Joseph Inman, 1 Lot Subdivision — 121 Dates Road, Parcel # 9.- 1 - 1 . 13 , in the RA District. Mr. & Mrs. Inman appeared requesting a 1 Lot Subdivision. The Inman ' s have sold their home with an additional 4 plus acres (lot A on map presented) . Lot B will be retained for the Inman ' s personal use. In addition, a cemetery is located on their property. Bud Shattuck encouraged the Inman ' s to have something written into their deed indicating that the cemetery remains with Lot B . Greg Travis made a motion to approve the 1 Lot Subdivision as submitted. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. . Lin Davidson completed the SEQR. Larry Sharpsteen made a motion to declare a li negative declaration. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION • CARRIED UNANIMOUSLY. Stephen Cardamone, Sketch Plan-Major (4) Lot Subdivision, Teeter Road — Parcel # 37 . 1 -7-18 , R1 District. Timothy Buhl, PE and Stephen Cardamone appeared before the Planning Boardwith a Sketch plan of a proposed (4) four lot Major Subdivision for the Teeter Road area. Mr. Buhl explained that the Subdivision will consist of 4 lots each with 225 ' of road frontage and approximately 2 acres each. Each lot will have an individual retention plan in accordance with The Town of Lansing Stormwater Regulations . Larry Sharpsteen suggested Mr. Buhl take pictures of the rear of each lot prior to building and after to prove that no disturbance has taken place or any additional flow added. Bud Shattuck advised Mr. Buhl sewer will be coming through the area within 2 years . Accommodations should be made in the planning stage for future hook up . Richard Platt advised both Mr. Cardamone and Mr. Buhl that public water is not available at their site. Mr. Buhl will contact David Herrick, in regards to connecting the loop from one end of Teeter Road to East Shore Circle. The next submission will show the house placements, driveways, septic areas, water line extension and Stormwater. • It was the consensus of the Planning Board that a short form SEQR will be completed as the project is on an existing paved road . All Saints Church-Final Site Plan Review Mr. Plan advised the board that final plans for All Saint Church will be forth coming and the contractor would like to start the project ASAP . Larry Sharpsteen made a motion to set the Public Hearing for June 13 , 2005 @ 7 : 15 PM. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY . Other Business : Hygear Suspension & Comprehensive Plan (Transportation portion) (Hygear) David Hatfield passed around a memo he had found at the Woodsedge Complex regarding the upcoming Public Hearing on Hygear Suspension. Bud Shattuck assured Mr. Hatfield that the memo did not come from the Town Board as it probably was initiated by an employee or resident. Rachel Jacobsen advised the board members that she had notified all landowners within 600 ' of the existing site (Hygear) of the said Public • I/ Y Hearing as it appeared in The Ithaca Journal. In addition, Ms . Jacobsen placed the notice • on The Town of Lansing ' s Web Site and listed in previous minutes . (Comprehensive Plan) Bud Shattuck advised the members that David Herrick has met with all interested parties except for Dwight Mengal from TCAT with regards to the transportation portion of the Comprehensive Plan. Mr. Herrick intends to have the finished product to the Planning Board as scheduled in mid June. Approval of April 11 , 2005 Minutes Page 1 , 2nd sentence, Bar to Barn David Hatfield made a motion to approve as amended. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY . Ronald Seacord-Continuation of Informal Discussion, Development of Cayuga Vista Drive Ronald Seacord appeared before the board with a draft of a proposed ( 18) Lot Subdivision Plan for residential homes . According to the Tompkins County Health Department the lots as designed are large enough for a septic also a provisional septic . Lin Davidson explained that previously the Planning Board had discussed the idea of having more density other than residential single family homes in that particular area. • Apartments with an engineered septic system until sewer came in was discussed . Larry Sharpsteen inquired from Mr. Seacord as to his opinion with regards to developing part of proposal at a lower density and as sewer approaches, increasing the density on the front portion. Mr. Seacord felt that it was something he could do as it would help the center of town develop . However, if Phase I were to sell out fast, he probably would sell the lots the same for Phase II. It was discussed that Mr. Seacord connect the two roads into one loop and make it a circle. Larry Sharpsteen indicated the road would not have to be built all at one time. Two stages would allow Mr. Seacord the additional funds to work with. Larry Sharpsteen made a motion to adjourn the meeting at 8 :28 PM . Thomas Ellis seconded. VOTE : ALL IN FAVOR. ( Click here for Zoning section 6 . 08 . 13 ) Code Enforcement • Sale will be conducted only within the property lines of the residence conducting the sale . - Code Revisions • Sale merchandise and activities cannot be displayed or conducted on any public property including sidewalks, streets and parkways . - Garage Sales • Sale items are primarily surplus items to the residential use ; o The sale of 25 bicycles is not a garage sale. - Outdoor Storage • The sale must not last for more than 3 consecutive days . This section permits a garage sale or a yard sale in a residential zone subject to restrictions hereinafter set forth designed to protect the character of residential zones and the peace, privacy, safety and general public welfare of persons within such zones . • (b) Garage or Yard Sale Defined. A "garage, patio or yard sale" means a sale conducted by any occupant of a residence from any location on the premises in any kind of residential zone of personal property accumulated during the course of ordinary residential living by selling the same to the public . Premises of churches, charitable organizations, schools and other nonprofit organizations are not residences as defined herein and expressly are not subject to the restrictions applicable to a garage, patio or yard sale defined herein. (c) Restrictions . A garage, patio or yard sale as hereinabove defined only may be conducted as follows : ( 1 ) No more than two sales may be conducted in any one calendar year. (2) Each sale shall last no more than three consecutive days beginning each day no earlier than 8 : 00 A. M . and ending no later than 8 : 00 P .M. , and shall be held no sooner than ninety calendar days after a prior sale. (3) Only a temporary advertising sign conforming to zoning ordinance standards and regulations shall be permitted, and posting the sign earlier than one day prior to the sale or for more than one day after the sale shall be prohibited. (4) Personal property sold at a sale shall not include secondhand goods obtained for purposes of resale. (d) Enforcement. The procedure for enforcement is as follows : ( 1 ) Any person may lodge a complaint with an enforcement official. An "enforcement official" means a city building inspector or city police officer, or other person designated by the community development director. (2) The enforcement official shall investigate each complaint and, if warranted, issue a citation or refer the matter to the city attorney for filing of a complaint; provided, however, that the enforcement official shall give only a warning for a first violation of the provisions of this section upon a written promise by the violator that no further violations shall occur. • (e) Penalties. ( 1 ) Violation of any provision of this section shall subject the violator to suit for civil remedy or criminal penalty, or both. (2) The criminal penalty for a first or second offense shall be punishable as an infraction, as defined by the California Penal Code, as amended from time to time . The criminal penalty for a third offense or more shall be punishable as a misdemeanor as defined by the California Penal Code, as amended from time to time. (3) The term "offense" means a judgment by a court that the provisions of this section have been violated as a matter of criminal law. (Ord. No . 1025 § 1 .) • Garage Sale Tips - City of Garland Page 1 of 2 • Garage Sales Tips Everyone understands how easily items no longer needed or wanted can accumulate . Once , twice , or maybe three times per year, household goods are displayed in driveways in hopes of selling unwanted items . The Code Compliance Department has provided these points for Garland residents to remember when holding garage sales : • Contact Code Compliance at 972 - 485 - 6400 for a permit number at least 24 hours before the sale . There is no fee required . • • Sales cannot be held continually from weekend to weekend . City ordinance : No more than three sales per year and no more than three consecutive days per sale . • Garage /yard sale signs cannot be displayed , placed , or posted on telephone poles , traffic signals , street signs , street lights , or city trees . Signs must be on private property . • A garage /yard sale is for selling used or unwanted household or personal items from the seller ' s own premises . • Merchandise and activities cannot be displayed or conducted on any public property, including • sidewalks , streets , alleys , and parkways . What The City ' s Code of Ordinances Says : Garage Sales are permitted for a sale period n ot to exceed more than three ( 3 ) consecutive days , excluding holidays , and n ot more than three ( 3 ) garage sales shall be permitted for the same location in any calendar year . You can get a permit from the Commissioner of the Revenue . • No more than two people who live at different addresses are allowed to have a yard sale at the same location . You must have proper identification . • Nonprofit organizations-- including fraternal organizations , civic associations , churches , and schools--are not permitted to conduct yard sales in any residential zone . • You may not have more than two yards sales at the same location • in any calendar year. • A yard sale can be held for up to three consecutive days . Yard sales exceeding three consecutive days are prohibited . • Yard sales may not be held before noon on Sundays . • You may not advertise your yard sales on any street , sidewalk , or any other public right of way in the city . • One sign may be displayed at the site where the yard sale is being held . • Your yard sale sign may not be larger than 12 square feet . • Violations of the city code for yard sales may result in a fine issued to you . . • If inclement weather rains out your yard sale , call the Yard Sales Page 1 of 2 yard Sales Page 2 of 2 Commissioner of the Revenue on the very next business day to • setup new dates . ( Permits may be obtained in the Building Services Department during regular weekday business hours and in the Police Department on the weekends . ) Signs permitted for these sales must be located within the lot where the sale occurs . Signs are not permitted at street corners or on utility poles within the public right-of-way . • The regulation of these sales is not intended to discourage or eliminate them ; but rather to ensure that they do not result in a burden or frequent inconvenience to the neighborhood . The increase in traffic and lack of available on -street parking are two concerns most often associated with garage and yard sales . Please be considerate of your neighbors when scheduling your next garage/yard sale .
