Nancy Loncto called the Planning Board Meeting to order at 7 : 15 PM. Mrs . Loncto
began by reading the Legal Notice published in The Ithaca Journal regarding the Public
Hearing.
Richard Thaler, Whispering Pines Subdivision-Phase V, Public
Hearing Final Plat, Parcel # 40.-3 -2 . 1
Chairperson Nancy Loncto opened the Public Hearing to the floor at 7 : 17 PM .
* Public Comments :
• *Alvin Feldzamen stated he has previously appeared before the board with concerns
regarding the connection of Whispering Pines Drive through to Warren Road. Increased

• traffic would be an issue. Mr. Feldzamen previously suggested that the Town install
speed bumps. The Planning Board rejected that idea, as the Highway Department has a
problem with snowplowing when they are on the road. Mr. Feldzamen presented ,a copy
of a map he designed showing the location of the new extension to Warren Road and the
word WHY? Mr. Feldzamen asked the following questions :
1 . What rights as a citizen in this area do we have with regards to this road? Suppose
I came in here with a petition with 90% of the residents of Whispering Pines and
Arrowood Lane saying they did not want this road to go through to Warren Road,
would that have any effect on your judgment? Would that have any affect legally?
2 . Does this Board have final authority?
Nancy Loncto responded to Mr. Feldzamen by advising him the Planning Board
Members have previously looked at petitions submitted to the Planning Board on time for
Public Hearing discussions. This Final Phase of Whispering Pines has had a previous
Public Hearing. Mrs . Loncto further stated that the Planning Board does have final say
on some parts of this application, and the Town Board makes the final decision regarding
water and final road approval.
Bud Shattuck advised Mr. Feldzamen that The Town Board has already acted on this
issue.
Larry Sharpsteen advised Mr. Feldzamen this is the 2nd Public Hearing and he is the only
• person that has come forth regarding the traffic issue.
*Nancy Knowles, a new resident to Whispering Pines has concerns regarding the traffic, as
she has small children. Mrs . Knowles inquired why it has to connect to Warren Road, and
not go around Grandview.
*Robin Steele, also a new resident to the area shares the same concerns regarding
connection of Whispering Pines to Warren Road. Mrs. Steele inquired if there were
safety issues involved for the reason the road is being connected to Warren. A large
concern of Mrs. Steele and other residents is, this will be another "shortcut".
Larry Sharpsteen explained to the public this project has been in process for several
years. Eventual connection to Warren Road was always a part of the original plan. Mr.
Sharpsteen further stated it has recognized that when you have a larger concentration of
residential homes in an area, The Planning Board must balance the problem with traffic
and provide multi access. As for the problem of speed control, that is an issue with the
State as they set the speed limits . Larry suggested for speed control that Mrs . Steele work
with the Town who will then work with the State and County to try to rectify the
problem. Due to the increase of traffic, Mrs. Steele requested to know if stop signs and
lighting will be added.
Bud Shattuck advised Mrs . Steele to contact Jack French,The Town of Lansing Highway
Superintendant regarding stop signs . In addition, Mr. Shattuck encouraged the residents
of Whispering Pines to attend the Town Board Meeting next Wednesday, November 17 ,
• 2004 to address their concerns.

• The question was raised as to the timeframe for the road construction. Larry Fabbroni,
Engineer for The Whispering Pines project explained the road will be constructed. next
spring and be completed early into the summer.
*Alvin Feldzamen inquired if this plan calls for a northern extension of Whispering Pines
up to Asbury Road.
Larry Sharpsteen stated no . Mr. Sharpsteen further explained that there is land still owned
by Mr. Thaler. If Mr. Thaler should sell land and the new owner brought before the
Board a new request to develop, The Town would be open to looking into another road, if
a road is proposed.
Mr. Thaler reminded the Board Members exactly what the Planning Board requested to
have with Phase V were :
1 . A connection between Water District 14 and District 9 .
2 . Access off of Hillcrest and Warren Road without a straight connection.
Larry Fabbroni stated he feels that motorists will discover this route is not shorter. It will
serve the local needs. In addition, 175 ' north of where the road is, will be a stop sign. Mr.
Fabbroni further spoke of the drainage plan. The finish drainage plan shows how it will
remove most of the water that now flows down Warren Road, take it back lot to the pond
and in turn discharge it into the creek.
*Alvin Feldzaman asked the Board to consider setting a One Way Sign on this new
• extension from Whispering Pines to Warren Road.
Nancy Loncto advised Mr. Feldzaman that mostly likely the Planning Board would not
recommend that to the Town Board, however, as a Citizen he may do so .

Dear Ms. Loncto,
Mr. Fabbroni submitted revised drawings on November 2nd in response to my comments of October 25th.
The majority of my concerns were addressed . I recommend that the following items be added as conditions of any
approval and be resolved prior to your signing of the Final Plat.
Road Extension
1 . With respect to driveways for Lots 24 and 29 the note 8 added to Subdivision Plat should be
• changed from "should" to "must".
2. Since Warren Road is a County Highway, the Town should receive an approval letter from the
County engineer for the intersection design .

• Stormwater Management
1 . Mr. Thaler will retain ownership and maintenance responsibilities for the stormwater management facility. It is necessary for
Mr. Fabbroni to develop a draft maintenance agreement and permanent access easement for review by the Town's
Attorney. Mr. Krogh can clarify the filing requirements.
2 . The 20-foot access easement recently added to the Subdivision Rat should be extended south to
Tiger Lily Lane across the 6D-foot strip of land owned by Lot 22.
3. The appropriate construction details (per the description on page 11 of the Stormwater Pollution
Prevention Plan ) for the access drive are to be added in the final documents.
4 . Grading of the roadside ditches on the short extension of Whispering Pines should be checked . I
believe the land form would favor draining to the south .

Miles McGarth inquired if the Planning Board was going to approve this tonight. The
question was brought up if an area where children could play together be considered in
this Subdivision.
• Larry Sharpsteen explained that this hearing is on the final plat, which is the last hearing
before final approval. Conditions were set forth in the presentation of the final plat based
on engineering considerations. With consideration of Public comment tonight, this
subdivision is at the point where it would be approved. Larry further explained that a
play area would not be considered due to the liability involved.
Richard Thaler advised Mr. McGarth to contact him regarding the play area.
Brenda Pillar-Feidzamen requested to know if the final plat showed all the homes or would
more homes be built. Brenda Pillar-Feldzamen inquired if the road continued on through
Pheasant Way and Grandview.
Nancy Loncto advised Mrs.Pillar-Feldamen to the best of the Planning Boards
knowledge, this is the end.
Larry Sharpsteen indicated the road extension was at the request of the Planning Board.
Larry further explained to Brenda Pillar-Feldzamen why the road was extended to
Warren Road as opposed to Asbury. Per the DEC this area is a registered stream, in
addition to the practicality of the Town maintaining another bridge .
Bud Shattuck advised the audience members that the State will set the speed limit based
on the number of homes, curb cuts, and where the road is located. Speed Bumps are a
Town issue. Jack French Highway, Superintendent is in charge of them.
Mr. Thaler advised the Whispering Pines residents that he will be glad to help them. out
• with setting of the speed limit.

• Sha Wang also had concerns regarding the speed limit. Large construction trucks were an
issue.
Mr. Thaler assured the residents that when this road is put in, there is not going to be
somebody using that road that does not belong there as far as Contractors are concerned.
Mary Adie inquired if the engineering had been completed sufficiently.
Larry Fabbroni advised Mrs . Adie yes .
Viola Miller made a motion to close the Public Hearing at 8 : 01 PM. Larry Sharpsteen
seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Glenna Thaler, 1 Lot Subdivision — 195 Hillcrest Road, Parcel # 41 .-2-2
Mrs. Thaler appeared before the Planning Board requesting a 1 Lot Subdivision in order
to sell an approximate 2 acre parcel to include the home, garage and barn.
Thomas Ellis completed the SEQR. Thomas Ellis made a motion to declare a negative
declaration. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION
CARRIED UNANIMOUSLY. Larry Sharpsteen made a motion to accept the proposed
Subdivision of property and waive the Public Hearing. David Hatfield seconded. VOTE :
ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Margaret Listar, One Lot Subdivision — 48 East Shore Circle, Parcel #
• 37. 1 -7-18
Peter Walsh, Attorney-Agent for the proposed buyer (Cardamone Home Builders, Inc . )
appeared before the Planning Board requesting a 1 Lot Subdivision. Mrs . Listar will
retain Lot A which consists 1 . 16 acre with a home and garage . Lot B, 12 .4 acres will be
sold to the above contractor who at some point will request a subdivision of 3 Lots , 3 acre
each with 300 feet of road frontage.
For the Board' s record if Mr. Cardamone divides his parcel as currently described, it will
be largely a formality. Drainage is a concern for the property owners on East Shore
Circle. At this time, the Board is not giving Mr. Cardamone permission he must come
before the Board.
Thomas Ellis Completed the SEQR. Larry Sharpsteen stated for the records the nearest
UNA is approximately 450 yards away, north of Teeter Road. Thomas Ellis made a
motion to declare this a negative declaration. David Hatfield seconded. VOTE : ALL
IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Larry Sharpsteen made a motion to accept the proposed Subdivision, and waive the
Public Hearing. Gregg Travis seconded. VOTE : ALL 1N FAVOR. MOTION
CARRIED UNANIMOUSLY.
Bud Shattuck advised the Board Members to think about as Sewer moves forward in the
• Town new and existing homes will be mandated to hook up . As more aggressive

• scheduling of Subdivisions get in the line of this original project, the board should let the
Contractors and Realtors know this will be an added burden.
To clarify the drainage issue, even though lots are 3 acres with 300 ' of road frontage, the
Planning Board may not have authority with the Subdivision, however, they do have
authority with the SEQR to see that the drainage is handled properly.
John Stevens, Sketch Plan, 3 Lot Subdivision —Warren Road West
Parcel # 44 .4 -5.32
George Frantz, Agent for Mr. Stevens appeared before the Planning Board requesting a
proposed 3 Lot Subdivision. Mr. Stevens would like to divide the 5 %4 acres into 3 lots
that will consist of,
1 . 58 ,000 sq. ft.
2 . 82 ,360 sq. ft.
3 . 88 ,070 sq. ft.
All lots meet the minimum requirements for the R1 district.
Viola Miller stated this is contrary to what they like their Subdivisions to have with lots
opening onto Warren Road.
Mr. Frantz explained further that this parcel is too shallow to do a cul-de-sac off Warren
Road and the Frontage off Hillcrest is too narrow.
• Larry Sharpsteen stated he liked the site distances . There is ample room for separation.
The lot that borders on Hillcrest has previously been subdivided in 1998 . The Planning
Board requested further mapping information such as drainage and separation of
driveways . A possibility of a shared driveway for Lot 1 & 2 . Stormwater Management
into consideration for all affected properties.
Thomas Ellis made a motion to accept this as a Sketch Plan for a Subdivision. Mr. Frantz
is to return with a topography map and address the issues associated with Stormwater
Management. In addition driveways . Larry Sharpsteen seconded. VOTE : ALL IN
FAVOR. MOTION CARRIED UNANIMOUSLY.
Viola Miller stated the Board should wait until Mr. Frantz returns with the requested
information before a SEQR is completed.

Ryan Janowski, agent for Cingular Wireless appeared once again before the Planning
Board with the requested changes (fence & gate) for Site Plan Review. Previously the
board also requested foundation details. Mr. Janowski stated he would explain the
foundation details, and ask that the board make any approval contingent upon receiving
them. Normally the company does not provide them until they apply for a Building
Permit. Larry Sharpsteen stated he has no problem with that happening, however, The
• Planning Board would also like a copy for their files in addition to The Code
Enforcement Office.

• Larry Sharpsteen clarified for the records that The Planning Board requested the fence be
8 ' . Mr. Janowski indicated that if the fence was raised to 8 ' and with the bob wire it
would be close to 10 ' . Larry stated this was not a promise to the Planning Board for 10 ' .
The new map presented does show both changes with the gates being a little more
elaborate then requested.
Larry Sharpsteen made a motion to recommend to the Town Board that they consider this
review. Comments that have been made by The Planning Board at an earlier meeting
have been addressed and are nolNready for Town Board review to include a Public
Hearing. Greg Travis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY.
Approval of October 25, 2004 Minutes
Larry Sharpsteen made a motion to approve the minutes as submitted. Greg Travis

letter. David Hatfield seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY.
