Scott Pinney, Supervisor Town of Lansing PO Box 186 Lansing , New York 14482 • Dear Mr. Pinney:. Town of Lansing farmer Daniel Starner attended the Tompkins County Agriculture and Farmland Protection Board (AFPB) meeting of October 22 , 2008 to seek the Board ' s advice and assistance in resolving an ongoing drainage problem in his farm fields . Mr. Stamer believes the problem results from redirected storm water runoff from nearby residential development, It appears the Town of Lansing has agreed with Mr. Stamer's position in the past, as the Town installed drainage tiles through his property ,as well as a concrete retention area to try and resolve the problem . Unfortunately, residential development in the area has continued and the drainage improvements are not sufficient to handle the additional water • redirected onto the Stamer property. Mr. Stamer presents a compelling case as this problem impacts up to 5 of his fields. He appeared at a • recent Town of Lansing Planning Board meeting seeking assistance on this matter and he claims that the Planning Board told him that they could do nothing to help him . The AFPB is concerned that existing New York State and Town of Lansing Storm Water Regulations, both of which prohibit increasing off-site runoff and require on-site mitigation of run-off, were not followed when residential development occurred near the Starner farm , to the detriment of the farmer. The Board has recommended that Mr. Starrier obtain a copy of the Storm Water Regulations, talk to the Town Engineer about the problem , and also contact the New York State Department of Environmental Conservation. • The AFPB would also like to bring this matter directly to the attention of the Town Supervisor, the Town Board and the Town Planning Board , and urge the Town to ensure that existing Storm Water Regulations a are being followed . The Board further requests that the Town work with Mr. Starrier to find a solution to the run-off problems impacting his agricultural operation . Public Comments/Concerns Mr . Davidson , Chairman inquired if there were any Public Bodies present that would like to make a statement. Margo :H.ittlernan requested clarification of what constitutes 4 or less Iots in a Subdivision . is it 4 or less lots at any given time or 4 or lots with one property owner over a period of time ? Lin Davidson, Chairman explained that the Planning Board Members are unclear. ® with Exempt Subdivisions at this time . Richard Platt stated it is his l DRAFT PB • understanding that they are looked at as a Single Lot Subdivision . Scott Pinney, Town Supervisor will speak to Legal Counsel for clarification . Jim Eyster questioned how far along in the process is the Planning Board or Town Board with filling the Planning Board vacancy ? Mr . Eyster recommended that the Town Board fill the position soon. At the Town Board Meeting the other night, a brief report was given on the New Ordinance Committee . Mr . Eyster requested to know further information on the report. Lin Davidson stated the Planning Board has recommended to the Town Board a candidate . To date, an appointment of the permanent or alternate position has not taken place by the Town Board . Mr . Davidson stated he is a Member on the Ordinance Committee and they have made a report to the Town Board . Mr . Davidson is unclear how open and Public that information will be. The Board is under process at this time reviewing the 2010 Plan, researching grant funds for a Planner, and gathering data . Lin Davidson explained to the Members the process with regards to the SEQR Review on Exempt Subdivisions . All neighbors within 600' of the said parcel have been notified via the U . S. Postal Service . • SEQR Review-1 Lot Exempt Subdivision, Applicant: A. Scott Pinney, Peruville Road, Tax Parcel # P/O 30. -1-28 .21 The Planning Board reviewed Part I of. the Short Environmental Assessment Form completed by the Applicant and completed Part II by the Planning Board Members . No Significant adverse environmental impact or effects were identified in Part II by the Planning Board Members . David Hatfield made a motion to declare a negative declaration. SEQR Review- 1 Lot Exempt Subdivision, Applicant: Jeannine Kirby, Goodman Road, Tax Parcel # P/O 20.-1 -8. 22 • 2 DRAFT 09 +22/09 P® I Thomas Ellis noted that item # 4 of the Agricultural Data Statement should read 1 Lot • Subdivision rather than 2 Lot Subdivision. The correction was made and initialed by Richard Platt, C. E. 0 on the original copy . The Planning Board reviewed Part 1 of. the Short Environmental Assessment Form completed by the Applicant and completed Part Il by the Planning Board Members . No Significant adverse environmental impact or effects were identified in Part 1l by the Planning Board Members . David Hatfield made a motion to declare a negative declaration .
