(on tape for further explanation) * * * March 31 , 2008 (ibid. serves a similar purpose to ditto marks) START HERE - - - -AT C . 23 PLANNING BOARD SHOULD RETAIN ALL RA AND R3 SITE PLAN — PRINCIPLE OF CANARY IN COAL MINE - - - C . 23 All full site plan before the PB — If in these areas we are going counter to developing other business areas ; transparency to public; — except for where it is not allowed at all (need facts to substantiate necessity of change) C . 24 ibid DRAFT 0331 /'08 Planning Roan' • C. 25 ibid maintain no -outside storage and landscaping, lighting (ancillary if in house) — need to be allowed in IR with site plan C . 26 ibid — needs to be allowed in IR with site plan C. 27 ibid C . 28 RA should have site plan review ( agricultural use is preferred use and needs to he protected) issue of outdoor storage ; IR should allow and allow outdoor storage — keep special condition from B I should remain and apply in R3 - - all should have site plan by PB (if more codifying then perhaps in-house B1 and B2) ? F . 3 OK F . 4 OK OBSERVATIONS ® SUBSTANATIVE REASONS 4 • DRAFT 03/3 I /08 Planning Boom • ON -GOING CONSIDERATION AND EXPERIENCE NO DESIRE TO OBSTRUCT FACT, CASE LAW, AND LIKE SOME CHANGES PEOPLE LIKE TRANSPARENCY ( RESTRICTIONS VS PROTECTIONS ) REVIEW SCHEDULE ii PREPARE OVERVIEW COMMENTS All agree that in-house checklist is too large a step at this time (more needs to be codified in the zo) Some Members requested that the Town Board provide the Planning Board with a written list of the reasons for the changes . Ms . Moynihan Schmitt expressed. to the Members that she would be happy to compile a list of items of which there is disagreement in advance of the joint working meeting. 411 Nancy Loncto made a motion requesting that Ms . Moynihan Schmitt compile an overview on the bases of the Town Board ' s recommendation that the Planning Board does not agree with and vice versa Lin Davidson seconded . VOTE AS FOLLOWS : Thomas Ellis - Aye Nancy Loncto - Aye Viola Miller - Aye Larry Sharpsteen - Aye Larry Zuidema - Aye Lin Davidson - Aye MOTION CARRIED. Cayuga Farms Ms . Moynihan Schmitt indicated that there was discussion at the last meeting whether this needed to be a FDA . Ms . Moynihan Schmitt has communicated with the Developer' s Attorney and his position was that there is not going to be any subdivision or selling off of any individual parcels and it does meet the density requisites of the Zoning Ordinance . Only one section of the land will be subdivided off. Ms . Moynihan Schmitt further stated that the Planning Department must have a formal Application and a project description before the Board can move forward . The Town Board is requesting a Developer' s 5 • DRAFT 03../3IrO,a Planning Board • Agreement before they go forward, in particularly before the Town Engineer reviews any Site Plan prior to any Sewer plans . Guy Krogh is currently preparing a Developer's Agreement for the Town to sign. Mark Wheeler, Counsel for the Developer is asking once the agreement is accepted by the Town, that the Planning Board give approval for David Herrick to start his review . Lin Davidson advised the Members that they will review the " ln-House" Checklist at the end of their 1st Meeting of the month . Larry Sharpsteen made a motion to close the Meeting at 9: 00 PM . Lin Davidson seconded .
