WHEREAS , Applicant S . E , h , Associates has submitted for consideration and requested
approval From the Lansing Planning Board of a Site Plan for expansion of the Lansing
Business Neuter building located at 3 i09 North Triphammer Road , Lansing, hew Nord
and othaswhe known as Tax Map Parch 3T1 -3 - I . 5 ; and
WHEREAS , the Planning Board has considered and carefully reviewed the requirements
of the Town ' s Laves relative to site plan review and the unique needs of the Town due to
the topography, the soil types and distributions, and other natural and rnae made features
upon and seareundind the area of the proposed Site Plan , and the Town has also
considered the Town ' s Comprehensive Plan and compliance therewith ; and
WHER.bAS , this is an Unlisted Action under the State Environmental Quality Review
• Act which requires environmental review ; and

WHEREAS , at the Lansing Planning Board Meeting held on June 9, 2008 , the Planning

Board resolved to waive a public hearing concerning the environmental review , pursuant
to the State environmental Quality Review Act, of the Site Plan for expansion of the
Lansing Business Center building located at 3109 North Triphammer Road , Lansing,
New York and otherwise known as Tax Map Parcel 37 . 1 -3 - 1 . 2 ; ; and
WHEREAS , General Municipal Law County Planning referrals 239 - land/or 23f-m ,
239-n (of Article 12 - B) were effected by Town of Lansing Planning Department; and
WHEREAS . on June 9 , 2008 , No Planning Board , acting on en uncoordinated
environmental review, reviewed and accepted es adequate a Short Environmental
Assessment Form { ' EAF" ) Part 1 , submitted by the Applicant, and the Lansing Planning
Board completed Part It (anti , if applicable , Part til }, of the EAF ; and
WHEREAS , by motion adopted June 9 , 2008 , the Town of Lansing Planning Board has
determined that, pursuant to the provisions of the State Environmental Quality Revie v
Act, the proposed site plan will result in no significant impact on the environment and has
issued a Negative Declaration of environmental significance for puipoees of Article 8 of
the Enviroinmental Conservation Law ; and
WHEREAS , by motion duly adopted on June 9, 2008 , the Planning Board determined to
waive a public hearing regrrding the overall consideration of the site plan application and
set the review thereof for the Planning Board meeting to be conducted June 23 , 2008, at
which time the Planning Board expected receipt of the Tompkins County Planning
Department comments respecting the NMl, 239 review ; and

WHEREAS , the Tompkins County Planning Department provided its GAL 239 review

comments to the Lansing Planning Department by letter dated June 23 , 2008 , in which it
determined that the project may have inter-community, or county wide impacts such that
the modification of the proposal was formally recommended as follows ;

" Per the Town OF Lansing ' s Zoning Ordinance, Section 701 . 5 , 2 , k, the ' site plan
shall contain proposed water source and sewage disposal system . ' The location of
the septic system should he clearly delineated on the approved final site plan . "

WHEREAS, at the June 23 , 2008 Planning Board meeting, the Lansing Planning Board
duly reviewed and considered the recommendations and concerns of the Tomkins

County Planning Department noted above ; and
WHEREAS , at theJune 23 ; 2008 Planning Board meeting; the Planning Board
considered the proposed site plan in accordance with the provisions of the Town of
Lansing Land Use Ordinance Section 701 .4 et sequence, including concerns addressing
topography, site lighting, landscaping, hours of operation and storm water drainage and
erosion control , parking, fencing and screening, and any potential on and off site
environmental impacts ; and
WHEREAS , upon due consideration and deliberation by the Town of Lansing Planning

to Applicant S . E . E . Associates for consideration the proposed Lansing Planning Board

Larry Shar Steen added for the record that this would be the perfect use for this

piece of property _ 'There will not be e lot of Public in and out of the premise, this
mainly will be for the flet of vehicles_
Larry Frabboni , Pt for Mr . Duthie states as far as Storrnwater does, he intends
on giving full details to the Town Engineer. To date he has sized an area
knowing that they can fit what they need to in the area . •Mr. Frabboni has gone
as far in the design to known what comes off the impervious surface that can de
handled in the pond on site . As for the sewer, the vehicle washing was just
speculation more than anything. Mr . Frabboni will check with Verizon to see if
indeed they want to wash on site and then re size the system. As For the Water
System, before die Town will consider e water extension, the Planning Board
must give some indication diet they are in favor of the project. Mr. Frabboni is
quite familiar with how the process works as he recently has been through one
that did not require the State to be involved . In Mr. Dverstrom' s report he
mentions that 1 bbdOl-I must rev ievv and approve, whereas Mr , Frabboni
disagrees with that statement . It is Mr . dcebbon.i 's understanding that the County
must give approval, however, the Town Board can pass with a Resolution. There
were concerns with the Road , fvlr _ brebboei explained that when the earlier
landowner gave die Town of Lansing the property, there was in the deed written
that someday it would be e town road , and the town would build the road .
According to Mr_ Frabboni, Mr. Duthie is not asking the town to build e road .
There is plenty of room for cars to park on bout cities and still have 40' in the
middle for the existing town highway trucks . There will be e small repair bay for
two trucks to be worked on at a time . No gas tanks will be on site, other than e
propane tank on a concrete tank . The hours of operation will be approximately
7 : 00 TM until. 5; 00 PM, unless an emergency arises . On each corner of the
building there will be cut off light . The lighting will be localized , A chain Link
fence will be located around the entire site ,
Lara' Sharpsteen inquired if Mr, Frabboni could have e point by point response
• with regards to the TT Miller comments back to the Planning Department and
TG Miller's by the end of this week , Mr, Frabboni indicated Ives .

• Larry Sharpsteen indicated the Town Board is waiting for the Plerunng hoard to
give some sort of indication that this is an appropriate use, before they move
forward on the water extension . Mr . Sharpsteen indicated that due to time
constraints on the proposed project, the Planning hoard should consider a
resolution to the Town Beard so they may move forward on their paperwork ,
Larry drebboni advised the board that he has atreehd been in contact with Deb
uraco and David Herrick. Mn hrebboni indicated that he thought Jeff
Mversteam was unaware of this .

Larry Sharpsteen made a motion requesting that a memo or Resolution be sent to
the Town Board via the Town Board Liaison stating in the Tieinring Board ' s
view, this is entirely an appropriate use for the area . The Planning Board is
generally in favor of the project per the Site Plan that has been presented . The
Planning hoard only needs to have the questions TG Miller proposed answered,
before the Public Hearing. The Planning Board Members state this business
would be good for the Town . David Hatfield seconded ,

The Payne' s are in the process of selling their existing home and would like to

Lots require a Public Hearing. This is located in the RA district, and an Ag . Data
statement has been completed .

Two different copies of the Planning By Laws were reviewed en discusses, Viola
Miller indicated approximately 1. 0 years after the PB was established, the 13v -
Laws were changed to reflect the Blot Member being a representative for the
Agricultural Distri:et within the town.

review / establish the process for policies and procedures and updating By -Laws .
Larry bherpsteen suggested that all Members review their copy of the By-Laws
and come prepared to share ideas for updating thein at a future r -orking
meeting.
Ms . Moynihan Schmitt will provide copies of By-Laws for the Members to view _
Nancy Loncto stated when she was Chairperson, she was charged with
reviewing all the documents and their activities involved with the Planning
Board . To date, the By- Laws were the only document that Ms. Loncto and the
Planning Board did not get to,
The Member suggested that the updated document be keep short and to the
point . Also, additions such or attendance policy, professionalism and code of
ethics get addressed, or referenced that the Follows the Tompkins County Rule of
Iucicipal Officials .
After some discussion, it was determined that Ms . Moynihan Schmitt will
research to hind out when the original Planning Board was established , as was

® Larry Sharpsteen has heard rumors that possibly a Puppy Mill is being run in the Town .
Mr. Sharpsteen will be contacting a Rescue operation to see if they have any proposed
wording that the Town can look, at for insertion into the Ordinance . Ms . Moynihan
Schmitt will research for samples for the Planning Board to review . Ms . Loncto
requested prior to Mr. Sharpsteen bringing it before the Planning Board again , that Mr.
Sharpsteen look into the enforcement side of this .
Town Board Liaison
Matthew Besemer advised the Planning Board two Resolutions at the Town Board level
has recently passed . They are as follows :

Nancy Loncto made a motion verifying the Planning Board received copies from the
Town Board Liaison of Resolution (s) number 03 - 171 Approving Warren Road Sewer

Warren Road Sewer District extension and 08 - 162 Approving Teeter Road Consolidated
Water District Boundary change and negative declaration regarding the environmental

Other Business
Lin Davidson , Chairman of the Board advised all present that he was notified by Scott
Pinney, Town Supervisor via the telephone the other morning that the Town Board had
discussed and voted on Thomas Ellis being asked to resign from the Planning Board . Mr.
Davidson requested that Nancy Loncto read a prepared statement in support of Thomas
Ellis bringing up subjects in relation to the Skate Park Site Plan Review . The items
discussed are items that should be attended to . Mr. Davidson stated there is a
compendium of things that make it the Planning Board purview to ask to questions of an
applicant .
Ms. Loncto read the following and moved the motion ;
l . I would like to note that this Board recognizes that it has a responsibility to not only
follow the specific Site Plan review criteria as outlined in section 700 of the Town of Lansing
Zoning Ordinance but also and moreover has the additional responsibility to acknowledge the
purpose of the same Ordinance as noted in Article II and I quote "'The purpose of this ordinance is
to promote the health, safety, and general welfare of this community ETC Under site plan
review regulations "We are to be guided by the existing characteristics and conditions of the site
• and its surroundings ; by particular design objectives of the applicant and by the quality and
distinctiveness of the proposal . Unless waived or otherwise modified by Planning Board
resolution as specified below , each site plan for a proposed land use activity shall conform to the
general standards listed in this Section 701 .4, as applicable, and to any other requirements
specifically related to a particular site , as may be identified and described in writing by the
Planning Board . ( 70I .4)"
THEREFORE : i MOVE THAT THIS BOARD AFFIRM TOM ELLIS IN HIS DECISION TO
NOT SUBMIT IHS RESIGNATION AS A VOLUNTEER MEMBER OF THE TOWN OF

• Larry Sharpsteen stated with regards to whether something is the purview of the
Planning Board , the board is required to consider the nature of the business with
regard to the type of buffering that may be needed between a business and an
adjacent business' or. residence' . The specific previsions of Site Plan Review were
addressed to protect existing business and residents . Mr. Sharpsteen does not
think anything Mr. Ellis said was out of order.
Nancy Loncto continued reading the following ;
2 . I would like to NOTE for the RECORD that the application presented to the
Planning Board at our June 9th meeting from Mr. Benjamin Jones for an Indoor Skate
Park dated ( 5 - 19-08 ) was incomplete and in fact failed to respond to the following
criteria as outlined in our Zoning Ordinance Section 701 . 5 :
a . name and address of the land owner of record and the applicant , if not the
same. Scale of the drawing(s) north arrow, and date.
b. An identification map showing the location and orientation of the proposed
development relative to the local road system. A tax map or USGS map is
adequate for this purpose. (a COOCLE map was provided — no scale
provided) (make note to possibly accept Internet maps and pictures in the
new ordinance)
c. Location of the site in relation to abutting properties and roads was provided
however it did not " Show existing property lines, right-of-way, easements
and the names of current owners of adjacent property nor on the
opposite side of the road(s) serving the site."
d. Existing buildings and land uses on the site and on adjacent properties
(some but not all).
e. Proposed buildings and land uses , off street parking areas, access and
egress drives, buffer strips or screening,
f. Location, size, and type of any proposed site lighting and signs.
Any of these and indeed other considerations may be waived if circumstances warrant.
We did not waive any of these on June 9'►'. in an effort to ensure our professional
approach to, not only this site plan review, BU1' all site plan reviews moving forward —
Nancy Loncto offered the following motion;
I MOVE that the Town of Lansing Planning Board in conducting site plan reviews
reference each and every criteria by name and either accept what is given us in the
application, request more specific information, or waive it giving a determination as to
why in each case; eventually making a determination as to when the Planning Board
considers the application to be complete. Further that at the very first meeting in
consideration of any site plan we make a determination of any additional criteria or
considerations we deem important to the health, safety, and general welfare of Lansing
and commit these to the applicant in writing and the minutes of the meeting. The List of
Site Plan criteria must be attached to the Site Plan Application Form .
Thomas Ellis stated he recently had a discussion with Andrew Sciarabba and Mr.
® Sciarabba' s concern as a builder and a developer was that the process is open
and consistent. Mr. Ellis states when Mr. Sciarabba ' s package arrived for the

• members to view it was very well marked, parking areas, surrounding
boundaries, etc . . were illustrated on the drawing. Mr. Ellis further stated Mr .
Sciarabba is extending an existing successful business. With regards to the Skate
Park, in Mr . Ellis' s opinion the board is looking at a fledgling business and the
board did not receive that information .
Larry Sharpsteen stated the requirements are the same for all Applicants . The
Site Plan Review has a list of requirements that all must follow .
David Hatfield stated he felt Ms . Loncto' s statement was written in anger and
should be re-considered .
Viola Miller indicated she did oof see a problem with having this statement in
writing. Further more, Ms . Miller feels the Planning Board deserves an apology
from the Town Board with regards to their previous actions .
Ms . Moynihan Schmitt stated. in regards to Ms . Loncto' s motion on the floor that
she can not stress how important it is for the Planning Board to go through factor
by factor looking at objective criteria . Findings are critical . Ms . Moynihan
Schmitt suggested that a Checklist be handed out to each Applicant. It should be
made very clear when the application is complete or what is outstanding.

The Code Enforcement Office can issue a building permit, for interior renovations, but a Site Plan

2 . Flow SEQR for exempt subdivisions is to be handled
3 . Lack of clarity regarding which subdivision involving discretionary action
4. Unusual discretion to the code enforcement officer and what the potential
liability issues for the Town will result
5 . Ask to hire professional help to work on Subdivision Rules es &
Regulations .

Lorraine Moynihan Schmitt indicated that it was her understanding that the
there was some anticipation by the Town Board that there could be some hiccups
along the way with the Subdivision Rules and Regulations and that the Town
Board would look at that document again to see if it needed adjustments or fine
tuning. Ms . Moynihan Schmitt inquired from Mr . Besemer if the Town. Board
would welcome comments/ proposed changes from the Planning Board that they
would like to see made with the revisions .
Matthew Besemer indicated yes . Mr. Besemer explained to the Members the
reason they were pushed through so quickly was that they discovered the
Planning Board Department was approving 3 acre, 300 ft' lot Subdivision
without Planning Board approval which was illegal . In order to correct the
problem., action had to be taken immediately .
Viola Miller stated that she does not believe the Town Board is versed in
Subdivisions and they are bound to make mistakes . Any changes to the
Subdivision Rules and Regulations should be made by the Planning Board .

Richard Platt, C . E .O. states an individual has come forward and would like to
open a Wild Bird Feed Store / Outreach Education/ Gift Shop on Auburn Road, in
the IR District. This individual is asking for an opinion whether this is an
allowable use there . Mr . Platt explained that it would be on the same parcel as
Scoop' s Ice Cream Stand . It was the consensus of the Planning Board that the
Applicant take their request to the Zoning Board of Appeals .
