Public Present None General Business : • Nancy Loncto called the meeting to order at 7 :22 PM. Subdivision Rules & Reaulations This meeting was a "working session" . The members present made additional changes to the Subdivision Rules and Regulations. All Changes in bold red were made. APPENDIX II: FLAG LOT REQUIREMENTS • 1 .5 x standard lot area in any given zone and the access strip may not be taken into consideration of this minimum standard. • 40' access strip in any area where there is Sewer currently planned. • 30' access strip in areas where Sewer is not currently planned. • Contiguous Flag lots (2) may be allowed as a means of utilizing back and isolated lands, or as a means to preserve road frontage land for a demonstratable purpose. • All Flag Lots with driveways over 500 ft. must show a special need for this length. (i.e. previously landlocked parcels) • All flag lots will undergo Site Plan Review and a Public Hearing. a. In the case of a Public Hearing, the Code Enforcement Office shall notify all landowners within 600'of the boundary of the parcel considered at said Public Hearing. The afore mailing list shall be obtained from the Tompkins County Assessment Office. All mailing charges shall be the responsibility of the 11-22-04 Planning Bd. Applicant A minimum feel of $45.00 standard processing fee will be charged to the Applicant • Flag Dot poles maybe required to be 60' to accommodate easements to extend roads to remaining back lands or other parcels. Lin Davidson made a motion to accept the Subdivision changes and now pass them on to The Town Board for a Public Hearing and final approval. This motion includes a. stipulation that if Guy Krogh or David Herrick have further comments that those be forwarded to The Town Board. Greg Travis seconded. VOTE : ALL IN FAVOR. Requirements shown in Schedule II are not necessarily consistent with the requirements specified for those land use activities in Schedule I that have Special Conditions attached (SC) or those that require a Special Use Permit (SP) or Site • Plan Review. Where such inconsistencies exist, the requirements of such Special Conditions, Special Use Permit, or Site Plan Approval shall take precedence over the regulations set forth in this Schedule II. ** Front yard setback measured from the right-of-way line of the road. *** In the RA zone there is a 100 foot setback requirement for any apartment or condominiums. **** When the applicant is faced with limits arising from road configuration or natural features, frontage may be reduced, on a case-by-case basis with a decision by the appropriate board, but in no case less than the flag lot requirement of 20'. (i.e. cul-de-sac, corner lot, flag lot). Requirements of Schedule II are superseded by the following supplementary regulations, as appropriate: 1 . While required lot width frontage for multiple family dwelling units in areas served by public sewers is a minimum of 75 feet, it does not have to be greater than 125 feet. 2. There is a minimum front yard setback of Thirty (30) feet from road right-of-way except in conditions requiring site plan review in Bl and B2. Warren Road, Triphammer Road, 34 and 3413 have (50) feet set backs from road right-of-way. 3. For lots fronting on Cayuga Lake, front yards are facing the lake. For other lots, front yards are facing the access road 4. Tompkins County Health Department requirements shall be used to determine minimum lot area and lot dimensions when on-site sewage disposal systems are used. Health Department requirements may serve to increase minimum lot area but shall not decrease minimum lot area below that listed in this Schedule H. 5. Flag lots, as defined in the appendix of this Ordinance, may have a minimum lot width at the road frontage line of twenty (20) feet. 6. Lots with frontage on Cayuga Lake must follow D.E.C. and Health Department regulations on distance from lake. Lots facing the lake. Any building closer than 30' to the lake will require Site Plan Review. 7. Exceptions may be made with Health Department approval and for inside corner lots. • 8. Common wall-no side yard setback is required on the sides where units share the common wall. 9. See 701 .4. 13. 10. This density is applicable only in developments of three (3) acres or more. 11. Height limitations do not apply to any building used for agricultural purposes (Also see 605.2). • Schedule I Changes The following changes were made to below pages. (In bold red) Page 24 SP* 21 . Permitted when: • a. A site plan has been approved in accordance with applicable provisions of Sec. 701 , including but not limited to buffer and landscaping concerns . Other: After discussion by the Board Members regarding the lighting at United Storage it was determined at the last Site Plan Review that the entire lighting for all the buildings must be revised. To date no changes have been made. Mr. Platt advised the Board that a C . O. has not been issued for that Building and lighting will be considered. Airport Hazard Zone- Check with the County Planning Department (Cathy Wilsea) for a copy of their Master Plan. Boat House- Need definition, Dick Platt will research other communities. In-law Apartment- Need definition, Dick will research other communities. Nancy Loncto advised the Planning Board Members at the November 17, 2004 Town Board meeting by Resolution (04-208) the Town supported The Tompkins County Comprehensive Plan. As for the Town of Lansing Comprehensive Plan, Nancy has per sued a couple of interns from Cornell to take on this task. At the next Working Meeting, the board will deal with the items that Dick Platt will have obtained information on. In addition, approval of the above changes as well as any additional changes will be made. Possibly an introductory presentation on the Comprehensive Plan. Approval of November 8, 2004 Minutes Lin Davidson made a motion to approve the minutes as submitted. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
