Public/Member/ Comments/Concerns Mr. Davidson inquired if there were any Public Bodies present that would like to make a statement. New Town Employee Jeffrey Overstrom , E . I .T. Introduced himself to the Planning Board Members . Mr. Overstrom has joined the Town in the position of Town Engineer and Planning Coordinator . Mr . Overstrom expressed to the members that he will be N as APPROVED 07E21/08 P13 working very closely with the Planning Board and Town Board in order to help the Town to move forward . lune 9, 2008 Planning Board Meeting: Connie Wilcox, Deputy Town Supervisor presented a prepared statement with regards to an Agenda item (East Shore Skate Park) which discussion / action took place at the -Planning Board Meeting of June 9, 2008 . (See File for copy of Letter) No other Public comments . Public Hearing- Application for Site Plan Review , East Shore Skate Park, LLC , Applicant ; Ben Jones, 2073 E . Shore Drive, Tax Parcel No . 37 . 1 -2 -3 . Thomas Ellis made a motion to open the Public Hearing on the Application of Mr. Ben Jones, East Shore Skate Park at 7: 21 P . M . Nancy Loncto seconded . Mr. Davidson inquired if there were any Public comments for the Skate Park Site Plan, there were none . Larry Sharpsteen made a motion to close the Public Hearing at 7: 22 PM . Ben Jones appeared before the Planning Board for Site Plan Review . Mr . Jones intends on opening East Shore Skate Park LLC and operating an indoor skate park in the old Egan ' s building. Indoor recreation is allowed in the 81 District. • At the Planning Board Meeting on June 9, 2008 the Board requested further information with respect to the following items; 2 .� APPROVED 07/21A38 PB • 1 . Parking 2 . Lighting Specs and placement of additional Lighting 3 . Sign Location and size 4. Location of Bus Stop Further Discussion Larry Sharpsteen inquired which cut of lights were intended to use . Ben Jones advised the 250 watt . Thomas Ellis inquired if the parking lot would have defined spaces. Mr . Jones indicated yes . Lorraine Moynihan Schmitt stated for the record, parking for this project is governed by Article 900 .0 at sequence of the Lansing Zoning Ordinance. It also references Schedule Ill page 67 for an Indoor Recreational Facility of this type it requires 1 space for each 3 occupants for the building based on the current New York State Fire Code Occupancy . Mr. Jones indicates that he was advised that the maximum occupancy would be • 99 persons, however, he anticipates no more than 35 occupants per day . Possibly on a special event there would be more . Richard Platt, C . E.O stated he and Building Inspector Lynn Day have looked at the building and dimensions have been taken . Once the project is completed, the Code Office will then be able to give a calculation for the occupancy . The Board inquired if Mr . Jones had spoken with his neighbor, The Rogues Harbor to see if arrangements could be made for over flow parking. Mr . Jones indicated he has not . The tentative hours of operation will be 12 PM to 9 PM . Thomas Ellis inquired if music would be used . Mr . Jones stated music will be played inside the building . Currently while construction is going on the music is playing and there has not been any complaints . Larry Sharpsteen stated currently there is a buffer in place due to the foliage however, when the foliage is lost in the autumn and winter he has concerns whether that buffer will be affected . The Town may want input on additional • buffering at a later date . 3 APPROVED 07121 ,08 PB Nancy Loncto made a motion to accept the prepared Resolution with the following amendments for Final Approval; 1 . Parking-if occupancy upon Fire Code Inspection turns out to be 99 persons or less, than the 31 parking space is acceptable, otherwise it is to come back before the Board for review . 2. Concern for buffering in the fall / winter season remain an open item for the Planning Board . RESOLUTION No . The Public Hearing will take place after the SEQR Review which has been scheduled he the Town Board For August 20, 2008 St 6; 25 Ms . Moynihan Schmitt indicated that in the hAF, page 2 under description of action, it refers to the over all project as single family residential structures, however, townhouses and apartments may also be constructed . Ms . Moynihan Schmitt indicated et the request of the Town Attorney that Mr _ Matteson clarify .for the record that the townhouse and apartments will be done in a later phase_ S It was the consensus of the Board that this project is at the Final Preliminary Plat stage. Jeff Overshaorn expressed his concerns to Mr. Matteson with regards to some of the Iet sizes and location. Mr . Mvecstrem was concerned with the driveways entering a public road . Wayne Matteson stated he had not gotten into the specifics rh the driveways at this point . Mr . Matteson will take e closer look at the layout of some of the lots per Mr, Hverskrow' s suggestion _ Larry Sharpsteen stated that the town tries to minimize curb cuts, Viola Miller had strong concerns with the driveways . Larry Frabboni stated Mr . Duthie has met with Jack French, Highway Superintendent and Scott Pinney with regards to the outdoor parking as far as the location goes . It was decided that the Alternate Plan submitted was the safest route to go . Mr. Duthie will pay for the material and the Town will perform the work . The Planning Board reviewed Part I of the Short Environmental Assessment Form completed by the Applicant and completed Part II . No significant adverse environmental impact or effects were identified in Part II by the Planning Board Members . O 0 OS y 0 c FI&ECr PlanningBoard Meeting June92008 EEC + ' I wish to address the Planning Board this evening and would like to take a chapter from Ms� - / D • Loncto's book and have my comments entered into the minutes of record . There seems to be a misconception that I had an issue with how the Planning Board does site plan review. I am fully aware of the procedures for site plan review and it was not necessary for Ms . Loncto to draft a letter stating such to the Town Board . • On June 9th 2008 I attended the Lansing Town Planning Board meeting as I often do . There were only 4 Planning Board members present, Nancy Loncto, Dave Hatfield , Larry Sharpsteen and Tom Ellis. Mr. Ellis was acting as the Chairman because Chair Lin Davidison was not present. There were quite a few members of the public present, some who were to come before the Planning Board and some who were observers. To my recollection the first couple of things went along okay, until the site plan review for the East Shore Skate Park came up. Ben Jones had brought his application forward to start an indoor skate park at the old Egan 's building . I would like to note that Mr. Jones was very professional and was dressed in a suit and tie. Shortly into the site plan , Mr. Ellis stated that he didn 't want to stereotype , but inquired about the type of people that this business would attract. The applicant remained very professional and tried to explain the business and the customers he would be serving . Mr. Ellis then stated in so many words , as a resident of this town , he didn 't think that this would be a very good business to have in town , and that having those kind of people hanging around would be a threat to the neighborhood . Mr. Ellis inquired to the hours of operation , he wanted to know how the clientele would be getting home . Mr. Ellis didn't think it would be a very good idea to have "these type" of people hanging out in the parking lot waiting for rides. Linda Hirvonen of the ZBA was setting behind me and she said he can 't say that, • or ask those type of questions . Linda has been a planning board member. At that point, I raised my hand to be recognized and told Tom that the questions being asked didn 't have anything to do with the purview of the planning board . It was very obvious that my comment didn't set well with him and he became very defensive of the comments I made to him . After the meeting , I was gathering up my stuff and the rest of the planning board members had left the courtroom except for Tom Ellis, Matt Besemer and Dick Platt. Tom walked over to me and I thought he was going to say that he was sorry for his behavior, but was concerned about how this business would fit. Instead he got very close to me and said he did not appreciate being chastised by me and that as a citizen he could ask any questions that he wanted to. All the time he his waving his arms and leaning in close to me and raising his voice . I told him that as Chair of the Planning Board he could not be a citizen , He told me that I needed to 'stop being and advocate for Scott Pinney all the time ". At this point Matt approached and Tom started to argue with him. Matt also told Tom that he can 't ask those kinds of questions in the planning board meeting . He told Matt he had every right to as a resident of the town . Matt told him that he had to remove himself from the seat as Chair of the Planning Board in order to ask those personal questions . He continued to argue with Matt that as a concerned citizen he didn 't think that it was a good idea to let that kind" of business into this town . I was greatly disturbed that Mr. Ellis would behave in this manner and thought it to be threatening . • Planning Board Meeting June 9, 2008 • These are the facts of what went on after the meeting and why Supervisor Pinney asked far Mr. Ellis 's resignation , not because of the Site Plan Review process . So you as a board can continue to support his kind of behavior from one of your members if you wish , but I felt you needed to have the facts , not just that Mr. Ellis was asked to resign on a whim of the Supervisor. There were two other witnesses present, so this is not something I fabricated in order to be an advocate for Mr. Pinney.
