Town Board/Legal Advice Bud Shattuck, Town Board Liaison brought before the Planning Board a request made by The Town of Lansing ' s Legal Counselor in regards to all voting procedures. Effective July 2005 New York State requires that all decisions must be taken in a roll call manner. Stephen Cardamone-Storm Water & Erosion Control Plal, Major 4 Lot Subdivision, Teeter Road, Parcel # 37. 1 -7- 18 . David Herrick, P .E. for the Town of Lansing offered the following comments : • Cardamone - Subdivision • 10/24/05 Planning Board Meeting o Drawings ST- 1 and ST-4 dated 911105 reflect some minor adjustments to the layout of the • proposed retention swales. The permanent control detailed in a revised ST-5 drawing utilizes a grass lined swale with perforated underdrain. This approach to stormwater management is reasonable but as stated in my August 4"' review it is necessary to show how the detail will be incorporated into the site grading given the relatively flat gradient of the Teeter Road ditches . The invert elevations of the existing ditch need to be compared with the outlet elevation of the 4 inch pipes draining the swales. This level of detail should be shown on the Preliminary Plat. o The retention swales are jointly shared by the 4 parcels. The subdivision plat should include cross easements to allow for maintenance and to ensure one parcel does not till or dismantle the practice . o As recommended in my June 13 `'' and August 8ih review letters the applicant still needs to approach the Town Board with a proposal to expand the Town ' s Consolidated. Water District Boundary to include these parcels. Completing a profile :for the water main is also outstanding. Mr. Buhl indicated that he had a conversation with Mr. Herrick earlier in the day and Mr. Herrick ' s concerns regarding the swales were addressed and agreed upon. Mr. Herrick further indicated that the road ditch flows west to east and there should be no problems with flooding. Larry Sharpsteen made a motion to accept the proposed Preliminary Plat with conditions that language is included in the Final Plat prior to Final Subdivision Approval to include cross easements to allow for maintenance and to ensure one parcel does not fill or dismantle the practice. In addition, the Applicant must approach the Town Board with a proposal to expand the Town' s Consolidated Water District Boundary to include these parcels . The approval by the Planning Board does not guarantee approval by The Town • Board for the Water District Extension. A completed profile for the water main is required. Thomas Ellis seconded. Cayuga Crushed Stone, Sketch Plan, 19 Lot Subdivision, Drake Road, Tax Parcel # 35.-3-13.12 The Besemers appeared before the Planning Board with their Engineer Timothy Buhl with a Sketch Plan of a proposed 19 Lot Subdivision to be located on Drake Road. David Herrick, P .E. for The Town of Lansing offered the following comments : Cayuga Crushed Stone — Sketch Plan. o The proposal for 19 lots anticipates that municipal water will be available . While no mains are shown on the plan it is possible to extend a connecting main to Ridge Road. Also, the Town Board has recently received a feasibility analysis for a larger loop main project between Fast Shore Drive and Ridge Road. A discussion with all residents, including the Besemers, will likely take place in the near future. if the parcel layout would be altered by using groundwater as the source of supply then a detailed review of the plan (i .e. stormwater management, road alignment etc.) should be • delayed. 10/24/05 Planning Board Meeting o The road alignment shown on drawing ST- 1 dated 8/27/05 includes a median 270 feet long at the • intersection with Drake Road . It may be reasonable to simply have a wider pavement section for the first 100- 150 feet of the new road.. i don ' t believe the median is warranted. o The area shown between Lots 6 and 7 for a "Retention. Area " is located on steep slopes adjoining, but not including, an existing drainage way. It is unlikely that such a land area would be suitable for any permanent practice . Given the topography and numerous drainageways that cross the parcel the development of aneffective stormwater management plan .may include multiple locations for permanent practices. o item C. 10. in Part 1 of the SEQ:R form is incorrect. It will be necessary to extend the Consolidated. Nater District boundary if public water is necessary. The presented Sketch Plan shows a looped road that has a dual entrance with one curb cut. Mr. Shattuck, Liaison for the Town Board clearly stated that he did not believe the Town Board would approve a development that did not have two (2) ways of access/egress. The total number of lots would be 19, each approximately one ( 1 ) acre. Mr. Buhl indicated that he would be proposing on behalf of his client the use of an existing retention pond located on a separate parcel owned by the Besemers/Cayuga Crush Stone for full retention collection of additional run off On site will be for treatment only. Permanent easements and right of ways will be part of the necessary paperwork. David Herrick offered additional options to consider. • 1 . Creating access to the existing pond for Town maintenance if need be, or another scenario would be to propose dedication of it to the Town. 2 . The existing facility would need to be reconstituted to be in line with the expectations of the current permit requirements . 3 . Additional off site details will need to be provided and shared with the Planning Board. Nancy Loncto requested clarification on the Stormwater Retention Ponds with regards to ownership . Timothy Buhl indicated at the present time they are private. The down stream retention currently is private that includes a bond for maintenance under the DEC . The Forebays that are on the proposed map could be turned over to the Town. Larry Sharpsteen further inquired about the Public ' s responsibility for the Treatment area. Timothy Buhl stated it is no different than the Bland Treatment facility except that theses are Forebay ponds and the larger Retention Pone being off site. Thomas Ellis inquired what would happen to the Large Retention Pond if the Quarry were to be sold years later. The Public that had purchased a lot from this Subdivision would depend on this large pond. Larry Sharpsteen agreed with Thomas Ellis. This proposal would need to have a permanent easement. • A 10/24/05 Planning Board Meeting • Timothy Buhl requested to know from the Board if the general concept of the road loop is okay with the Board, or will they require an additional entrance. Timothy Buhl stated that this layout proposal was designed under the assumption that public water will go through. David Herrick indicated that extending the line from Ridge Road down is a possibility. Thomas Besemer stated they would look at that option before resizing the lots . Mr. Besemer feels the reduction in the number of lots would not support the construction cost for the road. Bud Shattuck recommended to the Planning Board that all involved parties meet with the Town Board for further discussion regarding the proposed road. (David Herrick, Timothy Buhl, Scott Purcell & Jack French) Larry Sharpsteen stated, given the topography of the land, the proposal submitted to include an easement is the only way to do this subdivision. Larry Sharpsteen made a motion to declare this a Major Subdivision. Lin Davidson seconded. The Planning Board recommended that Richard Platt take the following concerns of drainage and access to the Town Board for feedback. Thorpe, Glen —Special Conditions (Site Plan Review )— Raising a Pony in the R1 District, 365 Asbury Road, Parcel # 39.-1-4.1 Mr. Thorpe appeared before the Planning Board for Site Plan Review in regards to raising/boarding one ( 1 ) pony occasionally. Mr. Thorpe ' s proposal meets all requirements for the allowed use. Lin Davidson completed the SEQR. Lin Davidson made a motion to declare a negative declaration. Larry Sharpsteen seconded. VOTE AS FOLLOWS : Lin Davidson — Aye Thomas Ellis — Aye Nancy Loncto — Aye Larry Sharpsteen — Aye • Greg Travis — Aye MOTION CARRIED . 10/24/05 Planning Board Meeting Larry Sharpsteen made a motion to accept the Site Plan Review proposal for the action . now before the Board. The action is presented does not negatively affect lighting, drainage, or access provisions of Site Plan Review with the understanding that the proper acreage will be fenced off for maintenance of the pony. Jones, Richard & Eunice, 1 Lot Subdivision 1100 Ridge Road, Parcel # 16:1 - 42 Mr. & Mrs. Jones appeared before the Planning Board requesting to Subdivide their property in order to gift each son a 1 . 12 acre parcel. There are currently two existing (2) septic systems on the parcel. The Jones' intend to split the septic services so each parcel has their own. Larry Sharpsteen indicated the survey line would have to accommodate where the septic system is, not where the Jones' would like to see it. • Nancy Loncto advised the Jones' that the Planning Board will wait to make a determination until a final survey has been completed. The Jones' will return at a later date. A SEQR will be completed at that time, also a motion to waive the Public Hearing will be made. Lansing Fire Department Representatives Scott Purcell, Fire Chief and Tim Myers, Assistant Fire Chief were guests at the Planning Board Meeting. Chief Purcell has requested in the future that the Code Enforcement Office provide the Lansing Fire Department with a copy of any Major Subdivision proposal/plan. The Fire Department would like to be able to provide feedback concerning roadways and fire hydrant placements . An additional document the Fire Department would like to see incorporated into The Town of Lansing Zoning would be a Fire Alarm Ordinance that would require all residential or commercial structures to have an installed Knox Box for entry by the Fire Department. John A. Stevens, Public Hearing Preliminary Plat — 4 Lot Major Subdivision, Warren Road, Parcel # 44.- 1 -5.32 Nancy Loncto read the Legal Notice published in The Ithaca Journal and opened the Public Hearing at 8 :40 PM. David Herrick, Town Engineer offered the following comments; John Stevens - Fi.nal. Plat • o The stormwater component of this plan is mostly addressed . Although the water gardens proposed do not conform to every technical standard outlined in the New York State Stormwater 10/24/05 Planning Board Meeting Management Design Manual, they are in our estimation adequate for this setting because of the • very small area disturbed, the limitations due to extremely flat topography of this site, and the nature of the development as individual lots. This specific configuration would not necessarily be approved in all settings, however. ® Typically, the State SPITES permit would require the developer to file a .NO.I with the NYSDEC. In this case, however, the development meets the criteria of a "rural subdivision. " This means that the seller does not need to file an NOl , but the buyers of the individual lots do need to file one. Ideally, an NOI with all information for the Erosion. and Sediment Control portion of the plan could be completed. for each lot. Also, each land. owner should receive a "stock" erosion and. sediment control plan. A simple solution is a set of plans for different scenarios that the N.YS.DEC has already made available. These are attached and for this setting the builders would want to use a plan for Condition 2 . It will fall upon the Code Enforcement Office to include this typical detail with the individual building permits . Richard Platt advised the Planning Board that Mr. Herrick has provided the Code Enforcement office with a set of different scenario plans . Also included in those plans was Mr. Herrick ' s recommendation to the builder to use plan for Condition 2 . Larry Sharpsteen suggested that language such as, "with the water gardens clearly shown on the plan (with a comment on the Plan of the Subdivision) that each is to be recorded in perpetuity with each deed". Bud Shattuck clarified for the record that all Subdivisions now have a Stormwater Plan. • Lin Davidson made a motion to close the Public Hearing at 8 : 55 PM. Larry Sharpsteen seconded. Roads (See Appendix I for definitions of road types): For the purposes of these Rules and Regulations, and unless otherwise indicated in the Town Comprehensive Plan, Roads shall be classified as follows: Primary Roads - Through Roads used primarily for faster and heavier traffic; Secondary Roads - Roads which collect traffic from local Roads and carry it to primary Roads, but do not carry heavy volumes of fast or through traffic; Local Roads - Roads which are used principally to provide access to abutting land, primarily of residential character; Dead-End Roads - Roads with a vehicular traffic outlet at one end and a Town approved turnaround at the opposite end. Private Roads - Those roads which are used to provide access to only one lot and which are not to be dedicated to, or accepted or maintained by, the Town. Private Access Drives — Those roads that are used to provide access only and are not to be dedicated to, or accepted or maintained by, the Town. A. The layout of new Roads in any Subdivision shall be designed to provide for the appropriate extension of existing Roads and utilities, and shall take into consideration topography, drainage, views, public convenience and safety, and the proposed uses of • the land to be served by such Roads. B. Roads whose primary function is to provide access to abutting residential property shall be designed to discourage through traffic. C. Subdivisions that abut primary Roads, as designated in the Comprehensive Plan, shall be designed to provide an adjacent service road, or reverse frontage, or to otherwise minimize the number of lots that will require direct access to said primary Roads. D. Road right-of-way widths shall not be less than 60 feet. Those Roads that are designated in the Comprehensive Plan as primary Roads shall have a 75-foot right-of-way to accommodate future widening. E. In general, all Roads shall be centered in the right-of-way. Road grades shall not exceed 10% for primary roads, and 12% for secondary and local Roads. Except as may be necessary at the bottom or crest of a vertical curve, no Road shall have a grade less than 0.5%. F. Horizontal and vertical curves shall be designed with a minimum radius of 150 feet to provide a safe sight distance. G. Permanent dead-end Roads shall, in general, be no longer than 10 times the narrowest frontage of lots along such dead-end Road. All permanent dead-end Roads shall provide a turnaround at the end with a pavement radius or design that meets current Town specifications. The distance from the edge of pavement to the right-of-way shall be no less than 15 feet. Alternative designs for a turnaround that are equally effective may be considered by the Planning Board. Roads that are to be continued at a later date shall provide a temporary turnaround. H. Insofar as possible, all proposed Subdivisions shall be designed to allow for future access to adjacent properties. If a Subdivision shows a reserve strip at the ends of any Road, or elsewhere, controlling access to adjacent land, control of such reserve strips shall be placed with the Town under conditions approved by the Planning Board. I. Proposed Road systems shall be designed, when possible, to provide for access to Roads in adjacent subdivisions. When adjacent land is undeveloped, the Planning Board may require the establishment of permanent rights-of-way connecting to such undeveloped land. Future construction of Roads on such connecting rights-of-way shall, generally, be the responsibility of the developers of such adjacent land, except that, if adjacent parcels are being subdivided within a similar time frame, construction of connecting roadways shall be the responsibility of each Subdivider, when so determined by the Planning Board. J. Subdivisions that include or continue existing Roads which do not conform to the minimum right-of-way width as • specified in this Local Law are not permitted. In such cases, the Subdivider shall dedicate additional width along either or both sides r 10/24/05 Planning Board Meeting of said Roads to bring them into compliance. If the Subdivision is located along only one side of an existing narrow Road, one-half of • the required total extra width shall be dedicated. K. Half-width roads shall not be permitted. Access to Flag Lots or other private parcels will be private. L. No Road shall have a name that will duplicate or so nearly duplicate the name of any existing Road within Tompkins County as to cause or potentially cause any confusion. Any continuation of an existing Road shall have the same name. M. No road in any Subdivision shall be deemed a public Road until it has been formally offered for dedication and cession to the Town and formally accepted by resolution of the Town Board. N. No private roads, driveways, water supply systems, septic or sewerage systems, and no utilities, may or shall be shared by different lots or owners absent a variance therethr. Bud Shattuck indicated that the Holochuck' s must go before the Zoning Board of Appeals for approval or denial in regards to the shared drive as proposed on their Preliminary Plat. Section 602 (N.) clearly indicates this is not allowed. The Planning Board may not move forward until either the ZBA grants approval or the Holochuck ' s build a Town Road.
