David Hatfield seconded . 33 VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY . 34 Richard Platt, Code Enforcement Officer distributed Part 2 of the PROJECT IMPACTS 35 AND THEIR MAGNITUDE form which he completed. Mr. Platt requested that the 36 Board Members make any changes or additions as needed . David Herrick, Town of 37 Lansing Engineer has approved the Soil and Erosion Control Plan. Larry Sharpsteen 38 made a motion to declare a negative declaration. Gregg Travis seconded . VOTE : ALL 39 IN FAVOR. MOTION CARRIED . David Hatfield recused himself from voting. • 40 No Public comments on the Boerman Project. The Public Hearing was closed. • 1 Thomas Ellis made a motion to accept the Major Subdivision contingent upon receiving 2 the written statement from the Town of Lansing Engineer regarding the Soil and Erosion 3 Control Plan. Gregg Travis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED 4 UNANIMOUSLY . 5 Alvin White, 1 Lot Subdivision, Goodman Road — Parcel # P/O 6 11 .22 7 Mr. White appeared before the Planning Board requesting approval of a one lot 8 subdivision. Mr. White explained to the board that the lot meets all requirements for the 9 Town of Lansing. It has 289 feet of road frontage, it encompasses 2 . 34 acres . The east 10 and west is bordered by a hedge row, across the road is a hay field. There are no water 11 problems, or wetland . Since the Town raised Goodman Road a few years ago there is 12 water in the northeast corner during snow melt. 13 Thomas Ellis completed the SEQR. David Hatfield made a motion to declare a negative 14 declaration. Thomas Ellis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED 15 UNANIMOUSLY. 16 Larry Sharpsteen made a motion to accept the Subdivision as presented, and waive the 17 Public Hearing for a 1 lot Subdivision with existing lots on both sides . David Hatfield 18 seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 19 Tricia Torney, Informal Discussion of Pet Cemetery and Crematorium. • 20 Ms . Torney appeared before the Planning Board seeking their guidance/advice regarding 21 a possible Pet Cemetery and Crematorium in the Town of Lansing. The exact location 22 was not disclosed at this time however, land is currently available in the North West area 23 of Lansing. Ms . Toney has performed extensive research into this proposal (See letter 24 below) and would now like advice from the board . 25 26 Pet Cemetery and Crematorium Proposal 27 I would like to take this opportunity to present a plan to develop a Pet Cemetery and 28 Crematorium in Lansing. I am also considering within 5 or 10 years to add grooming and 29 boarding, specializing in large dogs, to be developed on the same parcel of land . 30 Reviewing New York State regulations set out by the Department of State Division of Licensing 31 services that a Pet Cemetery is meant for the permanent interment or 32 inurnment above or below ground of pet remains . A license is required to operate a pet cemetery 33 or pet crematorium. The Secretary of State shall inspect periodically these cemeteries and 34 crematoriums . Real property to be used for a pet cemetery must file with county clerk where 35 property is located a dedication restricting the real property to be used only for such purposes as 36 are usual and customary for the operation of a pet cemetery .A copy of such dedication shall be 37 filed with the Secretary of State along with a copy of a survey map and appropriate zoning 38 approvals as may be reasonably required by the Secretary of State . A pet cemetery which • 39 provides for the permanent interment of pets shall consist of not less than five contiguous acres of • 1 real property in total area, inclusive of any structures, facilities, or buildings situated thereon and 2 used for the business purposes of the pet cemetery . 3 Discussion with the Health Department of Tompkins County showed no County restrictions for 4 this purpose . Requirements for any building permit as well as water and waste would all fall 5 under any normal development plans . The DEC would require air quality tests and impact reports . 6 TheDEC solid waste department . , not yet been successfully contacted at the time of the writing 7 of this proposal . Both the Health Department and the DEC Air Quality engineer will continue to 8 review documents for any further information and will advise of . any information found. All and 9 any manufacturer installation requirements for equipment would be followed . 10 There is currently land available in the North West area of Lansing which is zoned RA. Before 11 any offer would be made to purchase a parcel of the available land it must be deemed viable for 12 the purposes above . If permission is given to pursue development of these plans, yet the land 13 currently being considered is not obtainable, then the need for ability to have permission travel to 14 the new site if also located in RA zoned area will be needed . 15 If preliminary permission is granted for this land use and the property is then acquired, a site plan 16 will then be developed and submitted to this board for approval . Thank you for taking time to 17 consider this preliminary proposal . 18 Tricia Tomey • 19 1664 Ridge Rd. 20 Lansing, NY 14882 21 22 23 After a through discussion with the members, Ms . Torney was advised that a Cemetery is 24 permitted in the RA District with Town Board approval . It was mentioned that there 25 possibly would be an environmental issue with the crematorium due to it being classified 26 as medical waste. Ms . Torney will get the definition for medical waste . At this time 27 mostly dogs and cats would be taken for cremation . The Planning Board advised Ms . 28 Torney to have all the documentation she can possibly get on her equipment, and the 29 DEC approval on that equipment. Also it was suggested that Ms . Torney may want to 30 make site visits to neighborhoods where there has recently been a crematory erected to 31 obtain testimonials from neighbors . When asked of Ms . Torney as to whether she would 32 be doing subcontracting work from other places that have a cemetery service but do not 33 have a crematory facilities, her response was that she was not planning on it, or even 34 thought of it. The Planning Board advised Ms . Torney that her next step would be to 35 contact Mr. Platt in the Code Enforcement Office for a Special Permit application as the 36 Crematory is not in the Ordinance, therefore not allowed unless permitted under a Special 37 Permit. Mr. Shattuck advised the board that this application will not come back to the 38 Planning Board . 39 Michael Hovanec- Bailey Homes, Final Plat, 4 Lot Major Subdivision — ID 40 Goodman Road, Parcel # P/O 20 .-1 -8 . 2 1 Mr. Hovanec appeared before the board requesting that an approval be granted for a 4 lot • 2 Subdivision, and the Public Hearing be waived prior to him purchasing the property. 3 Previously this parcel was approved for a five lot Subdivision however, the owner/agent 4 neglected to file with the Tompkins County Clerk/Assessment Office within 60 days 5 from the approval, therefore, the approval was null and void. It was requested that Mr. 6 Hovanec show a containment swale on his final survey. 7 Thomas Ellis completed the SEQR. Thomas Ellis made a motion to declare a negative 8 declaration. Gregg Travis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED 9 UNANIMOUSLY. The Public Hearing is scheduled for November 10, 2003 at 7 : 15 PM . 10 Michael Waldman, 1 Lot Subdivision Estates Drive, Parcel #44 .- 1 -40 .28 11 Mr. Waldman appeared before the board requesting a 1 Lot Subdivision. Over the last 12 year and a half the Waldman ' s have lost their privacy due to this lot being woods and 13 people using it to cut through to Rosina Drive. Mr. Waldman states the lot line is literally 14 a few feet behind the house. The Waldman ' s would like to redraw the line at the point 15 where their back yard ends . The frontage would be 166 ' and the depth 125 ' . 16 Thomas Ellis completed the SEQR. Gregg Travis seconded . VOTE : ALL IN FAVOR. 17 MOTION CARRIED UNANIMOUSLY . 18 Thomas Ellis made a motion to approve the 1 Lot Subdivision pending the final survey. 19 Gregg Travis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED 20 UNANIMOUSLY. • 21 David Hatfield made a motion to waive the Public Hearing. Larry Sharpsteen seconded. 22 VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 23 Approval of September 09, 2003 Minutes 24 David Hatfield made a motion to accept the minutes a submitted. Larry Sharpsteen 25 seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 26 Other Business 27 Richard Platt brought to the Board ' s attention that in the new Ordinance they may want 28 to amend that 50 ' set back as a lot of the neighborhoods have 30 ' as standards . Mr. Platt 29 feels this could potentially cause problems with new developments . 30 David Hatfield made a motion to adjourn the meeting at 9 : 22 .PM. Thomas Ellis 31 seconded. VOTE : ALL IN FAVOR.
