Public Present Raymond Farkas Jeannine Kirby General Business Lin Davidson called the Planning Board Meeting to order at 7:30 PM. Mr. Davidson inquired if there was anyone from the Public that would like to speak. Public Comments/Concerns There were no comments or concerns. 1 Lot Exempt Subdivision & SEQR Review, Clifford Buck, Conlon Road, Tax Parcel # 27.-1-26.2 The Planning Board reviewed Part I of the Short Environmental Assessment Form completed by the Applicant and completed Part II by the Planning Board Members. No significant adverse environmental impacts or effects were identified in Part II by the Planning Board Members. David Hatfield made a motion declaring a negative declaration. Thomas Ellis seconded. VOTE AS FOLLOWS Thomas Ellis -Aye David Hatfield - Aye Larry Sharpsteen - Aye Lin Davidson- Aye 1 APPROVED MOTION CARRIED. Thomas Ellis made a motion to waive the Public Hearing. David Hatfield seconded. Approval/Denial of July 13, 2009 Minutes Larry Sharpsteen made a motion to approve as presented. David Hatfield seconded. Kirby Subdivision Discussion Jeannine Kirby appeared before the Planning Board requesting to know what the Planning Board's interpretation of a Minor Subdivision is, as she disagrees with the Town's Legal Counsel's explanation obtained by Jeffrey Overstrom. The Planning Board Members reviewed the current Subdivision Rules and Regulations as follows: 3 APPROVED • Minor Subdivision: The Subdivision of land into 4 or less Lots in any consecutive 3 year period where there are no Roads or Infrastructure that need to be developed, built and/or dedicated for use. Infrastructure that relates to Stormwater facilities that is (i) not significant in terms of structural complexity, and (ii) not significant in terms of land area disturbance, and/or (iii) which is privately maintained will not,standing alone,convert a Minor Subdivision into a Major Subdivision. The Enforcement Officer shall make an initial determination in this regard,and may seek the input of the Planning Board in relation thereto. Members disagreed with Legal Counsel as to how they figure the number of lots. After further discussion, it was determined that Jeff Overstrom would again, contact Lorraine Moynihan Schmitt, Legal Counsel for further explanation. David Hatfield made a motion to adjourn the Meeting at 8:30 P.M. Larry Sharpsteen seconded.
