When the existing sewagesystem eventually fails a sewage system construction permit can
• then be requested for each house individually instead of sharing a replacement sewage
system as indicated on the conversion permit.
Based on this information in regards to Mr. Cam's project referenced above, a permit is not
required by our office for conversion of a sewage system at this time. This letter is for your

411 conditions that comply with the Tompkins County Health Department. Nancy

Site Plan & SEOR Review for Pre-Fab Carport Sales, 1793 East Shore
Drive, Tax Parcel # 37.1-9-15, R2 District, Applicant John Oaks, Agent
for: Charles Scott Oaks
John & Scott Oaks appeared before the Board for a Site Plan Review . Mr. Oaks
has been in the body shop business at this particular site prior to the Town of
Lansing's Land Use Ordinance took effect . It was brought to the boards
attention that there are concerns with the set back of the carport due to it
currently being 10' from the road right of way where as 50' is required under the
current zoning. In addition , the classification of " In- Home Business " for the
carport was considered an incorrect description and could set precedence for
future Planning Projects . After further discussion it was the consensus of the
board that it was an expansion of an existing non conforming use and should be
referred with a recommendation to the Board of Zoning Appeals for a Variance .
Larry Sharpsteen made a motion on behalf of the Planning Boardto recommend
the following to the Board of Zoning Appeals;
• The Planning Board for the Town of. Lansing while recognizing that the
auction in question falls under the jurisdiction of the Board of Zoning
Appeals feels that this in no way changes or erodes the existing character
of the neighborhood . There is a well maintained existing business on site
and this function is being added . Site Plan recommendation for the
business would be the positioning of the material (carport) is behind the
appropriate setback line .

Ms . Moynihan Schmitt noted for the SEQR, the Planning Department has
classified this as a Type II Action pursuant to Section 617.5 Sub . 10, this is a
construction in placement of a minor accessory / apartment structure such as a
Carport. Therefore no Public Hearing is required .

• Ronald Ronsvalle appeared before the Planning Board for a Site Plan Review for a
proposed In-Home Office as applicable under Section 802. 9 of the Town of Lansing
Zoning Ordinance . Mr. Ronsvalle intends on erecting a carriage house style garage
with a business office above. The existing lighting will remain . There will be no
signage. Drainage will not be an issue as construction will not exceed 1 acre. There
are currently several plantings on the property, and additional ones will be
appropriately added if needed .
Larry Sharpsteen made a motion to waive the Public Hearing based upon the
proposal fitting every classification of a Home Business in the Zoning Ordinance.

Site Plan & SEOR Review for Commercial Business
Peruville Road, Tax Parcel # PLO 30. 4-28. 21 , Applicant
Building Essentials, Inc. on behalf of : Scott Hotchkiss
Mr. Mark Mecenas, Agent for Mr. Hotchkiss appeared before the Planning Board
for Site Plan Review as applicable under Section 701 . E of The Town of Lansing
Zoning Ordinance. Proposed plans show that Mr . Hotchkiss, owner of
Wheaton' s would like to erect a commercial building for his Heating & Air
Conditioning business . Darby Kiley , Environmental Planner for the Town has
checked the site for unique natural areas, streams and wetlands and there are
none . An Ag Data Form has been completed , and a 239 submitted to the
Tompkins County Planning Department for their review . The down Lighting
footprints were shared with the members. Signage will be on the building. A
discussion was held with regards to large tractor trailers being able to turn
around on site. After further discussion the Planning Board requested the
following:
• A Site Map to scale with evaluations
• A Drainage Plan
• Parking Plan
• 60' Culvert Pipe (State Permit required)

Mr. Mecenas was advised to return on Monday, October 22, 2007 at 7: 00 PM with
the requested information in order to move forward .
Approval/Denial of September 10, 2007 Minutes
Lorraine Moynihan Schmitt requested on page 2, under Chairperson Resignation
that it read;
• Chairperson Resignation
Nancy Loncto distributed and read aloud for the record the following; letter of
resignation and moved to resign as Planning Board Chair .
On page 3 (bottom) should read as follows;
• Larry Zuidema made a motion for a vote of which carried .
On page 4 after MOTION CARRIED should read;
• Ms . Loncto renewed her motion requesting that the board accept her
resignation. David Hatfield seconded. .

Paragraph discussing Nominating Committee should note that the purpose is to
canvas for an interim Vice Chairperson and to make a recommendation to the
Board as to that potential Vice Chairperson .

Other Business
Darby Kiley stated the Town of Ulysses is in the process of changing their
Zoning Law and Lansing recently received notification from them regarding
their SEQR process indicating they will be the Lead Agency .
Larry Zuidema advised all that he attended the NYPF meeting in Saratoga
Springs recently . One in particular that he wanted to share was the " Right to
Farm Law in Ag Districts " . There is a new municipal grant program that will
allow municipalities to receive up to $25, 000 . 00 in funds that will allow an
outside consultant to come in and review your Ag situation, as well as other
costs related to that district. This will be an ongoing grant program . A meeting
has been scheduled for October 18, 2008 in Auburn . Mr . Zuidema has provided
material to Supervisor Farkas, Darby Kiley and Lin Davidson , for Town Use .
Larry Sharpsteen stated he has copies of the EMC Resolution. regarding the
process of adding to or deleting from any unique natural areas . Once the minutes
from that particular meeting have been received , he will gather the information
and forward to Rachel Jacobsen for distribution to the Planning and Town Board
Members. Mr. Sharpsteen further stated he wants everyone to be aware that
anybody could anonymously turn in a parcel of land to the EMC to be
considered as an added to the unique natural areas . No permission was required
from the land owner . Since this came to light, changes have been made however,
Mr. Sharpsteen did not get to see the proposed Resolution .
Thomas Ellis also attended the NYPF in Saratoga Springs . Discussion around
" Affordable Housing" took place and the City of Saratoga has a written Zoning
amendment to put into their existing Zoning Law . They have been working on
this change for 2 years and are still not completed with it. You can view their -

Cluster Housing was also discussed, and according to the experts, in order to do
Cluster Housing, the Planning Board must be empowered by the Town Board .
Nancy Loncto reported that a spreadsheet is being developed on all of the items
that the Planning Board is to be considering . This will be ready for review at the
® January working meeting and then passed along to the Town Board . Ms. Loncto

requested to have a copy of the 2008 Budget for. the Planning Board . Darby Kiley
gave all members a copy . After reviewing the budget, there is no allowance for a
paid Consultant. The Planning Board requested that Matt Besemer, Town Board
Liaison give feedback to the Town Board that a dollar amount ($150 . x 20-30 hrs)
for a Consultant be added to the 2008 budget.
Larry Sharpsteen made a motion requesting that the Town Board give
clarification to the PIanning Board as to whether they will give an allotment to
the Planning Board' s budget for an outside Consultant or if they would give a set
figure from their own contingency fund .

presentation on Planning Skills at the working meeting on Monday , October 22,
2007. Mr . Platt has attended this workshop and feels it is extremely helpful .

seconded .
