Lin Davidson called the Planning Board working Meeting to order et 7: 15 PM .
Coneerns/Comments
Larry Sharpsteen inquired again as to why the Land Use Ordinance needed to be
converted to e Focal Lav ,
Lorraine Moynihan Schmitt, legal counsel, explained that from the Town Iloarh
perspective, a Local Law has more teeth in terms of enforcement purposes _
Larry Sharpsteen requested to go on record stating he did not feel this was
necessary , Viola Miller agreed .
Bantam Municipal Agricultural and Farmland Protection Planning
Grant
Darby Kiley explained that recently the Town was awarded e $25,000 grant for
Municipa [ Agriculture [ and Farmland Protection Plan Deve [ opment_ The grant
will be used specifically for updating the Agricultural portion of the Land Use
• Ordinance and to develop 3n Agricultural .Plan for the tow o. The money will be
used to hire a Consultant to complete the work .
• The board felt it would he advisable to match the Town' s efforts up with Cayuga
County .

• Larry Sharpsteen made a motion recommending that the Town Board consider
working with Cayuga County Municipalities on this farmland project. Nancy
Loncto seconded .

MOTION CARRIED.
Nancy Loncto recommended that someone from the Planning Board be
appointed to assist the Town Board on this new Committee . Three eligible
candidates from the Planning Board would be, Larry Zuidema, David Hatfield
and Lin Davidson .
Planning Department Report
Darby Kiley shared the following report with the Members .
• Building Permits : up I for December ( 7 permits in 2007 ) and up $ 3000 in lees collected
( because of Global Phoenix expansion ) ; 14 Certificates of Occupancy for December .-, 2
Fewer than in 2006 .
The total number of building permits in 2007 was 131 ( 2006 : 185 ; 2005 : 178 ) . Project
costs were down from 2006 but similar to 2005 .
For December n17 : The annual Mobile I tome Park and .funk Yard Licenses have been
renewed . There are 2 new businesses in town ( a beauty shop in home and chiropractic
practice) . In the coming months , public assemblies and bi - annual commercial
inspections will take place. Approximately 40 building inspections were completed in
the last month . A junk ordinance violation was noted and clean - up is in progress .
The Planning Board approved 13 site plan applications in 2007 .
Fee schedule is ready to approve . It is a formality fir Board to make resolution ( as
discussed several months ago , we compared fees of several neighboring municipalities ) .
Board will discuss resolution at the end of report .
Historical Records building : Planning Department provided a list of items to be
completed in order to issue a Certificate of Occupancy . Scott Weaver 1vorked on the
floor and some of the electrical and spent about S250 in supplies . The total cost to
complete the work with Town of Lansing labor is about $ 1300 ( with low - E windows ) .
• Board will discuss resolution at the end of report .

• Stonnwater — a public notice was issued last week about the SPDES General Permit for
Storrnwater Discharges from Construction Activity Permit No . GP -02 - 01 and the SPEWS
General Permit for Stormwuter Discharges from Municipal Separate Storm Sewer
Systems ( MS4s) Permit No . GP -02 - 02 , will continue and all conditions of those general
permits will remain in force and effect . " These general permits were set to expire on
January 8 , 2008 , but pursuant to die following Standard Permit Conditions contained in
these general permits, 0P132 -01 and CGP - 02- 02 will continue until new general permits
are issued . DEC staffexpect to complete review and response to those comments within
three ( 3 ) months . Until the issuance of new general permits related to stoimwater
discharges from construction activity and from MS4s , new and existing authorizations
will continue to be administered under the existing general permits ( GP -02 - 0 I and OP -
02 -02 ) . Ellen Hahn ( Stonmwater Control Specialist fOr Region 7 ) will hold a training
session for municipalities on the Construction and MS4 Permit Updates — February 20
8 : 30- 11 : 30 at Dryden Town Hall . Planning Department staff will attend . Other training
sessions will be planned for the spring; these will target contractors and others .
Subdivision : The current Subdivision Rules and Regulations states that all subdivisions
require Town approval , no matter what the hit size is . At the Enforcement Committee
meeting of December 5 , 2007 , the approval process was discussed and suggested that the
larger one- lot subdivisions (over 3 acres with 300 feet of road frontage) only need to be
approved by the Planning Department . However. according to the law , all subdivisions
n eed to 20 before the Planning Board for approval . Applicants can request a waiver
u nder Article 8 .
Darby talked to the Deputy County Clerk and asked that they not allow a subdivision to
be filed without a signature from the Town of Lansing! . She said that sometimes it is hard
to know that it is a land subdivision but that she will remind the staIT ofthat. They still
have a letter on filing with that request
Proposed Subdivision Rules and Regulations
Darby Kiley distributed the proposed changes made by Guy Krogh on the
Subdivision Rules & Regulations . The Members and Legal Counsel offered the
following concerns;
*Lorraine Moynihan Schmitt recommended the following :
Subdivision three step process
1 . Sketch Plan
2. Preliminary
3 . Final
According to the Members when the Subdivision Rules and Regulations were
u pdated a few years ago, a change was to be made to read : Single Lot
Subdivision. or just Subdivisions . Ms . Moynihan Schmitt will check into this
further .

*Nancy Lon.cto indicated under the portion where it says " Exempt Subdivisions"
frontage on a public highway versus a road should be clarified . A public
highway and road are two different things . There is no definition for public
highway .
*Larry Sharpsteen stated that he did not have a problem with this procedure for
Exempt Subdivisions however,
1 . The Planning Board should be informed by the Code Enforcement officer.
2 . The drawing gets signed by the current Planning Board Chairperson
3 . Determination Approvals / findings should be documented
* Larry Zuidema states the Planning Board should be involved with the
Subdivisions that are approved by the Planning Department . Mr . Zuidema is
concerned that the Agricultural land will be reduced considerably by allowing
landowners to subdivide without a process .
*Viola Miller stated one lot Subdivisions should be kept under the jurisdiction of
the Planning Board . If the Planning Board feels it falls under the exemption, they
can then turn over to the Planning Department.
*Lorraine Moynihan Schmitt suggested that the Stormwater process be clarified
• in the " Exemption " .
* Members had concerns regarding the 239 submittals on the 300' , 3 acre parcels .
*Larry Zuidema requested that Section 301 needs clarification .
* Na.ncy Loncto requested that under " Authority & Purpose" add reference to the
Comprehensive Plan
* Darby Kiley brought to the board ' s attention that Private Roads are listed in
Guy' s revisions however, it is was the Planning Board ' s understanding that the
Town Board did not allow -Private Roads .
*Nancy Loncto states under Preliminary Plat definition, it should include at the
end " or deemed necessary by the Planning Board. . "
*Lorraine Moynihan Schmitt questioned who classifies the project, Planning
Board or Planning Department.
* Nancy Loncto states under Subdivider, she would like to see that it states that a
® Town employee may not represent an Applicant. Matthew Besemer felt that it
could be taken care of internally as oppose to writing it in the law .

• *Larry Zuidema questioned in Section 702 (I) why some wording was crossed
out with regards to the building of a road . This needs clarification .
It was the consensus of the Planning Board to allow additional time for each
Member to review the proposed changes and offer any additional comments or
suggestions prior to the next Town Board Meeting, scheduled for Wednesday,
February 13, 2008 .
Other Business
Matthew Besemer announced to the board that Mr . Jeff Overstrom, a Lansing
resident has recently joined the firm of T. G . Miller, P . C . In addition, the Zoning
Ordinance proposals were given to the Town Board Members at their last
meeting . The Town Board will be holding a Special Meeting on Thursday,
January 31 , 2008 to begin their work on the changes.
Darby Kiley shared with the Board Members that her position as Environmental
Planner and Richard Platt, Code Enforcement Officer position (s) might be
terminated in the near future . Matthew Besemer gave further explanation as to
how the Personnel Committee is working through the process of filling the
position (s) with a Planner/ Engineer.
410 Nancy Loncto advised the Members that at the last Town Board Meeting it was
discussed that the Planning Board should also be looked into . Ms . Loncto
recommended that members look at the Board as a whole and come prepared
with any recommendations they see for the Board .
Approval/Denial of January 14, 2008 Minutes
Nancy Loncto requested on page 1 under Agenda Amendment in the first
sentence a space needs to be after was and before on. Also down further in the
third sentence it should indicate Mr. Cornell 's business . Mr . Loncto also
indicated there was a motion to forward the list of proposed Ordinance changes
as it stood to the Town Board and that motion does not reflect in the minutes .
Larry Sharpsteen did not appear only any of the votes .
Nancy Loncto made a motion to approve as amended . David Hatfield seconded .

to the Board at the next meeting.
