Nancy Loncto called the meeting to order at 7 : 14 PM.

Plan Review
Board Members reviewed the revisions Gary Wood prepared for IMR. Gregg Travis
inquired if the silt fence would go around the entire area. Mr. Kasonic advised the board
that it would be across the front. Nancy Loncto shared comments received in a letter
from Lansing' s Town Engineer, David Herrick regarding the Storm Water.
Thomas Ellis made a motion to accept the revised Site Plan Review as the permanent Site
Plan and proceed. Greg Travis seconded. Lin Davidson abstained. VOTE : ALL IN
FAVOR. MOTION CARRIED .
Mapes, Martha & Barth, Informal Discussion- Subdivision-Scofield
Road .
Mrs. Mapes appeared before the board requesting direction as to how to proceed with the
adivision of her property. The Mapes have two (2) perspective buyers that wish to

purchase three (3) acres with 300 ' road frontage (parcel A) and six (6) acres (parcel B-
• back lot) which forces the Mapes to have a plan. The Mapes have proposed to provide
two (2) 30 ' driveways. One for parcel B (6 acres) and parcel C they will retain. After a
lengthy discussion, it was determined that this would be a Minor Subdivision as long as
the 30 ' driveway(s) belong to the individual lots. The Mapes were advised to return to
the Planning Board with an updated survey showing their intentions.
Cornell University, Final Plat, 4 Lot Major Subdivision — Teeter Road
& Reach Run, Parcel # 36.4 -15 .2
Nancy Loncto read David Herrick ' s comments regarding the proposed Subdivision. At
this time there are no Stormwater and Town infrastructure issues . The proposed lots are
not located in the Town' s Consolidated Water District. It is not mandated that these lands
be included in a district unless the owners desire to connect to the Town mains. The
owners can petition the Town Board to extend the boundaries, however, there will be
some engineering and legal expenses at that time to be incurred by the owners . Nancy
Loncto advised the members that The Town of Lansing Subdivision Rules and
Regulations require Final Town Board approval when covenants are included. The next
Town Board meeting is scheduled for Wednesday, May 19, 2004. Lin Davidson made a
motion to approve the Cornell University Subdivision on Teeter Road and Reach Run,
Parcel # 36 . 4 - 15 .2 with the Final Approval contingent upon the Town Board approving
the covenants. Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION
CARRIED UNANIMOUSLY.
• Robert & Vicki Bland, Pheasant Meadow Subdivision, Revisions to
Preliminary Plat, Parcel # 40.-3-29.2
Nancy Loncto stated she recently heard from David Herrick regarding water quality and
quantity, Also, surface water runoff. Mr. Herrick has advised the board that Tompkins
County Health Department is requiring a small booster station to be constructed.
Standing water and saturated soils have been common along the north line of the
Swaminathan parcel in the Whispering Pines Development. The stormwater
management plan for Pheasant Meadow will provide permanent water quantity controls
to mitigate increases in runoff from the new impervious surfaces. Since no other
drainage improvements are proposed on the Swaminathan parcel, the present conditions
will persist. David Herrick and Guy Krogh both agree that the Planning Board may have
acted prematurely on the Preliminary Approval. It has been suggested that the Planning
Board rescind their original approval until the SEQR Long Form has been completed. Lin
Davidson made a motion to rescind the Preliminary Plat Approval from the Bland
Subdivision until the Planning Board receives an approved SEQR. Greg Travis
seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
David Herrick guided the board through the Long Form SEQR. Based upon the Board' s
findings and a lengthy discussion, it was determined there are no sufficient environment
impacts from the project. Larry Sharpsteen made a motion to declare a negative
declaration. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
• UNANIMOUSLY.

Lin Davidson made a motion to accept the SEQR and approve the Preliminary Plat for

the Bland-Pheasant Meadow Subdivision. Larry Sharpsteen seconded. VOTE : ALL IN
FAVOR. MOTION CARRIED UNANIMOUSLY.
Bud Shattuck inquired from David Herrick a concern he had regarding Mr. Buhl ' s
response on item # 3 of his letter dated April 4, 2004 regarding a drainage pipe. Mr.
Shattuck stated that there was a possibility that the Town would have an alternate route.
Mr. Herrick stated when he spoke to Mr. Buhl he was told they would stay with the
program. Mr. Bland stated to the Board that they could change back, right now it is a
level spreader of the over flow to mending the existing conditions .
Approval of April 26, 2004 Minutes
Thomas Ellis made a motion to accept the minutes as submitted. Greg Travis seconded.
Larry Sharpsteen and David Hatfield abstained due to their absence at the April 26, 2004
meeting. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Town of Lansing Record Storage Building, Site Plan Review, 29 Auburn
Road, Parcel # 37. 1 -2-6
Douglas McEver, Town Councilman appeared before the Planning Board requesting a
Site Plan approval for a 28 ' x 30 ' Pre-fabricated Storage building to be erected on The
Town of Lansing property for the purpose of storing Town Historic records and the use
• of records management. Several Town areas have been looked into, however, the site
between the Grange and the Old School House seems to be the most convenient area
without having to worry about utility equipment that is already underground. The setback
will approximately be 4 feet from the blacktop . The water and electric will tie into the
Grange building. Sidewalks will be poured, the location of them are unknown at this
time. There are no issues concerning parking, drainage, water & sewer, driveways or
lighting at this time. Lin Davidson stated that a landscaping plan should be presented as
this location is in the B1 district. Lin Davidson completed the SEQR. Lin Davidson
made a motion to declare a negative declaration. Larry Sharpsteen seconded. VOTE :
ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Thomas Ellis made a motion to waive the Public Hearing. Lin Davidson seconded.
VOTE : ALL IN FAVOR.
Bud Shattuck reiterated that in this district the Planning Board always asks for a
Landscaping Plan. Lin Davidson made a motion to amend the motion on the SEQR until
the Planning Board receives an acceptable Landscaping Plan. Larry Sharpsteen
seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
Stevens- Hillcrest Subdivision
Larry Sharpsteen inquired about David Herrick ' s comments on the Steven ' s Subdivision
(Lots 1 , 2 and 3) regarding The Town' s Consolidated Water District. Mr. Sharpsteen
understands that an application would have to be made to include those lots in the Water
District, hasten to comment that certainly the owner would not be required to put an 8
• inch main as suggested by Mr. Herrick. The owner should be able to put an easement on
across his property. Mr. Shattuck states no. You must have Town permission to get a
back lot extension to the Water District. Mr. Shattuck further states that the owner has 3

choices, to put in an 8 inch main, drill a well or due to a hardship request a Variance.

Thomas Ellis requested to know the status of the Test Track. Mr. Ellis recently received
a complaint from an area resident that resides near that location. The complainant has
seen and heard the motorcycle at various times of the day, as has Mr. Ellis . At a previous
meeting that Mr. Benson attended, he was told that he must submit an application to the
Code enforcement Office to request a Special Use Permit as this is not a permitted use in
that area. To date, The Code Enforcement Office has not received an application.

June Working Meeting (Changes and Additions to Subdivisions)
For those Members that were absent at the last meeting, Nancy Loncto advised the Board
that the meeting will start at 6 : 00 PM with Pizza being served as dinner. Subdivision
Rules and Regulations will be the working agenda item. Viola Miller requested that all
Members read their Subdivisions prior to the meeting and bring any recommendations
that they wish to see changed.
Lin Davidson made a motion to adjourn the meeting at 9 : 15 PM. Greg Travis seconded.

At the Planning Board meeting held on May 10, 2004 an unanimous vote was
made to approve the Final Plat for the Cornell University 4 Lot Major Subdivision
contingent upon Town Board approval . The Town of Lansing Subdivision Rules and
• Regulations state for Major Subdivisions with Covenants/Restrictions final approval
must come from the Town Board .
Please review the attached Covenants and Restrictions prior to your May 19 ,
2004 meeting.

Declaration of Covenants and Restrictions 5:5

410 Made and Declared this _day of . 2004, by Cornell University, an
education corporation, c/o Real Estate Department, Box DH, Cornell University, Ithaca,
New York, 14853 , being the owner of a certain tract or parcel of land more particularly
described in Exhibit A consisting of the four lots in Teeter/Reach Subdivision, and
intending to make the -use and sale of such four lots subject hereto . These covenants and
restrictions (hereinafter "Covenants") are established for the purpose of enhancing and
protecting the value, desirability, and attractiveness of the four (4) lots described in the
Teeter/Reach Subdivision, reference to subdivision map dated 8/ 19/2003 , entitled "Final
Subdivision Map Showing Lands of Cornell University, located on Teeter Road and
Reach Run, Town of Lansing, Tompkins County, New York" and the general area and
shall be binding upon and inure to the benefit of Declarant and the future owner
(hereinafter individually called "Owner") of each lot, and each heir, distributee, assign,
tenant, subtenant, licensee and/or successor in interest of an Owner. The Covenants
shall run with the land. The leasing of any property by any Owner, is subject to all of the
Restrictions and Covenants .
The following persons shall have the right to exercise any remedy in law or in equity,
including specific performance for the enforcement of strict compliance with the
Covenants contained herein:
a. Declarant during the time it owns property adjoining or abutting any of the
four (4) lots or owns any of the lots and for a period of two (2) years after the date of sale
• by Declarant of any of the four lots or its adjoining property.
b. The Owner during the time he or she owns a lot.
Covenants and Restrictions
1 . The real property conveyed hereunder shall be used primarily for single-family
residential purposes. For purposes herein, single-family shall exclude duplexes, multi-
family units, condominiums, and accessory income apartments . "Parent-In-Law"
apartments or nanny/butler apartments are permitted.
2 . No more than one single-family residence shall be constructed or occupied on any
lot. An office of the Owner if in residence is permitted. No more than 30 percent of the
square footage of the single-family residence shall be used for permitted office purposes.
The purpose of any permitted office shall be limited to professional use, such as a doctor,
lawyer, dentist, architect, musician, artist, or craftsperson. No more than two (2)
employees, besides family members, are allowed to work in a permitted office.
3 . Each lot, and any and all improvements located thereon, shall be maintained by
the Owner in good condition and repair, all at such Owner' s sole expense.

4 . All loud or offensive noise shall be strictly prohibited. In addition, all sound
• produced by any other than natural phenomena in excess of 60 decibels when measured
at the property line nearest to the source shall be prohibited. No exterior speakers, horns,
whistles, bells, audible insect killing devices, or others, except security devices, shall be
placed on or used upon any lot. This restriction does not apply to normal noise created
by necessary construction, Monday through Saturday, between the hours of 7 : 30 a.m. and
6 : 00 p.m.
5 . No signs whatsoever shall be erected or maintained on any residential lot, except:
a) such signs as may be required by legal proceedings; such signs as a builder or reactor
may erect or maintain prior to sale of a property, not to exceed 4 square feet; b)
residential identification signs of a combined total face area of one-half square foot or
less for each residence. Professional offices of owners in residence are allowed one sign,
not to exceed two (2) square feet. Non-permanent signs, advertising garage sales, etc. ,
can be erected for a period not to exceed one week. No signage of products for sale to
the public shall be advertised on or from the property.
6. No house trailer, mobile home, permanent tent, camper, boat, unlicensed vehicle,
or similar facility or structure shall be kept, placed or maintained upon any lot at any
time.
7 . Each residence shall contain a fenced service yard enclosing all above ground
trash and garbage receptacles, exterior incinerators, clotheslines and other maintenance
and service facilities used by the Owner. Such fencing or screening shall be of materials
• consistent with the principal structures on the site or plantings of suitable plant materials
whose growth patterns will screen both in height and density. In no event shall such
facilities be visible from any neighboring property.
8 . All fuel tanks, water tanks or towers, or similar storage facilities shall be
constructed as an integral part of the main structure of any residence installed,
constructed underground, or screened by fencing or plating . No fuel tanks may be
installed underground.
9. No exterior antenna of any sort or any satellite dish shall be installed or
maintained in such a way as to be visible from neighboring property.
10. Each lot shall contain parking spaces for at least two automobiles per residence.
11 . There shall be no hunting or discharge of firearms, or use of bows and arrows on
any lot.
12 . The following standards and restrictions are applicable to the construction,
reconstruction, alteration and refinishing of any and all improvements:
A. No part of any building with the exception of the chimneys with a maximum
• dimension of three (3 ) feet in width or plumbing flues may exceed the height limit for

each lot. Building height for each lot shall be no more than 35 feet. Building heig is 3® p

• defined as the vertical distance measured from finished grade to the highest point of a I a w
roof. On a hillside lot, finished grade should be considered as the average finished grade I,
on the uphill side of the structure.
B . Exterior siding shall either be solid wood, stone or brick. Plastic is not allowed
except as window cladding or flashing.
C. No reflective finishes (other than glass and surfaces of hardware fixtures) shall be
used on exterior surfaces. Exposed metal surfaces are limited to miscellaneous flashing,
connectors, and chimneys.
D . Fences shall be used for screening and privacy purposes only. Under no
circumstances will fences be built along property lines . Fences, screens and similar
exterior structures shall generally be constructed of wood except for nails, bolts, and
other approved connecting devices, hardware and fixtures.
E. Surfacing of driveways, paths and walkways must be with non-reflective
materials, i.e. gravel, asphalt. Surfacing materials that are reflective, such as white
marble chips, are prohibited.
F . No roof pitch shall be less than a 4 on 12 slope. Roof materials may consist of
wood shingles, asphalt shingles, copper or slate and will be earth tones or grays, except
copper.

G. No trees with diameter exceeding eight (8) inches may be cut or trimmed, except
where located in proposed foundation plot or with in sixteen ( 16) feet of the foundation
of the proposed residence.
H. None of the plants contained on the attached list may be introduced, maintained or
planted on the property or kept in pots on the property as these specimens constitute a
potential threat to the integrity of the natural area adjacent to the building lot.
I. No discarding or dumping of any kind, including disposing of potting soil or any
plant materials, on lands owned by Cornell.
13 . In the event that compliance with any of the above Covenants constitutes a
violation of the applicable building and fire code or the Town of Lansing Zoning Laws,
then in that event such specific Covenant is deemed amended in the narrowest manner so
as to conform with the applicable law in effect at the time of construction, addition,
alteration, reconstruction, and/or refinishing of any and all improvements.
