Nancy Loncto, Chairperson called the meeting to order at 7 : 04 PM
Kirby, Public Hearing — Final Plat 5 Lot Major Subdivision , Buck Road
- Parcel # 29.- 1 -37.6.
Nancy Loncto read the Public Notice printed in the Ithaca Journal regarding the Kirby 5
Lot Major Subdivision.
Lin Davidson moved to open the Public Hearing at 7 : 08PM. Greg Travis seconded .
VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY .
Lin Davidson moved to close the Public Hearing due to the lack of interested
• parties . The Public Hearing will be reopened at another time during this
• meeting to allow comments from latecomers. Gregg Travis seconded. VOTE ALL IN
FAVOR. MOTION CARRIED UANIMOUSLY.
Swearingen, VanOstrand Road, Preliminary One Lot Subdivision,
Parcel # 30 .-1 -26.23
Mr. & Mrs. Swearingen appeared before the board requesting approval of a One Lot
Subdivision. The Swearingen ' s would like to build a new home next to their current
business . Water and Septic permits have already been issued to the Swearingen ' s .
Lin Davidson completed the SEQR. Lin Davidson made a motion to declare a negative
declaration. Greg Travis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY.
Greg Travis made a motion to approve the Subdivision contingent upon the #239 review .
Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY.
Richard Platt advised the Swearingens as soon as they get their final survey, they would
need to bring it into the Code Office for a final signature.
Lin Davidson made a motion to reopen the Public Hearing at 7 : 19 PM for the Kirby
Subdivision. Viola Miller seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY.
Chairperson Nancy Loncto requested public comments . There were none .
• Lin Davidson made a motion to close the Public Hearing at 7 : 20 PM on the Kirby
Subdivision.
Viola Miller: I so move as we have had the Public Hearing that the Subdivision be
acceptable as approved. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION
CARRIED UNANIMOUSLY.
Baker, Preliminary 1 Flag Lot Subdivision, Warren Road — Parcel #
39.-1 -2 .2
Mr. & Mrs. Baker came before the board requesting a 1 Flag Lot Subdivision so that their
Son & spouse could build a home. The depth of the lot would be about 1 acre and 30 feet
for a driveway. It was mentioned that the rest of the property that the Baker' s own would
be used for hunting.
Viola Miller: This is the thing that very much concerns me. The purpose of flag lots are
they can 't be done any other way. This is a piece of land you can ' t get to any other way.
This opens itself up to all sorts of things .
Bud Shattuck: The problem is when you break out a flag lot like this, it creates more flag
lots.
Gregg Travis : The current Ordinance requires for minimum lot dimensions in the R1
zone, 100 Feet.
• Tom Ellis : The purpose of a flag lot is to alleviate a hardship .
Bud Shattuck: Just a note that the back lots (2 . 6, 2 . 7, 2 . 8 , 2 . 9) are all land locked. If they

took it all the way back to the end of the lot, it would alleviate creating another flag lot
behind it. The Baker' s could run their boundary line all the way back and still build their
home in that front spot.
Lin Davidson: I think the idea that Bud has would be a much more usable situation if it
went straight to the back line. The concept of a flag lot squares off the parcel . .
Viola Miller: I would hope that this wouldn ' t be something that in the future someone
comes in and says we ' re allowing these lots, because that is not the purpose of this board.
Lin Davidson: I would propose that they extend the lot further to the East
Bud Shattuck : It seems like a reasonable project giving it to someone within the family.
Nancy Loncto : We will consider this . You must first talk with the County Health
Department.
Dick Baker: I am awaiting a reply from the Health Department.
Lin Davidson : I would consider the 1 flag lot for the subdivision, and the rest be
conforming lots .
Nancy Loncto : We will need a current survey, as well as the Health Department
approval. Mr. Platt will submit #239 to the County. Once we have all the necessary
paperwork we can move forward.
Warner, Lisa —Modification of Previously Approved Subdivision, Jerry
0 Smith Road, Parcel # 16.- 1 - 12.3
Ms . Warner came before the board requesting that she be granted a modification of her
previously approved subdivision in order for her to install her own driveway. The
existing driveway is on Ms . Warner' s parents (Richard & Violet Rogers) land. The new
driveway would be moved to the East 40-50 Ft. and straight back.
Lin Davidson : This would be a boundary change
Nancy Loncto : What are your Plans for the existing driveway?
Mr. Rogers : We have a barn there. It ' s our access .
Lin Davidson: I make a motion that we accept the boundary change. Greg Travis
seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY
Lin Davidson: We need to forward#239 to the County for approval .
Greg Travis : Previous motion amended to say this approval is contingent upon receiving
County approval of the 239 . Lin Davidson seconded. VOTE : ALL IN FAVOR.
MOTION CARRIED UNANIMOUSLY.
Richard Platt : Please be sure to bring in the Mylar map and two paper copies. Once they
have been signed you must file them with the County Assessment and County Clerk
within 60 days .

• Lin Davidson made a motion to accept the minutes as corrected. Tom Ellis seconded.

Boerman, Sketch Plan Major Subdivision, Brickyard & Wilson Road-
Parcel # 32 .- 1 -8 . 2
Mr.Boerman appeared before the board explaining that he has previously had a few
subdivisions approved and would now like to classify the remaining lots a Major
Subdivision. Lots remaining for the Major Subdivision are, 2, 3 , 4, 5 & 7 . The total
acreage of Mr. Boerman ' s property is almost 36 acres total . The water line will be
installed prior to the sale of land.
Greg Travis : I move that we accept this as a Preliminary Sketch Plat for a Major
Subdivision. Tom Ellis seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
UNANIMOUSLY.
Ordinance Comments
Jim Eyster, a resident of Fiddlers Green presented board members with a copy of a letter
he composed on behalf of all residents at Fiddler' s Green regarding the rezoning of the
area. The Fiddlers Green, Pinney Lane, and Sweazy community has been established for
about 20 years and is a low density area in character. Average lot sizes are approximately
4. 9 acre. Areas such as Lake Watch, Cayuga Lake Highlands, East Lake and a few other
Subdivisions in the town have been surveyed and their lots are about half the size, with
lake shore frontage. In a petition submitted 2 years ago , all 38 lot holders requested
• rezoning to R1 . Mr. Eyster states the residents don ' t feel that the Lakeshore designation
for their community is appropriate because those do allow Mobile Homes, Mobile Home
Parks, Retail Sales Outlet, Veterinary Hospitals, Seasonal Cottages, and Indoor
Recreational facilities. The residents are requesting that they be treated like the other R1
communities and given the protection they need.
Tom Ellis : I feel we should make L1 as restricted as Rl .
Stephen Farkas : I have absolutely no problem with it going to Rl . It ' s the same as East
Lake, Lake Watch and Cayuga Lake Highlands . I would ask you strongly to consider the
fact that with nothing else there, it should be R1 .
Rob Cutting : I would encourage you to tighten up L1 . The L1 designation would allow
one of my neighbors to build an indoor paint ball facility. The traffic would then create
huge burden on the surrounding neighborhoods. I appreciate your comments about
moving us into an Rl .
Bud Shattuck: I' ve polled each of the Town Board Members and it seems as though that
area will be designated RI .
Kenneth Pomichter: I 'm asking why the Business District is now going to engulf our road
as well as a whole section of neighbors . We have a Business District already laid out,
and a lot of places that don' t have businesses in them and yet you want to extend the
Business District down through a little dead end street.

• Greg Travis : We ' ve thought about that and we think too you have a valid point. In fact
our intent was to extend the Business area for the town, and that ' s probably not
appropriate place to do it.
Pat Conlon : Has the board come to that conclusion yet?
Greg Travis : We ' re in the discussion right now.
Kenneth Pomichter: Several years ago we had a Committee asking for our opinion of
where things should be laid out and where the Business District should be formed. I
thought it was going to be 34 heading south towards the plaza. I thought that you had an
agreement with the community and that ' s the way businesses were going to be pushed.
Lin Davidson: Part of that also was a section on the north side of the road. The idea was
to extend into the town land, but that didn' t prove to be a possibility. That ' s where
looking at other places came into the thoughts of the board.
Tom Ellis : There ' s not a thing that you can ' t do even if it turns to B1 that you ' re not
doing now.
Kenneth Pomichter: We would not like a Business District. If you could pull that out we
would greatly appreciate it. Business at one time was suppose to say out South of here
and we thought it was a town agreement.
Pat Conlon : I need a couple of definitions I couldn ' t find. Page 19 , # 16 . Mixed
residential/commercial development.
• Lin Davidson : People wanted to have retail or a business in the first floor of a building
and residential above. It goes with the B1 designation.
Pat Conlon: What ' s the difference between SC prefix and the SP prefix .
Lin Davidson : For SC if you meet the defined conditions for the use as it ' s applied, it ' s
allowed as a matter of right, whereas a SP has to be granted by the Planning Board with a
Public Hearing.
Pat Conlon : The only Place a Roadside Stand is allowed is in an RA district. Have you
had serious complaint/problems with Roadside Stands?
Bud Shattuck : The biggest designation is to separate Roadside Stands from perpetual
Garage Sales that people have. You have to regulate them and if you don ' t someone
could say that it ' s a Roadside Stand.
Tom Ellis : They can create a traffic problem in a Residential area.
Lin Davidson : I would hope The Town Lansing could be open in the same way as
Lemonade Stands and few squash on a table versus a Roadside Stand that has traffic
stopping and creating unsafe situations . If a squash table got a little to out of hand there
would be something in the Ordinance to deal with that.
Pat Conlon: I appreciate your reconsideration of not dividing up my property, but I do
not want it divided up .
Gregg Travis : We have to address that whole section again and make our
• recommendations to the Town Board.

Pat Conlon: Your statement that nothing changed, Tom and Viola is not a true statement.
• Once you change the land Use of an area and someone sells property that has changed
your changing the use of the property. The problem isn ' t with us neighbors now, it ' s with
the next neighbor.
Lin Davidson : Somewhere there ' s a line Pat. There ' s always a line with zoning.
Pat Conlon : That line is very important to us that live there .
Kenneth Pomichter: Can I have an idea as to when we will be told where the line will be.
Nancy Loncto : I would suggest that you obtain a copy of the minutes from the last
meeting. Read over the comment, we did not come to a resolution.
Tom Ellis : There will be Public Hearings .
Supervisor Farkas
Supervisor Farkas advised the Planning Board that the Town Board had significant
conversations following their last meeting. Some of the things that they are looking at
are Trailer Parks .
Bud Shattuck advised the Planning Members that they also discussed Fiddlers Green area
after a lot of comments. The Farrell — Warren Road section of that community is also
being looked at, actually the designation of an R3 versus an R2 . The section of Asbury
Road that went from an R1 to an R2 has not been discussed.
Mr. Farkas advised the Planning Board members that the document needs to be wrapped
• up .
Viola Miller suggested that the Planning Board hold a special working meeting to get this
taken care of
Gregg Travis made a motion that the Planning Board hold a working meeting on
Saturday, July 12 , 2003 @ 7 : 30AM with no Public comment. Lin Davidson seconded .
VOTE : ALL IN FAVOR, MOTION CARRIED UNANIMOUSLY.
Viola Miller made a motion to adjourn the meeting. Lin Davidson seconded. VOTE :
ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
