DRAFTTownofLansingMonday,January14,20137:15PMPLANNINGBOARDPLANNINGBOARDMEMBERS(1*larrySharpsteeii*[inDavidson,Chairman*DavidFlatfield*FomEliis,Member*RichardPrybyl*AlFiorille*(heraldCaward*LorraineMoynihanSchmiU,Esq.KathyMiller,TBLiaisonPublicPresentLarryFabbroni,DavidHerrick,GeneralBusinessLinDavidsonChairpersoncalledthePlanningBoardMeetingtoorderat7:15PM.Mr.DavidsoninquirediftherewereanyquestionsorconcernsfromthePublicthatarenotrelatedtotheAgenda.Mr.DavidsonindicatedthattheFloydDavisdrivewaymatterwillbediscussed.Healsoaskedaboutputtinganominatingcommitteetogether,anditwasdeterminedthatthiswillbeaddressedatthebeginningofFebruary.Mr.DavidsonidentifiedthenewlyappointedPlanningBoardMembers,GeraldCawardandRayFarkas,aswellastheotherPlanningBoardMemberspresent.ReviewFinalPlatPDAforVillageSolars/VillageCircleApartments,WarrenRoad&VillageCircleChairmanDavidsonsuggestedthatthePlanningBoardgothroughtheTownBoardconditionsalongwiththeroughedoutResolutionratherthaneverybodytryingtoreadDaveHerrick’sreport,thenstartgoingonebyonegoingthroughthereportwithMr.Herrick&Mr.FabbroniansweringanyquestionsPlanningBoardMembersmighthave.Mr.FiorilleaskedforadditionalinformationonwhatwasfinalizedontheCommunityCenter,andthebusstation.ClarificationwasprovidedbyAttorneyMoynihanSchmittthatthedraftResolutionsetsforththefownBoardconditionswhichlargelyadoptedthePlanningBoard’sconditions.ItleavesblanksforfindinastobemadebythePlanningBoardbasedon-zwhattheyhavereviewedtodate.Mr.SharpsteenhadconcernsabouttherequirementforanIMAAgreement.Heunderstandsthatthethoughtistogowithanagreementto DRAFTagree;however;AttorneyMoynihanSchmittsuggeststhatthiswouldneedtoheaddressedwiththelownSupervisorasitwillultimatelyheadecisionoftheTownBoardtorequirethisasoneoftheconditions.Mr.SharpsteenaskstheotherBoardMemberstoconsideriftheyarecomfortablewithrelaxingtheoriginalconditionsidentified,becausetheofficialresolutionstatesthatallinterestedpartiesshouldbeinagreement.AttorneyMoynihanSchmittadvisesthatthePlanningBoardshouldmakewhateverfirmrecommendationsitchoosesto.Mr.DavidsonaskedMr.FahbronitoshareinformationfromthemeetinghehadwithKathyMiller,RuthHopkins,andJonKanterwithregardtotheTCATrequestforabusshelterontheinboundside(southboundsideofWarrenRoad).ThiswouldfitintherightofwayofthePhaseIofthedevelopment.ThePlanningBoarddiscussedtheoriginalconditions,andaskedMr.Herricktoassistinthereviewprocess.Mr.HerrickdiscussedtherequirementsforaccommodatingtheWaterSystem.ThismustallhefacilitatedbytheTownBoard.Mr.FiorilleaskedifthecostswouldbecoveredbytheDeveloperorifitwasgoingtobeaTowncost.Mr.Fahhroniindicatedthateachprojectoffered$35,000towardthis.Mr.Herrickstatedthattheultimatefundingoutsidethedeveloper’scontributionswillhebytheTownaspartoftheoverallimprovementtotheConsolidatedWaterDistrict.Mr.Davidsonaskedhowtodealwiththeagreementtoagree,anditwasdeterminedthattheywouldmoveontotheadditionalconditions.Ms.MoynihanSchmittnotedthatforPlanningBoardfindingsfor1AthePlanningBoardhasreviewedthecommentsofDavidHerrick,andaskediftherewereanyotherquestionsorfindingtoaddtothatsection.TheTownEngineer’sreportwillbeattachedtotheResolution,andwillbereferencedinthefindings.ThenextitemforreviewisSewer,andMr.DavidsonaskedMr.Herricktocoverthis.Mr.HerrickdiscussedtheinformationhereviewedwiththePlanningBoard,andspokeaboutthejointmeetingwiththeVillageofLansing,andtheVillageofCayugaHeightstoaddressthesewerneedsoftheproject.TheresolutionandfindingsofthePlanningBoardwillbepreparedbyAttorneyMoynihanSchmitt.PhaseIwillnotbeexceedingthecapacityasagreedupon.Mr.SharpsteenwantedtoheclearthatanythingpassedintheresolutiontonightwillnotheintendedtobeinsubordinatetothedirectionoftheTownBoardandtheirfutureresolution.ThenextconditiondiscussedbyMr.1-lerrickwasStormWater.AtsomepointtheprojectwillhavetosubmittothetownofficialformsthatwillhavetobeexecutedbytheStormWaterManagementOfficerfortheprojecttoreceivecoverage.Ms.MoynihanSchmittwilldrafttheappropriateattachmentsofthecommentsmade.Mr.Davidsonmovesontothebusshelterandnotesthatwetalkedaboutitbeinginsouthhoundlaneandthepossibilityofmoreridershiparidpotentialforapulloff.Doesanyonehaveanymoretoadd?Dave1--lerricknotedwewillneedapermitfromthecountyhighway.Mr.DavidsondiscussedthecommunityareasapprovaloffuturePDAphrasesandtheissuanceofbuildingpermitsandcertificatesofcompliances.Mr..DavidsonasksifweareallcomfortablewiththeTrailsandPathways.Nobuildingsareinthewayofthetrailsandpathwaysonlyafewlargetreesontheeast!westareacreatingawindingpathwayabouteightfeetwide.Thetwomainpathsthatwillbe DRAFTpavedwillhetheeast/westareaandtheareathatsubstitutesasasidewalkalongWarrenRd.Therewillbeotherpavedareasaroundthehandicapsitesandtogiveaccesstothebuildingswherewehavetoprovidehandicapaccess.Somelotswillnotbepavedandhaven’tbeenpavedfor40years.Lorrainenotedthedeveloperwillberesponsibleforthemaintenanceofthepathway.ToniEllissaidtherewillheaccesstothebusinessparkwitha60footrightawaywithintheindustrialpark.Larry’sconcernalongwiththeplanningboardiscontinuingtoagreethatamasterplaninatimelymanner.Mr.Davidson’scommentandcertainlynotspeakingforthewholehoardunlesstheyareingeneralagreementthatifweareaskingthedevelopertodothisthenwehavetocomeupwiththecriteriainatimelymannerandthatmeansinatimethatwillnotaffecthisdesignand/orconstructionplans.LarrySharpsteenstatesthatthemasterplanwillhereadywithin12months.Ms.MoynihanSchmittdescribesplanCisadelineationofthewidthconstructionmethodologies,materials,maintenanceplansforanypathwaysandtrails;recommendtothetownthatwithinthenext12monthsthatthedeveloperhaveready.Mr.DavidsonhasmovedontoRoadsandstatesthatthisisthequestionofthegreatcorner.Itneedsa60footrightofwayintotheindustrialpark.B-hasasectionthatwillbededicated;ifthetownboardwantsthatpiecededicatedwewillhavetodothattoo.C—TheTownwillneedtohavetherightwaydeededovertoheabletocompletetheproject.D—Thisistreatedasprivatedriveway.TownBoardwilldiscussingreaterdetail.Mr.Sharpsteenrequeststhatweclarifytheirrequirement.Mr.DavidsonmovesontoTrafficStudy.Mr.Herricktheprojectinvolvesnonewinfrastructure,nonewroads,nonewditches,nonewwater,nonewsewerisallservicesoffoftheplan.Therewillhepermitsfordrivewaysandsuch.Ms.MoynihanSchmittsaystheSRFtrafficcommentsareattachedtothelastpage.TheSRFcompletedtheirreviewandfindsacceptablelevelofserviceofallintersections,nosignificantadverseimpactsonsafetyortrafficoperationsatsimilarsections.Mr.HerrickaddsthatTCAThadrequestedapulloffonbothsidesofthehighway.Everybodyseemshappywiththatphase.Thesecondthingistheycriticizedourdepictionofthebuildingssolar.IfyouneedtolookintothatfurtherMr.Sharpsteencanexplainsomeofthedesignconcepts.IVIr.Herrickaddedthebuildingswillbedesignedtomaximizeasmuchlightasyoucantocapturepassivesolarenergyandalloweveryunittohavecrossventilation.Mr.Sharpsteenissatisfiedwiththepassivesolarenergyandstatesthatthedeveloperneverpresentedthedesigntobesolarconvertedtoenergy.Ms.MoynihanSchmittaskedifeveryoneagreeswiththepassivesolarandtrafficstudyallboardmembersfeelconfidentandnofurtherinformationisneededatthistime.ThesamewithTCATnofurtherinformationisneededandintermstosewerfortheairporttorefertotheTownBoardonthatissue.Mr.SharpsteenmovedtheResolutionasfollows;RESOLUTiONPB13-01 DRAFTWHEREAS,thePublicCommentPeriodontheApplicationwascommencedonJuly6,2012uponsubmissionoftheApplicants’StatementsofIntenttoComply,pursuanttoSection706.5oftheLansingLandUseOrdinance,andapublichearingwasheldbytheLansingPlanningBoardonJuly9,2012respectingPlanningBoardsiteplanreviewandconsiderationof’theproposedVillageCircleApartments/VillageSolarsPDAApplicationmaterialsandtheApplicants’StatementsofIntenttoComply,aswellasconsiderationofwhetherthePlanningBoardshouldrecommendtotheTownBoardeither:(1)disapprovaloftheproposedPDAdevelopment;or(2)conditionalapprovalofthePDAdevelopment,subjecttosuchconditionssetforthintheStatementofIntenttoComplyand/oranyotherconditionsotherwiseimposedbythePlanningBoard;andWHEREAS,atthepublichearingheldonJuly9,2012,theresidentsof’theTownofLansingweregivenafullopportunitytobeheardrespectingtheproposedVillageCircleApartments/VillageSolarsPDAdevelopment,andthePlanningBoardreviewedsaidcommentsandconcernsoftheresidents,includingconcernsrespectingthefollowingpotentialimpactsof’theproject:increasedtraffic,drainageandstormwaterconcerns,densityissues,infrastructurecapacity;andWHEREAS,on.July9,2012,thePlanningBoard,pursuanttoLansingLandUseOrdinanceSection706.5,underwentsiteplanreviewoftheproposedVillageCircleApartments/VillageSolarsPDAdevelopment,andhasconsideredandcarefullyreviewedtherequirementsof’theLandUseOrdinanceSection701elseq.,relativetoPlanningBoardsiteplanreviewandtheuniqueneedsoftheTownduetothetopography,thesoiltypesanddistributions,andothernaturalandmanmadefeaturesuponandsurroundingtheareaoftheproposedSitePlan,andconsiderationofstormwaterdrainage,erosioncontrol,parking,waterandsewerfacilities,driveways,sitelighting,off’siteimpacts,roadwaysandwalkways,heightregulations,landscaping,openspace,andcompliancewithotherstate,countyandlocalagencyregulations;andthePlanningBoardhasalsoconsideredtheTown’sComprehensivePlanandcompliancetherewith;andWHEREAS,attherequestofthePlanningBoard,Townof’LansingEngineer,DavidA.Herrick,T.G.Miller,hasreviewedtheApplicants’StateEnvironmentalQualityReview(SEQR)LongEnvironmentalAssessmentForms(LEAFs),andwaspresentatthe.July9,2012PlanningBoardMeetingtoaddressquestionsrespectingpotentialadverseenvironmentalimpactsoftheprojectsandoverallPDAfromthepublicandthePlanningBoard,andstatedthatbothhiscorrespondenceofMay28,2012andthePlanningBoard’sproposedconditionsandspecificationsforpotentialapprovalofthePDAaddressthepotentialsignificantnegativeenvironmentalimpactsoftheprojectidentifiedtodateandmitigationsthereof;andWHEREAS,theLansingTownBoard,asthedeterminingagencyof’finalapprovaloftheaction,istheresponsibleagencyfortheformalSEQRreview,anddeclareditsintenttoactasSEQRLeadAgencyandwill,asLeadAgency,bereviewingand,withtheassistanceoftheTownEngineer,DavidA.Herrick,completedPart11oftheLEAFstherebyfollyidentifyingallsignificantnegativeenvironmentalimpactsandmitigationsthereofinaccordancewithitsdutytindertheStateEnvironmentalQualityReviewAct(SEQRA);and5
