E. General Business Lin Davidson called the Planning Board Meeting to order at '7: 15 PM. Public Comments/Concerns Lawrence Cathles requested clarification from the Planning Board with regards to the proposed Zoning changes . 1 . Mr . Cathles inquired if the following changes would be made in the R1 District to allow the following uses ? • Roadside Stand • Commercial outdoor recreation • Commercial indoor recreation • DRAFT 05/ 12/0$ PB • 1 . Professional or business offices , banks, financial institutions (new and existing construction) Lin Davidson, Chairman stated yes, as stated in the earlier announcements. 2 . Mr. Cathles further inquired as to who was behind and or proposes the changes? Mr. Davidson stated the Planning Board has worked on the Ordinance for some time now . Proposed ideas submitted by people in the community were taken into consideration . Mr. Davidson further stated the proposed changes came from the Town Board after reviewing what they felt was needed in the Town. Both Boards are still conversing on the document therefore, it is not a final version . 3 . Mr . Cathles inquired if there is a clear reason for the changes? Mr . Davidson stated the Planning Board did not nuke the changes . The Planning Board has requested via a Resolution to the Town Board for an explanation. on their change . • 4 . Mr . Cathles asked how with these changes would any sensible plan for the Town be possible ? Lin Davidson stated " that' s a good question" . 5 . Mr. Cathles inquired what the procedure was by which the proposals are accepted or rejected ? Chairman Davidson indicated it was a call made by the Town Board with proper publications, Public Hearings and reviews by different agencies within the County . Mr. Cathles concluded by stating he feels the proposed changes are phenomenal and to put the change through without proper discussion would be a very serious issue for the Town . Lorraine Moynihan Schmitt advised Mr. Cathles may want to express his concerns to the Town Board . Ms. -Moynihan Schmitt further stated the Town Boardand the Planning Board have been trying to meet in joint sessions . The Planning Board has made recommendations to some of the changes that they believe could be acceptable and other they suggest be revised . Member/Applicant Discussion : Nancy Loncto referred to the Minutes of April 14, 2008 where Mr. Moore indicated that he intended on planting staggering of bushes of 6-8 ft . in size in a cluster formation . Now , his plans show Silver Maiden Crass. Ms . Loncto wanted to make sure that all Members were okay with the change, which they were . A Lighting and Signage Plan was also presented and agreed upon . The hours of operation will be from 6 : 00 AM until 10 : 00 PM . There will be no fence . RESOLUTION No. PB 08-53 RESOLUTION OF THE LANSING PLANNING BOARD APPROVING RICHARD PINNEY, JR., FARRELL ROAD ONE LOT MINOR SUBDIVISION WHEREAS, after submission thereof, the Lansing Planning Board , on April 14, 2008, reviewed a Subdivision Application submitted by Applicant Rick Pinney, Jr . , for a minor one lot residential subdivision of certain land, located on Farrell Road , Lansing, New York a.nd otherwise known as Tax Map Parcel 439.-1 -18; and WHEREAS , the Planning Board has considered and carefully reviewed the requirements of the Town' s Laws relative to subdivisions and the unique needs of the Town due to the topography, the soil types and distributions, and other natural and man made features upon and surrounding the area of the proposed Subdivision, and the Town has also considered the Town' s Comprehensive Plan and compliance therewith; and WHEREAS , the subject parcel is a minor subdivision and this is an Unlisted Action under the State Environmental Quality Review Act which requires environmental review; and WHEREAS, the Town of Lansing Planning Board is an involved agency pursuant to State Law governing local environmental review; and WHEREAS, on April 14 , 2008 , the Planning Board reviewed and considered the aforementioned subdivision application in the Lansing Town Hall , 29 Auburn Road , Lansing, New York 14882 and I _ DRAFT 05112M PB • resolved to waive a public hearing on the subdivision application , and to set a public hearing on the State Environmental Quality Review (SEQR) for May 12 , 2005 , and to accept the proposed subdivision application contingent upon an outcome of a negative declaration of environmental significance at the May l2 , 2008 SEQR review thereof; and WHEREAS, a public hearing concerning the environmental review, pursuant to the State environmental Quality Review Act, was held on May 12 , 2008 at the Lansing Town Hall at 29 Auburn Road, Lansing, New York 14882 and notice , posting and publication of the aforementioned public hearing was posted and published at least 14 days in advance of the opening of said hearing as required by law; and WHEREAS , on May 12 , 2008 , this Board, acting as an involved agency in uncoordinated SEQR environmental review, reviewed and accepted as adequate a Short Environmental Assessment Form Part I , submitted by the Applicant, and completed Part II and, if applicable, Part III, on the record ; and WHEREAS , by Resolution adopted on May 12 , 2008 , the Town of Lansing Planning Board determined that, pursuant to the provisions of the State Environmental Quality Review Act, the proposed subdivision will result in no significant impact on the environment and has issued a Negative Declaration of environmental significance for purposes of Article 8 of the Environmental Conservation Law; and NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS : RESOLVED : that the Town of Lansing Planning Board grant Approval of the Application for a minor one lot residential of certain land located on Farrell Road , Lansing, New York and otherwise known as Tax Map Parcel #39. -1 -18. Pinney approaching the Zoning Board of Appeals requesting an Area Variance on the newly created Flag Lot to erect an additional Duplex . Ms. Moynihan Schmitt expressed to the Planning Board that they could make a recommendation to the Zoning 'Board . Richard Platt again explained to the Members that a Flag Lot requires 1 Ve2 times the area . Mr . Pinney has 40,000 sq . ft. per dwelling unit, where 60,000 sq . ft. is required . AIso, the parcel is surrounded by Wetlands, and there will never be anything built around the property . The duplexes will be clustered together, and the Tompkins County Health Department has already given Septic approval for both buildings . We're a new non-ioofit that will do something about the problem—we'll build Green affordable housing locally using volunteers, and for every house sold hen, well build one in a disadvantaged country such . as Ecuador, Guatemala, or Mexico. Our partner, loumeyWays, Inc. provides the I purposeful travel packages to 14 countries, the foreign logistical work, and any extra ' volunteers. Ithaca Neighborhood Housing Services Inc. (fhtHS) provides the pre- purchase counseling and financing locally. We have dozens of people and groups lined up to work hen:, fmm three ranks: boomers with a social conscience. idealistic students, and folks wanting to learn more about Green Building or bask construction. In this way we can't help but sprout peace and open the lines of communiootion between Americans and citizens of other countries, one family at a time. Hard not to, really. Affordable housing is a crisis nearly everywhere in the world, and getting worse. Like _global warming or politics, we feel powerless in its face. Then we met Mateo Pablo, who came home from work in the mountains of Guatemala to find the Army murdering every man, woman, and child in his village. After burying his wife, children, and extended family, he walked to Mexico. He heard about our plans and came to ask for our help with. • a thousand-yard stare. After hewing his story, nothing in our lives seems hard . 1 ,. " Every month INNS turas out a dozen pro-qunlifed graduates from their award-winning system who can't find a decent, safe, affordable house to buy. Our board and staff have seen hundreds of strategies. Nothing worts as well as volunteer-built housing, something we've done locally, internationally. and in New Orleans. The house we built in Ecuador cost 53,000. With ten retinal teachers we built it in 15cr than a week. A widower and his five kids moved in—improved their standard of living 1000%. For what it coca to build one low-income home here, we can build a village in Guatemala. One for one is a start. In collaboration with the Ithaca Green Building Alliance, we've designed House 1 , an expandable super-insulated, passive-solar, convectively-cooled house, and at this writing aro negotiating to purchase lots to begin construction in May 2008. We wont "blitz build," us some groups do. Our priorities are that voltmeters team the skills we're using in a safe, structured, mentoring environment, and that the quality is equal or superior to a contractor-built home. We also hope to have fun along the way. Labor savings from using voltmte 'rs makes the house affordable, yet we will be able to take 23,000 off tate top for materials plus travel expenses for staff to make sure the foreign house is built well. yySaeecss Measures: Our business model shows two houses neat year, four in 2009, six in ' 10, eight in ' 11 , and ten in ' 12. We'll also track savings and educational attainment of the homeowners and kids, both locally and internationally, trended and compared to average over time. We'll track the number and type of volunteers, and conduct surveys to team if we helped them become more empowered, get a better job, or work on their own home. Need : Tiny Ithaca (pop. 30,000) will need 2,556 new affordable homes, rental or purchase, over the next 1. 0 years (County Planning Dept 2006 Affordable Housing Assessment). iNHS's grads are the credit-worthy working poor—single parents, young blue collar couples, teachers, police and firefighters. [ANIS averages 10- 15 new units per year using available government subsidies, and they mostly use it all up. It' s the same story all over the country. We're not keeping up; it's getting worse. The local Habitat has built 3 in 15 years. The private sector can't build a good home for less than S 180,000. Internationally, spin the globe and find need—should I waste time making the eeea for millions of units of decent safe affordable housing in the "third World? The better question is--do people feel the need to do something about it? The answer is yes. The ® Ithaca Journal wrote an editorial in support of our 50I (c)(3) application ; our llmdraising is ahead of pace, and we may have to limit participation to pre-registered groups only, based on high demand. Building is flm and empowering. In Ecuador, one of the retired teachers threw up her fists alter laying Mock all day and shouted, "I can build ANYTHING ! " We ALL laughed. That's not talk--chars peace. Two bottles next year, four the next. . . People feel the Need—to help. To ace The housing market has never adequately addressed workforce housing--it doesn't pay. Americans in poverty can find public housing, but the working poor get stuck in substandard apartments or buy trailers, which quickly lose their value. Seniors who have owned their homes for forty years are being forced out by rising property taxes, despite exemptions. Rent locally is high relative to value. Middle class .renters can't afford the dl 80K price tag of a decent house, but am usually qualify for amend $ 130K. But they need to put $50K into anything they can find to make it livable, and typically use home equity schemes to find the money. This dynamic drives the price of the low end up, so basic shacks sell for $ 129,999. The more permanently-affordable Green housing stock we can add to the mix, the better for everyone, except the slumlords and flippers. A high- effieicney home addresses climate change, and a thoughtful, sensitive approach to foreign projects opens peaceful lines of communication. it's hard to hate Americans when they helped you build your house, or school. E . for the Developer appeared before the Board for a Preliminary Site Review of the proposed Condos/ Townhouse Development. The project will be located North of Michaleen' s Florist and Garden Center on the West side of N . Triphanuner Road across from Horvath and Asbury Drive . Mr . Buhl stated he took into consideration previous comments from the Planning Board such as adding bus pull offs, more open space and the possibility of sidewalks. Mr. Buhl did indicate that they have concerns with putting in sidewalks as they create more runoff. In addition, due to the road width , they may have to put a pedestrian walkway on one side in place of sidewalks . Two of the comments in the T. G . Miller comments were addressed . They were the fourth bullet and the fifth bullet below . The road will not be dedicated to the Town. Easements for emergency vehicles will be provided . Jeffrey Overstrom of T.G . Miller offered the following comments via email . Cayuga Farms Townhomes Subdivision — Site Plan o The Storm water pollution Prevention Plan (SWPPP) and the Erosion and Sediment Control Details should slide that no more than five acres will be disturbed at any time . Plans and ® details should address the sequence of construction activities to show how this will be accomplished. • The Contractor Certification Statement in the SWPPP is not the same as the Town of Lansing Local Law Number I of 2005 , Stonnwater and Erosion Control, Article 2 . Section 2. 0 .5. Contractor Certification. • It is not clear how sediment during constntetlon will be contained, monitored and removed. • 'frees are shown in channel to Forehay 5 on ST-2 (2/7/08). o The radius of the intersection on ST-3 (2!1/08) should be 40 feet minimum in accordance with Town of Lansing Specifications for Town Highways. Timothy Buhl indicated it would be built privately then dedicated to the Town when. completed . It would then become a public sewer for anyone to use . The actual route has not been chosen, although there are two alternatives . It would depend on who would like to participate financially or easement wise could change the economics of how it actually gets tied in . This would be a publicly dedicated sewer that would go along townand county roads for part of it, and also through private property as well . Connie Wilcox cautioned Mr . Buhl that he may have problems with obtaining easements on private property for the installation of the sewer from Lansing Town residents as they do not want development brought into the area . It was requested by the Planning Board that the Fire Department Review the proposed development and provide comments . Larry Zuidema inquired if the issue with regards to the right of way has been resolved with Michaleen' s. Timothy Buhl stated he was advised by the Town Attorney and his client' s Attorney was that the piece in question can be used 41 according to the deed , even though it is still owned by MViichaleen' s . The Developer must pay for the connection ( build the road) . Ms . Moynihan Schmitt advised that it would be okay to set a date for a SEQR Review Public Hearing, however, she would not recommend any further action on this project until the sewer issue is ironed out. Ronsvalle is looking into a 4 . 15 acre parcel on North Triphammer Road, on the west side across from the 1-lolochuck Subdivision for the erection of Apartments . Mr. Ronsvalle would like to go through with a PDA, however, the area is in a R1 which requires 5 acres . Mr. Platt inquired from the Board if they would consider a waiver on the amount of required land . The Planning Board Members felt that Mr . Ronsvalle's request was a Zoning Board of Appeals jurisdiction. IMR Richard Platt advised the Board that IMR would like to expand their parking . Mr . Platt believes there is a drainage ditch-check damn where the expansion may be going. Mr . Platt will retrieve the original maps and bring them before the Board at the June 9, 2008 Meeting. New Subdivision Law Nancy Loncto requested that the Planning Department provide each Member. with a copy of the updated Subdivision Law . 25 DRAFT 05112:o PB Web Site Update Nancy Loncto made a motion requesting that all 100 items (Excel Spreadsheet) that have been reviewed by the Planning Board , as well their comments and the 1 own Board comments posted to the Town Web Site. Recognition of Employees Richard Platt and Rachel Jacobsen recognized for their hard work . Recent Journal Article Deputy Supervisor, Connie Wilcox advised all present that the Town Board did not take any action on any of the Land Ordinance, nor do they plan to for at least a couple of months . The Town Board does plan on having Public Informational ® Sessions . Ms . Wilcox further stated she was highly offended that she was told by a Reporter that the Town Board was holding a "Special Meeting" this week to pass the Ordinance . Further more, Ms . Wilcox wanted to make it perfectly clear that the Town Board is not ram roiling anything through, and if both Boards want to work together and have proper communication, providing incorrect information to a Reporter is not the way to do it. in addition, the " little thing" published in the Journal today is a lot of miss information . Matthew Besemer, Town Board Liaison advised the Planning Board Members that after the dual Meeting, the Town Board went along with a lot of the Planning Board recommendations and made changes . Mr. Besemer further stated the Article submitted to the Ithaca journal was very premature .
