Ms . Loncto began by reading the legal notice published in the Ithaca Journal regarding the Public Hearing for All Saints Church. Ms . Loncto opened the floor for Public comment. All Saints Church-Public Hearing - Final Site Plan Review Thomas Schickle presented a Site Plan map of revisions made to expand the existing parking lot. Mr. Schickle gave a brief refresher of the overall project as previously proposed. Approximately 25 parking spaces have been added to the plan. The secondary driveway coming out on route 34 will be eliminated. At a previous meeting lighting was an issue . Mr. Schickle indicated that the church has deep over hangs and the lighting will be in the soffits . The lights on the side of the church will give some residual light • however, no broadcast other than a reflection from the service of the church. The area that will be disturbed is approximately 35 ,000 SF which is under the requirements for a 6/13/05 Planning Board • SPEDES Permit. This church is registered with the State of NY. All Saints is working 11, with Steve Mabee from the Tompkins County Health Department with regards to using the existing septic system. Lin Davidson made a motion to close the Public Hearing. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Lin Davidson completed the SEQR. Lin Davidson made a motion to declare a negative declaration. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Larry Sharpsteen made a motion to accept the Site Plan. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Eileen and Floyd Wilcox (Richard Lobdell), 1 Lot Subdivision, Farrell Road, Tax Parcel # 39.-1 - 19 Richard Lobdell appeared before the board requesting that the board grant Mr. & Mrs . Wilcox approval for a 1 lot Subdivision. The Wilcoxs ' intend on purchasing a 5 acre section of the property and build a residential home. The dimensions are approximately 210 ft. wide by 1 ,023 ft. deep . A small portion in the north corner is considered Wetlands . • Larry Sharpsteen suggested that the board state for the records that due to adjacent Wetland, proximity of the UNA and the other traffic conditions on Farrell Road that this will never be considered for further Subdivision. David Herrick, Lansing Town Engineer had the following to offer: Re : Farrell Road Subdivision — Wilcox Dear Ms . Loncto , Per your request, I 've reviewed the subdivision sketch attached to the application and offer the following comment: 1 . The north end of Parcel 39- 1 - 19 abutts areas identified as wetlands on the US Department of Interior National Wetlands inventory. The Inventory includes many smaller potential wetland areas not recognized by the NYSDEC 12 acre threshold . The sketch suggests a new home will be constructed within 300 feet of Farrell Road . If this is the case then land filling and home construction will not approach the area delineated on the Inventory. if there is any doubt about the presence of Federal wetlands within 300 feet of the road a preliminary assessment could be performed by an environmental specialist. The assessment typically includes a field visit followed by a brief report and preliminary map of what could potentially be Federal wetlands . Formal delineation of wetland boundaries and permitting through the US Army Corps of Engineers would be the next step if it was clear that a project was disturbing or filling a Federal wetland . 110 6/13/05 Planning Board Mr. Lobdell does not intend on selling off additional acres of his property at this time, • however, the Board did advise him that planning of a Subdivision looks more favorable . Lin Davidson completed the SEQR. Larry Sharpsteen made a motion to declare a negative declaration. Dave Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Larry Sharpsteen made a motion to waive the Public Hearing. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Larry Sharpsteen made a motion to accept the Subdivision of property as presented with the statement that the Planning Board would not permit further Subdivision due to the proximity of the Wetland and difficulty with frontage. Viola Miller seconded. VOTE AS FOLLOWS : Larry Sharpsteen — Aye David Hatfield —Aye Thomas Ellis — Aye Viola Miller — Aye Lin Davidson - Aye Nancy Loncto — Aye Greg Travis — Abstained MOTION CARRIED. • Larry Sharpsteen clarified for the record that it is NOT required by The Town of Lansing Subdivision Rules and Regulations nor is it normal to have an announcement to surrounding property owners for a 1 Lot Subdivision. Stephen Cardamone, Preliminary Plat-Major (4) Lot Subdivision Teeter Road — Parcel # 37. 1 -7- 18, R1 District. Timothy Buhl, PE appeared before the Planning Board with a Preliminary Plat of a proposed (4) four lot Major Subdivision for the Teeter Road area. David Herrick, Town of Lansing Engineer offered the following : Re: Teeter Road Subdivision — Steve Cardamone Dear Ms . Loncto , I 've reviewed the Preliminary Plat submission drawings numbered ST- 1 through ST-5 and offer the following comments : Stormwater Pollution Prevention Plan 1 . This Land Development Activity is subject to the requirements of the Town 's Local Law #1 — Stormwater and Erosion Control . The general temporary and permanent controls included in • the drawings are a good beginning to fulfilling the requirements of the Law. I 'd be available at Mr. Buhl 's convenience to meet and discuss the balance of the items necessary to finalize 6/13/05 Planning Board the Stormwater Pollution Prevention Plan . It is expected that the SPPP be included with the • Preliminary Plat application . If the Planning Board chooses to grant approval it must include a condition that the SPPP be completed in conformance with the Local Law prior to Final Plat approval . There are no permanent facilities proposed for dedication to the Town so review by the Town Board does not appear necessary. Consolidated Water District Extension 1 . The four proposed parcels are outside of the present boundary of the Town Consolidated Water District. It will be necessary for the developer to request that the Town Board include this land in the District through an extension . A brief Engineer's Report and SEQR Short EAF should be submitted to the Town Clerk as soon as practicable . The Town Board could schedule a public hearing soon thereafter. Again , if the Planning Board chooses to grant approval it must include a condition that the District extension process be completed prior to issuing any building permits . 2 . The watermain extension design should include a profile . 3 . Once completed , the watermain design and details must also be reviewed by Bolton Point Staff and approved by the Tompkins County Health Department . Thomas Ellis stated for the records that he has received a complaint from one of the people in the neighborhood regarding previous flooding. Mr. Buhl indicated that there will be a side yard swale which should help the existing residents . • Larry Sharpsteen made a motion to set the Public Hearing for consideration of this application for July 11 , 2005 at 7 : 30 PM. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Mark & Matthew Holochuck, Sketch Plan, 4 Lot Subdivision, North Triphammer Road, Parcel # 41 -1 -29.2 Timothy Buhl agent for the Holochucks ' appeared before the Planning Board with a Sketch Plan of a proposed 4 Lot Subdivision. The Subdivision will consist of approximately 4. 9 acres of land. There will be 2 front lots, and 2 flag lots. 1 common driveway will be used. The lots are in a Water District and onsite septic systems will be installed. An easement would be given to the Town to run water to the back lots . David Herrick offered the following; Re : North Triphammer Road Subdivision — Holochuck Dear Ms . Loncto , I 've reviewed the Sketch Plan submission drawing numbered ST- 1 and offer the following comments : • Road Improvements 6/13/05 Planning Board 2 . Access to Lots 3 and 4 is presumably via a private drive in lieu of a Town road . Lots 1 and 2 also utilize the private drive to N . Triphammer. If this is a practice that the Town encourages then legal agreements should be drafted and submitted as part of the preliminary plat submission to define the person (s) or entity responsible for perpetual maintenance of the drive. The communal relationships inherently required of this concept could break down with subsequent landowners and the Town may be expected to `resolve' a neighborhood dispute by taking ownership and maintenance of a substandard drive . Mr. Krogh should advise on the acceptability of this proposal and any legal planning that would follow if the developer proceeds further. Stormwater Pollution Prevention Plan 2 . This Land Development Activity is subject to the requirements of the Town's Local Law #1 — Stormwater and Erosion Control . The general temporary and permanent controls included in the sketch are a good beginning to fulfilling the requirements of the Law. I 'd be available at Mr. Buhl 's convenience to meet and discuss the balance of the items necessary to finalize the Stormwater Pollution Prevention Plan . It is noted that the SPPP be included with the Preliminary Plat application . There are no permanent facilities proposed for dedication to the Town so review by the Town Board does not appear necessary. Consolidated Water District 4 . The four proposed parcels are within the Town Consolidated Water District. It will be necessary for the developer to identify the location of proposed water service connections and provide details for connecting to the main on the west side of N . Triphammer Road . Larry Sharpsteen suggested that 4 curb stops be out in front. Mr. Buhl states that can be • done. Nancy Loncto inquired if there was any intention or thought of the main drive from Triphammer cutting through to another piece of property in back of the existing property. Mr. Buhl does not think it can happen. Nancy Loncto has requested to hear from the Town Engineer in regards to a Fire Truck being able to get to the back residents. Mr. Buhl states he was looking at extending the water main to put in a hydrant. To date he has not spoken with Bolton Point or David Herrick in regards to this . Members had concerns regarding the shared driveway. It was suggested. that Mr. Buhl and Mr. Herrick look into samples that the Town of Ithaca uses. Anthony Massi, Informal Sketch Plan, 3 Lot Subdivision, 14 Pheasant Way, Parcel # 40.-3-28. 1 Mr. Massi appeared before the Planning Board with a proposed sketch plan of a 3 lot Subdivision. Neighbor Ronald Preston has approached Mr. Massi in regards to putting in a road on the Massi property in order to access the Preston property as they would like to future develop it. On the south side of the Massis ' property is the Bland Subdivision. 110 6/13/05 Planning Board It was suggested that the Code Enforcement Office obtain from the County Planning • Department a large map of the area to include properties owned by Bland, Thaler, Preston and Massi for future reference . The landowners were advised the lots are unusable until the road is built and the swap on the land is done, except for the 1 lot on Massi ' s property. William Kirk, Informal Discussion-Garden Center — 400 Auburn Road, Parcel # 28 .-1 -28.4 Mr. Kirk appeared before the Planning requesting feedback from the Planning Board with regards to opening a Garden Center. Currently there is a Landscaping business on the site. Mr. Kirk would basically like to formalize the business to include selling his items as a retailer. Mr. Kirk has been advised that he must include/show the forms of parking. This would be a Site Plan Review for the expansion of an existing building. Nancy Loncto advised Mr. Kirk to look through the Ordinance and determine what scripter is closest to his long-term intent. Larry Sharpsteen advised Mr. Kirk that the Planning Board will be looking closely at the lighting, signage, and drainage. Other Business : Connie Wilcox, Town Board Member and Liaison to the Lansing Fire Department voiced her concerns regarding private driveways and large emergency vehicles. Mrs . Wilcox • states taxpayers expect to get certain services when they own a home in Lansing and the Planning Board must be conscience of how trucks are going to be able to get into the drives. Mrs. Wilcox further stated at the last Fire District meeting it was brought up that they are not involved in what is going on in the Town. Recently the Code Enforcement Office has provided the Fire Department with copies of the Town Board reports that will help to keep them up to date on Building issues. It was agreed that the Planning Board would invite the Fire Department to their September working meeting. Rob Hall, Stormwater Drainage information was not provided. Postponed until the next meeting. Approval of May 9, 2005 Minutes Larry Sharpsteen made a motion to accept the minutes as submitted. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Further Discussion- Special Use Permit Thomas Ellis stated that he felt the Planning Board did not take enough time with discussion regarding the recommendation to the Town Board for a Special Use Permit for Hygear Suspension. Nancy Loncto, Chairperson advised Mr. Ellis that she felt the Board spent a large amount of time on discussion regarding this topic that the minutes do not reflect, nor do they need to . Larry Sharpsteen also agreed with Ms. Loncto and felt that all avenues were covered. 0 6/13/05 Planning Board • Nancy Loncto proposed that once the Comprehensive Plan is completed that the Planning Board review the Permit document that was previously proposed. This document is much more detailed, to include Comprehensive Planning. Larry Sharpsteen made a motion to adjourn the meeting at 9 : 20 PM. Lin Davidson seconded. VOTE : ALL IN FAVOR.
