Public Present Jacob Peter Greg Lawrence Larry Zuidema Gary Garrett Philip Bachellor General Business Nancy Loncto called the Planning Board Meeting to order at 7 : 15 PM. Ms. Loncto requested if there were any concerns/suggestion from the Public Present . There were none. AES Cayuga - Site Plan Review — Extension to Existing Cole Handling System, 228 Cayuga Drive, Parcel # 11.-1-3.21 Jacob Peter, Mechanical Engineer for AES appeared before the Board for a Site Plan Review. Mr. Peter explained AES would like to expand their Coal Handling Facilities. An explanation as to the location and use of the new Tunnel and related 30' x 30' structure was given. The Tunnel will be approximately 200' with about 100' of it being underground. No actual explosions will take place during the construction project. The purpose of the project is to blend fuels, creating a more efficient and cost effective way of burning coal. All required DEC permits have been satisfied. It was the consensus of the Planning Board Members that all . requirements in other arenas have been met, therefore, there is no thither action required on this project. Mr. Peter was instructed to proceed to the Code Enforcement Office for a Building Permit. Glen & Linda Strath. - Sketch Plan -3 Lot Subdivision, North Lansing School Road, Parcel # 7.-1-26. 12 9/11/06 Planning Board Philip Bachelor, Agent and Contractor for the Strad' s appeared before the Planning Board. The • purpose of this Subdivision is to gift a parcel of land (approx. 3 .78 acre(s) to each Grandson(s) for Residential purposes. Mr. Bachellor explained the topography of the lots. Each lot is sloped away from the road. An Erosion and Sediment Control Plan for each lot was submitted with the Application. Larry Sharpsteen, Planning Board Member who was not in attendance for this meeting sent a message via the Chairperson stating that due to size of the parcels involved, any future subdivision of the parcels would be considered a Major Subdivision. Due to Mr. & Mrs. Strauf not being physically present, it was requested that this message be made part of the minutes to include that Mr. Bachelor stated "he fully understood the Planning Board' s requirement". Nancy Loncto, Chairperson shared the following comments offered by, David Herrick, P.E. for The Town of Lansing. Glenn & Linda Strad. — North Lansing School Road • The creation and development of two residential building lots will likely result in 1 acre or less of site disturbance. I understand the third lot is the remaining parent parcel and already includes an existing residence. As a result, only temporary erosion and sediment control practices would be necessary. The details referenced above should be incorporated into the developer' s application. David Hatfield made a motion to classify the Sketch Plan as a Minor Subdivison as stated per The Tompkins County Health Department Regulations. Lin Davidson seconded . VOTE AS FOLLOWS : • Lin Davidson — Aye Thomas Ellis — Aye David Hatfield — Aye Nancy Loncto — Aye MOTION CARRIED. Nancy Loncto advised Mr. Platt a notification letter must be submitted to The Straufs within 10 days. Thomas Ellis made a motion to set a SEQR Public Hearing for October 9, 2006 at 7 : 30 PM and the Preliminary Plat Public Hearing at 7 : 45 PM. David Hatfield seconded . VOTE AS FOLLOWS : Lin Davidson — Aye Thomas Ellis — Aye David Hatfield — Aye Nancy Loncto — Aye MOTION CARRIED . Kansas Mead - Sketch Plan - 2 Lot Subdivision, Buck Road, Parcel # 28:1- 28.2 Philip Bachelor, Agent for Ms. Mead appeared before the Planning Board requesting to Subdivide • a three (3) acre parcel into two (2) Lots consisting of 1 . 5 acre per parcel. An Erosion and Sediment 2 9/11/06 Planning Board Control Plan were submitted with the original Application for each lot. The Topography in this area • slopes towards the road. Ms. Mead intends to sell the lots. Nancy Loncto, Chairperson shared the following comments offered by, David Herrick, P. E. for The Town of Lansing. Kansas Mead Subdivision — Buck Road • The creation and development of two residential building lots will likely result in 1 acre or less of site disturbance. As a result, only temporary erosion and sediment control practices would be necessary. Typical details developed by NYSDEC for residential site disturbance are attached and should be incorporated into the developer' s application. After further discussion it was determined that a home exists on Parcel A2 of the survey map that was presented to the Planning Board. It was the consensus ofthe Planning Board to adjourn any further discussion on this project until Mr. Bachelor returns with an updated Survey Map for the Sketch Plan. Gary Garrett - Site Plan Review — Shop Addition to Existing Building, 7 Peruville Road, Parcel # 37. 1-2-18 Gary Garrett, property owner and his Contractor Roily Green appeared before the Planning Board for Site Plan Review. Mr. Garrett currently has an existing business located on his property and • would like to expand for the purpose of assembly and storage. The project will consist of a 26' x 40' addition attached to the south end of the existing shop. The lot to the south is an undeveloped brush lot. The following have been taken into consideration. 1 . Setbacks have been met. 2. A buffer of Hedges has been planted. 3 . There will be no lighting installed. 4. No additional runoff will be generated. The existing drain system will be used. 5. No water supply or sewage disposal will be used. 6. No additional noise will be generated. 7. No increase in Employees or Traffic. • Thomas Ellis made a motion to waive the Public Hearing. Lin Davidson seconded . VOTE AS FOLLOWS : Lin Davidson — Aye Thomas Ellis — Aye David Hatfield — Aye Nancy Loncto — Aye MOTION CARRIED . Lin Davidson completed the SEQR review. Lin Davidson made a motion to declare a negative declaration. David Hatfield seconded. Thomas Ellis made a motion to accept the Sketch Plan as the Final Site Plan, and grant approval as for action on the Site Plan. Lin Davidson seconded. Approval/Denial of August 14, 2006 & August 28, 2006 Minutes Thomas Ellis made a motion to accept the minutes of August 14, 2006 as submitted. Lin Davidson seconded . Other Business Legal Council Nancy Loncto introduced Attorney Ms. Lorraine Moynihan Schmitt to the Board Members present. Ms. Moynihan Schmitt is Council associated with The Law Firm of Thaler and Thaler and will be working with the Board for the foreseeable future. Meetings Nancy Loncto advised the Members that she has had a number of meetings with David Herrick, P.E. , Guy Krogh, Esq . and Lorraine Moynihan Schmitt, Esq. Ms. Loncto ' s meeting with Mr. Herrick revealed that there are timing issues in the Town' s Subdivision Rules and Regulations that do not allow enough time to move through the process in • accordance with the NYS SEQRA requirements. Ms. Moynihan Schmitt will be reviewing the document, and providing further feedback/suggestions. It was agreed by 4 9/11/06 Planning Board Ms. Loncto and Mr. Herrick that a Procedural Checklist needs to be incorporated into the • . original paperwork generated from the Code Enforcement Office that will be presented to the Planning Board Members for review. Nancy Loncto further stated that all Members will be provided by the Code Enforcement Office with a completed Procedural Chart in advance of each Meeting that will clearly indicate where each project stands in the process. David Herrick will be providing a very detailed Checklist for the Planning Board to use. This Checklist will be broken down into three (3 ) separate categories consisting of Site Plan Review, Preliminary Plat and Final Plat approvals. This Checklist will be total separate from the Procedural Checklist. Letters Three (3 ) letters have been sent out at the direction of Nancy Loncto, Matthew Besemer and Stephen Farkas to the parties involved with the Drake Road Subdivision, The Cayuga Way Subdivision and Michaleen' s. Drake Road and Cayuga Way' s letter refers to their Preliminary Plat advising them they have been accepted, and a SEQRA Review will be held on September 18, 2006 and a Preliminary Approval subsequent to the SEQRA Hearings on September 18, 2006 pending a negative declaration on SEQR. The letter to Michaleen ' s is in regards to the road issue with the Triphammer Multi Use Subdivision. Lansing Sewer Site Nancy Loncto encouraged all members to visit The Lansing Sewer Web Site http ://www. lansingsewers. com/links. htm to view the Maps and Minutes. Ms. Loncto has attended both Public Sessions held by the Town Board; they have enlightened her to the • amount of work that the Committee Members has put into this project thus far. The next scheduled Public Session will be held, Saturday, September 16, 2006 from 9 : 00 AM until 3 : 00 PM in the Town Hall . Presentations Nancy Loncto advised the Members that she could arrange for presentations to be given on Sewer and the New Empire Zones if they Members were interested. Lin Davidson indicated that he would like to hear a presentation on the Empire Zones. Legal Council Ms. Moynihan Schmitt advised the Members that as Legal Council she will be in attendance to help the Planning Board focus on policies, obligations pursuant to the Law, and offer planning options. Ms. Moynihan Schmitt offered her assistance in any way possible. Prior to the working meeting on October 23 , 2006, Ms. Moynihan Schmitt will electronically mail out policies, flow charts, etc. that she will prepare in regards to SEQRA Review.
