Lin Davidson called the Planning Board Meeting to order at 7: 17 PM .
Public Comments/Concerns
Mr . Davidson, Chairman inquired if there were any Public Bodies present that
would like to make a statement. There were none .
Site Plan Review- Expansion of Auto Repair Building, Applicant
Keith Armstrong, 43 Lockerby Hill Rd, Tax Parcel # 17. -1 -11 . 31
Keith Armstrong is requesting site plan approval to add a 16' x 32' open shed
addition to his existing auto repair building at 43 Lockerby Hill Road .
Mr. Armstrong has operated the business for approximately 5 years in the same
location. His home is located on the same parcel . The entire area is in the Ag
District.
Mr . Davidson shared the following comments from Town Engineer, Jeff
Overstrom;

Re : Armstrong Property
Mr. Armstrong is proposing a 16 ft. x 32 ft. shed roof expansion on an existing structure . The top soil will
be stripped and approximately 6- 10 inches of gravel will be placed under the structure. The top soil will be
used to grade around the existing structure. The total project site will disturb well under a total of one acre.
The proposed roof expansion will create an increase in impervious cover however, I do not feel this
increase will greatly impact stone water runoff from this site . The site will be graded, mulched and seeded
to establish vegetation and stabilize the site around the structure .
Larry Sharpsteen stated for the record that this is an expansion of an existing use.
David Hatfield commented how %yell manicured the property is kept.
The Planning Board reviewed Part I of the Short Environmental Assessment
Form completed by the Applicant and completed Part H . No significant adverse
environmental impact or effects were identified in Part H by the Planning Board
Members .

Viola Miller stated she has a very serious objection to having Ms . Wilcox' s letter
referring to June 9, 2008 Planning Board Meeting made a part of the July 21 , 2008
Minutes . Ms . Miller does not have a problem with the Minutes referring to Ms .
Wilcox ' s letter as an addendum . Ms . Miller further stated The Planning Board
Meetings are centered on an Agenda , and Ms . Wilcox ' s letter was not a topic for
discussion . The Planning Board ' s final vote on whether to make the letter a part
of the record was not acted on due to the motion dying for lack of a 2nd .
Nancy Loncto stated a motion was made to accept Ms . Wilcox' s letter as part of
the Minutes, but there was not a 2nd , therefore, the Motion died . Ms . Loncto
requested that a correction be made to the Minutes reflecting that vote .
Larry Sharpsteen states any portion of any letter or comment addressed to the
Planning Board that has to do with personal attack should never be recorded in
the Minutes of the Planning Board . Mr . Sharpsteen states it has never happened
in his 28 yrs on the Board and should not start now . The Planning Board is not
in business of supporting or providing a forum for personal attack items.
Lin Davidson, Chairman of the Board states he contacted Legal Counsel at The
New York Planning Federation and was advised that the letter as it pertains to
the Maiming Board Meeting can be placed in the Town ' s Skate Park file,
• however, the portion of the letter that pertains to after the Meeting can be struck .
The alternative would be to include the whole letter and obtain a disclaimer from
the person who was quoted to be included in the file .
Larry Sharpsteen indicated the statements made during the Meeting of July 9th
were also addressed that night, at which time he stated the health, safety and
well being of the citizens of the town are the business of the Planning Board •
when doing a Site Plan Review .
Larry Sharpsteen made a motion to accept Nancy' s amendment to the Minutes .

Larry Sharpsteen stated in his opinion only the portions of the letter that pertain
• to the Meeting and the contents of the action of the Planning Board that was
being discussed , i . e . The Skate Park should be placed in the folder recording the
activity on the Application , and the portions reflecting after the Meeting should
be removed, not placed in the Minutes .
Lin Davidson, Chairman reminded the Board of the Open Meeting Law, Section
106 .
Larry Sharpsteen made a motion requesting that Ms . Wilcox' s letter be inserted
into the Skate Park File with the part not pertinent to the Planning Board
Meeting be struck. The letter will not be made a part of the July 21 , 2008
Minutes, however, the Minutes will reflect that there was a letter and can be seen
in the file. Nancy Loncto seconded .

New Zoning Ordinance Committee
Larry Sharpsteen advised the Members that the newly established Zoning
Ordinance Committee will be meeting soon for the first time . Mr . Sharpsteen
and Mr . Davidson from the Planning Board have been asked to be a part of that
Committee .

Viola Miller brought to the Board ' s attention that Zoning is not a part of the
Planning Board . The Planning Board has been asked by the Town Board in the
past to work on the Zoning however, it should be made clear that any cost
associated with the Zoning changes is the obligation of the Town Board .
Clinton, NY Planning Board Training Workshop
Nancy Loncto shared her feelings on a recent Workshop she, Lin and Viola
attended at Hamilton College, in Clinton NY . Ms . Loncto stated it was a fabulous
Workshop and she came away with a lot of new knowledge .
Proposed Farm Pond Circle Subdivision
It was brought to Richard Platt, C. E . O . ' s attention that on the proposed Map that
was presented at the Developer' s Conference, there are were no paper roads to
go to potential other developments or an emergency exit.
Larry Sharpsteen made a motion to adjourn the Meeting at 8 : 07 PM . David

Lin Davidson called the Planning Board Meeting to order at 7: 17 PM.
Public Comments/Concerns
Mr. Davidson, Chairman inquired if there were any Public Bodies present that
would like to make a statement.
Jim Eyster of 1 Fiddlers Green stated he has made a couple of observation after
reviewing the last Planning Board Minutes with the proposed Zoning Ordinance
changes . Mr. Eyster states it looks like a " blood bath" with almost everything

• being changed . According to Mr. Eyster, it looks like the Planning Board is
loosing the ability to approve plans . Mr . Eyster has concerns that the new
Engineer has no planning education or experience and is concerned with the way
the rational planning is being removed from the Planning Board and put in the
hands of an employee who is over seen by the Town Supervisor . Mr . Eyster
further stated he had applied to the new Zoning Committee as well as 7 or 8
other friends that had good planning experience and he was advised that the
establishment of the new Committee was on hold due to lack of Applicants . Mr.
Eyster is hoping that this will not be a " white wash " job waiting for enough
people that will agree with the Town Board . Mr. Eyster inquired from the Town
Board Liaison as to the status of such Committee.
Matthew Besemer advised Mr. Eyster that the Supervisor felt there were not
enough Applications received so he extended the process for an additional 2
weeks making the deadline August 1 , 2008 . There still will be a Committee put
together to review the proposed Zoning Ordinance changes . Mr. Besemer
further stated a number of the Applicants were from the same district, where as
the Town would like to have a variety of Members from the different areas to
represent their district .
Mr. Eyster is advising the new Committee not to " fast track" these proposed
• changes.
Larry Sharpsteen explained that he and Mr. Davidson has been asked to serve on
this Committee . Mr . Sharpsteen stated that the proposed Zoning Ordinance
changes are still in the discussion mode between both Boards and quite frankly,
they are going well . With regards to Mr. Overstrom, he brings a great deal of
experience as a Municipal infrastructure Engineer to the Town.
Further Discussion on Lansing Commons Subdivision, Phase I
(Lots 1 -12 of 37), Cayuga Vista Drive, Ron Seacord, Owner, Tax
Parcel No . 37. 1 -2-53 . 222.
Mr. Davidson asked for Public comments regarding this subdivision . There were
not at this time .
Mr . Davidson inquired from Mr . Seacord as to the status of his project. Mr .
Seacord indicated they are working on the SEQR process, and the Town Board
would like to have further community input on the project at this time.
Larry Sharpsteen inquired from Mr . Matteson, RE . for the Developer that it was
his understanding that the Town can go no further until they hear from the State
• with regards to the Package Plant.

• Mr . Matteson stated, correct.
David Hatfield inquired if this was considered a PDA ? Larry Sharpsteen states
no, the Developer did not choose to go that route.
Nancy Loncto read in the Zoning Ordinance, page 43, the intent of a PDA .
Larry Sharpsteen explained to the Public that the Developer, Ron Seacord will be
building the Sewer Plant for his Subdivision .
Thomas Ellis further stated the Town will actually own the Sewage Plant and the
28 lots with residential homes on them will generate enough revenue to cover
expenses related to the operation / up keep of this plant.
Lin Davidson, Chairman advised the Public that any further questions or
concerns regarding the Sewer Plant should be directed to the Town Board as
they are the Lead Agency for the SEQR process .
Brian Siddall stated this is a " back door " way of getting around the Town
residents . The Town residents have already said they do not want Sewer.
Thirteen other residents were also concerned with Mr . Siddall' s issue .

Roger Van De Poel who resides in the neighborhood is concerned with the safety
of the neighborhood due to the increase in the amount of thru traffic . Mr . Van
De Poel is suggesting that maybe Stop Sign be erected at Woodsedge Sr Cayuga
Vista come together .
Mr . Seacord expressed that if the State did not approve the Sewage Treatment
Plant, then the Subdivision would not happen.
Further Discussion on Cayuga Farms Condo Project, WB Property
Group LLC for a proposed 138 unit Condo project on N.
Triphammer Road, in the Town of Lansing, New York and
otherwise known as Tax Parcel No . 37.1 -6-3. 362.
Nancy Loncto informed the Public that a part of the consideration that comes
before the Planning and Town Board is consideration at the Preliminary Nat
stage of Preliminary Plans, details, and specifications for all water, sanitary sewer
and storm sewer lines. There will detailed information regarding all utilities .

• Richard Platt, C . E . O advised Mr . Buhl, P . E. for the Developer that the SEQR
Hearing held on June 9, 2008 was opened and closed on that date . The intention
of the Planning Board was to keep it open, however that did not happen. Part II
of the SEQR will require another Public Hearing at a later date. Prior to the
Hearing, the Town would like to see a more detailed plan of the Sewer . Mr. Platt
further advised Mr. Buhl that according to Jeff Overstrom., Town Engineer the
Planning Department should not be submitting a 239 to the County without
having a Sewer Plan .
Lin Davidson also advised Mr. Buhl from a Planning perspective, they also need
detailed plans .
Mr. Buhl is requesting a letter expressing exactly what the need is and degree of
detail needed in order to move forward .
Mr. Buhl gave an over explanation of the project to the Public present.
Jill Vaughn had concerns with the two exits roads on to Triphammer with the
increase in density by 138 Units . Also, 12 other residents have the same
concerns .

1 . Why weren't the property owners closest to the project notified? hen I spoke
with the Town Planning Department in March of this year, I was advised that we,
as property owners closest to the project, would be notified of the hearing .
2. Why was this hearing scheduled during the summer months when so many
people are away and on SUPER SHORT NOTICE? In fact, in the town where I
used to live , the Town Board didn't even meet during July and August. I will •
definitely be requesting that the town consider having a second public hearing in •
•
September, October or November so people have more notice of the hearing and
can bring informed questions to the Board. Please back me up on this so we can •
get our petitions, etc. ready.
3. Approximately how many children will be housed in the complex and how will
our school taxes be impacted?
4. Where will the school bus stop(s ) be located?
5. Will there be a fence or berm or some protection erected between the back
yards of these units and Triphammer Road or will we be looking at people's
backyards, not to mention the danger to children who are playing in them and who
might stray onto Triphammer Road ? What safeguards will be taken to ensure that
children will remain within the complex and not go near Triphammer?
6. Where will the entrance/exits to the complex be located?
7. Are there plans for traffic controls (lights, etc. ) at the corners of Hillcrest,
Asbury Rd. or anywhere in between?
8. Is there a plan to reduce the speed limit on Triphammer to accommodate the
extra traffic - such as 40 mph throughout the distance between Hillcrest and the 4-
way fight?
• 9. What about the trees that are at the far Western end of the property? Are they
staying or going? Has anyone thought about the wildlife? •
10. Ditto the drainage ditches that house much wildlife - are they staying or
going? Have any environmental impact studies been done?
11 . If the sewer project is not approved to bring the new sewer tine down Hillcrest
to the proposed site of the building project, or even if it is, If, as a result of the
construction project, any of the septic systems of the residents of Asbury Drive,
Horvath Drive or Asbury Road sustain any damage to their septic systems -
flooding , etc. (this occurred when the Triphammer Terrace area was developed for
homes in the early 1990s ), would the construction company make the residents
whole by paying for such losses?

• Sue l-lenne of 19 East Meadow Drive is a retired teacher . Ms . Henne gave the
public details of the recent drastic cuts in the Lansing School District cuts due to
budget constraints . Ms . Henne is concerned with the number of students that
could be introduced to the Lansing School as the result of this project . Ms.
Henne further stated she heard that Mr . Buhl has worked on an impact statement
and questioned whether the Planning Board or Engineer has spoken with the
Superintendent of Schools regarding this impact.
Mr. Buhl stated no .
Diane Dawson of 10 Asbury Drive is the former Deputy Village Mayor of
Lansing and does have experience with this type of Planning . Ms . Dawson •
requested to know;
1 . Requested proof that the parcel is Medium Density residential
2 . Where the sewer line lateral will be connecting to the existing Town Sewer
3 . Is there a local owner of the property
4 . What is the upper end unit selling price
5 . Have you done a Market Study for Viability
Dennis Read inquired where the western extension on Hillcrest would be
extending to?

Larry Sharpsteen stated it the purpose of the Planning Board when considering
any development within the Town to look at life safety, traffic patterns and an
eye towards future connector roads . The western extension that Mr. Read is
inquiring about is a connector road .
Cindy Jay inquired about the time frame for this development. Ms. Jay also
inquired if there would be a buffering.
Timothy Buhl expressed that he has been planning this for a year and a half
already . This would be Phased any where from 6-10 years . A buffering will be
along Triphammer Road .
Larry Sharpsteen made it perfectly clear for the Public that this proposed
development discussion has not been hidden. All of the Planning Board Meeting
are open to the Public, the Minutes are available on the Town Web Site and the
Planning Department is available to answer any further questions or concerns
regarding any Planning Board Agenda item (s) .
Lin Davidson, Chairman advised the concerned citizens that when the time
• comes for Public Hearings, all residents within 600' Will receive a notice . Mr .
Davidson further stated this particular meeting is what the Members call their

. " Working Meeting" however, the Planning Board Members felt they had not
received much comments or concerns on the two large proposed projects . that
they have been reviewing. The Board decided that they would put out a paid
notice to the Public so that input from the residents could be taken into
consideration on the projects .
Lorraine Fetch asked the question of the Board if they thought this meeting has
been productive, interesting and important enough to have made it available to
the public, rather than just put it on the web .
Paul Southard inquired if the proposal will require any Variances . Mr . Buhl
advised no . Also, vitt there be any street lighting and Mr. Buhl advised yes .
Jim Eyster indicated that with 138 units, each having 2 cars, it would increase
cars traveling on Triphammer Road to approximately 300 more . Mr. Eyster
stated he felt there should be a couple of traffic lights added .
Mr. Buhl states a 2007 Traffic Study has been included in his SEQR report.
SEAR for 1 Lot Subdivision , Applicant : John Flicks, Tax Parcel # 42 . - 1 -

Lin Davidson advised the Board that after speaking with Lorraine Moynihan Schmitt , he
was advised to have the Board hold off completing the short form SEQR at this meeting
due to neighbor notification not being sent out it. It was suggested that clarification come
from Guy Krogh .
Nancy Loncto stated her confusion comes from page 5 of the Subdivision Rules and
Regulations , Article IV with regards to Exempt Subdivisions .
Richard Platt, C . E . O . will speak to the Town Supervisor for clarification on this issue.
John Young — Handout on future " English Village" style neighborhood ,
Waterwagon Road .
Nancy Loncto made a motion requesting that we insert John Young ' s handout into the
minutes . Larry Sharpsteen seconded .

Our plan for the IOU acres we own between Watcrwogon Read and Route 34 is to eventually develop it into three
eparnte "Englich Village" style acigh?.orhoods . Each would consist of 20 to 25 homes clustered fairly densely
amorist a comnton%y owned "Village Green", what kids could play. families picnic etc. it's ray nope that the=
new family neighborhoods would allow for fairly intense use of the land (as the Town desires) without causing it
r.o feet crowded or low class. An example of such a environmentally-friendly clustered development in England
itself can be found et ,. s _ _ _: :in: • w. _ t obviously we'd dr thinga somevihat
differently here in the Stites, but the Boric concert of creating a place, out just a collection of houses, is whet I
like about the idea.
The initial Village, location I have in mind would surround the private soccer field I built off Route 34 a few years
,.go, which would become the Village Croon. The main meson I haven't moved ahctrd with that development to
date is the failure of the Town's proposed sever plans. Dense deseloprnent in areas with thio soil really dots
eequiro the availability of:zwer and water.

And I've been contorted on sebzml occasions urn-solicited by people who would like to live near The Rink fur the
convenience of their kids. So I think that We a concept that will telly wo*
if we can get eoeowa or sewage and permission to da outdoor recreation next to The Rink, I believe that I'd lx ahlo
to design, build and market attractive, affordable, environmentally-friendly cow residential neighborhoods on my
property along Waterwapee Road at a density that meets tiro t'own's desires for that area. With discussions
already under way that could diad both a sewer line corning north along Triphammer Rwwf, and the Lard ties
tlwliwmou changes required to let we repine my private weer d'>~I3 with something open to the public. all this
could be in place within the next year or two. If here is anything I can do to help move these two protects along , I
.hope you will letme know.
CU-Structural Soil Handout
Mr. Davidson suggested that Tim Buhl take a look at this handout as he had mentioned
internal trails as oppose to sidewalks .
Nancy Loneto clarified for the record with regard to Mr. Siddal ' s question as to how
many Planning Board Members live in or are affected by these development . tEls. Eoncto
stated the Board Members can not look at any project as living in a zone, the Board is
charged by law with looking at the project as a whole community, and the impact from a
community standpoint .

definitely be requesting that the town consider having a second public hearing in
September , October or November so people have more notice of the hearing and
can bring informed questions to the Board . Please back me up on this so we can
get our petitions , etc . ready .
3 . Approximately how many children will be housed in the complex and how will
our school taxes be impacted?
4 . Where will the school bus stop (s ) be located ?
5 . Will there be a fence or berm or some protection erected between the back
yards of these units and Triphammer Road or will we be looking at people 's
backyards , not to mention the danger to children who are playing in them and who
might stray onto Triphammer Road ? What safeguards will be taken to ensure that
children will remain within the complex and not go near Triphammer?
6 . Where will the entrance/exits to the complex be located ?
7 . Are there plans for traffic controls ( lights , etc . ) at the corners of Hillcrest ,
Asbury Rd . or anywhere in between ?
8 . Is there a plan to reduce the speed limit on Triphammer to accommodate the
® extra traffic - such as 40 mph throughout the distance between Hillcrest and the 4-
way light?
9 . What about the trees that are at the far Western end of the property ? Are they
staying or going ? Has anyone thought about the wildlife ?
10 . Ditto the drainage ditches that house much wildlife - are they staying or
going ? Have any environmental impact studies been done?
11 . If the sewer project is not approved to bring the new sewer line down Hillcrest
to the proposed site of the building project , or even if it is , if, as a result of the
construction project , any of the septic systems of the residents of Asbury Drive ,
Horvath Drive or Asbury Road sustain any damage to their septic systems -
flooding , etc . (this occurred when the Triphammer Terrace area was developed for
homes in the early 1990s ) , would the construction company make the residents
whole by paying for such losses ?

Our plan for the 100 acres we own ben een. Waierwagori Road and Route 34 is to eventually develop it into three •
sc} aa'ate " English Village" stele neighborhoods. Each would consist of 20 to 25 homes clustered fairly densely
around a commonly owned "Village Green", where kids could play, families picnic etc. It's my hale that these
new family neigbbothnods would allow for fairly intense use of the land (sus the Town desires) without causing it
to feel crowded car low class. An example of such a environmentally-friendly clustered development iii England

differently here in the States, but the basic concept of creating a place, not joist a collection of houses, is what 1 •

My feeling is that if you want people to live close together in a pSee like Lansing where there is ILO shortage of'

the planning hoard with an extremely high likelihood of creating public controversy
