Ms . Loncto asked the audience if there was any other business that would like to be brought before the board. Douglas McEver, Town Councilman appeared before the board with a special request that the Planning Board review an application from Donald Howser for a 1 Lot Subdivision that was submitted to The Code Enforcement Office today. Mr. Howser is experiencing a hardship situation and time is pertinent. Chairperson Nancy Loncto stated that it would be an unusual exception to review a subdivision with only a few hours notice. She further stated that it would be unfair to others who had submitted applications 10 days before the meeting as required by the Subdivision Regulations . Nancy asked for a full Board vote to determine whether or not the Board would review and take action on the application at tonight ' s meeting. David Hatfield made a motion for an exception to hear Mr. Howser' s case and resolve it tonight. J-A-M Storage, Public Hearing - Site Plan Review, 10 Lansing Station Road, Parcel #37. 1 -7- 18 Nancy Loncto read the Legal Notice published in The Ithaca Journal with regards to the Public Hearing. Thomas Ellis made a motion to open the Public Hearing at 7 : 20 PM. David Hatfield seconded. MOTION CARRIED . Mr. & Mrs . Burns appeared before the board with a sketch of the Cross Section as previously requested by the Board. No public comments were offered. Larry Sharpsteen made a motion to accept the Site Plan/Living Document. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. • David Hatfield made a motion to close the Public Hearing at 7 : 30 PM. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Tompkins County Waterfront Plan The Planning Board previously reviewed the proposed Waterfront Revitalization Plan as well as comments from other municipalities. Nancy Loncto read aloud the proposed resolution for acceptance of a negative declaration of environmental significance in relation to adopting the Local Waterfront Revitalization Program : Cayuga Lake Waterfront Plan. RESOLUTION MAKING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE IN RELATION TO ADOPTING THE LOCAL WATERFRONT REVITALIZATION PROGRAM : CAYUGA LAKE WATERFRONT PLAN WHEREAS, the governing bodies of the waterfront municipalities, including the Town of Lansing Town Board, have been asked to adopt the Local Waterfront Revitalization Program: Cayuga Lake Waterfront Plan (December, 2004), and WHEREAS, the Town of Lansing Planning Board has, for the purposes of compliance with the State Environmental Quality Review Act, been lead agency for the environmental review of this project; and WHEREAS, the Town of Lansing Planning Board has reviewed and accepted as adequate an Environmental Assessment Form with respect to that action, now therefore be it RESOLVED, That adoption of the Local Waterfront Revitalization Program: Cayuga Lake Waterfront Plan (December, 2004) is an Unlisted action, • RESOLVED, further, That the Town of Lansing Planning Board determines that the Local Waterfront Revitalization Program: Cayuga Lake Waterfront Plan (December, 2004) will not have a significant adverse effect on the environment, 08/22/05 Planning Board Meeting • RESOLVED, further, That the Town of Lansing Planning Board hereby makes a negative declaration of environmental significance in regard to adoption of the Local Waterfront Revitalization Program: Cayuga Lake Waterfront Plan (December, 2004). Lin Davidson made a motion to accept the proposal. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Joan Jurkowich advised the Board Members the Foreword she provided is not part of the actual document, it is for conversational purposes only. The Planning Board requested that Ms . Jurkowich change the Title of the Foreword to : Cayuga Lake Waterfront Plan — Update Lin Davidson made a motion to accept the Negative Declaration Resolution as presented . Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED . Ms . Jurkowich will return at the September 26, 2005 Planning Board Meeting. Approval of June 13th, July 11th, and August 8th 2005 Minutes Lin Davidson made a motion to accept the minutes of June 13th and July 11th 2005 as submitted. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. • Larry Sharpsteen made a motion to accept the minutes of August 8th 2005 as submitted. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Donald Howser, 1 Lot Subdivison, 932 Auburn Road, Tax Parcel # 8 .- 1 - 25.2 Mr. Howser appeared before the Planning Board requesting a 1 Lot Subdivision to sell a 1 . 03 acre lot to include the Well and Septic . Lin Davidson completed the SEQR. Lin Davidson made a motion to declare a negative declaration. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED . Larry Sharpsteen made a motion to accept the 1 Lot Subdivision as submitted and waive the Public Hearing. Greg Travis seconded. Other Business Nancy Loncto has requested that Rachel Jacobsen notify the Lansing Fire Department via letter requesting their invite to the September Working Meeting be postponed until October' s working meeting to allow the Planning Board time to take of unsettled business . Private/Shared/ Drives/Roads It was the consensus of the Board that one goal for the upcoming year is to review private/shared/drives/roads in the Land Use Ordinance and Subdivision Rules & Regulations to coincide with the updated Comprehensive Plan. Lin Davidson made a motion to adjourn at 8 : 25 PM. David Hatfield seconded. VOTE : ALL IN FAVOR.
