Ms. Loncto began by introducing the new Alternate Board Member, Larry Zuidema to the Planning Board. * CAYUGA WAY SUBDIVISION * Continuation of Public Hearing — SEORA Review Parcel # 40.-3-28. 1 & 40:3-28.2 The Planning Board Members reviewed Part 1 of the LEAF and completed part 2 of the EAF Form. (On file in the Code Enforcement Office). There were no Public comments regarding the SEQRA. Lin Davidson made a motion to close the Public Hearing at 7:29 PM. David Hatfield seconded. PUBLIC HEARING - FINAL PRELIMINARY PLAT-CAYUGA WAY David Hatfield made a motion to open the Public Hearing at 7 : 29 PM on the Final Preliminary Plat for Cayuga Way Subdivision. David Herrick, P . E. for The Town of Lansing offered the following comments : Re : October 23rd Meeting Agenda Dear Ms. Loncto, We ' ve reviewed the following project scheduled for the October 23`d Planning Board meeting and offer the following comments : Cayuga Way Subdivision — Preliminary Plat • I . Highway: a . A copy of a sealed boundary and topographic survey must still be submitted. b . A revised subdivision plat for the alterations within the Lakeview Subdivision should be considered by the Planning Board to guarantee that the road alignment as shown in the Cayuga Way development will actually be possible in the future. 2 . Stormwater Management: a . The design engineer, Mr. Buhl has addressed the majority of our previous comments, and has presented a response letter describing the reasoning behind some of the original items we identified as deficiencies. We still recommend changes to the plan to address some of these issues. In addition, we need to see a final complete set of plans and a revised SWPPP, since some of the edits described in Mr. Buhl ' s response letter are contained in the SWPPP or revised plans that we have not seen. The few items that need to be addressed include : 1 ) Provide a revised sheet ST- 1 . 2) Provide a revised SWPPP . 3 ) Revise pre-developed hydrology or demonstrate that the flow to point DP-2 will not cause erosive or flooding conditions immediately downstream. 4) Revise pond geometry based on discussions between T.G . Miller and Mr. Buhl. 5) Add some additional information to the existing maintenance and Construction Sequencing information based on discussions between T . G . Miller and Mr. Buhl. Lin Davidson made a motion to accept the following Resolution: RESOLUTION OF STATE ENVIRONMENTAL QUALITY REVIEW (SEQR) ,• NEGATIVE DECLARATION FOR THE PROPOSED CAYUGA WAY SUBDIVISION WHEREAS, after submission thereof, Developer John O'Connor has received preliminary approval of a Sketch Plan for a residential subdivision of certain land along Grandview Drive and Tiger Lily Lane in the Town of Lansing, said land being more commonly identified as the Town of Lansing Tax Parcel Numbers 40 .-3-28 . 1 and 40 .-3-28 .2, and said Subdivision to be known as Cayuga Way; and WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning Board is an involved agency for the purposes of environmental review; and WHEREAS, on October 23, 2006, the Town of Lansing Planning Board, in performing the lead agency function for its independent and uncoordinated environmental review in accordance with Article 8 of the New York State Environmental Conservation Law - the State Environmental Quality Review Act (" SEQR" ), (i) pursued its thorough review of the Long Environmental Assessment Form (the Full EAF or " LEAF" ), Part I, and any and all other documents prepared and submitted with respect to this proposed action and its • environmental review, and (ii) thoroughly analyzed the potential relevant areas 3 • Amended 11 - 13-06 10-23 -06 Planning Board y of environmental concern to determine if the proposed action may have a . significant adverse impact on the environment, including the criteria identified in 6 NYCRR Section 617. 7(c), and (iii) completed the Full EAF, Part II; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: The Town of Lansing Planning Board, based upon (i) its thorough review of the Full EAF, Part I, and any and all other documents prepared and submitted with respect to this proposed action and its environmental review, (ii) its thorough review of the potential relevant areas of environmental concern to determine if the proposed action may have a significant adverse impact on the environment, including the criteria identified in 6 NYCRR Section 617. 7(c), and (iii) its completion of the Full EAF, Part II (and, if applicable, Part III), including the findings noted thereon . (which findings are incorporated herein as if set forth at length), hereby makes a negative determination of environmental significance (" NEGATIVE DECLARATION" ) in accordance with SEQR for the above referenced proposed action, and determines that an Environmental Impact Statement will not be required . Further Comment/Concern Thomas Ellis inquired from David Herrick, P . E . for the Town if he was appeased with Timothy Buhl ' s corrections/adjustments . David Herrick stated yes. There are some still outstanding items ; however, he does not see them being significant at this point. They are items that technically will make it all come to a consensus on. Nancy Loncto read aloud for record the following conditions for the proposed Resolution. Subject to the following conditions: Cayuga Way Subdivision — Preliminary Plat • 3 . In addition, the Developer and the Developer' s engineer, Mr. Buhl, shall submit a final complete set of plans and a revised SWPPP, since some of the corrective edits described in Mr. Buhl' s response letter are contained in the SWPPP or revised plans that have not yet been reviewed by the Planning Board' s Engineer. RESOLUTION OF THE PLANNING BOARD APPROVING WITH CONDITIONS CAYUGA WAY SUBDIVISION FINAL PRELIMINARY PLAT WHEREAS , after submission thereof, Developer John O ' Connor has received preliminary approval of a Sketch Plan for a residential subdivision of certain land along Grandview Drive and Tiger Lily Lane in the Town of Lansing, said land being more commonly identified as the Town of Lansing Tax Parcel Numbers 40. -3 -28 . 1 and 40. -3 - 28 . 2 , and said Subdivision to be known as Cayuga Way; and WHEREAS, on September 18 , 2006, the Planning Board opened the duly public hearing for SEQR review and review of the final preliminary plat and, after hearing all the testimony therein and reviewing all the information provided by the Applicant and the Planning Board ' s Engineer to date, the Planning Board found that required comments and conditions set forth by the Planning Board ' s Engineer, as set forth in detail in the minutes of the August 14, 2006 meeting, had still not yet been addressed by the Applicant, as required to allow for a final approval of the Preliminary Plat, and the Planning Board • thereby resolved to continue the public hearing until October 23 , 2006 so that the Applicant could have an opportunity to provide the outstanding information and meet the 5 Amended 11 - 13-06 10-23 -06 Planning Board outstanding conditions as set forth in the Planning Board Minutes of the meeting • conducted on September 18, 2006; and WHEREAS, the Developer and its Engineer have been working with the Planning Board and its Engineer to develop a final Preliminary Plat, and various elements of the original Sketch Plan have been changed and amended to provide for lot design, infrastructure, stormwater management practices, and other elements in compliance with the Town of Lansing Subdivision and Stormwater Local Laws, among others ; and WHEREAS, the Town has considered and carefully reviewed the requirements of the Town' s Laws relative to subdivisions and the unique needs of the Town due to the topography, the soil types and distributions, and other natural and man made features upon and surrounding the area of the proposed . Subdivision, and the Town has also considered the Town' s Comprehensive Plan and compliance therewith; and WHEREAS, the subject parcel is a major subdivision and this is an Unlisted Action under the State Environmental Quality Review Act which requires environmental review; and WHEREAS, the Town of Lansing Planning Board has the primary responsibility for • approving or carrying out the action and has declared its intent to act as Lead Agency pursuant to State Law governing local environmental review; and WHEREAS , the only involved agency, as defined by the State Environmental Quality Review Act, the Tompkins County Health Department, has given its consent for the Town of Lansing Planning Board to act as Lead agency; and WHEREAS, a public hearing was opened on September 18, 2006 and continued on October , 2006 in the Lansing a , rn Road, Lansing, New York 14882 and notice23, posting and publicationTown of theHaforementioned public hearing was posted and published at least 14 days in advance of the opening of said hearing as required by law; and WHEREAS; a public hearing was continued on October 23 , 2006 at 7 :29 p .m. • concerning the consideration of the final Preliminary Plat for the Cayuga Way Y 6 Amended 11 - 13-06 10-23-06 Planning Board Subdivision, a residential subdivision of certain land along Grandview Drive and Tiger • Lily Lane in the Town of Lansing, said land being more commonly identified as the Town of Lansing Tax Parcel Numbers 40. -3 -28 . 1 and 40. -3 -28 .2 , and said Subdivision to be known as Cayuga Way; and WHEREAS , a public hearing concerning the environmental review, pursuant to the State environmental Quality Review Act, of the final Preliminary Plat for said Cayuga Way Subdivision was held on October 23 , 2006 at 7 : 15 p.m. , at the Lansing Town Hall at 29 Auburn Road, Lansing, New York 14882 ; and WHEREAS, on October 23 , 2006, this Board, acting as Lead Agency on environmental review, has reviewed and accepted as adequate a Full Environmental Assessment Form Part 1 , submitted by the Applicant, and Parts 2 and 3 , Prepared by the Planning Staff and • the Town Engineer and other application materials ; and WHEREAS, General Municipal Law referrals of the final Preliminary Plat pursuant to § § 239-1 and 239-m, and 239-n (of Article 12-B) were effected by Richard Platt, Lansing C. E. O. and those agencies given the opportunity to comment; and WHEREAS , by Resolution adopted on October 23 , 2006, the Town of Lansing Planning Board has determined that, pursuant to the provisions of the State Environmental Quality Review Act, the proposed Cayuga Way subdivision will result in no significant impact on the environment and has issued a Negative Declaration of environmental significance for purposes of Article 8 of the Environmental Conservation Law; and WHEREAS, upon due consideration and deliberation by the Town of Lansing Planning Board, now therefore be it • RESOLVED : that the Town of Lansing Planning Board grant final Preliminary Plat Approval for the residential subdivision of certain land along Grandview Drive and Tiger 7 Amended 11 - 13-06 10-23-06 Planning Board 4 •••' Lane in the Town of Lansing, said land being more commonly identified as the . IT IS FURTHER RESOLVED, that, to the extent that any of the above items listed are not "conditions," the same be and hereby are made conditions, the condition being that the Developer and/or his engineer shall amend the plans, provide information, supporting documentation, or other data, to the satisfaction of the Planning Board' s engineer, so as to ensure that the aforementioned conditions, requirements, or other information have been obtained and said conditions have been met to the satisfaction of the Planning Board ' s Engineer and the Planning Board. Public Comment: Dan Ferguson: Two main concerns are: 1 . Stormwater Runoff 2. Water Quality and Quantity Mr. Ferguson stated he has invested a large amount of money for drinking water to his home and would like to make sure that continues. In addition, Mr. Ferguson would like to make sure that as the homes are developed, the Stormwater Runoff does not negatively affect his home. Floyd Davis — Lakeforest Subdivision Lin Davidson made a motion to set a Public Hearing for SEQRA Review for, Monday, November 13, 2006 at 7:20 PM. Brian Ivery seconded. Thomas Ellis requested that the Board take into consideration and possibly put restrictions on the days/times that Contractors be allowed to work at the site. The five (5) weekends and weekday evenings in September from daylight to daybreak residents had to listen to bulldozers. Letter Tompkins County Planning Department — Re : TOL Zoning Ordinance - Comprehensive Plan Darby Kiley suggested that possibly the Planning Board would consider adding: "and protecting of environmentally sensitive area". After a short discussion, the Planning Board agreed that the change was not necessary. Town Board Liaison Report • 13 Amended 11 - 13-06 10-23-06 Planning Board • ti Matthew Besemer explained to the Board a new committee has been establish by The Town • Board for the purpose of looking at the changes to the Zoning Ordinance based on the Comprehensive Plan. The Committee consists of: Joan Jurkowich, Matthew Besemer, Nancy Loncto, Richard Platt, Darby Kiley, Connie Wilcox and Rachel Jacobsen. The first goal of this Committee is to review the List of Issues and Proposed Scheduled created by Ms. Jurkowich. As always, all meeting are open to the Public, although they may not be able to participate. RESOLUTION OF THE PLANNING BOARD APPROVING STRAUF SUBDIVISION FINAL PRELIMINARY PLAT AND STATE ENVIRONMENTAL QUALITY REVIEW (SEQR) NEGATIVE DECLARATION FOR THE PROPOSED STRAUF SUBDIVISION • WHEREAS , this matter involves consideration ofh t e following proposed action : Final Preliminary Plat approval of the Strauf Subdivision, a residential subdivision of certain land along Lansing School Road in the Town of Lansing, said land being more commonly identified as the Town of Lansing Tax Parcel Number 7 . - 1 -26 . 12 ; and WHEREAS , after submission thereof, Applicants Glen and Linda Strauf received preliminary approval for a three (3 ) Lot Subdivision Sketch Plan for a residential subdivision of certain land along Lansing School Road in the Town of Lansing, said land being more commonly identified as the Town of Lansing Tax Parcel Number 7 . - 1 -26 . 12 WHEREAS , a public hearing on the consideration of the final Preliminary Nat and the SEQR environmental review thereof was opened on October 23 , 2006 and notice, posting and publication of the aforementioned hearing was posted and published at least 14 days in advance of the opening of the public hearing as required by law; WHEREAS , the Planning Board has considered and carefully reviewed the final preliminary plat and the requirements of the Town's Laws relative to subdivisions and the unique needs of the Town due to the topography, the soil types and distributions, and other natural and man-made features upon and surrounding the area of the proposed subdivision and the Planning Board has also considered the Town's Comprehensive Plan • and Compliance therewith, and 11 DRAFT 10-23-06 Planning Board • WHEREAS, this proposed action is an Unlisted Action for which the Town of Lansing Planning Board is an involved agency for the purposes of environmental review; and WHEREAS , On October 23 , 2006 , the Town of Lansing Planning Board, in performing the lead agency function for its independent and uncoordinated environmental review in accordance with Article 8 of the New York State Environmental Conservation Law - the State Environmental Quality Review Act ("SEQR '), (i) pursued its thorough review of the Short Environmental Assessment Form ("EAF"), Part I, and any and all other documents prepared and submitted with respect to this proposed action and its environmental review, and (ii) thoroughly analyzed the potential relevant areas of environmental concern to determine if the proposed action may have a significant adverse impact on the environment, including the criteria identified in 6 NYCRR Section 617 . 7(c), and (iii) completed the EAF, Part II and if necessary, Part III; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS : The Town of Lansing Planning Board, based upon (i) its thorough review of the EAF, Part I, and any and all other documents prepared and submitted with respect to this proposed action and its environmental review, (ii) its thorough review of the potential relevant areas of environmental concern to determine if the proposed action may have a • significant adverse impact on the environment, including the criteria identified in 6 NYCRR Section 617 . 7(c), and (iii) its completion of the EAF, Part II (and, if applicable, Part 3 ), including the findings noted thereon (which findings are incorporated herein as if set forth at length), hereby makes a negative determination of environmental significance ( "NEGATIVE DECLARATION ") in accordance with SEQR for the above referenced proposed action, and determines that an Environmental Impact Statement will not be required. NOW, THEREFORE, BE IT FURTHER RESOLVED AS FOLLOWS : The Town of Lansing Planning Board hereby grants Preliminary and Final Subdivision Approval for the proposed action of subdivision of certain land along Lansing School Road in the Town of Lansing, said land being more commonly identified as the Town of Lansing Tax Parcel Number 7 . - 1 -26 . 12 into three (3 ) parcels as set forth in the Applicant's final preliminary plat. Thomas Ellis requested that the Board take into consideration and possibly put restrictions on the days/times that Contractors be allowed to work at the site. The five (5) weekends and weekday evenings in September from daylight to daybreak residents had to listen to bulldozers. Letter Tompkins County Planning Department — Re : TOL Zoning Ordinance - Comprehensive Plan Darby Kiley suggested that possibly the Planning Board would consider adding: "and protecting of environmentally sensitive area". After a short discussion, the Planning Board agreed that the change was not necessary. Town Board Liaison Report S 13 • • DRAFT 10-23-06 Planning Board Matthew Besemer explained to the Board a new committee has been establish by The Town • Board for the purpose of looking at the changes to the Zoning Ordinance based on the Comprehensive Plan. The Committee consists of: Joan Jurkowich, Matthew Besemer, Nancy Loncto, Richard Platt, Darby Kiley, Connie Wilcox and Rachel Jacobsen. The first goal of this Committee is to review the List of Issues and Proposed Scheduled created by Ms. Jurkowich. As always, all meeting are open to the Public, although they may not be able to participate. If due to a conflict of Ms. Loncto ' s work schedule and she is unable to attend the meetings, a Planning Board Member may fill in for her. Mr. Besemer encouraged the Planning Members to provide feedback to Ms. Loncto. A deadline date of Friday, October 27, 2006 was given. All Members were provided with a copy of the letter from Joan Jurkowich. (See below) Below is a tentative list of issues to be addressed in the update of the Zoning Ordinance . Please review this and let me know if you have any additions . Once I 've heard back from all of you , I will ask for the revised list to be distributed to the members of the Planning Board for comment. B. Prepare List of Issues October 13 - 23 TCPD will prepare a tentative list of issues to be incorporated in to the Town's updated Zoning Ordinance. This will be distributed to Committee members for confirmation. C. Review and Comment on Issues Oct. 24 — Nov. 7 The confirmed list of issues to be addressed will be provided to the Planning Board for comment. D. Finalize Issues November 8 - 9 Upon receipt of Planning Board comments, TCPD will finalize and distribute the list of issues fon the Comprehensive Plan to be addressed in the Update of the Zoning Ordinance. II . Potential Approaches November 13 — January 12 A. Prepare Approaches Nov. 13 — Dec. 8 TCPD will prepare a descriptive list (in layman' s terms) of potential approaches for addressing the identified issues in the Zoning Ordinance. B. Review List of Approaches December Il - 22 TCPD will distribute the descriptive list of approaches that will be reviewed by Committee members. C Finalize Approaches January 2 - 12 TCPD will meet with the Committee to review the list of potential approaches in order to identify • which the Town would like to include in the updated.Zoning Ordinance. III. Preliminary Draft Ordinance January 15 — March 2 A. Prepare Preliminary Ordinance Jan. 15 — Feb. 2 TCPD will prepare a complete preliminary draft of a Zoning Ordinance incorporating the approaches selected by the Committee as well as administrative amendments identified by the Office of the Zoning Enforcement Official. B. Review and Recommend Changes to Preliminary Ordinance: Committee February 5 - /6 The Committee will review and recommend broad-brush changes to the preliminary ordinance. TCPD will not be expected to attend these meetings. • C. Review Preliminary Ordinance: Planning Board and Town Board Feb. 19 — Mar. 2 The Planning Board and Town Board will hold a joint meeting to review the preliminary ordinance and recommend broad-brush changes. IV. Final Draft Ordinance March 5 — May 11 .4. Prepare First Draft Ordinance March 5 - 23 TCPD will prepare a complete first draft of the Zoning Ordinance. B. B. Ordinance Adoption Process May 28 — July 20? The Town will follow its normal adoption process for the adoption of the updated Zoning Ordinance, including review by the Planning Board, review by the Town Board, and appropriate public hearings. VI. Prepare Final Ordinance July 20? — August 3? • Upon adoption of the updated Zoning Ordinance, TCPD will prepare and submit an electronic version of the ordinance as adopted.
