Scott Pinney Connie Wilcox General Business Lin Davidson called the Planning Board working Meeting to order at 7: 15 PM . Other Business Darby Kiley advised the Board that Timothy Cornell / JT Landscaping will be appearing before the Zoning Board of Appeals tomorrow, February 12, 2008 regarding a request for a Use Variance . If a decision is made tomorrow, Mr. Cornell will then have to go through Site Plan Review. Ms . Kiley asked permission for Mr. Cornell to be placed on the February 25, 2008 Planning Board Agenda for completion of his Site Plan Review . It was the consensus of the Planning Board Members to place him on the Agenda . Cayuga Way Subdivision Timothy Buhl, P. E. for the Cayuga Way project delivered a letter today to the Planning Department. They would like an extension for their actual start time. Ms . Kiley has reviewed the Subdivision Rules and Regulations and found no mention of when an applicant must start their project. At the end of the discussion the Board recommended that the Developer has 2 years to complete the Subdivision , If they are close to the 2 year arrark and are not finished , then they ask for an extension _ Public Comments/Concerns Resident Pete Peters of Salmon Creek Road appeared before the Planning Board with a concern. regarding en illegal SUbh.ivisian that was previously- filed with the Tompkins County Clerk' s office under the name of Common Field, Inc . c/ o Christopher H . Mu e . Mr. Peters asked the following questions : 1 . Is the Town going to fallow r up en this unauthorized Subdivision? :Darby- Kiley advised. Mr . Peters that she spoke with Air . i ePe last week regarding his illegal Subdivision and he has informed her that he will be changing his map to reflect SP ' of road frontage and 3 acre in sire, This will be taken care of as soon as possible . Mr . .Peters states according to his maps kir. ivluka does not have 300' of road frontage unless you include the bridge, guardrail or anything north. Mr . Peter states in order for someone to use the Nature Preserve/ .Public Recreation, they dimast pass on his easement in order to access the property . Public parking on Mr, Peter' s property is a major concern of his. Viola Miller inquired what is defined as :hu blic Recreation, and if used for public use, than someone should be responsible For it. Lin Davidson stated this was never approved es a formal Subdivision by the Tou 'n of Lansing Funning Board , Darby Kiley stated that the Town does not regulate parking . Jack French, Highway Superintendent for the Town states parking is e State Police or Sheriff issue . Mr . French further stated if all four tires are off the pavement, then they are in the Public' s right of way and can park there . Thomas Ellis requested that the Planning Board consider writing e letter to the Tompkins County Clerk asking her to rescind this transaction . Mr . Peter was asked what remedy he would recommend . Answer as follows = 1 . Not to snake i.t Publicly accessible ( private use why) 2 . Park away from Peter's property 2 DRAFT 02. 1 I -f04 Planning Board ® Thomas Ellis stated that the Planning Board should hold a Public Hearing on the use (Public Recreation) if this comes before the board again . Nancy Loncto felt the Board was acting prematurely on this issue. Until the Planning Board hears from the landowner or appears before the board with a request, no further action should take place . However, the Board will take Mr . Peter' s requests into consideration if Mr. Muka appears before the Planning Board . Lin Davidson advised Mr . Peters that his Attorney would have to research what the definition of " easement" is on Mr . Peter' s deed . Members felt if they had a description of Public Recreation, they could handle this issue better when and if Mr . Muka appears before the Board with this particular request. Larry Sharpsteen made a motion requesting that the Planning Board refer the illegal filing of an un approved Subdivision performed by the County Clerk' s Office to the Town Board for further resolution recognizing in the meantime that the Planning Department has already initiated correspondence with the County 410 and the property owner regarding the matter . The Planning Board not having any enforcement capability is looking to the Town Board for guidance . Nancy Loncto seconded . VOTE AS FOLLOWS: Thomas Ellis - Aye Nancy Loncto - Aye Viola Miller - Aye Larry Sharpsteen - Aye Larry Zuidema - Aye Lin Davidson - Aye MOTION CARRIED. Nancy Loncto requested from the Planning Department that if Mr . Muka returns to the Planning Board with this request, that all minutes be provided before for reviewing . Board Conduct/Professionalism Supervisor. Pinney appeared before the Planning Board requesting that the Town Board and the Planning Board work professionally together on all issues . Mr. Pinney has reviewed the tape from the January 28, 2008 meeting and heard items that were very disturbing to him. Mr . Pinney would like both boards to do what is right for the town . At this time, Supervisor .Pinney is requesting that all 3 DRAFT er- I i w1R canning rani personal issues be put behind and both boards start with a clean slate, Mr . Pinney expressed to the Members that his office door is always opened, and phone calls are welcomed too, Viola Miller explained that the board started in 1967 and it wasn' t until recently that problems began between the two boards . Ms, Miller further explained that the boards have not always agreed on things but they have managed to work problems out. Lin Davidson thanked Mr . 'Pinney for including the Planning Board Members in the ' 'own Board' s special meetings . Larry Sbarpsteen felt in the last three years it has been a disaster . In the past, the Planning hoard had always worked together with tire Town Boards . Larry welcomed the inclusion and would welcome more information as to what is going on in the Town . Clear signals need to be given to the :Plaruung Board as to what is expected from them by the Town Board , harry Zuidema states he is new to the Board and would be interested in the " bigger picture issues" _ Mr, Zuidema suggested that the boards meet more frequently to discuss just these types of items . Town Board Liaison Report Matthew Besemer clarified for the record that the Special Meeting this week has been changed to Friday , February 15, 2666 et 730 am in the large Court doom . Matthew updated the Planning Board Members on what the Town Board reviewed at the last meeting which was, reviewed the Ordinance Chart, and obtained definitions . The Torn still has monies left over from the halt Point Grant_ These funds will be used to brush hog and clean up the area for visibility purposes . A loop road will be installed , as will swimming be allowed at your ewe risk , Mr . Besemer presented a Map of a proposed Football Field which will be across the road .From the Town Mali . The Town has authorized $1 ,000 to be spent on the drain , The installalion of the Field will be put in with donations. The reason for the new field is for the youth football . They have organized a Vonunittee to raise the funds for this project_ Town Employees, if not busy and Town equipment will be used . Approval/Denial of January 28, 2008 Minutes Maned 1_.c ncto requested on pale 5 under ether Business, ho paragraph it should read : d DRAFT 02 - 11 -ON Planning Board ® Nancy Loncto advised the Members that at the last Town Board Meeting it was discussed that the Planning Board should also be looked into. Ms . Loncto recommended that members look at the Board as a whole and come prepared with any recommendations they see for the Board . Thomas Ellis requested on page 4, under Viola Miller, the word is should read it. Nancy Loncto made a motion to approve as amended . Larry Sharpsteen seconded . Norfolk Southern Train Thomas Ellis expressed to the Town Board Members present that he recently has had three different residents from Myers Heights complain to him regarding the train idling on the tracks near their home . Connie Wilcox stated that Supervisor Pinney has made a call to Norfolk Southern regarding this issue. Mr . Pinney was advised this only happens in the winter. Due to complaints in the Ithaca area, they moved up the track to Lansing. Proposed Subdivision Rules and Regulations Other Business The Board reviewed Ms . Moynihan Schmitt' s notes from the previous Planning Board Meeting. Notification to Neighbors 600' Nancy Loncto questioned when there is a large parcel to be subdivided is there another way of notifying neighbors that are beyond the 600' ? Darby Kiley advised if a Public Hearing is required on any Subdivision, then it is published in the Ithaca Journal . 11 Lin Davidson stated in other counties he has seen a sign on the property . 1,1 DRAFT 112 - I I -52 Planning Guard Nancy Loncto would like to sec a sign. Larry Sharpstes.n had a problem with putting signs on properties. Further discussion an notification-signs can be discussed later. Deadlines Nancy Loncto suggested that they change the wording from 62 days to : ax number of regular meetings as the determination factor . This change will allow frit the numerous Monday holidays that fall on the Planning board Meeting night. Darby Kiley indicated that the number of days might follow what is in Town Lay . Tarry dharpstaan stated the next day after the holiday would be the default date . Nancy Loncto recommended if one of the Planning Board Meetings fall on a holiday , the Board should consider changing the meeting dates so that they meet twice within the month. This change would allow the client the ability to have the opportunity to come before the board in a timely way . 40 3 Aare Subdivision Larry Sharpsteen states he recalls at one time he believes that it vvas written into the Subdivision Rules Sr Regulations that when there is a 3 acre Subdivision a restriction was included that stated no further Subdivision of that parcel could happen . Members felt they should view all Subdivisions . Checklist Nancy Loncto requested that the " checklist" be added to the Subdivision Rules 8N Regulation document so that the Public can actually view it . Private Roads Members stated they believe private roads are allowed but, they must be built to nfowu Road Specs, lassifics tion The Planning Board should be making this determination . Subdivisions Remove discrepancies with wording on Subdivision . L' he. re is no 11vlinar or Major Subdivisions .
