(B1 District) 27 Mr. Benson explained to the board that he has been at this location for approximately 1 year and 28 basically he is running a small service repair as well as performing suspension work. They build 29 and tune suspension for a variety of different power sport vehicles . (Snowmobiles, Motorcycles, 30 ATV ' S) They are performing research and development on different types of products such as 31 spring testing, valve combinations and velocity flow control systems throughout the suspension 32 systems on the units . The units vary; they have different problems associated with each unit. 33 Basically this is what their business emphasis is . Business comes in from other towns, counties, 34 cites, and other states . The track has had limited use, approximately 12 times since October 2002 . 35 The business needs a place on site where they can test their product before they transport it 36 elsewhere for further riding. 37 The biggest issue that the Planning Board has is that this is a Zoning issue . The town Ordinance 38 clearly states for that area, not to have outside motorized uses for Commercial recreation, unless 39 a Special Permit has been issued by the Town Board. The Planning Board considers this an • 40 Industrial Research use, which would require a Special Use Permit. Mr. Benson was advised that 41 he must submit an application to the Code Enforcement Office for a Special Use Permit along 1 with a description of the hours of operation. The Code Office will then forward it to the Town S2 Board for approval or denial . If a denial is granted, the applicant can then go to the Zoning Board 3 for an Appeal . 4 5 6 Andrew Sciarabba, Site Plan Review— Child Care Center at "The Rink" 7 1767 East Shore Drive, Parcel # 37. 1 -6-9 8 Mr. Sciarabba came before the board with some further information regarding the Child Care 9 Center. There will be no kitchen facilities in the Day Care Center. Each child will bring their 10 own lunch. To the best of Mr. Sciarabba ' s knowledge , the new tenant ' s funding will come from 11 an SBA loan and a grant from a local Daycare Organization . The State of New York regulates 12 everything to do with this type of business, design, construction etc . A buffer zone (greens) 13 would be put in the front, and landscaping on the side that would tie into to the back area . DOT 14 has approved another driveway (24 ' width) on the Western part of the lot. This secondary 15 entrance would not be opened on a full time basis . Lighting for the building will be similar to 16 what they have on the current building. An outdoor fenced in area will be attached to the 17 building. 18 Mr. Shattuck advised Mr. Sciarabba that the Town Board would need a more definitive map 19 showing the outdoor area added on. 20 Mr. Platt will submit a §239 to the Tompkins County Planning Department, and request from The 21 Town Board a final approval . The Town Board will complete the SEQR. • 22 Larry Sharpsteen motioned to declare no negative comments in regards to Site Plan Review. A 23 public hearing would be waived. En Davidson seconded. VOTE: ALL IN FAVOR. MOTION 24 CARRIED UNANIMOUSLY. 25 26 27 William Targosh, 1 Lot Subdivion - Lansing Station Road. Parcel # 23 .- 28 1 -4 29 Mr. Platt explained to the board that Mr. Targosh was unaware of our regulations regarding 30 subdivisions . Recently Mr. Targosh divided some land, and filed directly with the County. Mr. 31 Platt advised Mr. Targosh that he should present this to the Planning Board as one lot has less 32 than 300 ' of frontage. Mr. Platt sees no reason for this not to be approved, the lot sizes according 33 to the county are 6 . 91 and 9. 2 acres . It was suggested to Mr. Targosh to file his deed restrictions 34 with the Code Enforcement Office, also with the County. 35 Tom Ellis moved to accept this subdivision as submitted, and waive the Public Hearing. Larry 36 Sharpsteen seconded. VOTE : ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 37 Lin Davidson completed the SEQR. A negative declaration was declared. 38 39 Review Minutes of January 13 , 2003 40 Gregg Travis made a motion to accept the minutes as presented. Lin Davidson seconded. VOTE : • 41 ALL IN FAVOR. MOTION CARRIED UNANIMOUSLY. 1 • 2 Lansing Planning Board By-Laws 3 Viola Miller introduced the By-Laws to our new members, and also reiterated to current members 4 that they should follow the rules of the Laws, also, act in a professional manner. 5 Larry Sharpsteen motioned that the Planning Board amend Article III of the By-Laws : to allow 6 the Planning Board to include an alternate member who shall vote when there is not present a 7 quorum of regular members . 8 Lin Davidson motioned to table this amendment vote until the Planning Board ' s next scheduled 9 meeting (February 10, 2003 @ 7 : 30 PM) Larry Sharpsteen seconded. VOTE : ALL IN FAVOR. 10 MOTION CARRIED UNANIMOUSLY. 11 12 Appoint Nominating Committee 13 Lin Davidson - Chairman 14 Larry Sharpsteen 15 Viola Miller 16 A slate will be available for the next Planning Board Meeting (February 10 , 2003 @ 7 : 30 PM) 17 18 Environmental Council • 19 Larry Sharpsteen advised the board that in regards to personal watercrafts, the Environmental 20 Council completed their own draft of recommendations to send back to the County Resource 21 Council . Larry Sharpsteen will forward via email to Rachel Jacobsen a copy of this for board 22 members review. 23 Mr. Shattuck states the Town has contacted Council at the State level and they have provided us 24 with the Case Law. No place in New York State does any jurisdiction have any regulations over 25 the type of motorized craft on a waterway. They can talk about, speed, wake, noise, pollution but 26 it must be across the board. There is no specific to any type of watercraft any place in New York 27 State . This is State Law; it ' s been tested twice last year. 28 Zoning Ordinance 29 Lin Davidson suggested that Dick Platt and Rachel Jacobsen take over the Planning Board ' s 30 responsibility of completing the Ordinance to include the necessary changes submitted by Susan 31 Brock. 32 Bud Shattuck advised the Planning Board that at the last Town Board meeting on January 15 , 33 2003 , the Town Board members set a deadline for the completion of the Ordinance and requested 34 that the document be in their hands by April 01 , 2003 . 35 The numbers have to be brought into line to the parts of the document that they tie to . Need 36 clarification in regards to density. A more realistic description per dwelling unit for high density 37 in B1 needs to be looked at. Also, side yard setback in every district for townhouses will need to 38 be looked over. Site Plan needs to be clear. 39 Larry Sharpsteen made a motion for Schedule II to make the lot density per dwelling unit for • 40 B1 & B2 Commercial, 8,000 square feet per unit instead of 20,000 square feet per unit, and further 41 recommend the allowance of 0 side set back per 1 side only for Townhouses in any district. Two 1 (2) footnotes in Schedule II need to be added. B1 & B2 should read: Access for high density • 2 dwellings should be either reverse frontage or on a side street, never on a main highway. Side 3 yard setback for Townhouses can be 0 on sides with shared walls . The schedules should be 4 integrated, and look at the pieces that Susan Brock has presented to the Planning Board . The map 5 needs to be looked at again. 6 Larry Sharpsteen motioned to adjourn the meeting at 9 : 18 PM. Tom Ellis seconded. VOTE : 7 ALL IN FAVOR.
