TOWN BOARD WORK SESSION MEETING
FIRE STATION NO. 4 – NORTH LANSING FIRE STATION
1189 AUBURN ROAD, LANSING, NY
August 1, 2018
PLEASE NOTE: The primary purpose of the Town Board Work Session is to be
informational/educational for the benefit of the Board Members. Public comment will be
taken at the regular meetings when the items are scheduled on the agenda.
The meeting was called to order at 6:35 p.m. by Supervisor, Edward LaVigne, and
opened with the Pledge of Allegiance to the flag. Roll call by Laura Nemecek, Deputy
Town Clerk, showed the following to be
PRESENT:
Andra Benson, Councilperson Katrina Binkewicz, Councilperson
Doug Dake, Councilperson Joseph Wetmore, Councilperson
Edward LaVigne, Supervisor
ABSENT: No one absent
ALSO PRESENT: Guy Krogh, Town Counsel, Charlie “Cricket” Purcell, Highway
Superintendent, Patrick Tyrrell, Recreation Supervisor, Dan Veaner, Lansing Star, Ted
Laux, Douglas Emerick, Chris Williams, Jeannine Kirby, and a few other attendees.
RESOLUTION HIRING PART TIME SEASONAL EMPLOYEES FOR PARKS &
RECREATION FOR THE TOWN OF LANSING
RESOLUTION 18-118
RESOLUTION HIRING PART TIME SEASONAL EMPLOYEES FOR
PARKS & RECREATION FOR THE TOWN OF LANSING
The following Resolution was duly presented for consideration by the Town Board:
WHEREAS, there is a need for Lifeguard positions at the Town of Lansing; and
WHEREAS, said positions have been classified and deemed as a Civil Service Laborer,
Lifeguard positions by the Tompkins County Department of Personnel; and
WHEREAS, Madeline Czymmek and Aidan Hulsebosch have been identified as
qualified Lifeguard candidates; and
WHEREAS, the Town of Lansing Supervisor has recommended that all of the above
positions be filled at the Town of Lansing; and
WHEREAS, upon a review and discussion of the matter, the Town Board of the Town of
Lansing has hereby:
RESOLVED, that effective August 2, 2018, Aidan Hulsebosch will be paid at a rate of
$10.50 per hour and Madeline Czymmek at a rate of $11.50 per hour, be and hereby are
approved to be employed as Lifeguards, in the Town of Lansing; and it is further
RESOLVED, that the appropriate Town officer be and hereby is authorized to make such
changes to the Towns’ employment and civil service rosters, to file the required Civil
Service forms to effect such changes per this Resolution, and to file Form 428s, if
required.
The question of the adoption of such proposed Resolution was duly motioned by
Councilperson Andra Benson, duly seconded by Supervisor Edward LaVigne,
and put to a roll call vote with the following results:

Councilperson Andra Benson – Aye Councilperson Katrina Binkewicz – Aye
Councilperson Doug Dake – Aye Councilperson Joseph Wetmore – Aye
Supervisor Edward LaVigne – Aye
Accordingly, the foregoing Resolution was approved, carried, and duly adopted on
August 1, 2018.
Topics of Discussion:
1. Consolidated Water District #3 Update – Guy Krogh, Town Counsel
• A qualifying petition was submitted
• Next step is to have a special election within sixty to seventy five (60 - 75)
days or the Resolution will become invalid, other option would be to
rescind the Resolution of approval and avoid election
• Setting the date for the special election needs to be done by Resolution
and the election must be held between September 18, 2018 and October 3,
2018
• The Town will have to publish notices, create eligible voter rolls, print
ballots, have propositions approved, hire election inspectors, get ballot
box, ballot keys, and all documents needed to do a special election
• Ballots will go in box, be officially counted, the vote will be certified, then
sent to the Comptroller for review
• Only tax paying land owners within the district are entitled to vote
• If one property has five owners, each owner gets a vote
• If one person owns more than one property they only get one vote
• Corporations, LLC’s, and Trusts only get one vote
• If someone believes they are entitled to vote, they can still vote and the
vote would be canvassed and not put in the ballot box
• If the vote passes the cost of the special election gets passed on to the
property owners in the district, if the vote does not pass the cost will come
out of the Town’s general fund
• There is no absentee voting in special district elections
Supervisor, Edward LaVigne noted, packets with information will be available at the
Town Clerk’s Office.
2. Budget Schedule
• Set tentative schedule
• Association of the Towns, Talk of the Towns & Topics Magazine gives
guidance and budget deadlines
• Supervisor, Edward LaVigne will send out an email to Board Members
with schedule dates
3. Zoning Changes Recommended by the Planning Board
• Reviewed packet from Planning Board with three petitioners with multiple
lots listed as requesting zoning map revisions
o Can this constitute spot zoning?
▪ Spot zoning has to do with a pending development
application or a pending development plan
▪ Not considered spot zoning if over a certain size, generally
five to seven (5-7) acres
▪ Spot zoning can also be small changes that are inconsistent
with the overall plan of the community, usually to benefit
the land owner as opposed to the community

• Town Counsel, Guy Krogh needs more information before the Town can
go forward with the recommended zoning changes
• Discuss further at the August 15th Town Board Meeting
MOTION TO ENTER EXECUTIVE SESSION
Supervisor Edward LaVigne moved to ENTER EXECUTIVE SESSION TO DISCUSS
PAY BENEFITS, WORK PERFORMANCE AND POSITION OF A
PARTICULAR EMPLOYEE AT 7:15 PM.
Councilperson Katrina Binkewicz seconded the motion.
All in Favor – 5 Opposed – 0
MOTION TO EXIT EXECUTIVE SESSION
Supervisor Edward LaVigne moved to EXIT EXECUTIVE SESSION AT 7:47 PM.
Councilperson Andra Benson seconded the motion.
All in Favor – 5 Opposed – 0
There was a short discussion regarding Myers Park and DEC matters pertaining
to wildlife and public health nuisances.
