Thomas Ellis, acting Chairperson called the Planning Board Meeting to order at 7:16
PM. Mr. Ellis requested to know if there was anyone from the Public that wished to
speak with concerns other then what was on the Agenda. There were none.
Sewer Update
Mr. Ellis had the opportunity to speak with Brent Cross, Cayuga Heights Engineer with
respect to the Warren Road Sewer project. Mr. Cross informed Mr. Ellis that there was
a Sewer Report prepared two years ago by T.G. Miller for this project that clearly
defines the capacity. Mr. Ellis was advised that there are approximately 250 available
hook ups for the Town, and Mr. Cross will be monitoring these closely. Mr. Overstrom
has been provided by Mr. Fabbroni with a copy of the "6 party contract" however, that
really does not apply to the new Warren Road Sewer Project, as it was prepared for the
Kline Road By-Pass. Mr. Overstrom will be speaking with Brent Cross tomorrow to
further discuss this and also meeting with Mr. Fabbroni and Scott Pinney next week .
Some Planning Board Members feel that one Developer should not be the only person
eligible for these units.
Farmland Committee
• Larry Sharpsteen states he attended the Farmland Protection Committee Meeting last
week and they have hired on George Frantz as a Consultant to review the Zoning

Ordinance. Mr. Frantz had several questions about why the Planning Board had done
certain things in the RA District. Fortunately, Mr. Sharpsteen was able to answer
questions he had . Mr. Frantz is now going to review his review, make changes on his
recommendations and provide further suggestions to the both the Town Board and
Planning Board. Most likely in September, the Ag Committee will be coming to the
Planning Board for a request for George to bring his comments to the Board. Mr.
Sharpsteen states overall, this was a good Meeting.
Richard Prybyl made a motion that the Agenda be re arranged in order to allow the
Board to review the Minutes prior to the Executive Session. Larry Sharpsteen seconded.

Approval of July 13, 2011Minutes
Richard Prybyl states on page 3, the 3rd line, should read: Mr. Overstrom stated there is
• a hedge row around the property and no additional lighting will need to be erected .
Thomas Ellis states on page 3, 3rd paragraph it should read: It was noted for the record,
C4 & C5 (this is basically putting an existing activity under cover) . Page 6 the
Resolution should say : Tracy Wilder

Public Hearing on overall Site Plan Review, Mini Storage Units and
Monthly Flea Market, Applicant: Erik Hewitt, 308 Peruville Road, Tax #
30.-1-26.27
Larry Sharpsteen made a motion to open the Public Hearing on the overall Site Plan
Application. Erik Hewitt appeared before the Planning Board requesting approval to
expand his existing " Barn House Antiques" business to include a sell storage building
(20 units) and a pavilion for a once a month flea market.

Thomas Ellis, acting Chairperson acknowledged the Legal Notice published in the
Ithaca Journal with respect to the Public Hearing.

Nancy Loncto inquired as to where the landscaping plan was, as it was her
understanding that the Hewitt's would provide the Planning Board Members with a
copy at this Meeting.
Karen Hewitt states they have not had a design plan drawn up yet, as they are waiting
for the final building plans to be prepared . They will not be planting "grasses" as
previously discussed. Low growing shrubs, and greens will be planted on the road
side.
Nancy Loncto made a motion requesting two amendments be added to the Resolution
w/ conditions;
1 . The Code Enforcement Officer shall receive a Landscaping Plan.
2. The Planning Board has reviewed the Tompkins County Planning
Department' s 239 recommendation and has determined that it is not
necessary for any further review from the New York State
• Department of Transportation.

RESOLUTION OF THE LANSING PLANNING BOARD
APPROVING THE ERIK HEWITT "BARN HOUSE STORAGE AND FLEA MARKET"
MINI SELF-STORAGE AND FLEA MARKET
SITE PLAN
WHEREAS, Erik Hewitt ("Applicant"), has submitted, for consideration and approval from the
Lansing Planning Board, a Site Plan for the proposed, Mini Self-Storage of 20 storage units and
a monthly seasonal pavilion flea market located at 308 Peruville Road, Lansing, New York, Tax
Map Parcel # 30 . 1 -26 . 22, within the RA Zoning District; and
WHEREAS the application is an expansion of an existing "Barn House Antiques" retail antique
shop business already located on the site; and
WHEREAS, this action is classified as an Unlisted Action, pursuant to 6 NYCRR Part 617 et
seq. of the State Environmental Quality Review Act (SEQRA), which requires environmental
review of the impacts of the project; and

WHEREAS , any Interested and Involved Agencies were duly notified of the project, and invited
to comment thereon; and the requisite General Municipal Law 239 Referral(s) of GML Article
12-B were duly effected by Town of Lansing Planning Department and any comments
received from the Tompkins County Planning Department and any Involved/Interested
Agencies were duly reviewed and considered by the Planning Board; and
WHEREAS, by correspondence dated June 3 , 2011 , the Tompkins County Planning Department
has offered the following formal recommendations pursuant to GML § 239 —1 and —m:
The site plan should indicate the location in which parking will be allowed. Additionally, the plan
should clarify how vehicles will enter and exit the site, particularly on days when flea markets are
held.
and,

WHEREAS, any decision by the Planning Board not to incorporate the above Tompkins County
Planning Department formal recommendations for the above modification of the expansion
proposal would require a supermajority vote of the entire Planning Board (majority plus one) ;
and
WHEREAS, the applicant has submitted the following letter, received June 6, 2011 , in response
to the comments of the Tompkins County Department of Planning comments:
This letter is in response to your concerns concerning my proposed Site Plan for Barn House Storage and Flea
Market, proposed for 308 Peruville Rd. , Lansing, NY. I have amended my proposal to show the available parking
space on the property. Parking would be set up on the south side of the property. There is also plenty of space on
the north side to use, if necessary. Entry and exit would be using the existing antique shop driveway, which I
already own and use. This entrance was designed and approved by the D.O. T when I builtthe antique shop.
Through the antique shop, we have had a number of Flea Market events, and a large sale benefiting the SPCA. We
have never had a parking problem. We have always set up signs on Rt. 34B saying there was to be no parking on
the highway, and directed the customers to the lawn parking. Historically, the north lawn use for parking was never
• necessary. The Flea Market would be seasonal, not being held in the cold winter months when the ground was snow
covered. I have attached photos of previous flea market events held at Barn House Antiques.

WHEREAS, the Planning Board is satisfied that the Applicant has incorporated the Tompkins
County Planning Department recommendations into the site plan, has complied with and
addressed the concerns and comments of the County Planning Department, and has determined
that, based on the Planning Board ' s inquiry and the applicant' s response, further review, by the
NYSDOT, of Route 34B ingress/egress and/or site plan parking will not be necessary; and
WHEREAS, the Town of Lansing Planning Department has requested that the Applicant submit
a proposed landscaping/buffering zone plan for the site, and the Planning Board has reviewed
same with the Applicant; and

WHEREAS , at the Planning Board Meeting on July, 11 , 2011 , the Planning Board determined
to waive public hearing on the SEQRA review, but set a public hearing on the overall site plan
review to be held on July 25, 2011 ; and
WHEREAS , on July, 11 , 2011 , the Planning Board, acting on a uncoordinated environmental
review, reviewed and accepted, as adequate, a short form Environmental Assessment Form
( `EAF") Part I, submitted by the Applicant; and the Lansing Planning Board completed Part 11 on
the record (and, if applicable, Part III of the EAF) ; and
WHEREAS, by resolution adopted July 11 , 2011 the Town of Lansing Planning Board
determined that, pursuant to the provisions of the State Environmental Quality Review Act, the
proposed site plan will result in no significant impact on the environment and issued a Negative
Declaration of environmental significance for purposes of Article 8 of the Environmental
• Conservation Law; and

WHEREAS, the Town of Lansing Planning Board duly noticed and opened a public hearing
concerning the proposed site plan application at Lansing Town Hall at 29 Auburn Road, Lansing,
New York, 14882, on July 25 , 2011 , and all citizens were given an opportunity to voice any
comments or concerns respecting the proposal and were given a full opportunity to be heard
thereon; and
WHEREAS, on July 25 , 2011 , the Planning Board duly considered and carefully reviewed the
Applicant ' s site plan in compliance with the requirements of the Town ' s Laws relative to site
plan review and respecting the proposed project in conjunction with the unique needs of the
Town, due to topography, drainage, soil types and distributions and other natural and man made
features upon and surrounding the area of the proposed Site Plan; and the Planning Board duly
considered the design objectives of the Applicant and the quality and distinctiveness of the
project proposal, in conjunction with the standards of review set forth at Section 701 .4 et seq. of
the Town of Lansing Land Use Ordinance, including, but not limited to, storm-water drainage
• plan, erosion controls, parking, water and sewer facilities, driveways, site lighting, on site and
off-site impacts, landscaping and/or fencing, buffering and/or screening, roads and walkways,
height limitations and compliance with other agency regulations and/or state, county and local
laws and ordinances ; and the Planning Board has also considered the requirements of the Town ' s
Land Use Ordinance and Comprehensive Plan, and has determined compliance therewith in
conjunction with said Site Plan Application and Review; and
WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board,
now therefore be it
RESOLVED : that the Town of Lansing Planning Board grant Final Site Plan Approval
to the Applicant for the proposed Mini Self- Storage of 20 storage units and a monthly seasonal
pavilion flea market located at, 308 Peruville Road Lansing, New York, Tax Map Parcel # 30 . 1 -
26.22, within the RA Zoning District based on the following condition :
1 . The Applicant shall provide the Code Enforcement Officer with a Landscaping
Plan, for buffering purposes, as discussed with the Planning Board.
