Public/Member/ Comments/Concerns Larry Zuidema shared with the Members that he had attended the Agricultural Farmland Protection Grant Workshop on behalf of the Town . Larry Sharpsteen indicated that Ronald Seacord is interested in coming forward for a Developer's Conference. Mr. Seacord , the Town Board and a State Representative met to discuss the Sewage Plant that was proposed by Mr. Seacord ' s Engineer . Mr . Sharpsteen further stated he attended the Tompkins County Better Housing Workshop on Nodal Development given by The New York Planning Federation . Mr . Sharpsteen will share the information he gathered at a later Meeting. l APPROVED Amaided3/24+08 PB Site Plan Review- Applicant: Timothy Cornell/ T .T. Landscaping Buck Road, Tax Parcel # P/O 28. -1 -28. 32 Timothy Cornell appeared before the Board for a Site Plan Review . After reviewing the material previously submitted, additional information was requested such as, what the planting would be to the East. Mr. Cornell did not see the need to spend additional dollars to plant trees to face a State Road when his building will be 360' from that road . Mr . Cornell' s concerns are more residential and plantings to the West and front reflect that concern in his site drawing . There will be no lighting at this time on the building . Mr. Cornell has stated for the record if in the future he decides to add lighting it will be installed to the Town Codes . Thomas Ellis stated for the record that this was approved via a Variance from the Zoning Board of Appeals . Mr. Ellis inquired if there were any restrictions placed on the Variance by the Board . Richard Platt advised the only requirement would be that Mr. Cornell appear before the Planning Board for Site Plan Review . Larry Sharpsteen made a motion to approve the Site Plan process to this point and remand the enforcement of the current plan to the Code Enforcement Office . Larry Zuidema seconded . VOTE AS FOLLOWS : Thomas Ellis - Aye Nancy Loncto - Aye Viola Miller - Aye Larry Sharpsteen - Aye Larry Zuidema - Aye Lin Davidson - Aye MOTION CARRIED . 1 Lot Subdivision - Applicant: Roger Sovocool, Old Orchard Road Tax Parcel # 12. -1 -15. 32 Roger Sovocool appeared before the Planning Board requesting a One Lot Subdivision . Mr. Sovocool owns approximately 26 acres of land off from Old Orchard Road and would like to sell the frontage portion which is approximately 11 . 5 acre parcel to a neighboring landowner. The remaining rear land would not have access to the roadway . Mr. Sovocool and the perspective owner plan on creating a 30' right of way through the middle of the property , which borders the stream to the back parcel . There is an old logging road on the parcel that will be used for access to a certain point of the back property . Mr . Sovocool further gave a description of the lay of land stating there are three streams on this property , and some points of the property are unable to be reached due to the terrain . 2 APPROVED Amended 3(24/08 PH • If approved , Mr . Sovocool would encourage the Town to put restrictions on the approval indicating that this is not a building lot and can not be built upon . The family would like to retain the back parcel for recreation/ natural purposes. Larry Zuidema inquired if Mr . Sovocool had considered putting the property into a land trust. Mr. Sovocool has checked into a land trust in the past . What has held Mr . Sovocool back is if a conservation easement is granted, it does not reduce the value of the land , it would have to be deeded over to the trust. Larry Sharpsteen reminded the Board that in the Subdivisions Rules and Regulations the town can not create a land locked parcel . Mr. Sharpsteen states the only way the Planning Board can consider the request is to clearly state that the land can not be subdivided in the future . Lin Davidson felt the Board should inquire from Lorraine Moynihan Schmitt if the right of way as described would make it a not a land locked parcel . Thomas Ellis stated the Board can create a Flag Lot, but does it have to be a surveyed Flag Pole . Mr . Ellis is concerned about creating a Flag Lot that does not have a defined entrance and exit for the future . Larry Zuidema states it is possible to have a right of way on a piece of land that is undefined . It is in his deed that he may choose where he would like to go . Roger Sovocool stated he was planning on defining it generally . It would be defined as running along south bank of the stream for approximately so many feet then, adjoining a logging road and then up to the top . A survey would not be done by meets and bounds . Thomas Ellis had concerns with future of the property if it were to be sold the next person could come in and build a dwelling on it . Richard Platt, C . E. O . advised the Board that a Building Permit would not be issued without an owned access . The Zoning Board of Appeals would have to grant them the right to build . Mr. Sovocool brought to the Board' s attention that according to the current "D'own' s Rules and Regulations, a Flag Lot must not be back more than 500' from the road and his is 600' . In addition a 30' deeded access is required as oppose to a right of way both of which would require a Zoning Board of Appeals Approval . However, the Planning Board may waive those requirements according to the Code Enforcement Officer . 3 APPROVED Amended 3l2410S PR ® The deed restrictions of no subdividing or construction of any non temporary structure will be in the deed and on the map . It was the consensus of the Board to await a reply from Lorraine Moynihan Schmitt. 1 Lot Subdivision - Applicant: Rohn Howell, Agent for Howland, 156 East Lansing Road, Tax Parcel # 20. -1 -23 John Howell appeared before the Board requesting Subdivision approval in order to subdivide and a portion of his Mother- in- Laws property . The entire property consists of five (5) acres of which the house and two (2) acres will be sold and the remaining 3 acres will be placed in a trust for the daughters to use for agricultural purposes . A Survey is being prepared at this time by T . G . Miller, P .C . Larry Sharpsteen stated for the record that a precedence does exist for not always having a prepared Survey Map at the time of the Planning Board Meeting . Larry Sharpsteen made a motion to approve the one ( I ) Lot Subdivision contingent upon completion of the Survey and successful completion of the SEQR . Viola Miller seconded . Larry Sharpsteen requested for the record that it be noted there will be no further development on the lot as the house is already existing and set back over 200' from the road . SEAR Review- Howland, 1 Lot Subdivision The Planning Board reviewed Part I of the Short Environmental Assessment Form completed by the Applicant and completed Part ll . No significant adverse environmental impact or effects were identified in Part It by the Planning Board Members . Lin Davidson made a motion to declare a negative declaration . Thomas Ellis ® seconded . Developer's Conference - Cayuga Farms, Applicant: WB Property Group, LLC North Triphammer Road (Condo/ Townhoresl Development, Tax Parcel # 37.1 -6-3 . 362 Gary Bush appeared before the Board on behalf of Timothy Buhl . Mr . Bush is requesting Site Plan approval contingent upon the connection of the Sewer System . There are two options for the system . One would be to go south along "Triphammer Road and connect in with Cayuga Heights, or go up Hillcrest and connect to the Town ' s system . They may also be able to bring others on board to help defer the cost if they go the Hillcrest route . Before any the further development occurs, the Developer would like to make sure the overall Site Plan is acceptable . ® Larry Sharpsteen clarified for the record that this is a " Developer' s Conference " not for consideration of any site plan . Secondly the last time the Planning Board saw this proposal, it was to be developed using on site disposal . Tentative site locations for the fields were already set up by the Tompkins County Health Department. Mr. Bush indicated the feeling was that eventually this would be tied into the Municipal Sewer System . By doing it now they would for go all the future issues . Prom what Mr . Bush understands, the Developer is more than willing to install the system, and absorb most if not all of the cost. Thomas Ellis stated the Sewer project is a dead issue and the Developer would most likely have to go back to the on site systems . Richard Platt explained that the Developer and John Young would be working on this project together. Matthew Besemer inquired if the Developer had spoken with any other municipalities regarding the Sewer proposal . Larry Sharpsteen stated easements from landowners and other entities must be obtained prior to moving forward . A lot of homework has to be done. Mr. 5 APPROVED Amended 3i24108 P13 Sharpsteen further stated he believes that the Planning Board has on record approving the idea of having the increased density in that location . For two reasons; 1 . It was in an area where eventually there would be infrastructure . 2. The board took the time to look at the roads so curb cuts onto Triphammer Road would be limited and greatly mitigate any traffic concerns that the Board has had with regards to other potential development in the area . The concept itself has not changed from the previously reviewed one . There are a lot of items that need to be filled in . Overall the Boardis in favor of the location for high density development. Viola Miller suggested that the Engineer research the cost of putting in this Sewer to see if indeed it is feasible before moving forward . Some Members felt that if installing sewer is unfeasible, then their only other choice would be a PDA . Larry Zuidema requested that the plan include some recreation space . Larry Sharpsteen agreed, and suggested that the Engineer visit the NY Planning ® Federation website for guidelines on open recreation space for certain density . Thomas Ellis requested a bus stop / pull off from Triphammer on the loop road . Viola Miller suggested sidewalks . Mr. Bush was advised that the Planning Board could not guarantee this concept in a year or two . The Town Board would have to provide any guarantees . Approval/Denial of Minutes for February 25, 2008 Larry Zuidema requested his comments on page 4, be combined and re- numbered if needed . Lin Davidson requested on page 5 , the word " use " should read " useable" Thomas Ellis made a motion to approve as amended . Larry Zuidema seconded . PB/ZBA Comments/Concerns on the proposed Subdivision Rules & Regulations & Land Use Ordinance Lin Davidson began by advising the group that he did speak with Scott Chatfield an Attorney who specializes in Planning and Zoning Law . Mr . Chatfield has agreed to review the document for the Board when they are ready at a cost of $175. 00 per hour or 52-3 thousand to review the entire Ordinance . Mr. Davidson has stated there is money in the Planning Board budget. Larry Sharpsteen : is requesting that Site Plan Review be required for all Commercial Development in the RA . Since this is RA, the Planning Board had real concerns about constraint with regard to the size of curb cuts, adequate buffering for surrounding Residential and Farm Uses . It was Mr . Sharpsteen' s understanding that Site Plan Review was never an onerous requirement for Commercial Development in the RA area and he believes it should remain that way . ® Thomas Ellis : Would like all zones to have Site Plan Review Linda Hirvonen : Concerned with the " Exempt" Subdivision change (letter submitted to PB previously) Thomas Ellis agreed with Ms . Hirvonen . Gregg Travis : Would like to see the number of lots that fall under " Minor" Subdivision defined . Larry Sharpsteen : Previously it was discussed to have " Subdivisions" and " One Lot Subdivisions " . Anything that was not a One Lot Subdivision would be a Subdivision . Everything that was a Subdivision would fall under the same rules that the Board called a " Major Subdivision" . Mr . Sharpsteen recalls this being a ✓ ote, but never being transcribed into the document. Viola Miller: All Subdivisions should come before the Planning Board . Ms . Miller feels the in house approval of Subdivisions will create too much of a load o n the ? Planning Department (can ' t be called that, no Planning done in the o ffice, ? Ordinance Department (can' t approve their own work) . The Board must be able to visually see on how the Subdivisions are laid out on a larger map for long term planning . Linda Hirvonen : Agrees with Ms . Miller . The Planning Board must keep track of these Subdivisions . 7 APPROVED Amended ded 3/24)08 P13 Nancy Loncto inquired from the Town Board Members present as to why the Town wanted to move in this direction , was it to speed the process up ? Matthew Besemer & Connie Wilcox : indicated yes . Larry Sharpsteen : States it was his understanding that the Planning Board already took back the One Lot Subdivision approvals and no further Subdivision Rules & Regulations were being discussed . All recent emails Larry received had to do with Ordinance changes . Larry Zuidema : Read the proposed description of the Planning Board and their role and function. Larry mentioned the word " certain " Subdivisions . Mr . Zuidema wondered if this was in accordance to State and Local Law . Mr . Zuidema would like to see this changed . Larry Sharpsteen: Does not believe it is in accordance with State Law . The Planning Board is strictly responsible for. Subdivision approval . Lin Davidson: Feels that In-House Site Plan when it is in a Residential neighborhood with regards to an - In Home Business should be handled through the Planning Board . S Linda Hirvonen: Feels the side lot setbacks of 10' is not enough to provide for what may happen in the future . Larry Sharpsteen and Thomas Ellis agreed with Ms . Hirvonen . Gregg Travis : Suggested looking at the front yard set backs as they may be too much. Linda Hirvonen : Suggested that the Board take a look at their Sign Ordinance and consider changing the number of Real Estate Signs an individual can have on their property . Nancy Loncto : Encouraged the Town Board Members to have an Informational/ Education Session for the Public other than just the Public Hearing. Viola Miller agreed . Nancy -Loncto made a motion recommending that the Town Board hold at least one (1 ) Informational Session for the Public regarding the proposed changes to the Subdivision Rules & Regulations and the Zoning Ordinance . Larry Zuidema seconded . Thomas Ellis : Stated for the record that there are major changes being made and he feels there should be a joint meeting between the Planning Board and the Town Board to discuss these changes . Lin Davidson : Reiterated that he feels the Planning Board should allow Scott Chatfield to review the documents . Larry Sharpsteen : Stated the Planning Board and the Town Board need to come together and discuss some of the things suggested being changed to " In-louse" Site Plan Review and Site Plan allowed to not allowed . Nancy Loncto : States one of the items brought forward by the Planning Board to the Town Board was Landscaping. The Planning Board recommended each district have their own requirements and that did not get incorporated in the Checklist . Larry Zuidema : Indicated a major change that was made without consultation with the Planning Board was the " In-house" Site Plan Checklist. It was Mr . Zuidema ' s understanding that the Planning Board should have a purview of Town development . If the Planning Board Members review the proposed Zoning changes, they will notice that several Commercial Business Uses and Industrial Use now will be out of the Planning Board hands. Viola Miller : Advised the Members that according to the Law, the Planning Board is responsible for Subdivisions . As for Zoning, it is the Town. Board' s purview and the Planning Board will assist at the request of the Town Board . Larry Sharpsteen : Stated the Planning Board ' s main priority is to clarify what the definition is for the responsibilities of the Planning Board in the Zoning Ordinance. Connie Wilcox : Agreed that the "Down Board will meet with the Planning Board for a joint Meeting. Ms. Wilcox advised the board to write down the issues that 9 APPROVED Amended 3124108 Pe they are concerned with from the most important to the least. Put together an Agenda to follow . A Moderator will be hired to facilitate the meeting . Nancy Loncto made a motion requesting at the next working meeting on March 24, 2008 at 6:00 PM that the Planning Board prioritize and itemized their concerns with the changes to the Zoning Ordinance for a discussion within 30 days subsequent to that meeting with the Town Board . Budget Information Nancy Loncto inquired from Connie Wilcox if there are resources in the Planning Budget. Ms . Loncto stated that possibly in the future, the Planning Board may wish to hire an additional legal consultant to review the final document. Ms . Wilcox will look into this for Ms . Loncto . Before any the further development occurs, the Developer would like to make sure the overall Site Plan is acceptable . Larry Sharpsteen clarified for the record that this is a " Developer' s Conference" not for consideration of any site plan . Secondly the last time the Planning Board saw this proposal , it was to be developed using on site disposal . Tentative site locations for the fields were thready set up by the Tompkins County Health Department. Mr . Bush indicated the feeling was that eventually this would be tied into the Municipal Sewer System . By doing it now they would for go all the future issues . From what Mr . Bush understands, the Developer is more than willing to install the system, and absorb most if not all of the cost. Thomas Ellis stated the Sewer project is a dead issue and the Developer would most likely have to go back to the on site systems . Richard Platt explained that the Developer and John Young would be working on this project together . Matthew Besemer inquired if the Developer had spoken with any other municipalities regarding the Sewer proposal . Larry Sharpsteen stated easements from landowners and other entities must be obtained prior to moving forward . A lot of homework has to be done . Mr. Sharpsteen further stated he believes that the Planning Board has on record approving the idea of having the increased density in that location . For two ® reasons; 1 . The board took the time to look al the roads so curb cuts onto Triphammer Road would be limited and greatly mitigate any traffic concerns that the Board has had with regards to other potential development in the area . The concept itself has not changed from the previously reviewed one . There are a lot of items that need to be filled in. Overall the Board is in favor of the location for high density development. Viola Miller suggested that the Engineer research the cost of putting in this Sewer to see if indeed it is feasible before moving forward . Some Members felt that if installing sewer is unfeasible, then their only other choice would be a PDA . Larry Zuidema requested that the plan include some recreation space . Larry Sharpsteen agreed , and suggested that the Engineer visit the NY Planning Federation website for guidelines on open recreation space for certain density . Thomas Ellis requested a bus stop/ pull off from Triphammer on the loop road . 110 Viola Miller suggested sidewalks . Mr . Bush was advised that the Planning Board could not guarantee this concept in a year or two . The Town Board would have to provide any guarantees . Planning and Zoning -Law . Mr . Chatfield. has agreed to review the document for the Board when they are ready at a cost of $175 . 00 per hour or $ 2-3 thousand to review the entire Ordinance . Mr . Davidson has stated there is money in the Planning Board budget. Larry Sharpsteen : Is requesting that Site Plan Review be required for all Commercial Development in the RA . Since this is RA, the Planning Board had real concerns abou.t constraint with regard to the size of curb cuts, adequate buffering for surrounding Residential and Farm Uses . It was Mr . Sharpsteen' s understanding that Site Plan Review was never an onerous requirement for Commercial Development in the RA area and he believes it should remain that way . Thomas Ellis : Would like all zones to have Site Plan Review Linda Hirvonen: Concerned with the " Exempt" Subdivision change (letter submitted to PB previously) Thomas Ellis agreed with Ms . Hirvonen . 1$ Gregg Travis : Would like to see the number of lots that fall under " Minor " Subdivision defined . Larry Sharpsteen : Previously it was discussed to have "Subdivisions" and " One Lot Subdivisions " . Anything that was not a One Lot Subdivision would be a Subdivision . Everything that was a Subdivision would fall under the same rules that the Board called a " Major Subdivision" . Mr . Sharpsteen recalls this being a vote, but never being transcribed into the document. Viola Miller: All Subdivisions should come before the Planning Board . Ms . Miller feels the in house approval of Subdivisions will create too much of a load on the ? Planning Department (can' t be called that, no Planning done in the office, ? Ordinance Department (can ' t approve their own work) . The Board must be able to visually see on how the Subdivisions are laid out on a larger map for long term planning. If the Planning Board Members review the proposed Zoning changes, they will notice that Commercial Business Uses and industrial Use now will be out of the Planning Board hands . As for Zoning, it is the Town Board' s purview and the Planning Board will assist at the request of the Town Board . Larry Sharpsteen : Stated the Planning Board' s main priority is to clarify what the definition is for the responsibilities of the Planning Board in the Zoning Ordinance . Connie Wilcox : Agreed that the Town Board will meet with the Planning Board for a joint Meeting. Ms. Wilcox advised the board to write down the issues that they are concerned with from the most important to the least. Put together an Agenda to follow. A Moderator will be hired to facilitate the meeting . Items 3 and 4 are really the same item and should be combined and expressed as follows ( if necessary, check your tape and my notes which I provided to Dick on the night of the meeting) . Item 3 — Suggest the term "in- house" be defined in the document (ordinance ) with an explanation of the operational procedure and likely outcome - It is noted that several 503 section items under "C - Business" uses and " D — Industrial /Research" uses will now go for "in-house" review and will not, therefore, go to the Planning Board . These items are mostly large projects in which the Planning Board ® should be involved . This represents a major change in the relationship between the Planning Board , the Town Board , the Planning Department and the citizens of the Town itself.
