HomeMy WebLinkAbout2003-03-24 • 4 6 Town of Lansing 7 Monday, March 24 , 2003 7 : 00 PM PLANNING BOARD s PLANNING BOARD MEMBERS 9 ('Denotes present) 10 * Nancy Loncto, Chairperson * Tom Ellis 11 * Larry Sharpsteen * Lin Davidson 12 Viola Miller * David Hatfield 13 * Gregg Travis Brian Ivery (Alt .) 14 Bud Shattuck, Town Councilman 15 * Richard Platt, Zoning and Code Enforcement Officer 16 17 18 Public Present 19 None 20 GENERAL BUSINESS • 21 Nancy Loncto opened the meeting at 7 : 02 PM. 22 Approval of March 10 , 2003 Minutes 23 Lin Davidson questioned if the Lauzun ' s request would be a Special Permit due to it not 24 being owner occupied, or was it because it ' s a business in a home . 25 Larry Sharpsteen states at the time the ordinance was written the board specifically 26 agreed that there would not be limits on businesses . They had to be owner occupied . 27 Richard Plan explained to the board that this would be a Special Permit due to the fact 28 that is will not be owner occupied . 29 Lin Davidson moved to approve the minutes as submitted. Larry Sharpsteen seconded. 30 VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 31 32 Ordinance Questions 33 1 . Should we define family or limit the number of related person living in a dwelling? 34 It was recommended by the Board that Mr.Platt obtain ordinances from The City of 35 Ithaca and City of Cortland for the board ' s review for their definition of family. It was 36 suggested that we limit the number of unrelated people to six (6) living in a residence . 37 Under definition A.44 we should add : Limited to 6 unrelated people living in a single • 38 family unit. 39 2 . Do we want Site Plan Review or Site Plan Approval? March 24, 2003 Town of Lansing Planning Board 1 Site Plan Review . • 2 Add 701 . 6 .4 Changes : Any current or future change to an approved site plan must be 3 reviewed and approved by the Planning Board. Failure to comply will result in loss of 4 permitted use. 5 3 . Do we want to change 40,000 to 20,000 in the R3 ? 6 Leave 40,000 7 4 . Footnotes from #7 to # 12 will be applied to the applicable districts by Richard Platt 8 All footnotes from 1 to 6 are okay. 9 #7 Health approval-inside corner lot applies to L1 , R1 , R2 and R3 10 # 8 Common wall- anywhere duplexes are allowed, also we need to expand the definition 11 to read : Common wall, no side yard set back is required on the sides where units share 12 the common wall 13 #9 Driveway share curb cut-Delete 14 # 10 Lake frontage lots have frontage on Cayuga Lake. Applies to L1 15 # 11 is okay 16 # 12 , where applicable 17 5 . Nancy Loncto provided Rachel Jacobsen with definitions for the following numbers : • 18 802 . 31 , 802 . 32 , 802 . 33 , 802 . 34, 802 . 36, 802 . 37 and 802 . 38 . 19 6 . The title should read : Town of Lansing Land Use Ordinance 20 7 . Table of contents under PDA- yes we do want to adjust the table of contents to reflect 21 what ' s in the document. (706 . 2 thru 706 . 13 ) 22 23 Richard Platt asked in Schedule I, if it was necessary to have all three (3 ) indications (SP , 24 * , 802 , 1 ) for Site Plan Review. Mr. Platt suggested removing SC and the number and 25 having just the asterisk indicating Site Plan Review 26 Larry Sharpsteen commented that we should leave "as is". It doesn ' t hurt people to look 27 at all those areas where those are listed. If that means that they have to look three (3 ) 28 places and see the same thing, it kind of beats into their heads that ' s what we ' re looking 29 for. 30 Richard Platt states that under Special Permits we do not have an expiration or renewal . 31 Once a permit has been issued, it ' s forever. Should there be a expiration, or should they 32 renew after a year, 2yrs, 5yrs or something like that? 33 Larry Sharpsteen : We make them renew a subdivision if there is no activity after how 34 long? 35 Lin Davidson : I think we have a point here. If we give a Special Permit for an Ice 36 Cream Stand and it grows into a Purity, that ' s good, but maybe we want to be looking at • 37 it as that changes, traffic and other issues . 2 March 24, 2003 Town of Lansing Planning Board • I Gregg Travis : I think once you issue a Special Permit, somebody invests in it, they expect 2 it to be okay unless they ask for a major change to it. 3 David Hatfield : If they change something, it ' s brought back here. What they have issued 4 to them shouldn 't have a time limit on it . 5 Richard Platt : My concern is, what if the area changes from what the Special Permit was 6 issued for. 7 Larry Sharpsteen: Moved to make the revisions as clarified based on the questions that 8 we just asked. Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION 9 CARRIED UNANIMOUSLY. 10 Gregg Travis reviewed the Comprehensive Plan verses our Ordinance as we intend to 11 change it and found that they were all consistent. 12 Richard Platt requested from the board their comments regarding Bradley Griffin 13 reviewing the document. The consensus agreed that would be a good idea. 14 15 Map Work 16 Nancy Loncto brought to the board ' s attention a letter that we sent from Mr. John Stevens 17 requesting that his property on Warren Road be rezoned from RI to R2 . 18 Nancy Loncto : Recused herself from the discussion as Mr. Stevens is a neighbor. • 19 Lin Davidson : We have been around this barn before . I don ' t disagree with the way he 20 states his situation, but I think whatever is done in that area since there is so much 21 attitude in the neighborhood that it would be a PDA rather then changing the zoning. 22 Gregg Travis : It would be strange to change that and leave the space in between. 23 Larry Sharpsteen : What ' s the difference between RI and R2 as far as what we ' re talking 24 about here? 25 Lin Davidson : Higher density 26 Larry Sharpsteen : Recused himself from any voting, as this is his Lawyer. 27 It is the general consensus of the board to leave the R1 district the way it is . 28 Gregg Travis will compose a letter advising Mr. Stevens that the district will remain 29 unchanged. The Zoning Ordinance and the Map will be coming before the Town Board 30 and if he would like to do something different feel free. Gregg Travis will forward via 31 email to Rachel Jacobsen. 32 Gregg Travis recommended that the board review the definitions of the different districts . 33 Larry Sharpsteen : changing the RA district to an R2 over by Asbury Road is not a good 34 idea. It ' s not suited for housing. It ' s a swamp . 35 Richard Plat: We were talking about dropping RA down across Peruville. 36 Gregg Travis : We have to look at where we ' re going to have water and sewer available . • 37 In the R2 it specifically says areas will have public water service, but may encounter 38 sewage disposal problems. 3 March 24, 2003 Town of Lansing Planning Board • 1 Lin Davidson : Public water is now on Armstrong, Warren, and Asbury. We need to 2 think about our density apartment houses? 3 Thomas Ellis : The whole chunk is going to an R2 , from Asbury Road to Peruville Rd . 4 Gregg Travis : It seems like there should be some sort of transition from areas where you 5 go from an RA, which is the least restricted to an R3 which is the next least restricted . 6 Larry Sharpsteen: Along that boundary where it is RA, make it R3 all the way up to the 7 dotted line. 8 All agreed to change RA to R3 9 Larry Sharpsteen: In the case of Wilson Road, the demarcation should be the centerline 10 of the road. That should stay RA on the North side of the road, and R3 on the South side. 11 Consensus was to move line to centerline . 12 L1 was moved up an additional 1000ft. 13 R2 towards city should be changed to L1 14 Gregg Travis : Brought up the transition of an RA to R3 . Maybe there should be a strip 15 somewhere in there. 16 Larry Sharpsteen: One of the reasons for putting all of Peruville Road in the R2 was 17 because that recognizes as an entry corridor which is the only place in town that allows 18 Motels . • 19 Lin Davidson : Our hamlet situation is R2 . At the top of the hill people get upset with the 20 apartments up there . We have gotten letters about that. People would like to see R1 . 21 Larry Sharpsteen: I ' m saying R2 is appropriate up there. From a Planning and Land Use 22 standpoint, with water up there it ' s completely appropriate . 23 Consensus was B1 to Portland Point, then R2 24 David Hatfield: Motioned to adjourn at 9 : 10 PM . Larry Sharpsteen seconded. VOTE : 25 ALL IN FAVOR.
