Mr. Oaks has been in the body shop business at this particular site prior to the Town of Lansing's Land Use Ordinance took effect . It was brought to the boards attention that there are concerns with the set back of the carport due to it currently being 10' from the road right of way where as 50' is required under the current zoning. In addition , the classification of " In- Home Business " for the carport was considered an incorrect description and could set precedence for future Planning Projects . After further discussion it was the consensus of the board that it was an expansion of an existing non conforming use and should be referred with a recommendation to the Board of Zoning Appeals for a Variance . Larry Sharpsteen made a motion on behalf of the Planning Boardto recommend the following to the Board of Zoning Appeals; • The Planning Board for the Town of. Lansing while recognizing that the auction in question falls under the jurisdiction of the Board of Zoning Appeals feels that this in no way changes or erodes the existing character of the neighborhood . There is a well maintained existing business on site and this function is being added .
