Approval of October 06 , 2003 Minutes David Hatfield made a motion to accept the minutes as submitted. Greg Travis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY . Deborah Teeter, Cooperative Extension Agricultural District 8 Year Review Ms . Teeter explained to the board that the Cooperative Extension has a contract with the County to perform Agricultural 8 year reviews with several area Townships for possible removal of Agricultural Districts . Those types of removal will most likely be Subdivisions where the Town is considering sewer and water. The Cooperative Extension ' s Timeline is as follows : Agricultural District #1 • 8- Year Review 300- Day Timeline 07/01 /03 Process Begins 08/01 /03 30-Day Public Comment Period 09/01 /03 - 10/31 /03 Gather Input from Town Planning Boards 11 /01 /03 • Agricultural District Review Worksheets sent to agricultural landowners 12/01/03 Worksheet results compiled 12/ 16/03 Public Hearing 01 /01 /04-02/ 15/04 Outreach to Town Boards for Input and to share Recommendations by 02/ 15/04 County Legislature determines to any changes to the District by 03/ 15/04 Review documentation sent to NYS Agriculture and Markets • by 04/ 15/04 NYS Agriculture and Markets reviews documentation Ms . Teeter advised the board that you do not have to be in an Agricultural District to get an exemption. It was suggested that the board look closely at areas where they can do away with the Agricultural District and fill in with houses that will have water and sewer. Ideally the area of Peruville Road and South should probably be developed, however, you can not force a property owner to withdraw from an Agricultural District . New Ordinance Set-backs Mr. Platt previously advised the board that they should seriously consider changing the set-backs back to what they originally have in the current Ordinance. After a lengthy discussion it was determined that the front footage should be changed to 30 feet in all districts except B1 , B2 and IR districts where they have Site Plan Approval . Under Footnotes Requirements for Schedule II, page 30, #2 should read : There is a minimum front yard setback of Thirty (30 feet from road right-of-way except in conditions requiring site plan review in B1 and B2 . Warren Road, Triphammer Road, 34 and 34B has Fifty (50) feet set-backs from road right-of-way. Lin Davidson made a motion to make the above changes to the proposed Ordinance . Greg Travis seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. • Mr. Platt will bring these recommendations to the Town Board at their meeting scheduled for November 5 , 2003 @ 7 : 00 PM . i • Waldman, 1 Lot Subdivision - Estates Drive Parcel # 44.- 1 -40. 28 At the Planning Board meeting of October 06 , 2003 Mr. Waldman appeared before the board requesting he be granted a 1 Lot Subdivision and a boundary change . The Board approved the 1 Lot Subdivision pending the final Survey and waived the Public Hearing. Board Member Viola Miller was absent from that meeting, and has now brought to the Board ' s attention that a change was made to a Major Subdivision which requires a Public Hearing. Ms . Miller explained that this particular Parcel has been before the board on July 08 , 1991 and approved as a boundary change. (See copy of Minutes from 1991 ) Fred Rogers-Tax Map # 44-1 -40.21 request to consolidate 2 lots (28 & 21) in the Horizons Subdivision. Lot #21 was not approved for septic by the Health Department. Mr. Rogers would like to incorporate it into one Deed. It was presented by George Pfann, Jr. Linda Hirvonen moved to accept the boundary change as presented by Mr. Pfann on behalf of Fred Rogers. Seconded by Viola Miller Mullane. Carried. Another boundary change can not be done as this was consolidated to one lot. The owner at that time choose to place his home essentially in the center of the lot (2 combined) . The purpose of having this filed with the County regardless of how many times it changes hands, is so that it stays according to the original Subdivision. Approving what Mr. Waldman is requesting will create a smaller lot within the Subdivision. This will affect the property assessment of others within the Subdivision. • Lin Davidson made a motion that the Planning Board review the incomplete Subdivision of the Waldman parcel in light of the fact that it is a change in a Major Subdivision. The proper protocol must be utilized. Viola Miller seconded . Vote : Nancy Loncto- Aye, Lin Davidson-Aye, Greg Travis-Aye, Viola Miller-Aye, Thomas Ellis- Opposed, David Hatfield-Opposed, Brian Ivery- Opposed . MOTION CARRIED . Review of Town of Lansing Subdivision Rules and Regulations It was suggested that the Code Enforcement Office enforce with the Landowner that all submittals be in their office Five (5 ) working days prior to the Planning Board Meeting. Brian Ivery made a motion to make the below changes . Lin Davidson seconded . VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. Page 4, Paragraph C, remove last sentence (In unusual circumstances, the Planning Board may increase the maximum number of lots classified as a Minor Subdivision.) Page 4, Paragraph E . add (Pg. 43 ) after Supplement 1 Page 43, Paragraph A, remove shall hold a Public Hearing and replace with may hold a Public Hearing. Add : A subdivision proposing one new lot shall be recommended for approval or denial by The Planning Board. Final approval or denial shall reside with The Code Enforcement Officer subject to The Town of Lansing Subdivision Rules and • Regulations and The Town of Lansing Land Use Ordinance . Add : All other Minor Subdivisions not requiring Public Hearings shall be approved or denied by the Planning \ • Board within 45 days from the date the sketch plan is determined to be a Minor Subdivision. Page 43, Paragraph C . add or disapprove after the word modification. Use of the Large Court Room It was discussed that the Planning Board will use the Large Court Room for their first meeting of the month. All working meetings will be held (if possible) in the small court room. Supervisor Farkas and Steve Colt are working together to either change the time of the class, change the day or possibly even locating a different Instructor. David Hatfield made a motion to adjourn the meeting at 9 : 34 PM. Thomas Ellis seconded. VOTE : ALL IN FAVOR.
