HomeMy WebLinkAbout2002-11-12 3 Town of Lansing •4 Tuesday, November 12 , 2002 7 : 30 PM PLANNING BOARD 5 PLANNING BOARD MEMBERS 6 ('Denotes present) 7 * Gregg Travis, Chair Brad Griffin 8 Larry Sharpsteen Lin Davidson 9 Viola Miller * David Hatfield 10 * Nancy Loncto 11 * Bud Shattuck, Town Councilman 12 * Richard Platt, Zoning and Code Enforcement Officer 13 14 15 Public Present 16 Candy Cima 17 John Barney 18 Tom Ellis 19 20 GENERAL BUSINESS 21 The Town of Lansing Planning Board was unable to hold a formal meeting due to lack of a quorum. • 23 Candy Cima, Informal Discussion —Guest Suites 24 Mr. Barney is concerned for his client Ms . Cima regarding the "future road" that is shown on the approved map . 25 To the best of Mr. Barney ' s knowledge there are no current plans for that road to be extended, nor does he think 26 the Town has any interest in taking it over. Ms. Cima has been paying taxes on the property since day one . It 27 would not make much sense to put a road in that location due to the sight distance. Mr. Barney questioned if 28 there is some reason why Ms . Cima should be obliged to maintain a prospective future road that the Town is not 29 paying for, that she is being taxed on for an indefinite time . Mr. Barney feels it ' s not reasonable without some 30 sort of compensation from the Town that Ms . Cima not be able to use her land . 31 Gregg Travis explained that the board has had prior discussion on this and from the memories of Larry Sharpsteen 32 and Viola Miller, (who were on the board at the time) they do remember this as a fairly strong commitment to 33 there being a future road. Mr. Travis presented the original document that was approved/signed in 1990 showing 34 the 60 ' wide right of way with two pins establishing the right of way, also , a 3 `i pin . Mr. Travis explained that 35 there was a plan to line up two potential sections of roadway (this and 60 ' right of way off of Cherry) . The board 36 has no issue with what Ms . Cima would like to do, the issue is the location . Members would like Ms . Cima to 37 explore alternatives regarding relocating the site . 38 39 Linda Hirovnen , Informal Discussion - Byrne Dairy 40 Ms . Hirovnen appeared before the board and spoke on behalf of Byrne Dairy. Byrne Dairy would like very much 41 to set up a 4, 000 square foot store that will predominantly sell dairy products, also, items that are not carried in the normal convenience store . All new Byrne Dairy stores include fueling stations . The location that Byrne Dairy is looking to purchase is owned by the town and located on Ridge Road . Ms . Hirovnen passed out 44 pamphlets to the members showing what the store would look like . Ms . Hirovnen and the Byrne Dairy 45 Representatives met with Mr.Farkas and Mr. Plan prior to her coming to the Planning Board . Their thoughts were 46 that the town felt there were enough gas stations in the B1 area and would prefer to limit that number by not • 2 Town of Lansing Planning Board November 12, 2002 1 allowing anymore . Ms . Hirovnen would like the Planning Board to discuss this idea. The Byrne Dairy 2 representatives and Ms . Hirovnen requested to be on the next Planning Board Agenda . •1 4 Mr.Platt, Code Officer — Several 1 Lot Subdivisions , Taxi Business & NYC Planning 5 Meeting 6 Mr. Platt presented the board with 3 different 1 lot subdivisions (Porter, Tuddenham, Mitchell) all the necessary 7 paper work was presented to the members present . A decision will be held at the next meeting. 8 Mr. Ralph Sirico is interested in opening up a Taxi business in the Town of Lansing . The location he had in 9 mind would be the small mall where the Post Office is located . There is nothing listed in the Ordinance that 10 defines this type of business . It was suggested that this type of livery service should go under Special Permits as 11 well as having Site Plan Review . 12 Mr. Platt advised the Board Member that the upcoming State Planning Federation Meeting will be held in NYC 13 starting Sunday, February 16, 2003 thru Wednesday, February 19 , 2003 . Members that plan to attend are required 14 to return all the necessary paperwork to Rachel or Sharon by Monday, December 9, 2002 . Mr. Shattuck 15 encouraged all Planning Board Members, as well as other interested Town Employees to attend . 16 17 Mr. Shattuck —Sun Path Update 18 Mr. Shattuck explained to the board members that were present some of the prior illegal transactions that occurred 19 by the current owner . A prospective buyer, Mr. Boris Simkin and current owner, Mr. Jay O ' Rear met with Town 20 Officials (Farkas, Shattuck, John) to discuss what must be done before any subdivision will be approved . It was 21 made clear that if Mr. Simkin were to purchase the property, he must build the road to town specs over to the 22 Butler property . Also, he must put in water. • 24 Review of Planning Board Applicants postponed until next Planning Board 25 Meeting . 26 27 The Planning Board ended their discussion at 9 : 20 PM .
