20 Nancy Loncto opened the meeting at 7 : 35 PM.

22 Larry Sharpsteen : Page 3 , line 34 is should be changed to than
23 Page 4, line 12 , "Zoned steam" should read "its ' own steam
24 Lin Davidson made a motion to accept the minutes as amended. David Hatfield
25 seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY.
26 Susan Brock-Invoice for Services Rendered
27 Nancy Loncto presented to the board an itemized invoice for services rendered by Ms .
28 Brock regarding the zoning ordinance. Ms . Loncto welcomed comments, and requested a
29 motion to authorize payment.
30 Larry Sharpsteen : I don ' t know if we were 100% clear on what we wanted her to do . We
31 received a lot of things that we didn ' t intend. Based on the original estimate, I don ' t see
32 anything wrong with the bill .
33 Lin Davidson : I would second Larry' s concern. The Junk Yard and Adult Entertainment
34 is water under the dam at this point. I would move to pay the bill as presented.
35 Gregg Travis : Seconded.
36 Larry Sharpsteen : I would note that it did come in under estimate.

03/ 10/03 Planning Board Meeting
1 David Hatfield inquired as to why we hired Susan Brock, do we not have a town attorney
2 that is on the payroll .
3 Larry Sharpsteen: For the record, we hired her because she is a Land Use Specialist and
4 we have gotten too many conflicting answers from the town attorney in the past. We
5 want someone who is not going to have their hands in it when it comes to the town board.
6 Bud Shattuck: We don 't have a town attorney on staff We pay them by the hour.
7 Steve & Diane Lauzun, Informal Discussion — Conversion of Two
8 Family home into Office and 1 Apartment. 138 Ludlowville Road.
9 Mr. Lauzun explained to the board that he and his wife currently work out of their
10 Ludlowville home. They have had their business for approximately 7 years in their home,
11 but due to them increasing their family, they are in need of more space for themselves .
12 They would like to relocate their business out of their home, however, still keep it in
13 Lansing. They have found a property at 138 Ludlowville Road . It is currently a duplex .
14 The Lauzun ' s would move their office into one of the units and the second one would
15 remain as a two bedroom apartment. They have looked at the zoning and have no
16 problem with the parking. The only problem they could see is that it will not be owner
17 occupied.
18 Richard Platt : For this type of use in the R2 district, a Special Use Permit would be
19 required, as well as site plan review . This would be considered a Professional Office.
20 Larry Sharpsteen & Thomas Ellis both agreed with the Code Enforcement Officer that
fis 21 with the Site Plan Review and the Special Permit function, this would seem to fit.
22 Diane Lauzun : It would revert back to an apartment if the office was ever moved out of
23 there.
24 Richard Platt: One thing that will have to be done is to create a fire separation between
25 the two units . That is a code issue, not a zoning.
26 Steve Lauzun: In terms of the site plan approval, what type of process is that?
27 Larry Sharpsteen : We have a standard cookbook for the things that we look at, drainage,
28 parking, access, lighting, buffers .
29 The Lauzun ' s will follow up with Richard Platt for all the necessary paperwork.
30 Revisions of the Ordinance
31 Distributed to all members was a copy of the revisions made to the Ordinance by Susan
32 Brock and the Planning Board. It was suggested by Nancy Loncto, Chairperson that each
33 member review their copy for corrections or errors that need to be implemented. All
34 requests should be forwarded to the Code Enforcement Office by Friday, March 14,
35 2003 .
36 Richard Platt : One major question was in the Junk Ordinance . From what we can see, is
37 this still left up to the Town Board? (Junk Yard Permits & Mobile Home Permits)
38 Bud Shattuck : Junk Yard, Cell Tower and Adult Entertainment are now Town Law.
39 Mobile Home parks can not be denied in a Town, one area must be left open for them.

1 Larry Sharpsteen: My recollection was that B1 & B2 were combined. Under B 1 , 20, 000
�►' 2 SQ ft. was suppose to be changed to 8 ,000 SQ. ft. per dwelling unit.
3 Thomas Ellis : I think it ' s too small .
4 Lin Davidson : I think if we have an area where we want density and somebody comes in
5 with a plan of x many dwelling units, they want to put in a green space, the dwelling units
6 could share a septic system .
7 Bud Shattuck: The Town Board looks at the Comprehensive Plan and says how they want
8 density to look. They like the idea of density, but, they want it buffered, separated and to
9 look good. Not only are they going to look at site plan, their going to want to have some
10 looks at the skeletal part to see how it ' s going to look as our community starts to grow.
11 There has to be a lot of space around the project, the town board is not going to allow
12 8 ,000 because that ' s going to put the possibility of things on top of each other. It ' s not
13 going to happen.
14 Larry Sharpsteen : Then we ' re not going to have any high density?
15 Lin Davidson : You ' re saying there ' s going to be a PDA or a project that could potentially
16 well that.
17 Bud Shattuck : A PDA works fine.
18 Larry Sharpsteen: I ' ll go back to what the people say about PDA, that ' s a bogus use of a
19 PDA. My point is when the design process is gone through, when the Engineer designs a
20 septic system for an apartment block, the County is either going to accept that or reject it.
• 21 If they reject it, they' re going to say it needs more space.
22 Bud Shattuck : We 're not denying that, we ' re thinking more of how it looks and how it
23 fits, more than how it works .
24 Larry Sharpsteen : Motioned to add a number ten ( 10 .) footnote to Schedule II, R2 (b .)
25 and B1 (b . ) to say the following : This density is applicable only in developments of 3
26 acres or more.
27 Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
28 UNANIMOUSLY.
29 Thomas Ellis : Motioned to change R2 Moderate Density (b .) from 8 , 000 Sq. Ft. per
30 Dwelling to 12 , 000 Sq. Ft per dwelling.
31 Larry Sharpsteen : Motioned to scratch the previous motion and add in Schedule II, B1 -
32 Commercial, (b .) to read .8 ,000 Sq. ft. per Dwelling, and B2 as noted in Schedule I, all
33 rules apply.
34 Lin Davidson seconded. VOTE : ALL IN FAVOR. MOTION CARRIED
35 UNANIMOUSLY.
36 Under Footnotes for Schedule II
37 Page 9, * * delete all red, should read: Front yard setback measured from the right-of
38 way.
• 39 Page 9, #3 . delete, green, #5 delete, green #9 delete, add # 10 . This density is applicable
40 only in developments of 3 acres or more.

1 Under Article VI, Rubbish needs to be changed to Garbage . Garbage needs to be inserted

4 Bud Shattuck : There are no private roads . There are driveways . We have a new Town
5 Road Law, that the Town Board adopted on April 17, 2002 . All roads have to be built to
6 that Town Law. We are now in the process of instituting that fee structure into this ahead
7 of time for the Engineering cost.

26 Nancy Loncto advised the member again, that if they had any further changes to let the
27 Code Office know by Friday, March 14, 2003 .
28 Richard Platt provided each member with a copy of the current map that the members
29 had been working on.
30 Cell Tower Ordinance
31 Bud Shattuck advised the Planning Board that we currently have a Cell Tower Ordinance
32 that we have actually had to stop cell towers from being built. The Town would like to
33 be able to get cell towers into the town. Mr. Shattuck distributed a copy of the Cell
34 Tower Ordinance to all members for their review. If all members are comfortable with
• 35 how the document looks than the town will adopt it as a Planning document. All cell
36 tower review will be conducted by the Planning Board. Mr. Shattuck read certain

1 highlighted portions of the document that would be of interest to the members . This will
ID2 be on the agenda for discussion at the next Town Board meeting, set for March 19 , 2003 .

4 Nancy Loncto distributed a draft list of Work and Development that she came up with for
5 the members . Nancy would like each member to think about the list, expand, and
6 prioritize them in order to move forward as a board.
7 Thomas Ellis made a motion to adjourn at 10 : 10. Gregg Travis seconded. VOTE : ALL
8 IN FAVOR. MOTION CARRIED UNANIMOUSLY.
