total maximum $1,000 ▪ Justice Howell will supervise and make decisions Town Board and Town Counsel Guy Krogh discussed Justice Howell’s request. Town Counsel Guy Krogh reviewed the contract and wrote motion M20-24 which was presented and voted on later in this meeting. LANSING COMMUNITY LIBRARY REPORT – CHRISTINE EISENHUT The following report was available on Town of Lansing website. TOWN BOARD UPDATES FROM THE LANSING COMMUNITY LIBRARY DECEMBER 16, 2020 1. The Library is now open with expanded hours including Saturdays for browsing by appointment as well as curbside pickup. New hours are Monday-Thursday 10-5, Friday 10-2 and Saturday 10-2. 2. The Book Club for adults and teens as well as Take and Make crafts will resume in January. 3. The LCL Feasibility Study conducted by in.site:architecture is available for review. 4. The LCL’s wifi is not password protected. The community is welcome to park in the lot to access the Internet. 5. The library will be closed 12/24-25, 12/30-31 and 1/1. Councilperson Andra Benson reported the following on the Lansing Community Library Feasibility Study. • Not a new building • Expanding the bottom floor – need computer space • Will not happen right away – costly LANSING YOUTH SERVICES REPORT – BRIDGETTE NUGENT The following report was available on Town of Lansing website. Lansing Youth Commission; Est. 1987 Supports Lansing Youth Services Youth Employment Programs December 2020 LYS held a virtual meeting on December 7th. The following are updates from LYS: December 16, 2020 3 1. Due to a leave of absence of program manager, RYS programs are currently on hold until January 2021. All participants and their caregivers have been notified and offered opportunities to attend virtual programming offered by RYS program managers in other municipalities. 2. Lansing Youth Services began discussion of their goals for 2021. Ideas to be considered included: Improving onboarding/orientation process to LYS, increasing member attendance and engagement, conducting a community needs assessment, and diversifying program participants. All ideas will be considered and goals narrowed down during the January 2021 LYS meeting. 3. Further planning for fundraising and programming is on hold until confirmed return date of Program Manager. TOMPKINS COUNTY LEGISLATOR REPORT – MIKE SIGLER Reviewed the following with Town Board and the report was available on Town of Lansing website. Tompkins County Legislator Michael Sigler December 16, 2020 Hello and thanks for having me in again. Obviously COVID-19 is the top of our agenda at the legislature as cases continue to rise. We passed 1000 cases since the pandemic began in the past month and have now seen over 1400 cases, at one point 193 active cases, and we’ve had four deaths at Oak Hill Nursing Home. The vaccine rolls out this week and the Health Department, in partnership with Cayuga Health Systems and long-term care facilities, has a plan on how to distribute vaccine to priority populations such as healthcare and long-term care workers. County Executive Jason Molino detailed New York State’s ‘microcluster’ zone metrics, sharing that while it would require a 3.5% infection rate to enter a yellow precautionary zone, the County estimates the local infection rate at 0.64%. 47 counties have completed the Johns Hopkins contact tracing training and are assisting the Health Department nurses and staff leading the operation. We’ve opened a new testing center downtown. It opened November 27th and is open 8 am to 4 pm by appointment on weekdays. We’re at the end of the tunnel on this and if we stay the course of slowing the spread, we could be seeing a return to normalcy very soon. We approved a financing plan that will increase the annual household recycling fee to $70 for 2021. While some areas have stopped recycling programs because of the lack of processing facilities and a market for these materials, we are continuing to recycle in this County. Recycling and Materials Management Department Director Barb Eckstrom says even with these increases we can move forward economically. We expect new processing facilities to come in over the next couple of years. We are coming up on a vote to make one of the seats on the IDA reserved for labor. The seat is designed for the Building Trades, but any union member can apply for the position. The hope is to get on the ground insight from someone who will actually be doing the work on these projects that we are approving. I’ve been on the IDA for the past couple of years and I’m hoping to continue in the New Year. The Reimagining Public Safety collaborative continues with the latest town hall just this past Friday. The group has received hundreds of ideas from community members so far. Supervisor Edward LaVigne stated the following regarding COVID-19 vaccines: December 16, 2020 4 Tompkins County will initially receive 4500 vaccines; which will cover 2250 people because two (2) doses are required. PARKS AND RECREATION REPORT – PATRICK TYRRELL The following report was available on Town of Lansing website. Parks & Recreation 12/16/20 Town Board Meeting RECREATION • Current programs include indoor soccer and flag football. We are following strict Covid-19 guidelines. • The Town of Lansing Parks, Recreation and Trails Community Survey will remain open until Dec. 18th : https://www.research.net/r/LansingParks • Security Camera installation at both the Town Hall and Town Barn has been completed. • We have purchased all the materials needed to complete benches and helmet storage for each dugout, those will be built inside this winter so they can be ready for the Spring. • We are currently working on software modifications to make things even more efficient in our office. • We have staggered our office schedules because of Covid-19 outbreaks so some of us are working from home whenever possible. • Every department in the Town Hall is now setup to work from home if necessary. PARKS • We are pulling all materials together for the Myers channel wall project, we will start that project after Christmas. The boat launch will be closed until we complete. • We have purchased lumber to build 2 new kayak racks for Myers Park. Those will be built inside this winter. • The Peter Wheeler plaque has been delivered, we may wait until Spring for installation. • We are working on several pieces of playground equipment, so they are ready for the Spring. • Several pieces of grounds equipment are currently being cleaned and refurbished for sale this January. Supervisor Edward LaVigne stated he is encouraging employees to work from home, if possible. HIGHWAY SUPERINTENDENT REPORT – CHARLIE “CRICKET” PURCELL Cricket reported the following: Winter – Busy with current storm Mike Moseley, Deputy Highway Superintendent – Thanks for lots of extra effort, being on top of COVID-19, PPE, etc. COVID-19 – Personal Protective Equipment (PPE) • Town has six (6) month’s supply • Masks, face shields, latex gloves, hand sanitizer, automatic hand sanitizer dispensers, alcohol wipes, etc. • Twenty-two (22) people – 2 items per person, per shift • Disinfect equipment • Unfunded mandate – already spent $8,400, additional anticipated bills to pay • May not need to order more supplies until February 2021 December 16, 2020 5 DIRECTOR OF PLANNING REPORT – C.J. Councilperson Joseph Wetmore, seconded the motion. All in favor – 5 Opposed – 0 MOTION AMENDING CONTRACT FORM NUMBERS WITH BERGMANN ARCHITECTS, ENGINEERS, AND PLANNERS, P.C., PREVIOUSLY AUTHORIZED UNDER RESOLUTION 20-151 MOTION M20-25 MOTION AMENDING CONTRACT FORM NUMBERS WITH BERGMANN ARCHITECTS, ENGINEERS, AND PLANNERS, P.C., PREVIOUSLY AUTHORIZED UNDER RESOLUTION 20-151 Supervisor Edward LaVigne, moved that at its November Meeting the Town Board, through Resolution 20-151, approved hiring Bergmann Architects, Engineers, and Planners, P.C. for the Town of Lansing Highway Department Building Renovation Project’s - Building and Site Programming - Concept Alternatives Analysis, for a lump sum not to exceed $40,000, based upon the assumption that the contract form AIA B101 would be utilized based upon the RFP, but as this is not a construction design contract and is only a preliminary design and feasibility alternatives analysis, the more proper AIA forms are AIA B102 and AIA B203, as these pertain to design services and concept pricing analyses, and the migration of services and terms into such simpler forms has been reviewed and approved by the Town Planner, the Town Engineer, and Town Counsel, such that Resolution 20-151 be and hereby is amended to further authorize the Town Supervisor to execute AIA forms B102 and B203 in lieu of the form B101, as well as authorizing the Town Supervisor to execute such related exhibits and document as are necessary to implement such AIA agreements and give force and effect to such Resolution and this amendment, in each case as the Supervisor deems necessary and expedient to the project and in the Town’s best interests, subject always to the maximum expenditure as approved therefor. MOTION AUTHORIZING TOWN OF LANSING SUPERVISOR TO SIGN AGREEMENT BETWEEN THE TOWN OF LANSING AND FOODNET MEALS ON WHEELS MOTION M20-26 MOTION AUTHORIZING TOWN OF LANSING SUPERVISOR TO SIGN AGREEMENT BETWEEN THE TOWN OF LANSING AND FOODNET MEALS ON WHEELS Motion to authorize Town of Lansing Supervisor to sign agreement between the Town of Lansing (Town) and Foodnet Meals on Wheels (Contractor), agreement is for January 1, 2021 to December 31, 2021, Town will pay Contractor $4,750 for 2021 services. b. MOTION TO APPROVE CARRYING FORWARD VACATION TIME EXCEEDING FORTY (40) HOURS MOTION M20-27 MOTION TO APPROVE CARRYING FORWARD VACATION TIME EXCEEDING FORTY (40) HOURS Motion that, due to 2020 being in and of itself an extraordinary circumstance relative to employee leave time and scheduling, including but not limited to emergencies and Executive Orders, the Town Board hereby approves exceeding the 40-hour vacation leave time carry-forward rule for all employees set forth in Employee Handbook § 802, with such time in excess of 40 hours to be, in each case and for all employees, approved, scheduled, and used in the first three months of 2021 in accordance with the directives of each employee’s respective Department Head; For all subsequent years § 802 shall apply as written and Department Heads shall continue to refer excess employee carry-forward recommendations to the Town Board for review prior to the deadlines set for scheduling matters for the regular December Town Board meeting, or sooner as circumstances may allow. c. RESOLUTION AUTHORIZING ACCEPTANCE OF BID, ISSUANCE OF NOTICE OF AWARD AND CONTRACT TO CAYUGA COMMERCIAL CLEANING FOR TOWN HALL AND COMMUNITY BUILDING CUSTODIAL SERVICES RESOLUTION 20-152 RESOLUTION AUTHORIZING ACCEPTANCE OF BID, ISSUANCE OF NOTICE OF AWARD AND CONTRACT TO CAYUGA COMMERCIAL CLEANING FOR TOWN HALL AND COMMUNITY BUILDING CUSTODIAL SERVICES The following Resolution was duly presented for consideration by the Town Board: WHEREAS, detailed bid documents and specifications had been developed, including a contract to be executed by the selected bidder, and the Town thereafter duly advertised for public bidding and conducted a public bid opening, and all bids were examined for compliance with bid requirements, including overall pricing and best value bidding standards and criteria, and the best value-lowest overall cost bidder duly identified; and WHEREAS, as a result of such examinations and meeting, and upon input from the Town Supervisor, such bid was deemed and determined to be in compliance with bid December 16, 2020 9 requirements, and such bidder is not listed upon any State Debarment List, such that the Town Board desires to now award such bid; and WHEREAS, after a review of the foregoing, and upon due deliberation and consideration thereof, and in compliance with the specifications and the requirements for public bidding upon procurements and public works, including but not limited to the Town’s Procurement Policy and General Municipal Law §§ 101 and 103, the Town Board of the Town of Lansing has hereby RESOLVED, that the Project bid be and hereby is awarded to Cayuga Commercial Cleaning, pursuant to its bid dated December 8th, 2020; and it is further RESOLVED, that the Town deems this Resolution to be legally sufficient as a Notice of Award, which Notice of Award shall be submitted to the successful bidder together with prepared contract documents, and which such delivery shall constitute acceptance of the bid by the Town; and it is further RESOLVED, that upon receipt of the required insurance coverages, the contract that was part of the bid documents be completed and the Town Supervisor be and is hereby authorized to negotiate and execute such contract by, for, on behalf of, and in the name of the Town of Lansing, and the Supervisor be further authorized to make, negotiate, and execute such changes and such further or other documents and agreements as are or may be necessary or convenient to cause such contract or bid award to be fully authorized and services to commence in 2021 in as timely a fashion as practicable and continue through 2023; and it is further RESOLVED, that the Town Clerk register the award with the Department of Labor under the PRC number assigned for this bid and project. d. RESOLUTION HIRING FULL-TIME INFORMATION AIDE IN THE SUPERVISOR’S OFFICE AND PART-TIME INFORMATION AIDE IN THE TOWN CLERK’S OFFICE RESOLUTION 20-153 RESOLUTION HIRING FULL-TIME INFORMATION AIDE IN THE SUPERVISOR’S OFFICE AND PART-TIME INFORMATION AIDE IN THE TOWN CLERK’S OFFICE The following Resolution was duly presented for consideration by the Town Board: WHEREAS, the Supervisor’s Office has a Full-time Information Aide and the Town Clerk’s Office has a Part-time Information Aide position available; and WHEREAS, acceptable and qualified candidates will be identified and selected by each department, and are therefore proposed to be hired to fulfill such job requirements; and WHEREAS, upon due deliberation thereupon, the Town Board of the Town of Lansing has hereby RESOLVED, that the above positions are approved to be employed at an hourly rate not to exceed $22.45 per hour, as a Full-time Information Aide (36.5 hours per week) in the Supervisor’s Office and a Part-time Information Aide in the Town Clerk’s Office; also RESOLVED, the probationary period be and hereby is scheduled for 26 weeks; also RESOLVED, that the appropriate Town officer be and hereby is authorized to make such changes to the Towns’ employment and civil service rosters, to file the required Civil Service forms to effect such changes per this Resolution, and to file Form 428s, if required. December 16, 2020 10 e. RESOLUTION APPROVING TOWN OF LANSING CONSERVATION ADVISORY COUNCIL 2020 ANNUAL REPORT RESOLUTION 20-154 RESOLUTION APPROVING THE TOWN OF LANSING CONSERVATION ADVISORY COUNCIL 2020 ANNUAL REPORT The following Resolution was duly presented for consideration by the Town Board: WHEREAS, per Town Board Resolution 19-49 the Conservation Advisory Council was authorized to perform certain functions for the Town and to act in an advisory capacity under General Municipal Law § 239-x; and WHEREAS, the aforementioned Resolution and General Municipal Law 239-x(f) require the Conservation Advisory Council to file required annual reports with the Town Board on or before the thirty-first day of December of each and every year, and once approved by the Town Board, to send a copy thereof to the New York State Commissioner of Environmental Conservation; and WHEREAS, upon due deliberation thereupon, the Town Board of the Town of Lansing has hereby: RESOLVED, the Town Board of the Town of Lansing has received and accepted the Town of Lansing Conservation Advisory Council 2020 Annual Report. f. RESOLUTION REAPPOINTING MEMBERS TO THE TOWN OF LANSING CONSERVATION ADVISORY COUNCIL RESOLUTION 20-155 RESOLUTION REAPPOINTING MEMBERS TO THE TOWN OF LANSING CONSERVATION ADVISORY COUNCIL The following Resolution was duly presented for consideration by the Town Board: WHEREAS, in November of 2017, and as is set forth in the updated 2018 Comprehensive Plan, the Town approved creating a Conservation Advisory Council to perform certain functions for the Town and to act in an advisory capacity under General Municipal Law § 239-x; and WHEREAS, on January 16, 2019, the Town Board of the Town of Lansing adopted Resolution 19-49 creating the Conservation Advisory Council (hereinafter termed “Council” or “CAC”) under authority granted to the Town by General Municipal Law Section 239-x; and WHEREAS, on December 3, 2020, as per the Town of Lansing Appointed Board Application Process, the CAC unanimously passed a Motion recommending that the four members whose terms are expiring continue to serve on the CAC; and WHEREAS, the following candidates, in the judgment of the Town Board, are qualified to continue serving on the CAC and are reappointed to terms of membership of two years, subject to reappointment, and the Town Board of the Town of Lansing has hereby: RESOLVED, that Andra Benson be reappointed to the Conservation Advisory Council with a term to expire December 31, 2022; and it is further RESOLVED, that Robyn Bailey be reappointed to the Conservation Advisory Council with a term to expire December 31, 2022; and it is further RESOLVED, that Tom Butler be reappointed to the Conservation Advisory Council with a term to expire December 31, 2022; and it is further December 16, 2020 11 RESOLVED, that Karen Edelstein be reappointed to the Conservation Advisory Council with a term to expire December 31, 2022. g. RESOLUTION REAPPOINTING SANDRA DENNIS CONLON, THOMAS BUTLER, AND DALE BAKER TO THE TOWN OF LANSING PLANNING BOARD RESOLUTION 20-156 RESOLUTION REAPPOINTING SANDRA DENNIS CONLON, THOMAS BUTLER, AND DALE BAKER TO THE TOWN OF LANSING PLANNING BOARD The following Resolution was duly presented for consideration by the Town Board: WHEREAS, the Planning Board has three members terms expiring on December 31, 2020; and WHEREAS, Sandra Dennis Conlon is qualified to be and remain on the Town of Lansing Planning Board by virtue of having mandatory NYS and Town of Lansing training and by already serving on the Town of Lansing Planning Board since 2015, and Thomas Butler is qualified to be and remain on the Town of Lansing Planning Board by virtue of having mandatory NYS and Town of Lansing training and by already serving on the Town of Lansing Planning Board since 2018, and Dale Baker is qualified to be and remain on the Town of Lansing Planning Board by virtue of having mandatory NYS and Town of Lansing training and by already serving on the Town of Lansing Planning Board since 2019; and WHEREAS, on December 14, 2020, as per the Town of Lansing Appointed Board Application Process, the Planning Board passed a Motion recommending Sandra Dennis Conlon be reappointed as a Member to the Town of Lansing Planning Board, Thomas Butler and Dale Baker be reappointed as Alternate Members to the Town of Lansing Planning Board; and WHEREAS, the reappointments require Sandra Dennis Conlon, Thomas Butler, and Dale Baker to complete the mandatory New York State and Town of Lansing training requirements; and WHEREAS, upon due consideration and deliberation by the Town of Lansing Town Board, now therefore be it RESOLVED as follows: 1.
