RESOLUTION OF STATE ENVIRONMENTAL QUALITY REVIEW ( SEQR)
NEGATIVE DECLARATION FOR THE PROPOSED
DRAKE ROAD SUBDIVISION
WHEREAS, This matter involves consideration of the following proposed action :
Preliminary and Final Plat approval of the Drake Road Subdivision, a residential
subdivision of certain land along Drake Road in the Town of Lansing, said land
being more commonly identified as the Town of Lansing Tax Parcel Number 35 .-
3-13. 12; and
WHEREAS, this proposed action is an Unlisted Action for which the Town of
Lansing Planning Board is an involved agency for the purposes of environmental
review; and
• WHEREAS, On September 18, 2006, the Town of Lansing Planning Board, in

• performing the lead agency function for its independent and uncoordinated
environmental review in accordance with Article 8 of the New York State
Environmental Conservation Law - the State Environmental Quality Review Act
(" SEQR" ), (i) pursued its thorough review of the Long Environmental
Assessment Form (the Full EAF or " LEAF" ), Part I, and any and all other
documents prepared and submitted with respect to this proposed action and its
environmental review, and (ii) thoroughly analyzed the potential relevant areas
of environmental concern to determine if the proposed action may have a
significant adverse impact on the environment, including the criteria identified
in 6 NYCRR Section 617. 7(c), and (iii) completed the Full EAF, Part II;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS :
The Town of Lansing Planning Board, based upon (i) its thorough review
of the Full EAF, Part I, and any and all other documents prepared and submitted
with respect to this proposed action and its environmental review, (ii) its
thorough review of the potential relevant areas of environmental concern to
determine if the proposed action may have a significant adverse impact on the
environment, including the criteria identified in 6 NYCRR Section 617. 7(c), and
(iii) its completion of the Full EAF, Part II (and, if applicable, Part 3), including
the findings noted thereon (which findings are incorporated herein as if set forth
at length), hereby makes a negative determination of environmental significance
("" NEGATIVE DECLARATION" ) in accordance with SEQR for the above
referenced proposed action, and determines that an Environmental Impact
Statement will not be required .

David Herrick explained to the Moffett' s the two (2) scenarios proposed for the Water Project,

RESOLUTION APPROVING WITH CONDITIONS FINAL PRELIMINARY
PLAT OF THE PROPOSED DRAKE ROAD SUBDIVISION
WHEREAS , after submission of the Application thereof; Applicant Developer, Cayuga
Crushed Stone, received preliminary approval on December 12 , 2005 of a Sketch Plan for
a residential subdivision of certain land along Drake Road in the Town of Lansing, said
land being more commonly identified as the Town of Lansing Tax Parcel Number 35 . -3 -
13 . 12 ; and

® WHEREAS , the subject parcel is a major subdivision and this is an Unlisted Action
under the State Environmental Quality Review Act which requires environmental review ;
and
WHEREAS , the Town of Lansing Planning Board has the primary responsibility for
approving or carrying out the action andhas declared its intent to act as Lead Agency
pursuant to State Law governing local environmental review; and
WHEREAS , the only involved agency, as defined by the State Environmental Quality
Review Act, the Tompkins County Health Department, has given its consent for the
Town of Lansing Planning Board to act as Lead agency; and
WHEREAS , the Developer and its Engineer have been working with the Planning Board
and its Engineer to develop a Preliminary Plat, and have developed and changed various
elements of the Sketch Plan to provide for lot design, infrastructure, stormwater
management practices , and other elements in compliance with the Town of Lansing
Subdivision and Stormwater Local Laws and other applicable Laws , Rules, Ordinances,
and Regulations ; and
WHEREAS , the Town has considered and carefully reviewed the requirements of the
Town' s Laws relative to subdivisions and the unique needs of the Town due to the
topography, the soil types and distributions, and other natural and man made features
upon and surrounding the area of the proposed Subdivision, and the Town has also
considered the Towns Comprehensive Plan and compliance therewith; and
WHEREAS , by prior Resolution adopted on August 14 , 2006 , the Town of Lansing
Planning Board resolved that a public hearing be conducted concerning the review of the
final Preliminary Plat for the aforementioned the Drake Road Subdivision, a residential
subdivision located at the westerly end of Drake Road in the Town of Lansing and
County of Tompkins to be scheduled at 7 :45 p. m. on September 18 , 2006 at the Lansing
Town Hall at 29 Auburn Road, Lansing, New York 14882 , and
WHEREAS , a public hearing was held on September 18 , 2006 at 8 : 07 p . m. concerning
the overall review of the final Preliminary Plat for the Drake Road Subdivision, a
residential subdivision located at the westerly end of Drake Road in the Town of Lansing

and County of Tompkins , at the Lansing Town Hall at 29 Auburn Road, Lansing, New
York 14882 ; and
WHEREAS , a public hearing concerning the environmental review, pursuant to the
State environmental Quality Review Act, of the final Preliminary Plat for the Drake Road
Subdivision was held on September 18 , 2006 at 7 : 15 p . m . , at the Lansing Town Hall at
29 Auburn Road, Lansing, New York 14882 ; and
WHEREAS , notice, posting and publication of the aforementioned public hearings were
posted and published at least 14 days in advance of said hearing as required by law ; and
WHEREAS , on September 18 , 2006, this Board, acting as Lead Agency on
environmental review, has reviewed and accepted as adequate a Full Environmental
Assessment Form Part 1 , submitted by the Applicant, and Parts 2 and 3 , Prepared by the
Planning Staff and the Town Engineer and other application materials ; and

WHEREAS , General Municipal Law referrals of the final Preliminary Plat pursuant to
§ § 239- 1 and 239-m, and 239 -n (of Article 12 -B) were effected by Richard Platt, Lansing
C . E . O . and those agencies given the opportunity to comment; and
WHEREAS , by prior Resolution adopted on September 18 , 2006 , the Town of Lansing
Planning Board has determined that, pursuant to the provisions of the State
Environmental Quality Review Act, the proposed Drake Road subdivision will result in
no significant impact on the environment and has issued a Negative Declaration of
environmental significance for purposes of Article 8 of the Environmental Conservation
Law; and
® WHEREAS , upon due consideration and deliberation by the Town of Lansing Planning
Board, now therefore be it

® RESOLVED : that the Town of Lansing Planning. Board grant final Preliminary Plat
Approval for the Drake Road Subdivision, a residential subdivision of certain land along
Drake Road in the Town of Lasing, said land being more commonly identified as the
Town of Lansing Tax Parcel Number 35 . - 3 - 13 . 12 ; subject to the following conditions :
1 . Highway and Water System:
a. The Town Board must review and conditionally accept the preliminary road design. The latest
plan will be presented to the Town Board on September 20`x'.
b . Establishment of a water district for and around the subdivision is being evaluated by the
Town Board. Until a district is created the subdivision as proposed cannot receive Final Plat
approval.
2 . Stormwater Management:
a . Grading
1 ) The site grading suggests the swale that captures runoff from lots 8 and 9 does not
ultimately reach the pond.
b . Hydrology/ Hydraulics
1 ) Plans reference Hydrocad Modeling Results, but none were provided. The Preliminary
Stormwater Management Report dated March 29 contains the only hydrologic modeling
results provided to date, and these results do not include the proposed on-site pond. The
plans do provide some information, but are missing the following:
• Peak discharges and flow volumes from each catchment.
• Stage-Storage curve for the proposed pond.
• Hydrographs.
• • Actual model input values to spot-check assumptions.
• Schematic to determine routing
2 ) The concept of using the existing ponds at Crushed Stone to provide quantity control
appears, based on our site visit, to be technically sound. The ponds have a large volume,
and any overtopping that occurs would be confined to the same property. See notes
under"Permanent Stormwater Management' regarding their long-term function.
3 ) Although the swale that captures runoff from lots 8 and 9 does not convey runoff to the
pond, the catchment delineations on plan ST-7 suggest that this runoff does reach the on-
site pond.
C . Erosion and Sediment Control
1 ) Please provide more detail on construction sequencing.
2 ) if the houses will be developed separately, they will need a stand-alone sequence, and a
stand-alone erosion and sediment control plan.
3 ) Will the stormwater pond be used during construction as a sediment trap, and if so when
will sediment be removed?
d . Permanent Stormwater Management
1 ) The pond grading plan is very detailed, but some issues remain regarding pond geometry
as follows:
• Minimum Length to Width Ratio of 1 . 5 : l (Required)
• Long Flow path (design guidance) ; this could be achieved with berms internal to
the permanent pool.
• Irregular Geometry (Design Guidance)
• Pond Buffer (Required)
2 ) If the downstream quarry ponds will be used for stormwater quantity control, some
mechanism needs to be in place to ensure the long-term condition of the ponds even if the
property is sold. This agreement should ensure that both the ponds and the land adjacent
to them permanently remain in a condition' to detain upstream flows.

® e . SWPPP Format
1 ) The May 29 , 2006 SWPPP must be updated once the final practice designs are found
complete.
2 ) Some 'referenced documents are currently out of date including :
• The 1997 "Guidelines for Erosion and Sediment Control" and TOG 5 . 1 . 10 have
been replaced with a 2006 document available on DEC' s web site.
• The "Reducing the Impacts. __ " document is also out of date. .
3 ) The reference to the Cayuga Way Subdivision in the "Post-Construction Inspection and
Maintenance" section should be removed.
3 . Dedicated Easement:
The Town must be granted a permanent dedicated easement and right-of way to permit the Town
of Lansing, its agents and employees to enter in and upon the Lands of the Developer and the Lands
containing the downstream quarry ponds used for stormwater quantity control for the development, such
easement to be permanent and bind the successors and assigns of the current owners of those lands, for the
purpose of inspecting, repairing, maintaining and otherwise expanding and managing the stormwater
facilities as needed. Each and all such permanent easements and rights-of way shall be in a form approved
by the Town of Lansing' s counsel and the cost of review and recording shall be the Developer Applicant' s
expense .
4 . The Applicant' s Engineer must demonstrate, to the satisfaction of the Tompkins County Health
Department, as referenced in the letter from John Andersson, Director of Environmental Health
Services, dated August 28 , 2006 , requiring that Percolation rates will be satisfactory and the soil
will not be "overloaded with water through the year. Extreme care must be given to site water
® control to prevent the water from the higher elevations passing through the areas for sewage. [The
Applicant' s] engineer needs to show how this will be done, perhaps by means of diversion trenches
and swales, and special consideration to keep the roof and driveway drainage away form the
systems. All percolation results must be accounted for in the design, and areas with rates slower
than 60 minutes per inch incorporated into the design. There may still be areas where the
percolation tests are too slow for development, or the area receives too much water from
uphill. The variability of the tests means that percolation tests must be done in every proposed
system area prior to approval [by the Tompkins County Health Department] ."
In addition, as set forth John Andersson's August 28 , 2006 letter, the final plans must "show
the north property line, the stream to the north, or the 100' sewage system setback to it. Sewage
systems on lots 2 , 3 5 , 6, 8 , 9, 10, and 18 will need to be modified or moved because of complex
slopes, steep slopes, or too little separation (20' ) to the drainage ditch, assuming the percolation and
water controls are satisfactory"
IT IS FURTHER RESOLVED , that, to the extent that any of the above items listed are
not "conditions" , the same be and hereby are made conditions, the condition being that
the Developer and/or his engineer amend the plans, provide information, supporting
documentation, or other data, to the satisfaction of the Town' s engineer, that such
conditions, requirements, or other information has been obtained and said conditions met .
The aforementioned conditions must be satisfied before the Town of Lansing Planning
Board shall approve the Final Subdivision flat.

• Vince Mehringer: Questioned if the water lines for this Subdivision will be connected to the
existing waterlines that there are currently there. Mr. Mehringer is concerned with the
volume of flow and pressure of the water. Runoff is a concern, and Mr. Mehringer would like
to know how this will be addressed.
David Herrick explained the existing Booster Station would be utilized to serve the upper lots
and the lower lots would run off of the tank pressure in this project. Mr. Herrick further stated
the pipe size is generous, and volume is not an issue.
Timothy Buhl explained to Mr. Mehringer the runoff plan.
Steve Jones, Barden Rep : There is no problem with the road connection. Barden Home' s
intent is to provide a thru street if and when they finish the Phase of their Subdivision.
David Herrick advised the Board that he has received correspondence from The Tompkins
County Health Department with regards to incomplete information from Developer/Engineer.
® In addition, Mr. Herrick will need to provide additional information with regards to the
Town' s Water System and Pump Station. There are still issues outstanding from
previous reviews. Mr. Herrick did receive additional information on this date from Mr. Buhl,
however, time did not permit Mr. Herrick to review. .
Mr. Buhl requested that the Board review the SEQR this evening. Many of the technical
issues that Mr. Herrick has spoken of , can be answered this evening.
Nancy Loncto advised Mr. Buhl there are major outstanding Stormwater Management details
that must be satisfied.

• WHEREAS , after submission thereof, Developer John O' Connor has received
preliminary approval of a Sketch Plan for a residential subdivision of certain land along
Grandview Drive and Tiger Lily Lane in the Town of Lansing, said land being more
commonly identified as the Town of Lansing Tax Parcel Numbers 40 . -3 -28 . 1 and 40 . -3 -
28 . 2 , and said Subdivision to be known as Cayuga Way; and
WHEREAS , the Developers and their Engineer have been working with the Planning
Board and its Engineer to develop a Preliminary Plat, and various elements of the Sketch
Plan have been changed and amended to provide for lot design, infrastructure, stormwater
management practices , and other elements in compliance with the Town of Lansing
Subdivision and Stormwater Local Laws, among others ; and
WHEREAS , the Town has considered and carefully reviewed the requirements of the
Town' s Laws relative to subdivisions and the unique needs of the Town due to the
topography, the soil types and distributions, and other natural and man made features
upon and surrounding the area of the proposed Subdivision, and the Town has also
considered the Town' s Comprehensive Plan and compliance therewith; and
WHEREAS , at the August 14, 2006 Town of Lansing Planning Board Meeting, the
Planning Board advised the Applicant of the comments offered by the Town' s Engineer,
as set forth in detail in the August 14, 2006 minutes thereof, and further advised the
Applicant that the Applicant' s Engineer must address those comments and concerns , as
set forth in the August 14, 2006 minutes , before the final Preliminary Plat could be
approved by the Town of Lansing Planning Board ; and
WHEREAS , the Planning Board opened a duly noticed public hearing for SEQR review
and review of the final Preliminary Plat on September 18 , 2006 at 8 : 30 p . m . , and, after
hearing all the testimony therein and reviewing all the information provided by the
Applicant to date, found that all the aforementioned required comments and conditions
have still not been addressed, as required to allow for a final approval of the Preliminary
Plat; and
WHEREAS , the subject parcel is a major subdivision and this is an Unlisted Action
under the State Environmental Quality Review Act which requires environmental review ;
and
WHEREAS , the Town of Lansing Planning Board has the primary responsibility for
approving or carrying out the action and has declared its intent to act as Lead Agency
pursuant to State Law governing local environmental review ; and

• WHEREAS , the only involved agency, as defined by the State Environmental Quality
Review Act, the Tompkins County Health Department, has given its consent for the
Town of Lansing Planning Board to act as Lead agency; and
WHEREAS, a public hearing was held on September 18 , 2006 and notice, posting and
publication of the aforementioned public hearing was posted and published at least 14
days in advance of said hearing as required by law ; and
WHEREAS , the Town of Lansing Planning Board did not consider the environmental
determination at the, September 18 , 2006 meeting as the Planning Board has requested
that the following additional information be provided by the Applicant, as previously
required from the Applicant by the Town' s Engineer and the Planning Board :

I . Highway and Water System:
a . The Town' s engineer has coordinated the connections to the Town' s booster station constructed
in Pheasant Meadow and future connections to a higher pressure tank grid and will provide the
Applicant' s Engineer with additional details of the actual connection locations for use and
inclusion with. the Applicant' s construction documents .
b . A copy of a sealed boundary and topographic survey must still be submitted.
2 . Stormwater Management:
a . Grading/ Site Layout
1 ) Two culverts are displayed differently on Plan ST- 1 than on Plan ST-5 , as follows.
• The culvert that passes under "New Road B" has different inverts presented in
each plan. While the inverts on the erosion control plan ( 1116 . 5 and 1106. 5 ; ST-
5) appear to match the grading plan and road profile more closely, neither is
completely correct. The actual inverts are about 1114 . 5 and 1104 . 5 based on site
grading.
• For the culvert that crosses "Road A;" the written inverts are the same on each
plan, but the orientation of the culvert is different.
The downstream location is the same on both plans, and appears to be at
about elevation 1060, but the reported invert is 1066 . 2 .
The upstream location is different on each plan; the reported upstream
invert is 1068 . 8 , which appears nearly correct based on the location of Plan
ST- 1 . The upstream invert on Plan ST-5 is approximately 1161 . 5 .
On the Erosion and Sediment Control Plan (ST-5 ) the swale that conveys
runoff from the northern edge of the site to the basin appears to run either
• completely flat or at a slightly negative slope . This swale also flows
through the frontyard of Lot 10 , within about ten feet of the edge of the
house.

• 2 ) The swale on the west side of"Road A" does not convey flow to the roadside ditch along
this road, but appears to flow directly into the edge of the road.
b . Details
1 ) The outlet structure for the retention basin appears on plans ST- 1 and ST-5 to include
some sort of junction at about elevation 1043 , followed by another pipe connection to a
level spreader. The detail on ST- I 1 shows a control structure in the embankment, leading
to a traditional stone apron outlet.
c . Hydrology/ Hydraulics
1 ) The pre-developed watershed areas are bound by the site, rather than the actual watershed
boundaries. In fact, much of the site does not drain to design point DP-2 , and flows
directly to the north.
2 ) A large volume of water is disappearing within the ponds (0 .9 acre-feet for the 1 -year and
1 . 3 acre-feet for the 10- and 100-year). It is not clear how this is happening, but the
volume of flow should be the same entering and leaving these practices .
d . Erosion and Sediment Control
1 ) This may just be a hatching issue, but the "dry riprap" called for on the ESC plan does not
appear.
2 ) The text calls for 75% stabilization, but the DEC requires 80% .
3 ) The construction sequence is not of sufficient detail. It is unclear when the road will be
constructed relative to individual lots.
4 ) Will the stormwater pond be used during construction as a sediment trap, and if so when
will sediment be removed?
e . Permanent Stormwater Management
® 1 ) The pond does not conform to the geometry guidelines and requirements set forth in the
'New York State Stormwater Management Design Manual" as follows :
- Minimum Length to Width Ratio of 1 . 5 : 1 (Required)
- Long Flow path (design guidance)
- Irregular Geometry (Design Guidance)
- Pond Buffer ( Required)
2 ) The dry swale proposed does not meet state standards due to the shallow depth of material
above the underdrain. This practice only treats a few lots, and a traditional grassed
channel" may provide sufficient treatment. Regardless of which option is used, a "60-
day" DEC review period will be required.
3) A more detailed long-term maintenance program is required , for both the pond and dry
swales. Further, the developer needs to state the intent to dedicate the permanent practices
to the Town for ownership and maintenance .
f. General Format
1 ) Some referenced documents are currently out of date including:

3 . Dedicated Easement:
The Planning Board shall require a permanent easement, dedicated to the Town of Lansing for
future use as a highway and for the purpose of connecting the roadway from the proposed subdivision
to the roadway proposed in the adjacent Lakeview Subdivision. Such easement must be approved by
the Town of Lansing' s counsel and the cost of the recording and review shall be borne by the
Developer Applicant.

SEQR PUBLIC HEARING TO OCTOBER 23, 2006
WHEREAS , after submission thereof, Applicant Glen and Linda Strauf received
preliminary approval of a Sketch Plan for a minor residential subdivision of
• certain lands along North Lansing School Road in the Town of Lansing, said
lands being more commonly identified as the Town of Lansing Tax Parcel

said preliminary approval of sketch plan thereof being granted by the Town of
Lansing Planning Board at a meeting held on September 11 , 2006, and
WHEREAS, at the September 11 , 2006 hearing, the Planning Board resolved that
a public hearing on the environmental quality review of the final Preliminary
Plat for the Strauf Subdivision be scheduled at 7: 30 on October 9, 2006 and a
public hearing concerning the final subdivision plat be scheduled at 7:45 p .m. on
October 9, 2006 at the Lansing Town Hall at 29 Auburn Road, Lansing, New
York 14882; and
WHEREAS, the Town Hall and Town offices shall be closed on October 9, 2006
to celebrate Columbus Day, a national holiday, it is hereby
RESOLVED, that a public hearing on the environmental quality review of the
final Preliminary Plat for the Strauf Subdivision be re-scheduled for 7: 30 on
October 23, 2006 and a public hearing concerning the final subdivision plat be re-
scheduled for 7:45 p . m. on October 23, 2006 at the Lansing Town Hall at 29
Auburn Road, Lansing, New York 14882, and it is further
RESOLVED, that notice, posting and publication of this Resolution be completed
at least 14 days in advance of said hearing as required by law, and that any
required notices be delivered pursuant to General Municipal Law §§ 239-1, 239-
m, and 239-n (of Article 12-B) by the Clerk of the Planning Board .
